At this time I would like to clarify questions that developed at the Eagan
City Councsil meeting on April 7t 1987 in reference to the above variance.
On January 6, 1987 a City building inspeetor was making a fireplace inspeetion
wherein he noticed the above decks were being framed in to inelude roofs. At
that time, Calnin Hedlund of Hedlund Engineering, General Contractor, was
advised that by enclosing the decks, the setbaeks were no longer in compliance
with the Eagan Code. Approximately, one week later, Mr. Hedlund contacted
Steve Hanson, Construction Analyst, as to whether these decks were in
violation of the code and if it would be possible to obtain a variance. Steve
informed him the decks were in violation and recommended he contaet the
Planning Department to review his alternatives.
On March 4, 1987 Hedlund Engineering called for a final building inspection
and certificate of occupancy, stating their need Por a place to live. This
department allowed them to move in, but would not issue a certificate of
oecupancy until the deck issue was resolved. Mr. Hedlund stated the
certificate of oecupaney was required for finaneing of the homes. This
department stated we could not issue the certificate of oceupancy until the
homes were in complianee with the City Code.
