THIS INDENTURE, made and entered into this ~ day of
, 1937, by and between B& K PROPERTIES COMPANY, a
Minnes a Partnership, as Grantor, and the CITY OF EAGAN, Dakota
County, Minnesota, as Grantee,
. WITNESSETH WHEREAS, said Grantor, in consideration of One Dollar
($1.00) and other good and valuable consideration, to it paid by
Grantee, receipt of which is hereby acknowledged, hereby qrants an
easement to said Grantee, its heirs and assigns, for permanent
drainage purposes, including the normal practi.ce of filling with
water from storm sewer runoff, and for utility line pucposes:
Part of Lot 17, Block 4, Vienna Woods, Dakota County,
Minnesota, which lies 5.00 feet West and 10.00 feet East of
the following described line:
eeginning at a point on the south line of said Lot 17, distant
5.00 feet east of the west line of said Lot 17, as measured
perpendicular to said west line; thence northerly, parallel
with said west line to the intersection with a line drawn from
a point on the west line of said Lot 17 distant 77.00 feet
north of the southwest corner thereof to a point on the east
line of said Lot 17 distant 185.00 feet north of the southeast
corner thereof and there terminating.

The Grantee shall have the right to do whatever is necessary for
the enjoyment of the rights herein granted, including the right of
clearing the easement area to allow for the use of the land as
stated hetein, and for ingress and egress to and from said tract of
land and over and across said easement only for the purpose of
constructing and maintaining, operating and repaicing said drainage
facilities and utility lines.
And the said Grantor, for itself, its heirs, executors,
administrators and assigns does hereby release the said CITY OF
EAGAN, its successors and assigns, from all claims for any and all
damages resulting to said land by reason of the location of said
drainage easement and utility lines.
By acceptance of these easements, the Grantee agrees that it
shall restore the property located outside the anticipated perimeter
of moving water to as near the existing grade as is reasonably
possible and further agrees to replace existing cultivated shrubs or
sod and to seed all other areas not covered with moving water.
IN WITNESS WHEREOE, the Grantor has hereunto set its hand the
day and year first above written.

Issue: Restitution of driveway disturbed by construction activity
Location: 2099 Vienna Lane, Eagan, MN (residence)

Date of Occurrence: August - September, 2001 (Verify with Stan)
As part of the installation of a storm sewer pipe near the front o£ the property at 2099 Vienna
Lane, damage to the driveway occurred to an azea approximately 2 to 3 squaze feet in size at the
edge of the public right-of-way. The damage was brought to the City's inspector's attention. The
on-site inspector recognized the need to correct the situation and visibly marked an azea to be
removed and replaced that included approximately 540 squaze feet of the driveway, up to a well
defined pre-existing crack across the entire width of the driveway. The replacement azea began at
the curb and extended the full width of the driveway to the crack, about 10 feet beyond the
damaged area. This reparation of a driveway disturbed by construction activiry is standazd City
procedure.
Said driveway work was completed 2 days after it was marked by the inspector. The day
following the driveway conshvction the resident contacted the City's inspector requesting that the
entire driveway be replaced. The resident offered a contribution to finance the poRion of the
driveway that had not been disturbed. The resident was told that this would not be possible since
the paving contractor had completed his work within the project area.
On April 5, 2002, City Engineer met resident at 2099 Vienna Lane to discuss concerns with the
driveway reparation and desire to have the entire driveway replaced. During this meeting, 3 main
concems were stated about the driveway by the resident;
• Separation at the construction joint
• Perpendicular crack at the east end of the construction joint
• Color differentiation between the old and new driveway.
City Engineer's inspection of the driveway, indicated the following.
• The construction joint is straight, neat, level and tightly abuts the remainder of the pre-
existing driveway. There is no apparent separation.
• There is a small crack, about 10" long, at the east edge of the new driveway section,
perpendicular to the construction joint. The cracked area is on the opposite side of the area
where the storm sewer construction activities occurred. It is unlikely that the damage
occurred during conshvction, or that the driveway was damaged by the construction activity
related to the storm sewer work. The driveway may have been damaged by a vehicle parking
on the edge of the driveway, with a tire partially on the less compacted turf azea.
• The color differentiation beriveen the old and new driveway surfaces is to be expected.
Within 3 years, the color differentiation will be very slight, if noticeable.
At the close of ineeting, City Engineer suggested that resident pursue any previous arrangements
regarding the driveway replacement made with the contractor and that the City of Eagan would
not be responsible for additional driveway improvements. In discussing this matter with the
contractor and the City's consultant engineer who provided the inspection services it appears that
no arrangements were previously made. Resident has been reminded on several occasions that no
further driveway work is expected to he completed at residence as a pad of this contract. It is
regrettable that damage to driveway inadvertently occurred as part of the construction of the
drainage improvements. However, the restitution appears to be more than adequate.
