Following is a recap of events that have taken place since the City's August 14 letter requesting your attention ro
construction concerns of homeowners in the Villas of Violet Lane town homes recently constructed by D L J
Associaces:
Aueust 15-Aueust 30. 1996 - Inspections were made at least nvice a week to insure that concems of these homeowners
were being properly addressed by you. In this time period, the irrigation system was almost completely installed and
landscaping was in progress. The final lifr of blacktopping is to be installed by mid-to-late September.

Dear Sirs,
On 7/17/96 Mrs. Donna Berg, Mrs. Cheryl Otte and Mrs.
Carol Rosengren, residents of the townhomes Villas of Violet Lane,
met with Mr. Joseph Voels and Mr. Douglas Reed of the City of
Eagan, to discuss problems that are occurring at'the previously
mentioned townhome complex. The following issues were discussed:
1. Landscaping: In accordance with a copy of the
landscaping plan submitted to the city of Eagan
by DLJ Associates, the developer and builder
of the townhome complex the following comments
are submitted:
a. Lots 1, 2, 3, 4, Block 1, are extremely rough
in finished grade. The lawn maintenance con-
tractors at the townhomes have complained
about the uneven and rough grading. Due to the
poor conditions they are scalping the lawn and
where sod has not been laid, there is rock.
b. Irrigation is not being provided for complete
1ots. Residents were told at the time of
purchase that all lots would be completely
irrigated from front to back. The builder
now does not wish to irrigate tha entire
completed lots, just portions
c. Our irrigation system is still not on a main
water valve with timer. We are at the dis-
cretion of the builder as to when our lawns
are watered.
d. The finished grade between lots 2 S 3, block
1, is so rough it is unsafe for walking on.
e. There is a significant difference in land-
scaping designs between the lst and 2nd
additions of the townhomes. The lst additio?
has decorative rock approximately 1 inch deep
in front of the townhomes and approximately

2 inches deep on the sides. The rear
landscaping is comprised of bark and wooa
shavings insi:ead of rock'. 7'hea Zr•(-! acdition
haa rock, approximately 5 inches deep in the
front and sides. The back landscaping is also
done in rock. This difference was brought
up to the builder and he claimed "builder's
discretion. Owners without rock in ttie rear
an3 who needed more in the front were told
by the builder that they could purchase
additional rock for $50.00 and would have to
lay it t'hemselves. The landscapin7 plan
filed with the city of Eagan specifies that ?
inches of rock iaill be used entir2ly for the
landscaping design.
f. The buiider is burying large slabs of broken
up cement pieces Prom patios he has had to
replac=. The pieces ara being buried in the
unsold lots of th'e=d2yelopment.
g. E12ctrical/valve receptaclas on various lots
are being left open while the builder watera
the grass. This is an unsafe practice which
could cause serious injury for might st2p in
these unattendad boxes.
h. The boulevard area and front portions of lots
1, 2, 3, 4, 5, & 6, Block 1, are a mixture
of weed, clover and some grass. This entire
area shouid be grass.
i. The drainage for the private drive of lots 1, 2,
3, 4, 5, & 6, biock 1, lst addition, is im-
proper and after h=a3y rains causes standing
pools oi water sav2ral inches aaep to remain.
2. The private drive for lots 1, 2, 3, 4, 5,& 6, Block
1, lst addition has not be2n comnleted. The final
layar of blacktop must be laid. The buildar '.Te2ps
saying na is waiting for the final unit to be sold
before he complat25 the blacktop. This includes
2ach driveway as w211.
3. Lots 1 thru 4, Block 1, lst addition have low2r
level dfvider/privacy walls in the rear of the
buildings cover2d in stucco. Th2 2nd addition
dgvid2r walls are covered in vinyl siding. The
lst addition should be brought into compliance with
the 2nd addition's standards.

4. Cem2nt patios on various townhomes are
crac'ced as a result of incorrect construction.
The builder, how2ver, has r2Pused to correct
many of thes2 deficiencies. In many cases the
cement was poured directly on hard clay surfaces
with little or no preparation, such as sand or
mesh or rebar. There are also sidewalks and garage
flooring which have craclced. In the case of some
of the sidewalks, no expansions seams were insert2d
wher2 the sidewallcs meet the front steas. These
were cern2nted together and as a result when the
ground haaved in the spring the sidewallcs crack2d.
5. Th2re are townhorn2s in this complex which have
doorbells shorting out, incorrect or imoroper
electrical wiring, and heating and airconditioning
malfunctions which aren't being addressed by the
builder. In our unit (lot 1, block 1, lst addition)
the airconditioner has tripp2d the circuit breaker
3 tim2s and the buildzr said it was because of the
air filter (whic:h was only a month old). The door-
bell has burned out twice. In lot 3, block 1, lst
addition the doorbell has shorted out 3 times a:ad
there scorch marks on the wall under the doorbell
cov2r.
6. On July 18, 1995, Hr. Rich Bradley, contract
electrical inspector for the city of Eagan came
to insppct our e12ctrical complaints. He discovar2d
the doorbell transform2r was burned out and wired at
the furnace against a 1993 code. In addition he
d2t2rminad that the coinpr2ssor on the airconditioning
unit was yitting 70 amps on initial startuo. The
builder kept sayin3 this was a filter hrobler... A
report and letter to DLJ Associates stating what
corrections must be tak2n will be issuad.
7. In our lower level bathroom no heating or aircon-
ditioniny duct work has been installed. 4dhen this
was brought to the att2ntion of the builder he said
it *aould have to be installad at our rxpease. We have
exp2ri2nced signifcant sheet-rock damay2 o°caus2 of
the lack of warm air to help in dryin7 out the bath-
room aPter a shower. Each of our 5 other new homes
hav2 all had duct iaork into the hathrooms, upner and
low2r. Th~tre-:is no duct work in the upper 12ve1
guest bathroom as well. In zhe winter our daughter
in-laia has told us it is too cold to shower down-
stairs. We had tha lowzr lavel finished off to
include a usable b:;throom, borTever, because of
the lack of heat in the bathroom this arza is
not completely usuablz in the winter. Why was
heat included ia the rest of the lower 1ev21 and

not the bathroom.
7. The water spiggot in the garag2 is 2quipped
witM a device which is supposed to eliminate
water pr2ssure, howaver, the only thing that
happens is that a larg2 backaash comes throuyh
the d2vic2 when shut off causing water to leak
into tha basement. It is nzcessary to place
receptacles under the spiggot to catch the water
b2fore it flows onto the floor an3 into the base-
mant. The builder's solutian to this groblem
is to have someone nold the hose nozzle open
outside while someon2 els° shuts off the
spiggot. This is, oP course, a team effort.
8. The linen closet in our master bath has toro
or three areas which have no shelving.. The
shelves can b2 installed at owner's exp?nse.
We never had a new home where it was necessary
to order shelv2s for the linen closet.
9. Our 4 seasons porch doas not have a roof vent
nor does the adjacent townhome, however, all the
other townhomes in the complex hav2 either one
or two. The build2r claims that the v2nts are
really not necessary, but his own personal
townhome has one.
10. There are 3 different size townhomes in the
development. When we purchasad our townhome
v2 were informed that all units would be the
same size with very little alterations. There
is th2 original sized tocrnhome, 2 townhomes which
are lar5er (one of which is own2d by the builder)
and 4 townhomes that ar2 smaller than the original
townhomas (there are 14 townhomes altogether.
11. The toilet stool in the lower level of the
townhom2 bathroom doesn't appear to flush
properly. There is a lond bubbling noise and
a bubble apnears whan it is flushed. This has
never occurred in any other home we've had and
seems unusual. It may be caused by improper or
inadequate venting. The cziling fan in tha 4
seasons porch has an annoying hum which was
brought to the builders attention right aftzr
we moved in with no correction as of yet.
Ther2 are townhomes here with different type front doors, different
patterned front walks and patios and one unit with teal colored
patio doors. All front doors were to b2 green, wit5 a 1/2 moon

window. Patio doors were to be uniformly white. The builder
was informed that thes2 did not comoiy witlZ the originai
standards and, again, h2 used that tired old statem2nt "5uildars
discration". When we bouybt, ore aer=_ told no changes to
exterior. We knew that, but wan*2d to aake sure it caas followzd
thru, but is has changeja~. This is, now, so;nething we as
homaowaers have to accept because now build2r has set a
precident - anythirig goes. He is Presidant of the Association,
at his own appointm2nt, and even as a member o,` th2 Board, I
realll have no say, except wh2n he did not want to irrigate
a11 af the progerty..
There ar2 just so many things. *Saybe the City should come
back and reinspzct all of the townhomes for 2lectrical,plumbing
and a general huildincl inspection. There is a reason homeowners
have air-conditioning/heating, plumbing and structural problems.
Tlie builder (DLJ Associates) has a nons2nse answer for °very
oroblcm that arises, but I think the time has come for so,n--
raal answers. I(Caro1 Rosangren) personally saw Davi3 and
Miriam, Jchnson insult4:the unit next to ours - not a professional
but a man who knows how to farm and grow beets.
Evaryone who curchas2d homas on our block was told when they
purchased their homes, that th,ere was common ground for gen2ral
use behind the townho:nes. We found this not to be tru2 as
othzr hom2owners of lots 9 through 14, of lst and 2nd adaition
moved in. How could 311 these homeown2rs in lots 1 ghrougn 4
be incorrect? It just does not se2m logical.
On Jun2 13, 1996, aMr. Darrel Fahr came to our home with the
builder to make a list of all our conc2rns. Ha told us all
repair would b2 madz and he even had the build¢r; sign hio
reQort. Darrell then tri2d to set up appointinents witn the
various subccntractors to no avail. At the 2nd of the ineetin3
DarrEll asked us to sign that we ^ad a Sdarranty Manual. wVe
n^v2r r°_c°iv2d one, tha_r°for~., ca2 could no` sign that w2 rec2ived'
one. we still 3o not have a Svarranty rnariual or a list oi who
worknd in our hone in case cae had an 2metg2ncy and n°2ded to
reach them for caarranty wor'c.
On 7/17/96, Carol Roszngren and Donna Berg met with Craig
Knudsen, from the city, to diacuss our concerns on the
aforem°ntioned landscaping concerns and.also picked up'a
copy of the landscapa alan for our toianhom2s. I ha.va a
meeting schaduled with Mike Ridley oz 7/24/96 at the
townhom2s. He was also going to request Mr. Johnson be ther2.
