Dear Tom,
I am attaching for your review a proposed grading plan for the
drainage swale along the south property line of Lot 31, Block 2,
Bridle Ridge 2nd Addition. Based on the calculations of our
engineer, James R. Hill, Inc. this swale should conduct 20 c.f.s.
without causing significant damage to the swale or damage to the
structure.
In order to accommodate this flow, it is necessary for us to
construct a 3 foot high retaining wall along the landscaped berm
on the south property line to create enough distance between the
house and this berm to build a swale with an eight foot bottom a
reasonable distance from the house. It is also necessary to fill
the back yard so that a 5$ grade is maintained through the
majority of the lot.
We are proposing that the retaining wall be a boulder wall
approximately 3 feet in height for a distance of approximately 70
feet. It is my estimate that a wall of this type will cost
approximately $8.50 a square foot to construct. The rear yard
can be filled by using fill material left on the parkland from
the construction of Northview Park Road. I have complained about
these piles of dirt for two years because they look unsightly and
block the view of the ravine and Bald Lake. This dirt would
finally put the fill to good use. I would estimate the cost for
these improvements to be approximately $3,350. Itemized, the
costs are:

Sienna has spent nearly $1,000 in engineering which we will
absorb. Because we are presently grading the Oaks of
Bridgewater, there should not be any mobilization charges for the
equipment.
It is Sienna's request that the costs to modify the swale to
accommodate the City's required flow be paid by the City. We
believe that the cost is minimal compared to other alternatives
and is fair in light of the fact that we were not informed of the
need for such a"heavy duty" swale at the time our plat and
grading plan was approved. As we discussed, Sienna will grant
the City a drainage and utility easement over the swale to
prevent future homeowners from blocking the swale and to allow
for the potential of pipe being installed at some point in the
future.
I would appreciate a response to this request at your earliest
convenience. I understand that the City is planning to refuse
occupancy of the house under construction on this lot until this
matter is resolved; occupancy is presently planned for
Thanksgiving week. I have committed my efforts and the efforts
of our engineers to ensure that the need to refuse occupancy will
not arise and that an amicable solution can be achieved. Should

Dear Tom,
Since your letter of November 21, 1990, Sienna has had
constructed and received bills for the grading of the above
mentioned emergency overflow swale and retaining wall. I have
attached the billings for your review; the total cost to date
(only seeding remains) is $5,080. This includes engineering that
I had originally committed to pay.
It is still Sienna's request that the City pay the costs to
construct the swale, including the retaining wall. As I
originally offered, Sienna will pay for our engineering fees
incurred. I realize that this is contrary to your opinion but I
am having difficulty understanding the logic behind the City's
present position. Without question, our berming and landscapiny
is located within a public easement and was not shown on the
development plan. I believe however, that this is not the
problem or the issue; it is simply a constraint. What I believe
the issue to be is the amount of water that is planned to be
conveyed through this swale (at one time 100 c.f.s.) and the
absence of any communication of this to us when our plat was
approved; I believe it could be argued that the City was not
cognizant of the amount at the time of our approval. When this
issue was being discussed before the City Council several months
ago, Sienna chose not to appear before the Council and point
fingers, but chose t.o try and work with the homeowner to try and
design a solution that they would be happy with and be as
inexpensive as possible. I believe this solution is much more
attractive and less expensive than either a pipe or a"stair step
swale" that would have had to have been constructed in the
drainage easement if the homeowner had been uncooperative.

But rather than spend more of my time, and subsequently yours,
writing all the reasons and rationale behind our respective
conclusions, I would prefer to meet with you at your earliest
convenience to discuss this in person; letters are too formal,
take too much time and should be used to document our decision,
not make it.
Please contact me at your earliest convenience so that we can put
this issue to rest once and for all. I don't know about you, but
I would like to put this problem in the "resolved" file as soon
as possible.

Dear Tom,
I am attaching for your review a proposed grading plan for the
drainage swale along the south property line of Lot 31, Block 2,
Bridle Ridge 2nd Addition. Based on the calculations of our
engineer, James R. Hill, Inc. this swale should conduct 20 c.f.s.
without causing significant damage to the swale or damage to the
structure.
In order to accommodate this flow, it is necessary for us to
construct a 3 foot high retaining wall along the landscaped berm
on the south property line to create enough distance between the
house and this berm to build a swale with an eight foot bottom a
reasonable distance from the house. It is also necessary to fill
the back yard so that a 5% grade is maintained through the
majority of the lot.
we are proposing that the retaining wall be a boulder wall
approximately 3 feet in height for a distance of approximately 70
feet. It is my estimate that a wall of this type will cost
approximately $8.50 a square foot to construct. The rear yard
can be filled by using fill material left on the parkland from
the construction of Northview Park Road. I have complained about
these piles of dirt for two years because they look unsightly and
block the view of the ravine and Bald Lake. This dirt would
finally put the fill to good use. I would estimate the cost for
these improvements to be approximately $3,350. Itemized, the
costs are:
Retaining Wall @ 210 s.f. @ $8.50/sf = $1,785
5 Hours D-6 Dozer @$95/hr = 475
2 Hours Grade man @$45/hr = 90
1 Acre Seed & Mulch @$1000/ac = 11000

Sienna has spent nearly $1,000 in engineering which we will
absorb. Because we are presently grading the Oaks of
Bridgewater, there should not be any mobilization charges for the-
equipment.
It is Sienna's request that the costs to modify the swale to
accommodate the City's required flow be paid by the City. We
believe that the cost is minimal compared to other alternatives
and is fair in light of the fact that we were not informed of the
need for such a"heavy duty" swale at the time our plat and
grading plan was approved. As we discussed, Sienna will grant
the City a drainage and utility easement over the swale to
prevent future homeowners from blocking the swale and to allow
for the potential of pipe being installed at some point in the
future.
I would appreciate a response to this request at your earliest
convenience. I understand that the City is planning to refuse
occupancy of the house under construction on this lot until this
matter is resolved; occupancy is presently planned for
Thanksgiving week. I have committed my efforts and the efforts
of our engineers to ensure that the need to refuse occupancy will
not arise and that an amicable solution can be achieved. Should

Drainage Swale Construction
Dear Rick:
I have received your letter of November 6 addressing the issues
associated with the construction of an adequate overland drainage
swale across the above-referenced lot. You and I have discussed
this situation and I have reviewed the application and progress of
this building permit.
The cost "estimates" contained in your letter are helpful in
identifying the different aspects associated in providing this
drainage swale. Previously, we agreed in concept to the City
paying for a portion of the costs incurred with the grading beyond
normal final lot shaping. The need for a retaining wall is
accentuated by the existence of a significant subdivision landscape
buffer area along Northview Park Road that was not part of the
approved development grading plan. Also, it is located within a
dedicated drainage and utility easement. If the approved
development grading plan had been adhered to, a retaining wall
would not have been necessary. Therefore, I feel that all costs
associated with this wall should be considered part of the
development's landscape buffer or the final lot landscaping
improvements.
Therefore, the City will consider financing the D-6 Dozer and
Grademan costs along with the seed and mulch restoration costs for
the area outside a typical lawn area for this lot. (I'd be
surprised if it encompassed a full acre.) Correspondingly, this
would include the proportionate share of the engineering costs
incurred regarding this issue.

Dear Tom,
Pursuant to our last discussion, I am re-submitting the invoices
we have paid to construct the emergency overflow swale on the
above mentioned lot. These invoices include $1,377 to James R.
fiill Inc., $8I3 to Enebak Construction and $884 to Mulligan Tree
Moving. The remainder of the bill to Mulligan is Sienna's
responsibility for work done elsewhere in the subdivision. The
total cost to the City is thereforeyfia.yQ7,, I am also having an
easement drafted covering the south 40 feetyof the lot so that
the swale is entirely within a drainage easement. As soon as the
property owner signs it I will forward it to you. When Sienna
receives payment, I will also send a release to you relieving the
city of any further claims.
Your cooperation in resolving this matter has been greatly
appreciated. Cominq to this conclusion wasn't easy for either of
us; the fact that we :eached s mutually benefieial conclusion in
spite of the difficulty says something for the relationship that
Sienna and the City of Eagan have formed over the years. Please

Dear Tom,
The purpose of this letter is to inform you of Sienna's position
regarding the City Council's recent decision pertaining to storm
sewer improvements for the Stafford Place/Northview Park Road
area and the use of a portion of Lot 31, Block 2, Bridle Ridge
2nd Addition as an emergency overflow for this system. The
reason these concerns were not voiced at the last City Council
meeting was that I was not aware of the volume of water that was
anticipated to be conveyed through the mentioned emergency
overflow swale.
As part of the approval for Bridle Ridge 2nd Addition, we were
required to put an emergency overflow swale along the south side
of Lot 31, Block 2. This was constructed in accordance with the
approved plan. Additionally, Sienna installed entrance monuments
and landscaping alonq Narthview ParY. Doad and Trotter's Ridae.
While this landscaping and berming was not shown on the grading
plan, I think you will conclude that it does not effect the width
of the swale at the back of the building pad; this is the
critical area in that this is where the velocity of the run-off
is greatest.
The problem arose when, during the review of our plans, we
weren't told the amount of water that was expected to be
conducted through the swale in the event of a 100 year event.
According to Mark Hanson at B.R.A.A., this overflow is expected
to accommodate 80 c.f.s. during a 100 year event, serving as the
emergency outlet for a 118 acre area. In my opinion and the
opinion of my engineers, the over-land transmittance of this
volume of water is neither acceptable or desirable. Zf I were to
propose this in any of my subdivisions, the City would certainly
not allow or approve it. This design is particularly

unacceptable considering the slope of the lots and parkland that
receive this water. I believe, in light of the known volume that
this swale was expected to receive, the simple request for an
emergency overflow swale on our property was at best understated.
What the City should have requested was an EMERGENCY OVERFLOW
SWALE!!!!
Furthermore, I believe that in the presentation of the proposal
to the City Council, the comparative need for an alternative to
this swale was not stated. The people in Stafford Place who
experienced erosion damage had nowhere near the volume of water
flowing across their yards that we had across our lot. The
problems occuring adjacent to Northview Park Road were only
briefly discussed, leading the Council to believe that the only
significant problem was the brief flooding in the street.
Because there was no significant damage to our property, they
were unintentionally lead to believe there was no problem. Good
turf establishment and the fact that the lot was vacant,
therefore allowing the water to flow over the entire lot, were
the reasons we experienced little damage.
As you are aware, we had sold that lot nearly 2 weeks prior to
the Council meeting. After being properly informed after the
meeting of the ramifications of the Council's action, I felt
obliged to convey that information to the buyer. For obvious
reasons, the buyer is now looking for a different lot.
I have intentionally not attempted to get technical at this
point; I am confident that you and your consultants are aware of
the magnitude and severity of this problem. If you weren't, a
solution (al beit an expensive solution) would not have been
presented to the Council. While you have volunteered your
services to help a prospective homeowner design landscaping to
prevent erosion in this swale, I thinl; we all agree that a rip-
rap ditch is not a traditional or commonly found design element
in the average homeowners yard.
We are therefore requesting that the City either purchase our
lot, therefore enabling a very wide drainage swale, or design a
catch basin/pipe system that prevents that amount of water from
being conveyed over this lot. I don't believe that a system has
to be constructed from the low point of Northview Park Road as
suggested by B.R.A.A.; there should be less costly methods to
eliminate or minimize the amount of water being conveyed by this
swale. Because Sienna now owns that lot, we would be happy to
grant the necessary easements to do this provided it does not
effect the buildable area of the lot.
I have attempted not to take a hostile position at this time in
hopes that we can work out an amicable solution. I have every
reason to believe that a solution can be reached quickly and
without much pain. It is important to stress however that,
should this not be possible, Sienna is prepared to take whatever
measures are necessary to see that our concerns are adequately
addressed and the problem rectified. I would appreciate meeting
with you and other appropriate staff or consultants as soon as
possible; it is important that the status of this lot be
resolved, at least at a staff level, by sometime this week.
