Re: Backyard drainage issues
Dear Ms. Shetty,
The purpose of this letter is to summarize my site visit to your property on June 18 and review the
discussion we had regarding the drainage issues you and your neighbors are experiencing in the
back of your properties.
The intended drainage path for the properties from and including 864 to 878 Wescott Square is
for the water to run through the rear yards from east to west with the stormwater then entering
the storm sewer system at the catch basin in the southwest corner of 878 Wescott Square. I
obtained elevations using the City's GPS unit and determined that the elevation at the top of the
catch basin is 862.15' and the elevation in the approximate low point behind 870 Wescott Square
is 864.60'. Thus, there is 2.45' of fall from the backyard low point to the catch basin. This should
allow for an adequate grade to properly drain the low point.
There are several factors that are currently inhibiting drainage. The wooded area on the western
side of the 864-870 homeowner's association appears to have built up over the years with natural
leaf litter, branches, soil and other natural material and is blocking a portion of the intended
drainage swale. The other issue is the landscaping that's been done in the drainage and utility
easement at the rear of 874, 876 and 878 Wescott Square. They've narrowed the available
channel to approximately 1.5'-2' in width. As a result, it has created a choke-point that slows the
water down and thus does not allow for proper drainage. In addition, it likely fills with snow during
the winter which then freezes, essentially damming it off for spring runoff.
In addition to the drainage issues, the City owns a water main and sanitary sewer that run through
this easement. According to City code, there should not be any structures (i.e. storage sheds),
landscaping or retaining walls within this easement. Should the City ever need to access these
facilities for maintenance or repair, they have the legal right to remove said obstructions and are
not required to replace them.
So, what is the best, quickest and most economical way to address this issue? I think there are
several steps that can be taken that will improve the situation. First, I would suggest hiring a

knowledgeable landscape contractor to re-grade the drainage swale beginning at the low point
behind your complex and working toward the west to the fence line of 874 Wescott Square. This
will require permission from the property owner at 872 Wescott Square to work in their property.
There is approximately 0.88' of fall to the fence line so it is fairly flat and will require some
surveying knowledge from your contractor to get it to flow properly. Once graded this area should
be reseeded with grass to stabilize the soils and prevent erosion downstream.
I'm hopeful that this will be as far as you need to go, and no further action will be required.
However, if that is not the case then step 2 would be to work with your neighbors to have the
landscaping removed or altered to allow more water to flow through the area and get to the catch
basin quicker. Hopefully the property owners will be willing to work with you on that process, if
not, our Code Enforcement Division may be able to offer some assistance.
If all else fails, then the last option that I have would be to connect to the existing catch basin and
install new storm sewer pipe to the east to pick up the storm water on your property. This will be
difficult with the presence of the other City utilities in the same area and much more expensive.
Unfortunately, this is considered a civil matter and the City has no authority to require anyone to
work with you or cooperate with the project (other than the previously described Code
Enforcement issues). It is also City policy that we do not do the grading work nor participate in
the costs associated with said grading for situations such as these. We can work with residents
from a consulting and education standpoint to assist you in resolving your issue.
