Dear Sir/Madam:
We are writing this letter to you express to our displeasure
with a construction company in the Twin Cities area by the
name of Mittelstaedt Hrothers, Inc.
My wife (Krista) and I will be moving to the Twin Cities
area in the summer of 1995. In preparation for the move we
have been searching for a place to live; either build or
purchase. We are moving here from Onalaska, Wisconsin,
which is 150 miles South of here.
On the weekend of March 3, 4& 5,1995 we looked at about 18
houses/lots. One house that was of particular interest was
a model home in the Wildflower addition in Eagan. We talked
with the agent (Bev Somerville) showing the house and we
were informed that the lot L(TO10 Trillium Court) next door
to the model home was for sale. We talked with Bev and our
agent (Rick Plank) on March 5 and requested that a hold be
put on the lot for our construction. Bev said she would
double check and reserve the lot in our name. The next day
Bev talked with me and said that she had contacted the
builder and.that the lot has been resexved in our name. I

application and she made an appointment for March 9,1995.
I met with Bev and Rick on the evening of March 6,1995 and
completed all forms, including a purchase agreement so that
I could take the forms, with me to have Kris sign them. I
asked Rick Plank what would happen if someone else would
want the lot, so on March 10 he informed me that the
developer expressed an interest in selling us the lot on
contract for deed. Therefore, if someone else expressed an
interest in buying the lot we would have 48 hours to come in
with a 10t down payment and execute a contract for the
remainder. So, regardless of what would happen we would be
guaranteed the lot.
I faxed a purchase agreement to Robert Engstrom Developer on
Monday, March 13 and was assured via telephone conversation
with Bev and Rick that we were okay for the lot purchase. On
Tuesday, March 14 Rick Plank picked up the original purchase
agreement from me, a check for $1000 and all other forms for
final processing. At this time we felt that everything was ,
okay and the lot was ours. The next step would be meeting
with Mittelstaedt. On Thursday (March 16), I was informed
that the lot had been sold to another agent of Mittelstaedt
Construction, whom I have since discovered was his sister.
I called Dean Mittelstaedt and asked him about the situation
and how this lot could be sold to another party and he said
that the other purchase contract was in a brief case and had
an earlier date (March 3 or 4) on the contract. I said that
rhe con*_ract date could hav= been put cn at any tim2 ard
could have been pre-dated.
Although, the procedure used by Mittelstaedt Brothers is not
illegal (or is it?), we feel that it was unethical, devious,
underhanded and Mr. Mittelstaedt dealt with us in a poor
business manner which was not open and truthful. Incidents
like this situation reflect on the construction business in
the area, other agents & realtors and the Community in
general. Mittelstaedt Brothers actions should not be
accepted. We are requesting an investigation into the
incident, and that Mittelstaedt's practices & procedures be
reviewed and questioned.
Since that incident we have been pursuing other lots and
builders which has caused us additional expenses for lots,
travel, time, interest rates and many other miscellaneous
inconveniences. If further information is required we can
