Dear Mr. Huttner:
Based on our meeting last Thursday, October 5, you identified a statemem in my September 14, 1995,
correspondence to Mr. Brian Anderson, 960 Trillium Court, that was not accurate. Mr. Anderson
had informed me that you as the builder of the home on Lot 12, Block 2, had provided the finished
grade for the lot as a part of the home construction. Based on our conversation, it is my
understanding that Mr. Anderson hired the contractor to provide the final grading of the lot as well
as the installation of sod. Also my understanding is that as a part of the home constructioq you
provide a sod allowance to the future homeowner.
As we discussed, the developer is required to submit as a part of his subdivision approval, a
development grading and drainage plan which identiSes proposed house styles, floor elevations,
proposed lot corner elevations and general drainage pattems within the subdivision. Even though the
home constructed on the above-referenced lot does not provide for the grading and drainage pattems
as orignally identified in the development plan for the subdivision, the drainage pattems as they exist
do conform with the site plan submitted as a part of the building permit appGcation process. The
e)dsting lot corner elevations today do reasonably conform with those identified on the site plan
submitted.

Huttner. Both pieces of correspondence are attached for your information. The City has no
Imowledge efwho provided the final gade on the above-referenced lot. T'he infonnation presented
in the correspondence u based on a discussion with Ntr. Anderson prior to September 14, 1995, and
a discussion with Mr. Huttner prior to October 10, 1995.
As we have previously discussed, the developer of a pazcel of land within the City of Eagan is
required to submit, as a part of his subdivision approval, a development grading and drainage plan
wtrich idenrifies proposed house styles, floor elevations, proposed lot comer elevations, and drainage
patterns within the subdivision. My September 14, 1995, correspondence to W. Anderson states

This statement is an accurate statement. .
My October 10, 1995, correspondence resiates the information as presented in the September 14,
1995, coaespondence but also references a"site plan" wtrich was submitted as a part of the building
pennit appGcarion process. The "site plan" submitted as a part of the building permit application for
the above-referenced lot identifies proposed drainage patterns which are not identical to those
identified in the original development grading plan. The "site plan" submitted as a part of the
building permit application generally needs to conform with the intent of the original development

drainage plan were proposed. Proposed modifications to the original development grading and
drainage plan are acceptable if they do not adverseiy impact the overall subdivision gading aad
drainage patterns.
The Ciiy's review at this point has been to checlc spot elevations on the above-referenced lot to
determine if the grading and drainage pattern av it exists today "reasonabi}~" conforms with the
deveiopment grading and drainage plan as well as the site plan submitted as part of the building
petmit applicatioa There appears to be an area of the above-referenced lot which does not drain as
well as it could, but the existing gading and drainage patterns do not advesseiy impact adjacent
properries. The final grade provided on a lot prior to the installation of sod and landscaping is beyond
the scope of review which the City perfoims. The final gade established by the individual property
owner and the contractor is an agreement between those two parties.
