The application by David and Patricia Odell for preliminary plat approval
of Odell Addition in MeCarthy Ridge Addition uas then presented. Mr. Daniel
Heeson, attorney for the Odells, was present who explained the proposal. He
Sndicated that in his opinion the plat met ali of the subdivision standards
for an R-1 piat. He also i.ndicated that the restrictive covenants xere not an
issue due to the 30 year limitation under state law. The Advisory Planning
,Commission has recommended denial on Augvst 24, 1982. it was also noted that
• the issue had been Sefore the Council on Juae 15, 1982 as a waiver of plat
requast which was denied for the lack of hardship. Mr. Terry Votel spoke on
behalf qP homeoHners in MeCarthy Ridge Addition, a significant number of whom
uere also present at the hearing. Mr. Votel indicated that the Petitioner was
in error in regard to which area oP the,new lot as a result of the splitting
of the original Iot, would actually be the frontage. He also described
MeCarthy Ridge Addition as a fully matured, orderly and stable subdivision for
which a replat of this type would present a precedent which could destroy the
continuity and aesthetics of the community. He also indicaLed that it could
be argued that the restrietive covenants regarding lot size may still have
some relevanee. There was a. s3gnificant amount of discussion by the Council
regarding the affect of the covenants, location of the existing garage on the .
proposed nesr lot, and the Pact that this was not the First replat oP a large
lot within a subdivision in the City. It was indicated that in the futare
homeowaers such as those fn MeCarthy Ridge Additior; could consider estate
zoning in order to preserve the continuity of a neighborhood consiating oP
large lots. Council then requested legal research by the City Attorney re-
garding the covenants, estate zoning, and the signiFicance of the location oP
the garage on the proposed neK lot. Upon motion duly made and seconded, it
cras moved that the matter be continued until the October 5, 1982 meet,ing at
which t±me the City Attorney will provide information regarding the matters
discussed. All voted yes.
qARIAI'1C8 - SIENNA COAPORATION - iIEDGEW0pD ADDITION
The application of Sienna Corporation for a variance for the Pront set-
back of Lots 19 through 26, Block 1, Wedgeuood Addition cras then brought
before the Council. Mr. Rod Hardy appeared on behalP of Sienna Corporation
and explained that the Petitioner was requesting the variance Por the
Pollowing reasons: To preserve as many trees-as possible in the rear yards of
the lots, to provide proper slopes Por the houses and maximize rear yard
space, and to mini:nize the cost tc buyers. He also indicated that due to the
configuration of the plat, the variance would not affect adjacent propertizs.
Smith moved, Waehter seconded the motion to approve a v3riance of up to 10
feet from the front yard setback, subSect to compliance.uith applicable ordi-
nances. All voted in favor.

and the City of Eagan, a Minnesota municipal corporation, hereinafter
referred to as "the City".

A temporary construction easement over, under and
across that part of Lot 20, Block 1, WEDGWOOD
FIRST ADDITION, according to the recorded plat.

20.00 feet and 30.00 feet westerly of the line
described in Document No. 593655 as:
Commencing at the Northeast corner of Lot 19,
Block 1, said WEDGWOOD FIRST ADDITION; thence
westerly a distance of 33.27 feet along the
northerly line of said Lot 19, said northerly line
is a curve concave to the south having a radius of
681.10 feet, a central angle of 2 degrees 47
minutes 55 seconds and the chord of said curve is
assumed to bear South 81 degrees 58 minutes 31
seconds West to the point of beginning of the line
to be described; thence South 13 degrees 11
minutes 35 seeonds East, not tangent to said
curve, to the intersection with the westerly line
of the drainage and utility easement as delineated
on said WEDGWOOD FIRST ADDITION and said line
there terminating.
The sidelines of said temporary easement are
prolonged or shortened to terminate on the
northerly line of said Lot 20 and the westerly
line of the drainage and utility easement
delineated on WEDGWOOD FIRST ADDITION.
Said temporary easement contains 280 square feet

The grant of the foregoing temporary construction easement for
site grading purposes includes the right of the City, its
contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct and inspect site grading
and the further right to remove trees, brush, undergrowth and other
obstructions. After completion of such construction, maintenance,
repair or removal, the City shall restore the premises to the
ccnditicn in which it was .found pr.ior te .re conrenrement of such
actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions, subject only to permanent
easement alterations.
The Landowners, their heirs and assiqns, do.covenant with the
City, its successors and assigns, that they are the owners of the
premises aforesaid and have good right to grant and convey the
easements herein to the City.
