Approximately 9 months ago, you and I met to discuss the situation pertaining to
outstanding assessment obligations regarding your property and the need to execute an
assessment agreement allowing portions of your assessment from the above-referenced
project to be postponed to a later date. Enclosed is a copy of a letter dated March 25,
1992, wherein all the background information was fonvarded to your attention.
On April 16, you and I met to discuss the information and to make the necessary
corrections associated with the 1992 obiigations if they were to be.paid.,
Not having heard from you since that time, I was wondering if there are any other
questions or concerns that you might have that would preclude you from signing the
enclosed assessment agreement and returning it to our attention as soon as possible.
Please let me know if I can assist you in bringing closure to this outstanding issue.

Dear Marge:
Recently, you had inquired as to the potential future financial
obligation against your property if it were to be subdivided and
developed in the future. When researching this parcel, it was
discovered that the assessments associated with Project 467
(Wescott Road - Streets & Utilities) were levied based on assessing
only 100' of your frontage and 1 acre of your land subject to you
executing the appropriate agreement whereby the remaining frontage
and area would be postponed until such time that the property
developed. Enclosed please find a letter explaining this situation
that was mailed to your attention on March 8, 1988. As you will
note in the second to the last paragraph, this reduced assessment
levy was based on the premise that you would execute a special
agreement which was to be forthcoming within the next 30-60 days.
Unfortunately, this agreement got waylaid and never did get
forwarded to your attention. Therefore, I am enclosing a copy of
this agreement for your execution as previously agreed to. Also,
you will find a copy of Special Assessment 86-3 which e~tplains the
need for this agreement. ,
Based on this previous reduced assessment levy, we have calculated
the remaining assessable obligations for your parcel. While
explaining some of this information to you recently, you had
inquired as to what the obligations are for the adjacent parcel to
the east owned by Mr. Irven Dahl. Enclosed you will find a chart
identifying the improvements that were partially assessed to both
you and the adjacent property as well as the remaining obligations.

You will note that Mr. Dahl, through a subsequent agreement,
requested to be locked in at the 1990 rates and have the City levy
the additional assessment obligations at that time. This chart
also shows the remaining assessment obligations against your parcel
($21,798.33) if you would choose to have them levied during 1992.
You will note that while the street assessment rate dropped from
the 1987 rate (due to favorable bidding climates), it does appear
to be continually increasing.
As you are aware,'there is a wetland/pond that is located in the
middle of your parcel. The City records show that this wetland was
at the various elevations as follows:
April 1966 894.7
April 1990 893.9
March 1992 895.9
There presently exists a storm sewer outlet in the southwest corner
of your property at an elevation of 892.6 which provides plenty of
flexibility in controlling the pond elevation at a desirable level.
While there is no public easement over this wetland, any alteration
is governed by the Wetland Conservation Act of 1991 by the State of
Minnesota. Mr. Rich Brasch, Eagan's Water Resource Coordinator
(681-4300) can answer any questions regarding this legislative •
control.
While I hope that the information provided is not too confusing,
please feel free to contact me if you have any questions regarding

Re: Project 467, Wescott Road Final Assessment Certification
Dear Marge:
Recently, you forwarded to my attention your property tax
statement r,equesting that I review it to make sure that the
special assessment allocations were.correct. In reviewing the
final assessment roll approved by Council action on October 6,
1987, the ifinal amount of special assessments for the above-
referenced project that was certified by the County for
collection is correct and is further identified and broken down
by the attached special assessment search summary.
All assessments associated with Project 467 were spread over 15
years at an annual interest rate of 8.5$. However, the 1988
installment ($652.80 priniciple and $971.02 interest) includes
interest for all of 1988 plus the last two months of 1987
resulting in your 1988 annual statement interest calculation
($971.02) being calculated on an interest rate of 9.916$ (8.5$
plus 1.416$). Hereinafter, future annual interest installments
will be calculated at the rate of 8.5$ on the remaining unpaid
balance. Correspondingly, with the reduction of your principle
assessment amount by $652.80, the remaining unpaid balance of
$9,139.50 at an interest rate of 8.5$ will result in the 1989
interest installment of $776.86. The 1989 total principle and
interest wil~l be $1,429.66. Every annual principle and interest
installment will be further reduced due to the interest
calculation ~being based on a continually declining outstanding
principle balance.

As you will notice from the enclosed summary of the final
assessment roll approved by the Council on October 6th, your
reduced assessment obligation certified to the County was subject
to the execution of an agreement in accordance with special
assessment policy 86-3. Due to past staff work loads, we have
not been able to prepare this special agreement to be forwarded
to your attention for execution and subsequent recording.
However, based on your past verbal concurrence, we proceeded with
the certification of the reduced amount. We hope to have an
agreement ready to be forwarded to your attention in the next 30-
60 days.
I hope this letter isn't too confusing in trying to explain your
general concerns. Any further technical questions can be quickly

THIS AGREEMENT dated this day of March, 1992, between
the CITY OF EAGAN, (called City), and Barry & Maraaret Tillev
(called Owner) of 1055 Wescott Road, Eaaan MN 55123, (address);
WHEREAB, the City proposes to assess the following described
premises in Dakota County, Minnesota owned by Owner: (legal
description): P.I.N. 10-01400-041-53
The East 330 feet of the West 990 feet of the South 660 feet of the
West s of the Southwest Quarter of Section 14,
for the following improvements pursuant to City Project(s) 467
Water lateral benefit water trunk storm sewer lateral, storm
sewer trunk and street improvements
WHEREAS, assessments would normally be based upon the total
frontage area of said premises; and/or
WHEREAB, the present use of said property is homestead for a
single use; and
WHEREAS, the highest and best use of the property may be at a
different zoning, higher density or more intense use than presently
exists;
NOW, THEREFORE, upon consideration of the mutual covenants
herein, the parties agree as follows:
1. The City agrees to assess said property for the Project
and purposes described above at its present singular use, in
accordance with Special Assessment Policy No. 86-3.
2. The Owner agrees for himself, his heirs, executors,
administrators, successors, and assigns, that if the actual use of
said property is changed in the future to a use or zoning category
which is greater than its present use, the City may reassess or
levy a supplemental assessment at such time based on the assessable
units (frontage and/or area) postponed under this referenced
project at the appropriate zoning classification assessment rates,
according to City policy, in effect at such future time.
3. a. The Owner for himself, his heirs, executors,
administrators, successors, and assigns waives any and
all objections to the City's right to reassess the
property in conjunction with the Project if the actual
use and/or the zoning for the property is changed.
Further, the Owner waives any and all objections to the
present assessments agreed to herein and to the
proceedings related thereto.

b. By executing this Agreement, the Owner does not waive
the burden of the City to establish the benefit received
by the property under the Proj ect at the time of the
change in use or zoning.
4. ' The undersigned hereby agree that this agreement may be
recorded with the Dakota County Recorder and that the Owner shall
execute any and all documents necessary to implement the recording
of this agreement including the delivery of the Owner's Duplicate
Certificate of Title to the affected lands if necessary.
5. The undersigned agrees that this agreement shall run with
the affected land and binds the heirs, successors and assigns of
such land.
6. The undersigned heirs, successors and assiqns of such
land, includes all of the persons, firms or corporations that hold
an interest in the assessed land descried above, including the fee
title owners, contract for deed vendees or vendors or holders of
any other interest under contract for deed, option or otherwise.
7. Other conditions:
The undersigned have read and understand the above agreement
and hereby bind themselves to it in all respects.

SOBJECT: Calculation of reduced assessment obligatioas for large

POLICY: When existing unplatted property~meeting the qualifying area
and frontage requirements desire to oonneet to existing
previously under/unassessed public improvements or when nea
public improvements are installed ad~acenL to aimllar type
property, through the execution of the attached agreement, the
assessment obligation eill be caley],,~ted on 100 ft. of frQntaRe
and 1 acre of land with the remaiedeT ef thP A44essment
obligation being postponed until such time that the nrooertv is
developed to a higher or more intense use. At that time, the
postpone assessmen obligations vill be reactivated and
certlfied in accordance with the agreement. Qualifying
properties must have a minimum of 2D0 ft. of frontage on the
public right-of-way incorporating the public improvement and
must be greater than 3 acres in area exeluding all dedicated
right-of-aay, ponding easements andlor signif3eant and unusual
utility easements.
OBJECTIVE: To reduce and postpone the significant financial burden of
public improvements on large pre-existing unplatted property
until such time that it is developed' to a higher and/or more
intense use thereby realizing a benefit more directly related
to the assessment obligation. It also provides an opportunity
for existing homesteaded unplatted property to cotuiect to
existing utilities when needed without ineurring the burden of
benefit for the larger undeveloped property beyond the nominal
one dwelling unit property dimensions.
JUSTIFICATIOH: Many times, benefit of publie improvements to existing large
unplatted tracts of land is not realized until such time that
that land is developed to a higher and/or more intense use
requiring the benefits provided Prom the puDlic improvements
available. This postponement vill recognize the extenb of the
immediate benefit and vill provide a recordable agreement
informing perspective future developera end/or investment
purchasera of additional assessment obligations if the property
is to be used for other than its use at the time of the
agreement execution.

Dear Marge:
Recently, you forwarded to my attention your property tax
statement requesting that I review it to make sure that the
special assessment allocations were.correct. In reviewing the
final assessment roll approved by Council action on October 6,
1987, the final amount of special assessments for the above-
referenced project that was certified by the County for
collection is correct and is further identified and broken down
by the attached special assessment search summary.
All assessments associated with Project 467 were spread over 15
years at an annual interest rate of 8.5$. However, the 1988
installment ($652.80 priniciple and $971.02 interest) includes
interest for all of 1988 plus the last two months of 1987
resulting in your 1988 annual statement interest calculation
($971.02) being calculated on an interest rate of 9.9168 (8.5$
plus 1.416$). Hereinafter, future annual interest installments
will be calculated at the rate of 8.5$ on the remaining unpaid
balance. Correspondingly, with the reduction of your principle
assessment amount by $652.80, the remaining unpaid balance of
$9,139.50 at an interest rate of 8.5$ will result in the 1989
interest installment of $776.86. The 1989 total principle and
interest will be $1,429.66. Every annual principle and interest
installment will be further reduced due to the interest
calculation being based on a continually declining outstanding
principle balance.

As you will notice from the enclosed summary of the final
assessment roll approved by the Council on October 6th, your
reduced assessment obligation certified to the County was subject
to the execution of an agreement in accordance with special
assessment policy 86-3. Due to past staff work loads, we have
not been able to prepare this special agreement to be forwarded
to your attent'ion for execution and subsequent recording.
However, based on your past verbal concurrence, we proceeded with
the certification of the reduced amount. We hope to have an
agreement ready to be forwarded to your attention in the next 30-
60 days.
I hope this letter isn't too confusing in trying to explain your
general concerns. Any further technical questions can be quickly
answered by our special assessment ~lerk, Deanna Kivi, or myself.

Notice of Continued Final Assessment Hearing - Oct. 6, 1987
Dear Property Owner:
On September 15, a final assessment hearing was held before the
City Council regarding the improvements associated with the
above-referenced project. Prior to that meetinq, you were mailed
a notice of that hearing which identified the proposed
assessments against your property.
Unfortunately, the amount referenced in that earlier notice did
not accurately reflect the total financial obligations of your
property in relationship to the improvements for that project.
The amounts that you were previously noticed for were based on
the assumption that you would execute an agreement with the City
postponing the additional assessments until such time that your
property were ever to be subdivided or developed to a greater
intensity than presently exists.
Because of this improper notification, the City Council continued
the final assessment hearing for your property until October 6 to
allow staff to provide you with a formal notification of your
property's total obligation.
You will still have the opportunity to execute the appropriate
agreement which will allow your assessment to be reduced to the
amount that you were originally noticed of. As mentioned
previously, if you execute the appropriate agreement, the
significant difference between your previous noticed amount and
the one enclosed with this letter can be postponed at no interest
or carrying charge until the time of further development. If,
and when, your property should e.ver be subdivided or developed to
a higher use, the assessments to be levied at that time would be
in accordance with the rates in effect at the time of chanqe of
use of your property. We cannot accurately state or guarantee
what those future rates will be. That is why you are being given
the opportunity to pay your property's entire obligation at the
present time or postpone a significant portion of it to a later
date at yet to be determined rates.

This special assessment policy providing for this postponement is
made available to those homeowners who currently homestead large
tracts of property adjacent to proposed City improvements and is
based on assessing only 100' of frontage and 1 acre of area.
If you have already submitted a written objection at the
September 15 meeting, that objection will still be honored at the
October 6 meeting without having to resubmit the new objection.
However, it is necessary for us to formally notice you of the
increased obligation and the necessity to execute the appropriate
agreement to have your assessment obligation reduced accordingly.
If you would like additional information regarding this policy or
the agreement, please feel free to contact me at your convenience
prior to October 6.

Special Assessment Objection
Dear Ms. Tilley:
At the formal public hearing before the City Council, you
submitted a written objection to the proposed final assessments
against your property for the improvements associated with that
project. Subsequently, the Council deleted your property from
the final assessment roll that was formally adopted and certified
to the County for certification onto the tax rolls. Your
objection was then referred to the Special Assessment Committee
for an in-depth review of the improvements, the related benefit
to your property and the proposed assessments.
This Special Assessment Committee is comprised of two Council
members, two Planning Commission members and three residents of
the community. After their review, they will forward a
recommendation to the City Council for formal consideration of
final adoption of the proposed assessments. The Council's
consideration of the Special Assessment Committee's
recommendations will be held at a future formal public hearing
and mailed notification similar to the public hearing process you
recently completed.
While there is no definitive schedule for the Special Assessment
Committee meetings, it is not anticipated that this item will "
come before that Committee any sooner than November/December,
1987.
When the Special Assessment Committee meeting has been scheduled,
you will be so notified in writing with a request to provide any
additional information or appraisals you may have compiled in the
interim. Once all this information has been gathered , a staff
report will be prepared for the Committee meeting with a copy
forwarded to your attention prior to that meeting.

In the interim, this special assessment will continue to be
listed as a"pending" assessment but there will be no interest
accrued beyond the amounts proposed at the time of the recent
final assessment hearing.

my attention recently where in you modified the wording in accord-
ance with our discussions to alleviate your concerns pertaining to
this easement. After reviewing these changes, 2 also noticed that
your execution of the easement had not been notarized. Therefore,
since I would have had to have returned the easements to your
attention for proper notarization, I took the liberty to revise
the utility easements to incorporate those changes that you express-
ed concerns with.
Therefore, I am forwarding to your attention three copies of this
revised utility easement. I would appreciate it if you would have
two copies fully executed, notarized and returned to my attention
by August lst. The City of Eagan has several notaries on its
staff which can provide its services to you free of charge if you
so choose.

Dear Jim:
As you are aware, in consideration for acquiring the permanent and
temporary construction easements for the extension of the sanitary
sewer from Wescott Road to your Lexington Place South Addition,
you entered into an agreement with Barry and Marge Tilley whereby
you agreed to pick up all their assessments associated with
sanitary sewer improvements. I have been contacted by Mr. Tilley
requesting how his final assessment of $3,681.50 for trunk area
sanitary sewer under Project 361 will be handled.
Please inform me as to whether you will be paying this assessment
off or if you would like to have this obligation transferred over ~
to your Lexington Place South Addition.
Your prompt response to this situation will be appreciated and
will help ~the City to inform Mr. Tilley how to handle his
obligation.
Please be informed that Project 361 had its final assessment roll
approved on September 18, 1984, and that payment in full can be
made to the City of Eagan within 30 days of that day without any
interest being added to the principle amount.
