Jerald and Simone:
Enclosed is a copy of the new ordinance amendment adopted by
the City of Eagan at its regular City Council meeting dated
November 15, 1988. The new ordinance requires that: "All
outdoor swimming pools within the City of Eagan must be
completely enclosed by a security fence or wall at least four
feet, but less than 6 feet high, and located at least four feet
from the edge of the pool."
It was brought to our attention that you currently do not have
a fence around your pool. Please be advised that this is a
violation of City Ordinance #70, 2nd Series. All existing
switnminq pools are required to comply with this ordinance by
May 15, 1989.
Your attention to this matter is greatly appreciated.

your outdoor pool. We are requesting your compliance with the
following City Ordinance:
Chapter 4, Section 4.70 of the Eagan City Code was
amended and adopted, effective November 24, 1988. This
amendment requires that all existing outdoor swimming
pools, and those constructed hereafter, shall be
completely enclosed by a security fence, or wall, at
least 41, but not more than 6' in height, and at least
4' from the edge of the pool.
This Ordinance does not apply to aboveground outdoor swimming pools
having at least 4' vertical or outward inclined side walls,
provided the pool has a self-closing and self-latching lockable
gate, or sole access is by means of a removable ladder, ramp, or
stairs which must be removed when the pool is not in use.
Please reply within seven days of receipt of this letter,
indicating a schedule of compliance. A reinspection of your
property will be made within six weeks from the date of this
letter. Should Code violations exist, this matter will be referred
to the City's Police Department.
