was made and granted for the above referenced parcel. Certain concerns
were brought to the Council's attention by the neighboring property owner,
Mr. Charles Souza. As I was personally involved in this matter, I wish to
provide information which may clarify this situation.
Duriny construction of the home at 803 Yorktowm Place, Mr. Souza called the
City Hall to express concern that this home was placed too close to the side
lat line. He spoke tviih Steve Hansen who checked the site plan. The siie plan
indicated a 10-foot side yard setback which did not conform to the information
that Mr. Souza provided. Because of this, Mr. Hansen informed Doug Reid,
Assistant 6uilding Inspector, of the discrepancy. Mr. Reid performed an
on-s'ite inspection, verified the discrepancy and tallced with Mr. Souza.
t.Sr. Reid immediately contacted me and recommended that I obtain a variance.
I applied to the City for the vaiance wilich application was heard on September
3, 1985. In addition, I met with Mr. Souza on site to inform him of the
procedures that would be taken to rectify the problem, per recommendations
of the inspection Department.
I have always found the Eagan Building Inspection Department to be organized,
helpful and professicnal. The..quality of the department is a continuing
credit to the City.

Mr. Charles Souza appeared at the regular City Council meeting on
Tuesday, September 3, and was quite vocal about two (2) issues
directly relating to our Inspection Department. Mr. Souza
claims that he was aware of a potential setback violation
regarding Lo~t 1, Block 3(home is under construction by Joe
Miller Construction C ny) and telephoned the City Building
Inspection Department on three separate occasions and did not
receive a favorable response on any of those occasions. He first
reported the setback violation when the footings were poured,
there was no action taken. He then called when the blocks were
laid for the basement and there was still no action. And finally
when he called the third time, someone in the Inspection
Department indicated that the building was too far along and the
inspector would mark "variance" on the drawing. He questioned
how often this is happening that the inspectors are overruling
the City Council and not enforcing known variances at the time
the problem is first sighted.
Secondly, Mr. Souza claims that none of the homes are meeting the
Uniform Building Code requirements. He referenced several things
that are in direct violation and further stated that any ten year
old could inspect the neighborhood and see that these items were
in violation.
I would suggest that you and Doug, from inspections, City •
Councilmember Wachter and myself arrange for an on-site meeting -
' with Mr. Souza to discuss all of these allegations in detail.
When a property owner makes those types of statements at a public "
meeting in front of the media, the entire City Council and other
residents, I feel there is a definite need for the City to
respond.
