There currently are no open cases for City Code violations at this address. There are Fire Code
violations however, and those are as follows:
. Exit & emergency lighting must be updated and installed in the following locations: All buildings;
every floor
. Update all keys for fire boxes at all buildings
. Repair all ceilings and walls in laundry rooms and boiler rooms (there are holes in the sheet rock
[gypsum board] in those locations; one-hour fire rated assembly must be maintained; holes
jeopardize the integrity of the fire rating system)
. All fire alarm panels need to be locked or secured (to avoid tampering)
. All laundry room doors need to be signed with "keep this door closed"

Dear Mr. Hedges:
The puipose of this.letter is to give notice of a proposed bond refunding and to provide an
opportunity for community review and comment.
The Dakota County Community Deve]opment Agency (CDA) issued $16,865,000 in multifamily
housing revenue bonds in 2004 to finance the acquisition and sLibstantia] rehabilitation of the
View Pointe Apartment Project, a 327-umt multifamily development project Iocated at Valley
View Drive and Rahn Road. The development was constructed in 1970 and is compnsed of 13
resideotial buildings with sepazate garage strucmres.
The previous owners had defaulted on their financin5 and the property suffered from high vacancy
rates, deferred maintenance isssues, a aeneral run-down appearance, and communiry safety
concerns on the part of the City. View Pointe Apartments, LLC ([he "Owner") consul[ed wtth the
City prior to beomning the renovation project and addessed the City's concerns. Attached is a
summary of the rehabilitation work completed, totalme $4.8 million. The project is now operating at
more than 957c stable occuplncy.
The Owner requests that the CDA issue tax exempt bonds in an amount of $16,865:000 to refund
the existing debt and issue additional taxable bonds of approximately $2.2 million to reimburse
part of the Owner's equity contribution and pay costs of issuance. The proposed refinancing is
estimated to have a net present value savings of 6%.
The CDA's policy related to such requests is to inform the cuy in which the development is
located and provide an opportunity for review and comment. The CDA will not approve
requests for funding where a community indicates that the development is not consistent with a
ciry's plan, policies, or eoals. If you have concems or comments related to this proposed

View Pomte Apaaments, LLP
Apartment Rehabilitation Summary
In 2004, View Pomte Apartments, LLP acquired a 327 unit apartment complex in Eagan,
Vlinnesota. At the [ime the property was purchased there were 57 vacant apartments and the
property itself was in a state of despair. The acqwsition of this property required a renovation of
[he property [o modem standards with many improvements such as roofs and siding replacement,
p2ving replacement, wmdow development, concrete replacement, and improvements ro the
interior common areas and apaRment units. In addition, a new management office and
community center were built on site and improvements were made to the garage banks.
At the onset of the redevelopment, the property was split into two distinet apaRment complexes.
Five buildings on the North side of the property have view of the river valley, comprisin; of 125
imits. These buildmgs remamed under the name View Pointe Apartments and involved a rehab
which consisted of upscale amenities and improvements, resulting m a hiaher price point for
these units. The remainina, buildings were renamed HighPointe Apartments and were also
renovated, but at a more modest level.
Improvements for View Pomte Apartments
The old roofs were replaced with hip roofs to modernize the buildings and to extend the life of
the roof. The old vinyl siding on the buildingas was replaced wi[h hardie plank siding with hardie
board accentine him. The balconies were replaced with aluminum deck railmgs and old windows
were replaced wi[h energy efficient ones. ln addition, all the patio doors were replaced as well ns
the dama.aed gutters and downspouts.
The interiors of the buildings were also renovated. New air conditioners were installed in all
uni[s :md the boilers were repaired and modemized with appropriate controls. All units received
plumbine renova[ions consistine of new sinks, stools and tubs and electrical upgrades were made
relative to new baths and kitchens. New light fixtures were installed in all units along with new
ceiling fans. The renovations to ail units consisted of new carpet and flooring, new cabmetry and
countertops, and new apphances. Also, all the common area hallways were resurfaced with
Knock-Down Texture in an effort to update and modernize interior appearance of the buildine.
Improvements for HighPointe Apartments
The roofs were replaced and repaired as needed based on the condition at the time of acquisition,
however some of the IlighPointe buildines recerved new hip roofs. New aluminum sidine was
installed and the balconies were replaced and repaired as needed to uniformly improve safety and
improve the aesthetic appeal oF the buildings. Windows were ulso replaced with energy efficient
windows and pntio doors were replaced as needed. All damaged gautters and downspouts were
also replaced.
Improvements to the buildine interiors consisted of new air conditioners in all units and boiler
repair and modernization, new sinks, bathtubs and stools in those units that requtred it, new
floorin2 and new liahtinq in all common areas ro create a more uniform look. Knock-Down
Texture was also applied to the common area hallways, as it was in [he View Pointe buildings.
Improvements and upgrades were made in selec[ units and involved the installation of new
caipet, floorina, cabinetry and countertops, and new appliances.
Several improvements were made to the property as a whole. For instance; the asphalt parl:ing
lots and driveways were replaced with new material; concrete curbina, was installed in certain
areas to protect the arassy areas of the property and new property signs were installed to
reinforce the aesthetic appeal. Agging garage doors were replaced with modem doors and new
siding was installed on the garage banks as needed to create a more uniform look. Exterior
liohting was improved by the addition of modem high efficiency lamps. In addition, a new
management office and maintenance shop was built on the propeity near the View Pointe
Apartments entrance.

View Pointe Apartment Office Building located within the City of Eagan.
This project should be chazged no additional SAC Units. This office is for use by the
apartment complex. The existing office will be demolished when the new one is complete.

Enclosed please find a current survey for the View Pointe Apartments. You will note that two
buildings along the northwest property line and one building along Rahn Road encroach over the
current setback back lines.
We understand this property was built in 1970 and we would appreciate an e-mail confirming
that the location of the buildings have been grandfathered-in. We understand that if the
buildings were rebuilt following damage or destruction, they would need to comply with current
zoning requirements.

We are in receipt of your request to review the View Pointe Apartment survey dated December 6, 2007. It
appears from the survey that three of the existing structures on the property are located within building setback
areas. Therefore these are legal, non-conforming structures.
The buildings can be repaired and maintained, provided the repairs are nonstructural in nature The expansion of
an existing nonconforming structure is not allowed. Also, per zoning code Section 11.40 Subd. 9., "whenever a
lawful non-conforming structure shall have been damaged by fire, flood, explosion, earthquake, tornado, war, riot,
or act of God, it may be reconstructed and used as before if it is reconstructed within 12 months after such event, .
unless the damage to the building or structure is 50 percent or more of its fair market value as shown on the
assessor's records at the time of damage in which case the whole thereof shall be for a use in accordance with
the provisions of this Code." ,
