that are on city right-of-way and within the proposed construction limits for the new traffic signal projec[.
These trees will need to be removed or relocated prior to the consUuction of the itrtersection

salvage them. Any efforts on your part to remove the trees adjacent to your property should be compieted
by August 15, 1999. After this time, the trees wili be removed as part of the public contract or relocated
by the Parks and Recreation Department.

Dear Mr. LaRue:
Recently, an issue arose regarding the potential additional fees associated with
connecting to the sanitary sewer and water system and the City's release of the water
meter for Lot 1. This issue related to the inadequacy of the trunk area fees previously
levied by the City of Eagan for the four lots and outlot of the Wiiliams & LaRue 2nd
Addition that was a replat of Lots 3 and 4 of Williams & LaRue 1st Addition.
The trunk area sanitary sewer and water fees were previously levied under the original
parcels and were subsequentiy allocated equaily on a per lot basis to the five newly
created iots of the 2nd Addition. However, when these trunk area fees were originally
levied, they were on a per lot basis for the two lots of the 1 st Addition. Although the two
newly created tots with the 2nd Addition should have paid a similar per lot trunk area
assessment for both sanitary sewer and water at the time of the final piatting, it was
inadvertently overlooked by the City. Due to the fact that you, as developer of the 2nd
Addition, agreed to pay any additional fees associated with the replatting, the Gity's
inability to properly inform you of these additional fees at that time should not now be held
as a liability against these lots as building permits are being issued.
Therefore, Lots 1, 2, 3 and 4 of the Williams & LaRue 2nd Addition, are being recognized
as having fully fuifilled all related and required trunk area assessments associated with
connecting to the sanitary sewer and water system. This clarification is being made to
ensure that there is no such further confusion with future building permit issuances on
either Lot 2 or Lot 4.

Dear Paul,
The connection of Weacott Road to Lezington Avenue requires the alignment of
Wescott Boad to be located north of the aection line due to Williams Borthers
Pipe. This reaulta in the cen[erline alignment of Weecott Road east and west
of Leaington Avenue having a 35 f oot offeet at the centerline of Lex+.ngton .
Avenue. It would be advantageous at thia time to reconetruct a emall portion
of Weecott Boad east of Leaington Avenue to match the alignment west of Lex-
ington Avenue. Thie requiree a permanent triangular easement and a temporary
construction easement from the lo[ located in the northeaet comer of Leaing-
ton Avenue and Wescott Boad. We vould like thie easement to be pursued at
this time if ite acquiaition can be obtained relatively easily. The easement
descrip[ion ie ae follove:

Commencing at the southweat corner of Lot 4, thence eae[ along the south
