A complaint had been submitted to the City Council by Ruby Hiltner who
liyes at 1821 Turquoise Trail that George Pereell who lives at1817_Turquoise--"- )
!Trail ls construeting a driveway too close to her home, including a new garage
~facility at the rear of the Percell property. She was coneerned about the
driveway being 5 feet From her bedroom window and also concerned about drain-
age to her property. Mrs. Hiltner and Mr. & Mrs. Percell were present. It
was noted the Hiltner property is 6 inches higher than the driveway and
therefore, there should be no drainage problem. Mr. Percell appears to comply
with the set-backs, but there were concerns about whether he was operating a
business out of his home in violation of the ordinance. He stated that the 3-
car garage would house personal vehieles only and that his home has only a
business phone, no customers, no sales and no storage. He stated that two
vans leave the property after 8:00 a.m. and are in by 6:30 p.m., generally.
Only two people operate the business. Smith moved to grant a special permit
to Mr. and Mrs. Percell at the location with the understanding that it would
be considered a non-6usiness use, that there be no more than two vans, no
storage on the property and flirther, the staff checking the Hiltner property
to determine whether there is adequate drainage away from the Hiltner home.
Waehter seconded the motion. All voted in Favor. Mr. Percell also indicated
that he would be building a Pence ad3oining the Hiltner property.

represent her regarding the construction of a driveway and garage--._

As you see listed in the second paragraph of the letter you wrote
to George Percell, this matter was to be delineated in a letter from the
city attorney's office. My client wants a copy of that letter together
with the attachment referred to in your letter and the attached letter
also referred to in the letter, which my client did not receive.
Please send me a copy of the city attorney's letter, that attachment,
and the attached letter we did not recieve at your earliest convenience.
My clients concern is that she is not fully informed as to what is
happening, and I would agree with her.

I am in receipt of your letter of December 9, 1981 concerning your
client, Ruby Hiltner, and her concern regarding the construction
of a driveway and garage at 1817 Turquoise Trail in the City of
Eagan.
I have reviewed my letter of November 16, 1981 to Mr. George Percell
and have discovered that there seems to be a misunderstanding re-
garding the attachment to that letter. The "attachment" referred
to, the "attached letter", and the "letter from the City Attorney"
are all the same document, the letter from the City Attorney.
I regret that this letter was -inadvertently not enclosed with Mrs.
Hiltner's copy of my letter to Mr. Percell.
I am enclosing a copy of my original Ietter to Mr. Percell and
a copy of the one attachment, the letter from the City Attorney.

Dear Mr. Percell:
In official action that was taken by the Eagan City Council at
a regular meeting held on Wednesday, November 4, 1981, the Chief
Building Inspector, Mr. Dale Peterson, was asked to specifically
make an inspection to verify proper assurance that construction
of a driveway between your property, described as 1817 Turquoise
Trai1, and an Ms. Ruby Hiltner's property, described as 1821 Tur-
quoise Trai1, will not create any runoff problems that could damage
her dwelling unit: Mr. Peterson, with the assistance of the City's
engineering department, made an inspection on November16,1981 and
it was found that there is a 5-7 inch slope from the Ms. Hiltner
residence. . Therefore, the concrete driveway should not cause any
storm water impact on that property.
It was the ruling of the City Council that you conform to all the
restrictions as listed in a letter from the City Attorney's office
and, therefore, a special permit or application for a home occupa-
tion permit was not deemed as necessary. (See Attachment.) However,
if the number of vans should increase from two (2), storage of
additional equipment should become necessary in the garage facility
or the business affects any of the restrictions as listed in the
attached letter, it would be necessary for you to make application
and pursue consideration of a,home occupation or special use permit
which would require the action of the City Council.
If you have any questions regarding the City Attorney's letter
or the inspection by Mr. Peterson, please feel free to contact
this office at any time.

Re: Complaint by Ruby Hiltner Against George Percell
Dear Mr. Hedges:
You have passed on to our office a letter to you from Ms. Ruby Hiltner dated
Octoher 27, 1981, which objects to certain activities of her next door neighbor
George Percell. Pfs. Hiltner's address is 1821 Turquoise Trail, and PSr.
Percell's address is 1817 Turquoise Trai L
Ms. Hiltner has asked where Mr. Percell's construction of a garage storage
facility is in violation of the zoning ordinance. Ordinance 52.07 Subdivision
4C allows private garages as a permitted accessory use to all residentially
zoned property, and Section 52.07 Subdivision 5 provides that garages shall
be set back from the side lot lYne at least five feet. Therefore, if Atr.
Percell's garage is at least five feet from the side of the lot line, and if
the garage is used for private purposes, the construction of the garage will
not be in violation of the zoning ordinance.
If, however, a garage is devoted to commercial use, the business caould have
to comply with the home occupations requirements in order to be a permitted
use on residential property, under Section 52.07 Subdivision 4A. Home occupa-
tions are defined in Section 52.05 Subdivision 2CC, and there are a number
of restrictions on home occupations. These restrictions include the following:
1. The business may be engaged in only by persons residing in the dwelling,
2. The occupation must be conducted within the principle structure,
3. Evidence of tlie occupation nust not fie visible from the street,

4. No signs may be present except as permitted in residential districts,
5. No stock in trade may be stored on the premises,
6. No over the counter retail sales may be involved,
7. Entrance to the home occupation must be gained from within the structure,
8. No accessory buildings or attached garage shall be used for the home
occupation.
If any of these restrictions are not complied with, the home occupation
would not be a permitted use, and a variance would be necessary in order to
allow the use.
Ms. Hiltner has also objected to the construction of a driveway between the
two houses. The zoning ordinance does not regulate the placement of driveways,
since ' setback requirements refer only to buildings, and not to pavement.
Ms. Hiltner has also asked whether construction of the driveway might interfere
with any City utility easements. Utility easements do not prohibit construction
of driveways or other paving over utility easements, since the easements allow
the City to remove driveways or paving to the extent necessary to maintain
utility lines.
It therefore appears that the construction of the driveway and garage in <question would not be in violation of City ordinance unless the garage does `
not meet City building setback requirements, or unless the garage is to be
used for commercial purposes which are not permitted under the home occupation
definition. Compliance with tiuilding setbaclc requirements could be determined
by City staff,and compliance witli the home occupation provisions could be
determined by the Advisory Planning Commission and City Council upon review
of the evidence.
