Safety
1. Traffic shall be allowed to pass and to be protected at all times. If it is not ~
possible to allow traffic to pass, a suitable detour must be provided and plans
submitted to the Director of Public Vorks 72 hours in advanca.
2. Barricades shall be erected in.a ma:mer which will provide suitabla visibility Ln all `
directions. All barricades shall be Ln good condition. and all signs shall be of such
size and legibility to provide adequate warning to oncoming traffic. At least two 7"
flashing amber lights shall be mounted on each end barricade with one on an advance ~
warning sign.
3. Excavatioris must be shored or sheetedwhen necessary to prevent under-mining of
roadway, trailways, utilities.-or for safety raasons.
4. Cuys or stays shall not be attached to trees on right•of•way or private property
without aritten permisaion. - :
5. _ Flagaaen shall be furnished by the party or organization performing the work whenever
the work being done creates a hazard either to the traffic usiag aaid road or the ,
personnel engaged Ln the constxuction, or whea directed to do so by the City.

2. Provisions and Specifications--7,'hese general provisions, specifications atid Std. Plate
P-1 shall be considered as forming an integral part of each and every permit issued for .
operations within Eagan. The work authorized by this permit shall ba doas 4t such time
and Ln such manner as shall be consistent with the aafety of the public and shall ~
conform to all requiraments'and standards of•the•City. If at any time it ahall be
found by the City that the work is not being or has not been pzoperlq performed, the '
permittee, upon being notified by the City, shall immediately take.tha riecessary steps,
at his own expense, to place the work in condition to conform to aaid requirements or
standards. 3. Execution--The permittee shall use diligence Ln the executioa of the vork authorized •
under this permit Ln order not to endanger or unnecessarily obstruct travel along any
road or trailway. Operations shall be ao•conducted at all timas as to permit aafe and .
reasonable free travel over the roads and trailways within the limits of the work
herein prescribed. All safety measuraa for the frae movement of trsffic shall be
provided by the permittee at his own cost. .
4. Confermity to Laws--The installation shall be uade ia conformity rith all applicabla laws, regulations and codes coveriag 4aid installations. All installatioas shall be
made Ln conformity with regulatioas of governmental ageacies for tba protection of.the
public. • .
a. The applicant shall furnish a bond or financial guarantaa in the amount to be
determined by the City whicb is required to ensure adaquate & timely completion
of repair. This bond or financial guarantse rhall remain in effect for 2 yearr

responsibility of the applicant to call for aecessary locations of existing utilities.

11. Driving Limitations.

EASEMENT aGREEMENT
This Agreement made and entered into this f day of June, 1995, by and beiween
Principle Construction, Inc., a Minnesota Corporation, hereinafter referred to as "Principle" and
Wobken, Walsh & Noreen Architects, Inc., a Minnesota Corporation, hereinafter referred to as
"Wobken".
WHEREAS, Principle is the fee owner of the following described reai property situated
in the County of Dakota, State of Minnesota, legally described as follows, to-wit:
Lot 2, Block 2, Wescott Hills Revised 2nd Addition, according to the recorded plat
thereof, hereinafter referred to as Parcel "A"; and
WHEREAS, Wobken is the fee owner of the following described real property situated
in the County of Dakota, State of Minnesota, legally described as follows, to-wit:
Lot 17, Block 1, Wescott Hilis Revised 3rd Addition, according to the recorded plat
thereof, hereinafter referred to as Parcel "B"; and
WHEREAS, Principle intends to construct improvements located on Parcel "A" which
require that a sanitary sewer line be constructed across Parcel "B".
NOW, THEREFORE, in consideration of the mutual benefits described hereof, Wobken
hereby grants unto Principle, its successors and assigns a non-exclusive easement for the
construction and maintenance of a sanitary sewer over and across the North 15 feet of the
East 70 feet of Parcel B described above. The use of said easement shall be limited to the
owners of Parcel A however, the owners of Parcel B shall have the right to use said sanitary
sewer line that it constructed. All costs incurred in maintaining said sanitary sewer line shall
be the sole responsibility of the owners of Parcel "A". However, in the event the owners of
Parcel "B" decide to construct a connection to said line the owners of Parcel "B" shall be
responsible for all costs incurred in constructing said connection and shall be responsible for
any repairs to said sanitary line resulting from said connection. It is further understood that as
long as the owners of Parcel "A" are the sole users of said sanitary sewer line, the owners
of Parcel "A" shall indemnify the owners of Parcel "B" against any personal injury which may
occur within the easement area due to its use by the owners of Parcel "A", their servants,
agents, or the servants or agents of any governmental unit responsible for maintaining said
sanitary sewer line.
It is further understood that by granting this easement the owners of Parcel "B" are not
creating a public easement but are simply creating an easement for the sole benefit of the
owners of Parcel "A" and any governmentai unit responsible for providing sanitary sewer
service to Parcel "A".
All promises, obligations and undertakings contained herein shall constitute covenants
which run with the land and shall be binding upon the owners of Parcels "A" and "B", their
successors and assigns. No amendment to this Easement shall be valid or enforceable unless
reduced to writing.
