On June 8th, you forwarded to my attention a letter you received
from the above-referenced property owners expressing concerns
associated with erosion and runoff from the Wilderness Ponds
development.
Craig Knudsen, who has been extensively involved with problems
associated with the Wilderness Ponds development runoff and
erosion, prepared the attached history as it pertains to this
specific issue.
Upon reviewinq the memo, I visited the site on June lOth and had an
opportunity to personally review the area of concern with Mrs.
Nelson. She identified all the areas where they have had ongoing
problems over the years with not only the development's runoff but
also the impact from adjacent new home construction. She had
informed me that since the most recent corrective work was
completed last fall, they have not experienced any problems.
However, they were concerned about potential problems that may be
associated with future heavy rainfall events.
A review of the site revealed that the retaining wall and wood
fence screen were in a satisfactory, functional and aesthetically
accepting condition. However, the erosion control fence installed
as either a part of the original development vr with the recent
construction of the fenced retaining wall was in disrepair after
successfully retaining siqnificant volumes of silt and sediment
runoff before entering the above-referenced adjacent property. On
the upstream side of the fenced wall, the aggregate base access for
the future driveway extension appeared to have been properly graded
to intercept and divert runoff from the Wilderness Ponds
development further minimizing any potential impact on the adjacent
properties. A notation has been filed in the parcel file that any
future driveway construction on Lot 5 must maintain this cross
slope to intercept and handle surface water Yunoff from the
Wilderness Ponds development and direct it to the internal ponding
area.
It was also explained to Mrs. Nelson the situation where the
developer has already been declared in fault and his financial
security liquidated and allocated to the storm sewer improvements
on the west end of this development as necessary to prevent
structural flooding of other property. There is no longer any
money or contractual ability to require further efforts by the
developer beyond what has already been accomplished.

In response to your request, the following are presented for your
consideration:
Option #1:
Recognize the significant efforts that have been made to date
in working with an uncooperative developer, and the inability
to do anything further without City financing.
Option #2:
With the landscaping restoration associated with the above-
referenced storm sewer improvement, direct the landscapers to
dismantle the wood barrier fence as necessary to gain access
to, and remove, existing erosion control fence and related
trapped sediment. In addition, remove the aggregate base
access to the future driveway for Lot 5, Block 2, and regrade
(with appropriate vegetation restoration) a more definitive
diversional earthen berm. No cost estimate is available at
this time. However, with the bid opening schedule for June
26th for the corrective storm sewer work, a specific bid
proposal could be provided if requested by special addendum to
be distributed no later than June 19th. With the limited
financial liquidation being less than the anticipated cost of
the storm sewer project, all costs would have to be financed
by the City Storm Water Utility Fund.

Dear Tom,
We built our homes at 4444 and 4445 Uildmark Court in 1973 and 1974
respectively. Tfie land in back of our fiomes was undeveloped, and even
thouvh it had a hiaher elevation, we never exnerienced any water runoff or
erosion pro6lems aTons our common property line. Copies of our lot surveys
do not indicate a drainage easement in this area.
In 1987, the lot behind our two houses was built on and we immediately
began to experience watercourse flow through and soil erosion onto our
properties during normal rainfall. This 9s a direct result of the Plotting
of two flag lots directly adjacent to our lots. The developed lot has a
long blacktop driveway that drains runoff down to the low point and into
both our lots along the common property line. The unbuilt lot fias the same
proposed drainage which will eventually compound the current problem.
Mr. Craig Knutson, who is on the city staff, has been very helpful in
assisting us in getting action from the developer to remove soil washed
into our yards, planting 9rass, and building a retaining wall, but this has
not solved the basic problem and water and soil continue to flow over and
under the retaining wall every time it rains.
This continuing problem requires a permanent solution which the developer
has refused to implement: a catch basin which would collect water and
divert it to a natural pond behind the present house.
We request that you, in your capacity as City Administrator, assist us in
bringing this problem to a final and permanent solution.
We will be willing to meet you at your convenience in your office or at our
homes.

With the associated construction of Wilderness Ponds, there were
several problems affecting the above-mentioned residents on
Vildmark Court. Efforts by the residents to have the developer
respond to concerns were ignored and the City was requested to
help. Listed below were the problems.
• Erosion and runoff was directed into their property.
• Erosion was causing damage to their property.
• The proposed retaining wall and visual screening was not being
provided.
After several phone calls and letters from the City, the developer
did install a retaining wall and fence as visual screening.
However, the developer failed to provide adequate erosion control,
erosion cleanup and stormwater diversion. Due to the lack of
cooperation, the City hired a contractor at the developer's expense
for the following:
6/90 Installed silt fence and removed eroded sand from lots on
Vildmark Court.
10/90 Regrade a gravel driveway to a flag lot in Wilderness
Ponds to divert drainage.
Removed eroded soils from residents on Vildmark Court.
Provided topsoil, seed and erosion mat.
8/91 Thinned overgrowth to allow sunlight and promote growth
to stabilize the bank.
Planted 4 high rooting shrubs to hold soils in place.
Cleaned and restored bank to evenly dispense water flow.
Cleaned all additional eroded material, added peat moss
for water retention and reseeded disturbed areas.

Although the drainage area was reduced due to the development of
Wilderness Ponds, the denuded slopes during development did cause
an ongoing problem. When the last flaq lot develogs and a hard
surface driveway is installed, additional protection would be
provided. As of today, this area is stabilized as well as can be
expected due to a natural area along the common property lines of
Wilderness Ponds and 4444 & 4445 Vildmark Trail. Since this
natural area does not have a tight root system to hold soils in
place, it will be subject to a minimal amount of erosion. However,
this potential erosion should be no greater than pre-development
stages.

municipal corporation, organized under the laws of the State of Minnesota, (hereinaSter referred

WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
A pemianent drainage and utility easement over west 40' of Outlot G, Wilderness
Ponds.
The grant of the foregoing permanent easement for drainage and utility purposes inclades
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
