However, you did indicate that the city inspectors would have the authority to approve or disaprove the grading as to its compliance with the original plan. I believe you indicated that the original plan provided that the yard would be graded in such a manner so that the drainage would occur on the neighboring 1ot and the water runoff would drain towards the street. As presently graded, this is not occurring. Thus, I am hopeful that you will relay this information to the inspectors if they are not already aware of the problem. It is my further understanding that Mr. Raway has had discussions with you regarding this potential problem. It is understood that there is a five (5) foot easement along the side lot line for utility and drainage purposes. However, Mr. Raway is greatly concerned that the run-off will not remain confined in the easement area but rather will continue to run and accumulate near his house. The purPose of this letter is to notify you that Mr. Raway fully intends to hold the city, the contractor and the owner of the neighboring property fully liable for any damages incurred by this run-off problem as well as the costs incurred to properly landscape this area to avoid such a problem.
