To the Mayor, the Council Members & Mr. Hedges:
Thank you for passing the motion to waive the building fee for us to be able to re-roof the "group home"
house that was purchased. I also understand Attomey Dougherty's position on not being able to donate a
tree. No problem. We were just happy to be able to share the good news with the Council that we were able
to prevent the group home from opening up in Eagan.
Thanks also for passing the "repeat call for service" ordinance. I think it is a step in the right direction.
I would like to see the Council continue to pursue a policy of notifying neighboring residents of any property
requesting zoning approval for Rule 8 group homes or any othertypes of facilities. Itjust doesn't make sense
that the fact that a group home is within 2 miles is deemed required disclosure to any potential purchasers
when you sell your house, but that same fact is apparently not important enough to have to wam the current
residents! Remember, the only way we found out about the group home is that they had an open house prior
to being licensed, prior to having a host contract with Dakota County and prior to commencing operations. (I
don't imagine he will have an open house again if he tries to open up another group home!)

it
was very short notice and sincerely appreciate your attendance. There
are a
few more things Z want to share with you that we have learned about.
Jean Stuedemann drove to our neighborhood after reading the article in
the
Pioneer Press yesterday. Her daughter was raped and murdeied by a
17year
old male living at a group home in Woodbury. He was not her boyfriend
as
the press would like you to believe, she did not even know this boy. He
broke into their home raped her and then murdered her with a
screwdriver.
Her sister found her. She has shared with us the details of the boy
living
at this group home. He was locked out of the group home that night. He
had
access to a car and had been watching their house. He was off of his
medication because the boys were providing lawn seivice in the
neighborhood.
This family lived 3 1/2 blocks from the home. Mrs. Stuedemann came to
tell us that Ken Barber and the State are lieing to us about the type of
kids and their Low status offences. These kids are a danger to our
neighborhood, Oreatha Howards childcare, and the city of Eagan.
Also, apparently Mr. Batbe= can be bought out (no suprise there).
199,000.00 for the house. He paid 180,000.00. Just an FYI, because
some of
us are very seriously considering this as we11 as a contract to exclude
him
from Dakota County. Before we do anything this will be carefully
checked
and drafted by a lawyer.
The city of Woodbury is having a town meeting on Monday night April
17th.
The topic, GROUP HOMES. We will be researching theis agenda and
possibly
attending so we can unite another city into our fight. '
Thank you very much for your support. We strongly feel the city should
draw
up some by-laws, ordinances to protect ou= neighborhoods and childzen.
We

Some of the boys might have police records for crimes such as
theft or underage smoking, but none will be sex offenders,
habitually violent or have serious mental health problems. The
home will serve up to five teens between ages 15 and 17, for
average stays of six to nine months. The youths will atteod school
and work, participate in recreational activities and receive
therapy. They will be constantly supervised, Bazber said.
Barber plans to seek a contract with Dakota County to refer
youths and to pay for their stays. If Dakota County does not want
a contract, he could seek one with a different county. '

Minnesota has about 70 Rule 8 homes, including one in Eagan,
according to Jerry Kerber, director of licensing at the state
Department of Human Services.
The state is expected to grant Barber a license soon. Barber is
limiting the type and number of boys in the home and has
experience working with children, which bodes well for his
success, according to Kerber. He also invited neighbors to an
open house, something he wasn't legally required to do but
indicates that he wants to be a good neighbor, Kerber said.
Barber said he realized there was a lack of quality group homes
while working as a Hennepin County juvenile probation officer
the past four years. The 32-yeaz-old, who has a tattoo on his azm
wtuch reads "Only God Can Judge Me," said he will not be
deterred by the judgment of his neighbors and hopes to eventually
open a few more group homes.
Young parents said they moved to the neighborhood because it's
a friendly place to raise children who are welcome to run in and
out of one another's homes. It's the sort of place where neighbors
welcome new families with cookies and casseroles. Pazents feel
their cory environment is now threatened.
"The innocence is gone," Liz Brothers said.
Neighbors leazned about the home when Barber invited them to
the open house, which neazly 100 people attended. Residents
have met with police to learn crime prevention tips and have
called elected officials to try to prevent the home from opening.
State law allows group homes in residential areas, and does not
prohibit one next to a day-care center,

Kerber said he was unawaze of studies examining whether group
homes affect crime or property values but "more of these
programs are good neighbors than not."
However, it takes only one high-profile incident to spread feaz.
Tony Roman Nose, 17, was living in a Rule 8 Woodbury group
home last summer when he allegedly sexually assaulted and then
stabbed 18-yeaz-old Jolene Stuedemann to death with a
screwdriver. He has been charged with murder and awaits trial.
The owners later closed the home and relinquished their license to
operate group homes as part of an agreement with the state,
although their sons were allowed to take over a couple of the
homes.
Authorities say the public should not generalize about group
homes.
"I've seen residential treatment facilities that were never an issue
and some that were constant issues," Eagan Police Chief Kent
Therkelsen said. Police also get calls about youths who live with
their pazents causing problems, he said.
"It's reasonable people are going to be fearful of the unknown
coming into the neighborhood," Kerber said. "Our hope is a year
from now we can all look back on this and say it's been a positive

welcome new families with cookies and casseroles. Pazents feel
their cozy environment is now threatened.
"The innocence is gone," Liz Brothers said.
Neighbors learned about the home when Bazber invited them to
the open house, which neazly 100 people attended. Residents
have met with police to leam crime prevention tips and have
called elected officials to try to prevent the home from opening.
State law allows group homes in residential areas, and does not
prohibit one next to a day-caze center.

Kerber said he was unaware of studies examining whether group
homes affect crime or property values but "more of these
programs aze good neighbors than not."
However, it takes only one high-profile incident to spread feaz.
Tony Roman Nose, 17, was living in a Rule 8 Woodbury group
home last summer when he allegedly sexually assaulted and then
stabbed 1 S-yeaz-old Jolene Stuedemann to death with a
screwdriver. He has been chazged with murder and awaits trial.
The owners later closed the home and relinquished their license
to operate group homes as part of an agreement with the state,
although their sons were allowed to take over a couple of the
homes.
Authorities say the public should not generalize about group
homes.
"Ibe seen residential treatment facilities that were never an issue
and some that were constant issues,° Eagan Police Chief Kent
Therkelsen said. Police also get calls about youths who live with
their pazents causing problems, he said.
"It's reasonable people aze going to be feazful of the unknown
coming into the neighborhood;" Kerber said. "Our hope is a yeaz
from now we can all look back on this and say it's been a positive

well being, safety, and liberty. On Thursday night (Mar 29th) our neighborhood wlas
shocked (and blind-sided) that a residential house has been purchased solely for the intent
of private business use; that is...to be used as a Group Honie for delinquent and/or ~I
emotionally disturbed male juveniles ages 14 - 18 years old.
The owner and program leader, Mr. Ken Barber, claims (without Guarantees, of course)
they will NOT be of the sexual-assaulUpredator dispositions; but perhaps, will include
those with "proven" criminal records and/or with life histories of physical and sexual
abuse. Mr. Barber has named the home as "Reality Check"... But, as Mr. Barber an~ his
wife discovered Saturday afternoon, the "sugar-coating" melted away as there was no
lack of "Reality" in our CONCERN about his plans in the core of OUR ~
NEIGHBORHOOD.
Yes. I say again... OUR NEIGHBORHOOD. We have the responsibilities.... We pay the
property taxes. We provide the incomes, through the fruits of our hard-earned labor---
which pays the mortgages. We invest in the improvements and maintenance of our I
HOMES. We maintain our property and landscapes. We provide the Safety "for the
children" by living with mutual respect of property while promoting the moral virhies of
RIGHT and WRONG. Without a doubt, we have the vested interest in OUR
NEIGHBORHOOD.

Mr. Barber's transient male juveniles, "IN REALITY".... DO NOT and WILL NOT
have a vested interest in OUR NEIGHBORHOOD. i
Once again... it is OUR NEIGHBORHOOD...Because it IS our Freedom of CHOICE to
be SO....
And to LIVE where WE choose based upon our own values and reasons.
Mr. Barber seems to believe this is trivial in his zeal to force this on us - while the ~
essence of our Freedom is being invaded and eroded. Most of the families in our neighborhood choose NOT to live by a group of troubled value-less teenage boys. We
choose to live in an environment far distance from misery. Contrarily, we all applau'd Mr.
Barbers valiant efforts to help these kids, but again, this is ...his choice... for his
humanitarian cause... not ours. Yes, in truth this is a case of "not in our backyardsl
Again, I cannot over-stress the severity of our concern.

this Group Home: I
There are many residents here, who took command, and did not allow permissiveness to
stand and allow this thing to passively infringe upon our unalienable RIGHTS--They
boldly took quick action to organize a united opposition against this pending usurpation
of our neighborly well being. ~

In great brevity, they gathered pertinent facts, statistics, actual trends, and statue law I
pertaining to residential Group Homes and promptly informed the neighborhood.
Although, to some credit to Mr. Barber, he did disclosed his intentions, which, for some
evidently ridiculous reason, the State Law does not require. I
In personal observation, I believe, maybe too cynically but within acceptable dish-ustJ the
timing of disclosure was calculated to be the longest period between his purchase date
(January) and the pending licenser date (APR l lth). All for the deception of appearing to
be so forthcoming; that is, to slide under our radar screens, avoiding detection, until tl e
threat of our defense is, in any practical sense, hopeless.
As it went, we, the concerned citizens of our neighborhood, marched in mass to attenld
Mr. Barber's "Reality Check" open house. We were determined, but respectful to Mr!
Barber and his wife - which demonstrates our civility when one considers the gravityi of
the anger for which such a thing could create. In turn Mr. Barber invoked race implied
in an opening statement by describing us, the people of the neighborhood, as fearing i
people "who may LOOK different". If there is any "pre judging" it was from Mr.
Barber's side. The fear of this Group Home is not prejudice, rather, it's based upon tfie
real and proven criminal ACTIONS and behaviors for which these kind of kids possess;
and the heighten risk upon the safety of our children that their presence will cause.

Admittedly, I am not up to speed on all the facts, and do not pretend to have all my T's
crossed here - there are others who are, or are attempting to do so. Here are some facts
and observations/opinions as they seem to be: I
1. Mr. Barber seems to be a good man with a noble cause. It is, without a doubt, thatl he is
committed to the crusade of HIS worthy cause on the other hand, the way in which he
is going about it... is wrong. The law may support him, but he, and the Law, is carelessly
trending upon our RIGHTS... We seem to have no CHOICE or INPUT. In short, we~ do
not desire to be the apparatus for his social experiment and business.

2. The Concept of "Reality Check", although noble, has totally ignored the environment
for which it is to be placed... that is, the reason for it's selection is that iYs a great
place to live ...and is affordable". But again, Mr. Barber has failed to have any insight
about the rights of those in this neighborhood: that the invasion of these troubled kids

will, and already has, caused great anxiety, grief, and as I believe, will result in corrupting
our "great place to live".
3. In the "Open House" discussion it was disclosed that a similar group home in Eagan
has had many Police calls. In fact, the Eagan Police Records have indicated that there has
been 67 calls (over 3-years) directly related to the home (which just happens to be near
Mayar Awada's residence). Specifically, instances of fights, drug use, runaways as well
as other typical acts of disruptive and criminal behaviors. If there is any indication of the
seriousness of this situation - the Eagan Police has already planned for increased patrols
in our neighborhood.
4. N1r. Barber claims "Reality Check" will implement extensive background checks and
personal interviews of each candidate juvenile to assess their "fit" with the program-
further claiming to filter out those of sexual predators/abuse histories. But, his claims, as
evident in this "Open House" discussion lacks credibility:
a. A BIG ISSUE: He admittedly failed to find out that there is a residential home
Day Care right next to the home he purchased. Furthermore, he seemed to notlcare
about the fact that there are a least seven other Home Day Cares within a quarter
mile of the home. This has to be, within all reason, absolutely unacceptable. And in
fact, absolutely ludicrous! This demonstrates the incompetence of the bureaucratic
nature of our state government, that is, the Dept. of Human Services which is
responsible for the licenser of both residential Home Day Cares and Group Homes,
failed to see that there was a home day care right next to the Group Home!
b. But, using any vestige of common sense, how can the STATE allow a
GROUP HOME of proven juvenile delinquents to be placed right next to a
DAY CARE far innocent small children?
c. In Fact, the home owner and Day Care provider next to Reality Check has
to comply with very stringent provisions and regulations in order to remain
licensed Ironically, the Group Home which is, in "REALITY", an increase
of RISK to the Safety of those who live within close proximity - and seems
NOT to be heid to those same rules and standards.
d. 5adly, the mere presence of the GROUP HOME next store may revoke the
Day Care providers license by the rules set-up within the very same Dept. of
Human Services.

e. Moreover, the Home Day Care provider will, most likely, lose her
customers anyway because of the huge increase of potential Risk by the mere
presence of the Group Home.
f, In addition to the Home Day Cares, Mr. Barber failed to know that the High
School students in the NEIGHBORHOOD are required to walk to school
when he told us that the "Reality Check" gang will be attending Eagan High.
And, will "ride the bus". To much of our displeasure, we had to informed him
about information he should have known. It does seem disingenuous - and
only increases our suspicions and dishust. Moreover, we cannot envision these
boys saintly walking through our streets to Eagan High, among other young
children, without causing disruption and disorder despite the claims of close
supervision. Mr. Barber had made a big sell-pitch about how much
supervision there will be... but as it always seems to go, when an incident
occurs there will be plenty of excuses and blame.
5. Mr. Barbers Group Home has not yet received licenser... the date for which we have
been given is April l lth.
6. Property Rights I stand by the American Ideal for an owner to use his/her property as
they please. There are many people who run private businesses from their homes; this
practice is not unusual and should be applauded. But it must be implemented within
reason. The safety and effects of the business upon the neighbors must be considered in a
logical and reasonable manner. For example, there would be a safety issue if, say I
decided to manufacture FIRE WORKS in my basement, or if I raise a buffalo heard in my
backyard, or open a Gun Shop in the garage...
Again, with the most basic reasoning, it seems a residential home is, by design, a home
for a family (or at least a single individual who actually lives there). Which brings us to
the next point: Mr. Barber's Family will not be living at the residence nor living near the
residence. In fact, Mr. Barber's family lives many miles away in Hastings..

7. If Mr. Barber's family was moving into the Home; he would, without a doubt, be
welcomed into the NEIGHBORHOOD; or if the home was to be used by mentally or
physically disable kids or adults... the difference being that of the proven record of
criminal behavior and value-less characters of the kind of kids who are sent to group
homes.

I am writiag to express my concern about the above proposed group home, and to offer my
support for the city's opposition against the licensing of said group home as described in you
letter of Apri14, 2001 to Michael O'TCeefe, Commissioner of Human Seivices.
This Moming at approximately 8:30, I called Ivtr. O'Keefe's office and 1eft a message with his
secretary that I wished to discuss thia matter with lum. As of the time I am sending this to
you, he has failed to retum my call. As a resident ofEagan who lives within approximately
two blocks of this proposed goup homc, I am very concerned about the problems suaounding
the placing of such a home in a quiet residential neighborhood will inevitably create. Many of
those issues were nised in ypur A.pol 4, 2001 letter. I am largely concemed with the nature
ofthe individuals to be located in the group home, the ]ack of adequate supervision and the
proximity of the home ta small children (including mine), a park, schools and daycares.
While such a home may be needed, there are numerous other, more well suited locations in
Eagan where such a home would be better located.
May I suggest that the city consider having the city attomey seek an injunetion against this
group home being placed in the proposed Trenton 7rail location on the basis of lack of notice
to the city, potential violation of chapter 245A, danger to public health, and any other
grounds which the city attorney may find in researching this issue. I feel the city, and we
citizens, are being forced to accept something that we do not expect &om our neighborhood
and a city such as ours. Also from what I understand, a neighborhood meeting was held last
night .vith a reporter from the Pioneer Press in attendance, and it was alleged that eertain
issues sunrounding the home were broug6t to light which bear further investigation. I would
suggest that all of these should establish a basis for the city attomey to obtain a restraining
order st least forstalling establishment of this group home pending further investigation. I

I came out of the meeting tonight with a feeling of hope and very good feeling about our Mayor, City Council Members, City
Attorney, City planner and everyone there who heard our fears and concerns about what is happening here in our

This is not right!

There is a definite need for Juvenile Shelters to try and help these kids/adults. But, NOT next door to a licensed day care

By now you have been made aware of the group home for "Troubled Teenage Males" that will open up next door
to a licensed in-home day care facililty in Eagan, MN, to be operated by Reality Check Group Home Inc,
I am counting on your expertise and good judgment to deny Mr. Barber's (Reality Check Group Home Inc.) a Rule
8 licensing request.
Today, there is a shortage of in-home day care providers. You may or may not have seen or heard about this on
the news. Just recently there was a television broadcast about this situation.
Please be aware that Mrs. Oretha Howard (the day care provider) could lose her business. This is not known for
sure, but as it stands, Mrs. Howard's clients are frightened and extremely concerned for the welfare of their
children being next door to this type of group home and are strongly considering placing their children
elsewhere.
It also concerned me and I am frightened to death of what could happen. My mother worked for the Lino Lakes
Juvenile Correctional Center for many years and I am aware of what type of residents this home can take in.
Mr. Barber and his wife held an open house on Saturday March 31s. We were told that this Mr. Barbers first
business venture of this type. NO HISTORY!
There are all kinds of residents that Mr. Barber can accept under Rule 8 Licensing such as:
1. Runaways
2. Abused (Physically and mentally)
3. Behavioral problems
4. Mental disorders (possibly medicated)
5. Situations where the resident cannot return to their home environment
6. Drug addicts
7. Convicted or suspected thieves
8. Teenagers who are convicted or suspected of assault
9. Teenagers who are convicted or suspected of property damage
10. Teenagers who are convicted or suspected of burglaries
11. Teenagers who are convicted or suspected of arson
With problems such as these, we now have "Troubled Teenagers" who have little or no control over their actions.
Mr. O'Keefe, to me that only spells out IMINENT DANGER to the welfare of the day care children.
THIS IS LIKE A TIME BOMB HANGING OVER MRS HOWARDS DAY CARE CHILDREN AND HER BUSINESS!
After speaking with Mr. and Mrs. Barber, they give no guarantees that nothing will happen to, or in front of these
children which vary in ages from infants to ten year olds. Things like harassment, vufgar language, indecent
exposure, witnessing fights between the residents, arguments between staff members and the residents, the
increase in danger of personal harm.
I am pleading for your help! Do I as a homeowner want to welcome this group home and allow the possibly that
these or my children could be harmed? Mrs. Howard could lose her day care License.
Realizing this is the fear of the unknown, this license will increase the odds of criminal activity within my
neighbarhood. We have written proof
(Police reports) of another group home in Eagan that has had 67 police calls in the past three years. This
information can be provided easily, as it is a matter of public record.
Who will be held responsible when something happens? Whose child has to be the first victim?

I have lived in St. Paul and Minneapolis for twelve years and have
wo=ked in
Eagan for six of those years. I love both my home and my job. I just
wish I
did not have such a long commute with no feasible public transpoitation
option. Every year, the drive to work has grown evei more dreary as
Eagan
becomes yet another ugly, anonymous suburb with almost no soul. The
Eagan
sp=awl of strip malls, freeways, parking lots, and boxy houses is
depressingly like the sprawl that makes so many other US cities such
generic
places, a11 in the name of "personal freedom."
I know Minneapolis and St. Paul are not perfect, but I sense a strong
commitment in both cities to solve problems. In Eaqan, I sense a st=ong
commitment to run away f=om problems and insulate their residents from
the
poo=, minorities, or any lifestyle outside the norm. Shockingly, Mayor
Awada, whose city has very little affordable housing and almost no
racial
diversity, decries "new urbanist" ideologies that force people out of
the
housing market. I wish Mayoz Awada could understand how interconnected
our
region has become and how her views only work to exacerbate
inequalities.
As I commute from Minneapolis to work in Eagan, I pass many Eagan
residents
commuting to jobs in Minneapolis. Everyone benefits from this
relationship.
We no longer live in a small town; we live in a large thriving
metropolitan
area. Forward-looking regional planning, including good public
transportation, is the smartest way to preserve the high quality of life
we
sti11 enjoy.

• Told me thai at Rule 8 could not have: sex offenders, individuals with acute
psychiatric rw_eds, active addictions, or ofrznders with fire or arson in their
background. Klingner could not guarantee me 100% that an offender that had been
originally amsted for one aF these crimes, but, plea-bargained down to a lessor
offense, ca-iid NOT be in t'w_ home. Coufd tell me that the teenaged males could
have violeni pasts, have committed crimes with weapons, etc.

GROUP HOMES
9545.1400 STATUTORY AUTHORITY.
The authority of the Department of Human Services, Licensing Division, to
prescribe and publish minimum standards for the approval and licensing of group
homes is contained under Minnesota Statutes, chapter 245A. Standards
prescribed, and contained herein, shall be in force until revoked or revised by
authority of the department.
The commissioner of human services is delegated responsibility by the state
legislature to see that the minimum requirements as herein prescribed are met
and maintained by county welfare departments, licensed chiid-placing agencies,
licensed children's institutions, foster family group homes, and independent
operators of group homes.

9545.1410 PURPOSE OF GROUP HOMES.
In our day, we are greatly concerned about all chiidren in society and their
need for proper care. We have the responsibility to see that proper resources
are established and maintained. With our growing child and youth population
and expansion of needs, we find that there are gaps between the service needed
and the variety of resources available to provide the service.
In recent years, in an attempt to meet diverse needs, new resources for care
have been established. One of these new resources is the group home. Group
homes provide a type of care that is not available through traditional foster
families or institutions. Group homes are not meant to replace either of these
types of care but present a unique opportunity to combine different aspects of
treatment from both resources. Group homes can provide adult guidance and
professional services to the chiid placed out of the child's own home and yet
keep the child in community living. The facility is community based, and the
program is community oriented.
The group home represents a resource that has tremendous flexibility in giving
care to children of all ages with varying needs. Group home care should be
used on a selective basis as a treatment of choice. The group home should not
be considered a panacea of care tor children. It is a distinct resource in its own
right that is part of the whole broad spectrum of resources available to children.

9545.1420 DEFINITIONS.
Subpart 1. Agency. "Agency" means the party responsible for providing
social service, administration, and the direction and control of the program. This
party can be a county welfare department, licensed child-placing agency,
licensed children's institution, or independent operator.
Subp. 2. Children. "Children" means persons under the age of 1a years of
age or persons over 16 years of age if for reasons of inental retardation they still
require the protection needed by persons under 16 years of age (Minnesota
Statutes, section 245A.02, subdivision 4).
Subp. 3. Group home. "Group home" means a specialized facility tfiat
provides care on a 24-hour-a-day basis for a sefected group of not more than ten
children. The facility can be owned, rented, or leased by a county welfare
department, licensed child-placing agency, licensed children's institution, or
independent operator, or subsidized by any of the above. The specialized care
will be a planned treatment program under the direction and control of an
agency, institution, or independent operator. Natural children of the group home
parents under 21 years of age, if present in the home, are included in the total
number of children living in the home.
Subp. 4. Group home parent. "Group home parent" means a person who
carries out the continuing daily living program and provides care to the children.
This may be a member of the agency staff or a person subsidized for the care he
or she provides. It may be a married couple, a single person, or singie persons
working on a shift basis.

9545.1430 ORGANIZATION AND ADMINISTRATION.
Subpart 1. Philosophy, purpose, and function of home. The philosophy,
purpose, and function of the group home shall be clearly defined in writing and
maintained as part of the group home file in the agency.

Subp. 2. Written description. The agency shall similarly define, in writing,
and file a statement of the geographic area to be served, ages and kind of
children to be accepted for care, and the specific extent, limitations, and scope
of service for which the group home is established.
Subp. 3. Written agreement. The agency snall have on file a written
agreement between itself and the group home parents. The agreement shall
contain the following items:
A. admissions and discharge policy for the residents;
B. program plans for residents;
C. terms of the agreement as they affect length of time to be in effect and
what conditions necessitate the formufation of a new agreement;
D. the roles, responsibility, and authority of the agency and its personnei
and group home parents;
E. the per diem or monthly care rate paid to the group home parents; and
F. the maximum number of children to be cared for in the group home.
Subp. 4. Finance plan. The agency shall have a sound plan of financing that
will give assurance of sufficient funds to enable it to carry out its defined
purposes and to provide proper care for children.

Subp. 6. Coordinatian with community services. The agency shall coordinate
its services and program with appropriate persons, agencies, and organizations
in the community. This shall include schools, vocationai training centers, mental
health centers, job placements, day activity centers, parent organizations, and
churches.
Subp. 7. Needs of children. Clothing, personal allowance, spending money,
and medical expenses for the children in the group home shall be worked out by
the agencies involved.
Subp. 8. Discrimination prohibited. All licensed individuals, agencies, or
organizations shall operate on a nondiscriminatory basis, according equal
treatment and access to their services to all persons.

9545.1440 PERSONNEL.
Subpart 1. Director. The director of the agency will be the chief administrator
of the group home. The chief administrator may direct the total operation of the
group home or may delegate this duty.
Subp. 2. Employee qualifications. All employees shall be persons of good
character, good physical and emotional health, and appropriate age and maturity
and shall possess sufficient ability and education to carry out adequately the
duties assigned to them.
Subp. 3. Adequate staff. There shall be sufficient staff to carry out the group
home program.
Subp. 4. Social service staff. The agency shall provide qualified social
service staff for the group home either from within its own structure or through
contractual arrangements.
It is recommended that not more than two persons provide continuing social
service to any group home. (Recommended.)
Subp. 5. Group home parents. Each group home shall have full-time group
home parents. If a married couple is employed in this position, at least one of
them shall be on a full-time basis. A group home parent shall be on duty at all
times.
Subp. 6. Substitute parents. Adequate arrangements shall be made for
substitute group parents to serve in emergency situations, vacation, illness, and
when the regular group parents have their time off.
it is recommended that the full-time group home parents receive two weeks
vacation per year and that they be allowed one full day off per week.
(Recommended.)
Subp. 7. Medical and dental staff. The agency shall provide medical and
dental staff for the care of the group home residents either from within its own
structure or through contractuaf arrangements.
Subp. 8. Additional staff to carry out the group home program. Additional
staff to carry out the group home program:

A. Psychiatric consultation: to provide consultation on a case basis as weil
as overall treatment goals for the group.
B. Psychologicai consultation: to provide testing for assessment purposes
at the time of admission as well as to measure gains throughout the stay or at
the time of dismissal. The psychologist may also be used to set up and carry
out a research project to evaluate the progrem and its impact on the children.
C. Service personnel: a cook, a housekeeper, or maintenance personnel
may be hired to perform specific duties. This could relieve the group home
parents of these functions and allow them more time with the children in
carrying out the program.
D. Volunteer services: to augment and assist other personnel in carrying
out the program. Volunteers shall be-aware of, and interested in, the needs of
children. They shall be oriented to the program, staff, and children of the group
home.
E. Trained group worker: to carry out direct group treatment services,
consult about overall group programs, and provide training in group process to
the group home parents. (Recommended.)

9545.1450 PROGRAM.
Subpart 1. In general. The program shall be a composite of the services
offered in the group home, community, and agency supervising and directing the
operation of the group home. (Recommended.) The program shall be based on the purpose of the group home, with plans for
the individual children as well as the total group.
Subp. 2. Individual program plans. A progrem plan for each child shall be
formulated by the agency in conjunction with the group home staff, community

resources, and auxiliary services at the time of intake. This plan snall be
reevaluated at least every six months, with changes implemented according to
the needs of the chiid.
SubQ. 3. School for chiidren. All school age children shall be referred to the
local school district for educational planning and placement. "Local school
district" means the district in which the group home is located.
It is recommended that this referrai to the locai schooi take place prior to
placement in the group home to ensure that the chiid is eligible for service and
that the local school has an appropriate program.
Subp. 4. Goal of group living. Group living shall be used in pianful and
purposeful ways to help the children develop constructive relationships to adults
and to other children and constructive patterns of handling time, money, and
care of belongings and property.
Subp. 5. Community experiences. Community living experiences shall be
used in conjunction with pians for education and training, recreational and social
pursuits, job placements, and attendance at religious services.
Subp. 6. Social service. Sociai service shall be a ciearly defined and
identifiable phase of the totat care, treatment, and training program. Social
service shall be provided on both an individual and a group basis. It is
recommended that social service be extended to the families of the residents
whenever feasible and in accordance with the planning of the child.
(Recammended.)
Subp. 7. Recreation. Leisure time activities shall be planned to allow for
constructive activities that enhance social and physical skills. Time shall also be
available for compietion of academic assignments and to allow for individual
pursuits.
Subo. 8. Health examinations. All children shall have medical and dental
examinations yearly, or more often if necessary.
It is recommended that each child be given a medical and dental examination
prior to admittance into the group home.
Subp. 9. Religious practice. Each child shall have the opportunity to practice
the child's religious preference.

9545.1460 RECORDS.
Subpart 1. Group home records. The supervising agency shall maintain a
record on each group home. The record shall contain a copy of each of the
following items:
A. the philosophy, purpose, and function of the group home;
B. the statement of the geographic area to be served, ages and kind of
children to be accepted for care, and the specific extent, limitations, and scope
of service for which the group home is established;
C. the agreement between the agency and the group home parents;
D. theintake policy and procedure;
E. the arrangements for the provision of social services;
F. the arrangements for the provision of inedicai and dental services;
G. personnel policies;
H. criteria for sglection of group home parents. (The criteria outtined in
parts 9545.0030 to 9545.0080 for foster parents may be used in the
development of the criteria for the selection of group home parents.
Recommended.);
1. names of group home parents and substitute group home parents;
J. the state fire marshal report; and
K. a floor plan of the group home, the designated room dimensions.
Subp. 2. Financial records. The financial record of the group home shall be
maintained in the agency.
Subp. 3. Individual recorda. The agency shall maintain a record on each
individual resident in the group home. The record shall contain a copy of each
of the following items:
A. admission information;
B. objectives of individual planning;

C. reports on progress toward the accompiishment of these objectives; and
D. dismissal summary.
Subp. 4. Medical records. The group home parents shall maintain medical
records on each cfiild.
Subp. 5. Children's progress reports. The agency shall send the referring
agency a record of the child's progress at least every six months.

Subp. 7. Confidentiality. Information on record pertaining to an individual or
the family shall be held confidential and released only to authorized persons or
agencies. -

9545.1470 PHYSICAL FACILITY.
Subpart 1. Location. The location of the group home shall be related to the
program it offers. It shall be accessible to religious, school, training, and
recreation facilities and other appropriate community resources.
It is recommended that the home be located in a residential area and be
undifferentiated from other residences. It is helpful to locate in a neighborhood
where there are other children and the neighborhood accepts children and their
behavior. (Recommended.)
Subp. 2. Grounds. The grounds shali provide adequate outdoor space for
recreational pursuits.
Subp. 3. Compliance with codes. The group home shall meet the regulations
of the local health authorities as well as local zoning and building codes.
Consultatian with the state Department of Health is available if desired.
The group hame shalf ineet the requirements set forth by the state fire
marshal. The state fire marshal shall inspect all facilities.
-Build'ing. Building:

+ A. There shall be living and recreation space of 35 square feet of floor
space per child. This may include living room, dining room, and recreation room
but excludes bathrooms, halls, laundry room, bedrooms, furnace room, and
' kitchen.
B. The dining area shall be large enough to comfortably accommodate all
the children, the group home parents, and guests at a meal. The room shall be
cheehul, well ventilated, and convenient to the kitchen.
C. Every sleeping room for the accommodation of one child shall contain 80
square feet of floor space, with a minimum horizontal dimension of eight feet.
D. Every sleeping raom for the accommodation of more than one child shall
contain 60 square teet of floor space per child, with a minimum horizontal
dimension of eight feet. Each child shall have an individual bed. Individual beds
shall be at least three feet apart.
E. No bedroom shall accommodate more than four children.
It is recommended that there be no more than two children per bedroom. It
may also be helpful to have single occupancy rooms. (Recommended.)
F. Each resident shall have a set of dresser drawers to accommodate
personal articles and clothing.
G. Each resident shall have an individual storage closet or locker for
day-to-day clothing, and other storage space for clothing not currently used.
H. There shall be one toilet for every five children, one lavatory with hot and
cold water for every five children, and one tub or shower for every five children.
The toilet facilities shall be maintained in a sanitary condition equal to the lacal
health regulations. All group homes that house children af both sexes shall have
separate toilet and bath facilities for each sez.
1. The heating plant shall be of a size and capacity to maintain a temperature
of 70 degrees Fahrenheit in all rooms.
J. Provisions shall be made for laundry facilities adequate in space and
equipment to meet the needs of the children, the group home parents, and the
home.
K. A ffashlight and a first aid kit shall be available in every group home for
emergency use:

L. All medications for the children in the group home, as weil as household
poisons, shall be kept in a safe and secure place.

should the facility not be in compliance with local zoning. Per State Statute.
