First and foremost, please know that we both take your concerns very seriously and appreciate how proactive you have been in representing your concerns with the City. As Mayor Maguire stated in our phone conversation, the removal of scrub trees is part of the project that was approved by the City Council, without the planting of additional trees. While Mayor Maguire understands your concerns, as one of five members of the City Council, he is supportive of the direction that the Council as a whole provided. That said, if you, your neighbors, and/or your association have an interest in planting additional vegetation or trees within the public right of way, at your cost, I encourage you to return the enclosed right of way permit to City Engineer Russ Matthys, who can assist you with the permitting process. As we discussed, it is very important that you work in coordination with the City should you desire additional trees in the area. Please know that the Council has been aware of your ongoing concerns regarding a green space buffer to the project, and took your concerns very seriously as they considered the project. If you have any further questions or concerns, I encourage you to continue working with City Engineer Matthys, who can be reached at (651) 675-5646. Associates and asked that he let me know when he would fix these footings, however, he did not contact me. On Tuesday, April 8, I received a call from your son informing me that he had stopped by your townhome and Mr. Johnson appeazed to be working on or azound the support footing for your porch. I made an inspection the next day and found Mr. Johnson digging around the center support footing. He was approximately 4' down and not yet to the bottom of the footing. He stated that he had dug up the outside footing and backfilled with rock after putting metal around it as the engineer had suggested. As I was not present to inspect the work when it was done, I asked that he uncover the footing so I could use a probe rod to inspect. I stopped by the following day to do so and everything appeazed to be as Mr. Johnson stated. Enclosed for your information is a copy of the engineer's report as well as photos of the work that was done. Mr. Johnson is responsible to conect the problem you are experiencing. Reid: 1. Sound problem through the common wall between 1480 and 1482 Violet Lane. llLJ Associates had Wm. H. O. Kroll & Associates, Inc., engineers consulting in acoustics, come into our two units on May 23, 1996 and take sound tests. They discovered their was a sound problem and advised DLJ Associates in repainog the problem. DLJ Associates did some construction to the wa0 on the 1482 Violet Lane side, but I was never allowed to view what was actually being done. We still have the souad problem. DLJ Associates had the same firm back for more sound tests on Iuly 9, 1996. We have not yet been informed of the results of that test. We still have the sound problem. 2. Register f'or heat and air conditioning not in downstairs bathrooms. 3. Wall outside between 1480 and 1482 Violet Lave upper decks not the same width as the other units. Tlris wall is higher and cuts into the facial and the rain gutter is not continuous between the two units which is different than all the other tovmhome units in this development. The workmanship of the wall unit is not acceptable. We want the entire wall torn down and rebuilt to the same specifications as the same wall partition in all the other townhome units of this development. We want the facial and the rain gutters done correctly. 4. The siding on all three exterior walls around the upstairs deck are not done correctly. It is not all the way to the bottom of the walls and must be removed and done over. 5. There is a wood strip uound the end of the exterior of the 4-Season Porch that has to be removed and replaced with a metal trim. There is siding and facial that is bent that needs repiacement. 6. 7'he common exterior wall on the fower floor between units 1480 and 1482 and between units 1476 and ] 478 have a cement finish instead o£the vinyl siding that all the otlier units have. We want vinyl siding installed as all the townhomes should have the same exterior look. 7. The cement patio is cracking in several areas. There were no expansion joints used in the cement on our patio. We want this cement removed and redone correctly. There is no expansion joint between the cement patio and the house. DLJ Associates had the cement contractor use some type of saw to cut out a part of the cement along the wafl. This was done without our permission after we had closed on the property. 8. Our cement floor of the garage and our cement sidewalk is getting full of holes where the cement is popping out. The first 6 to 10 inches of the cement gazage floor by the garage door is coming apart terrible. I feel that the cement mi3cture was not to code and should all be replaced. 9. The kitchen wood floor has chips and scratches in it. 1 10. [ have an amperage problem with the light, fan, and heater unit in the ceiling in the master bathroom. Tlie light dims when t6e heater unit is on and the heater unit smells hot. 11. The irrigatioa water sprinkling system is inadequate. The water does not have enough pressure to do the job correctly. The sprinkling heads are not all placed at the proper location to water the lawn and shrubs as needed. There are no automatic controts. All the sprinkling heads have to be tumed on and oft' manually. 12. I am concerned about the outside spnnkler controls. There are several holes in the ground with exposed electrical wiring. 'Phe on and off valves are in these ground units and most of the time the covers ro these units aze not replaced when the water is turned on or off. I am also concerned that these covers have no rype of locks to prevent anyone, especially children, from stepping in these holes and getting hurt. 13. There are some cracks in the wall and ceiling area above the dining room window and in the ceiling in the.4-Season Porch that I am concerned about. The wvers to the electricat receptacles and the telephone jack connection boxes do not St Ilush to the wall. 15. Top portion of Blacktop for the driveways for the units 1476, 1478, 1480 and 1482 has not been done. The road running North and South to the East of these units does not have the final blacktop done. 16. The lawn in front of my unit at 1480 Violet Lane was seeded with clover. All the other units have been sodded. 1 want the clover seeded area redone with sod. 17. The entire landscaping is a mess. The lawn is so uneven that the service that mows the grounds complains that they cannot mow it correcdy. It is so uneven that they scalp many areas of the grass when they mow it. I dodt think the ground was prepared correcdy or covered wi[h black dirt beFore it was sodded or seeded, The area between our townhome, 1480 Violet Lane, and the townhome next to us, 1478 Violet Lane, is so rough that you cannot even walk on the center portion of it without fear of fatling down or twisting your ankle. We are afraid of getting sued if someone wouid fall and get hurt. 18. We have bark mulch around the shrubs by our back patio. The landscape plans call for 3 inches of rock. I dodt think we even have 3 inches of rock where there is rock now on the sides and front of our townhome. 19. There are maiiy things I requested in writing on June iQ 1996 to DLJ Associates to fix in our townhome at 1480 Violet Lane. There were 45 items on this list which was later expanded to 56 items. Many of these items have not been done. Besides those mentioned carlier in this letter, tfiere are several items yet to be done by a painter. A painter came on Friday, July 19'" at about 12:00 PM and left approximately at 3:30 PM without even telling Donna that he was leaving. He had not frnished all the items he was supposed to do. He did not even clean up his mess. We had to clean it up. A plumber has not been here yet to put splash guards in both upstairs bathroom vanities, to caulk the bathtubs and showers, to fix the hackwash in the garage water connection, and to caulk around kitchen sink. There are finishing nail holes that have to be filled. We have been given two different screens for our main floor patio door, both had holes in them. We are still waiting for a good one. We have never received the sliding screen unit for our downstairs patio door. The open area above the linen closet in the master bathroom has never been finished. 20. The entire situation is very frustrating to both of us. Donna has been doctoring for Fibromyalgia. Stress is something that really flares this up in her system. The stress from dealing with all the problems of living in this townhome is really getting bad. We hoth cannot sleep Uecause of the sound problems with the wall between us and unit 1482. Dave Johnson just doesn't seem to care. We just cannot understand why he doesn't get these things taken care of. Pm not even sure if he can fix the sound 2 problem if it is a serious construction problem. He has admitted the wall was not done correctly when constructed. What he has done so far has reduced the sound level but there is still a sound problem. We had Bill BruesUe, Eagan City Inspector, at our townhome on July 17, 1996 and we had Richard C. Bradley, Eagan Electrical Inspector herc on July 18, 1996. 1 sent a written list of items for Bill BruesUe with Richard Bradley on July 18, 1996 to give to 6i11. i have not received a response report from Bitl Bruestle yet, but 1 was hand delivered a report from Richard Bradley on July 19, 1996.
