Enclosed you will find a copy of the tests performed by Brown Engr.
and Testing on the mortar used in your fireplace and the brick veneer
across the front of your home.
Table 24-20-A of the Uniform Building Code Standards requires a min-
imum compressive strength of 750 lbs. per square inch after curing
for 28 days. As you can see, the minimum results of the tests from
mortar samples taken from your home are 900 lbs. per square inch
with an averaqe of 1,070 lbs. per square inch. These results meet
the minimum required by the Building Code and it is an established
practice in the industry. Hopefully this will alleviate your con-
cerns that were created by the mason that was installing your fire-
place insert.

PRELIIMffNARY PLAT - ODELL ADDISION "
The application by David and Patricia Odell for preliminary plat app^oval
of Odell Addition in MeCarthy Ridge Addition was then presented. Mr. Daniel Beeson, attorney For the Odells, was present who explained the proposal. He
indicated that in hfs opinion the plat met all of the evbdivision standards
for an R-1 plat. He also indicated that the restrictive covenants xere not an
issue due to the 30 year limitation under state law. The Advisory Planning
-Commission has recommended denial on August 24, 1982. It was also noted that
the issue had been Sefore the Council on June 15, 1982 as a waiver oP plat
request which sras denied Por the lack of hardshfp. Mr. Terry Votel spoke on
behalf of homeowners in McCarthy Ridge Addition, a s3gnificant number of whom
were also present at the hearing. Mr. VoLel indicated that the Petitioner was
in error ia regard to which area oP the.new lot as a result of the splitting
of the original Zot, would actually be the frontage. He also described
MeCarthy Ridge Addition as a fully matured, orderly and s.table subdivision for
which a replat of this type would present a precedent which could destroy the
contfnuity and aestheties oP the community. He also indicated that it could
be arguad that the restrictive covenants regarding lot size may still have
some relevance. There was a signiPicant amount of discussioti by the Council
-l regarding the aPfect of the covenants, location of the existing garage on the
i proposed new lot, and the fact that this was not the Pirst replat of a large
lot within a subdivision in the City. It was indicated that in the Future
homeoxners such as those in McCarthy Ridge Addition could consi.der estate
zoning in order to preserve the continuity of a neighborhood consiating of
large lots. Couneil then requested legal researeh bp the City Attorney re-
garding the covenants, estate zoning, and the significance of the loeation of
the garage on the proposed new Zot. Upon motion duly made and seconded, it
was moved that the matter be continued until the October 5, 1982 meeting at
which time the City Attorney wiil provide information regarding the matters
discussed. All voted yes.
oARIAHCE - SIENNA CORPORAYIOM - pEDGERppD gpDITION
The application of Sienna Corporation for a variance for the froot set-
back of Lots 19 through 26, Block 1, Wedgewood Addition ctas then brought
before the Council. Mr. Rod Hardy appeared on behalF of Sienna Corporation
and explained that the Petitioner was requesting ~the variance for the
Pollocring reasons: To preserve as many trees as possible in the rear yards oP
the lots, to provide proper slopes Por the houses and maximize rear yard
space, and to mini:nize the cost to buyers. He also indicated that due to the
configuration of the plat, the variance would not affect adjacent propertles.
Smith moved, Wachter seconded the motion to approve a variance of up to 10
feet from the front yard setback, subject to compliance uith applicable ordi-
nances. All voted in Pavor.

of-way in violation of the City Ordinance referenced below.

SEC. 10.32. OBSTRUCTIONS ON PUBLIC PROPERTY
Subd. 1. Obstructions. It is unlawful for any person to place,
deposit, display or offer for sale, any fence, goods or other
obstructions upon, over, across or under any public property
without first having obtained a written permit from the Council,
and then only in compliance in all respects with the terms
and conditions of such permit, and taking precautionarv
measures for the protection of the public. An electrical co_3
or device of any kind is hereby included, but not by way of
limitation, within the definition of an obstruction.
Subd. 6. Continuing Voilation. Each day that any person con-
tinues in violation of this section shall be a separate offense
and punishable as such.
SEC. 11.1. GENERAL PROVISIONS
Subd. 9. Structures in Public Right-of-Way. No buildings,
structures or uses may be located in or on any public lands
or Right-of-Way without approval by the Council. ,
The public right-of-way or boulevard is that area from the curb
to your property line (approximately 13 feet) and is intended solely
for utilities and snow storage. The structure must be removed from
this boulevard area to provide for required storage and also to
protect our snow removal equipment from damage. We apologize for

to the appropriate enforcement division.
THEREFORE, YOU ARE HEREBY NOTIFIED TO HAVE TAE VIOLATION CORRECTED
AND THE OBSTRUCTION REMOVED WITHIN 60 DAYS OF THE DATE OF THIS LETTfiR.
After that time, you will be subject to the fines as stipulated
