The Eagan City Council at the regular meeting of April 2, 1985 directed me to
enforce the provisions of your Conditional Use Permit, Failure to do so would
indicate to us that you no longer desire to do business at that location in
Eagan and are willing to have the permit revoked, Conditional Use Permits are
designed to protect Eagan citizens property values and environment. On April
19, 1983. You signed an agreement with the City to meet the following
conditions in return for the privilege of operating a business at Lot 1, Block
1, Lembke Addition:
1) Install green areas with 28 double needle Blue Spruce to screen the
outside storage of trucks as shown.
2) Install concrete curbed driveways as shown.
3) Install bituminous drives and parking as shown.
4) Install clean, crushed rock in storage areas as shown.
5) Keep lawn areas weed free and mowed.
6) Keep stored tractors and trailers in an orderly manner.
I feel quite confident that you will want to maintain agood image in the City
and will take immediate steps to fulfill your obligations. If you have any
questions, feel free to contact me.

west side of Pilot Knob Road in the SE 1/4 of Section 16.
ACTION: All items were approved unanimously.

Ordinance Amendments to Chapters 2, 11, and 13 of the Ciry Code regarding
Code enforcement officers.
ACTION: The amendments were approved unanimously.

A regular meeting of the Eagan Advisory Planning Commission was
held on Tuesday, July 28, 1992, at 7:00 p.m. at the Eagan Municipal
Center. Present were members Voracek, Graves, Merkley, Hoeft, Miller,
Griggs and Alternate Hunter. Also present were City Planner Jim
Sturm, Community Development Director Dale Runkle, Assistant City
Enqineer Mike Foeztsch, and City Attorney Mike Dougherty.

Griggs moved, Hunter seconded, the motion to approve the agenda
as presented. All present voted in favor.
Chairman Voracek explained the Advisory Planning Commission
procedure to the public.

Chairman Voracek opened the first public hearing of the evening
regarding a grading/excavation permit for approximately 12 acres on
Lot 1, West Publishing 2nd Addition and..Lot 1, Block 1, Lembke ist
Addition located along the north side of Wescott Road in the SE 1/4
of Section 13. ~
City Planner Sturm explained that West Publishing is in the
process of acquiring the Lembke property. This land will be qraded
immediately after acquisition and will provide a building pad for
future expansion. Landscaping consistent with what is currently along
Wescott Road will be provided immediately after grading is completed.
Steve Bryant, a representative of West Publishing, stated that
they have no immediate plans for building construction on the
proposed site. A warehouse will eventually be built on this site,
however, no access onto Wescott Road is predicted.
Chairman Voracek asked whether the current driveways on the
Lembke property will remain. Mr. Bryant answered that the driveways
will be removed and the curb cuts will be replaced with straight
curb. Chairman Voracek requested that this item be added as a
condition.
Member Merkley requested that a condition be added which requires
the applicant tA abandon the existing wells and septic systems on the
.proposed site in accordance with City and County requirements.

RE: UPDATE - WERNER LEMBKE &
WEST PUBLISHING
As you have requested, the Community Development Department has been researching past
backgrounds and conditions of the Conditional Use Permit issued to Werner Lembke. As
you are aware, there is a great deal of information and conditions which had been spelled
out for this particular use. Staff has monitored the conditions to the present day operations
and it is our findings that Mr. I.embke is in violation of the Conditional Use Permit. A
forma] complaint is in the process of being served and wil] be issued to Mr. Lembke hy April
26, 1991. This should update you as to the status of the Conditional Use for Werner
I.embke.
I have met with Mike Foertsch and SEH to discuss the problem of costs for West Publishing
as it relates to Trunk Highway 149. As you ]rnow, there is a Project 600; the Corridor Study
for Highway 149, and other miscellaneous costs which have occuned in expediting the
construction and development for West Publishing. We elcplained to SEH the issue of how
the bill should be tabulated and once this was done, we would again meet and review the
expenses of the project. Mike Foertsch was to coordinate this with SEH and at this point

The Eagan City Council at the regular meeting of April 2, 1985 direeted me to
enforce the provisions of your Conditional Use Permit. Failure to do so would
indicate to us that you no longer desire to do business at that location in
Eagan and are willing to have the permit revoked. Conditional Use Permits are
designed to protect Eagan citizens property values and environment. On April
19, 1983, you signed an agreement with the City to neet the following
conditions in return for the privilege of operating a business at Lot 1, Block
1, Lembke Addition:
1) Install green areas with 28 double needle Blue Spruce to screen the
outside storage of trucks as shown.
2) Install concrete curbed driveways as shown.
3) Install bituminous drives and parking as shown.
4) Install clean, crushed rock in storage areas as shown.
5) Keep lawn areas weed free and mowed.
6) Keep stored tractors and trailers in an orderly manner.
I feel quite confident that you will want to maintain a good image in the City
and will take immediate steps to fulfill your obligations. If you have any

Dear Mr. Edwards:
I am responding to your letter that was dated March 28, 1985,
concerning industrial property at 3773 Highway 149 in the City of
Eagan which is referenced as the Lembke lst Addition. The concerns
you have raised in that letter are legitimate and the City has
placed the owner of the property on notice that proper action must
be taken to guarantee compliance with conditions that were set
forth in a conditional use permit approval that granted outside
storage. A letter has been sent to Mr. Lembke by the City's
Inspection Department insisting that all the violations be brought
into proper compliance or the City will no longer allow business
to be conducted at that location thus giving cause to revoke the
conditional use permit that was granted to Mr. Lembke.
The City Council is concerned about the positive image of its
corporate citizens and as a result will make every effort to
require conformance by Mr. Lembke for his business operation lo-
cated at Lot 1, Block 1, Lembke Addition.
Mr. Dale Peterson, Chief Building Inspector, is attempting to en-
force the.provisions of the conditional use permit and w-ill keep
you informed of any and all progress.

Dear Mr. Hedges:
AS owners and operators of industrial property at 3773 Highway 149 in the city
of Eagan, West Publishing Company is concerned about existing conditions at the
adjoining property known as Lembke First Addition. We have in excess of 600
employees that must pass the Lembke First Addition on a daily basis. In addi-
tion, we feel we have a certain image to project, and it is rather difficult to
do so, when others viewing the property in question do not know it does not
belong to West Pu6lishing Company. "
We take pride in maintaining our property in a safe, sanitary, and neat manner,
and feel we are entitled to having others in the area do the same.
Representatives of West Publishing Company have voiced complaints to the City of
Eagan on a numher of occasions regarding the condition of the Lembke First
Addition property, but to date, to no avail. We request that prompt action be
taken to alleviate the conditions that exist on the property in question.
It is our understanding the City of Eagan insisted on certain requirements that
the owners of the property would have to meet (see City of Eagan Council Minutes
of July 15, 1980). It is obvious that the required asphalt surface has not been
installed; the storage area does not have proper dust control measures put in
place; vehicles without current licenses are being stored on the property; at
times the fifteen truck and trailer maximum is being exceeded; truck and trailer
parts and other debris are 6eing stored outside of the existing building; trucks
and trailers are being parked outside of the storage area; the required solid
screening along Westcott Road has not been instatled; and in addition, there is
rubbish, debris, old machinery, vehicle parts, etc., in full view on the
property.

Enclosed are copies of the conditions of the Lembke lst Addition and the Settlement
Agreement for the Conditional Use Permit review and revocation process that took place
in 1985. Following is the current status of each condition, to the best of my knowledge:
LEMBKE 1ST ADDTf10N CONDTI'IONS
1. The applicant is in compliance.
2. It is obvious that there is no plan for where employee parldng would be and the
condition of the asphalt surface is higlily in question.
3. There is no crushed limestone and no dust control measures are apparent.
4. This is hard to determine without a much closer on-site inspection, however it looks
apparent that there would be more than one vehicle or uailer without cunent
licenses, including possibly cars.
5. It appears that there would be more than 10-15 trucks and trailers on an average day.
6. There is obvious violation with old parts, trash, and tires throughout the site.
7. Again, parlring is randomty scattered throughout the site.
8. This one is hard to determine from a drive-thru and review from the street.
9. This was not done to the plan that was provided, attached to this memo, and there
has been no even reasonable attempt to provide screening on either the south or east
property lines.
, 10. Unlmown at this time.
11. This has not been inspected recently, to my ]mowledge, and probably should be
looked into further.
12. The building is not hooked up to either City sewer or water.
STIPULATION FOR SETTLEMENT AGREEMENT
On page 2 of the conditions, Item a: There is no curb and gutter and only portions of
asphalt that are in questionable condition.
Item b: It dcesn't appear there are any dust control measures, however it still be hard to
prove that twice a year application has been done.
Item c: The ground cover has not been maintained and the berm extension is questionable
as to its effectiveness.
Item d: Additional landscaping has not been provided.
Item e: The storage of trailers and vehicles is scattered randomly throughout the site. It
appears that they are stored for more than 72 hours at a time and it is clear there are more
than six uailers on the property.
Items f& g: Unknown to me at this time.

entrance of the property, and inetall adtlitional lanoscaping as is requireG in

hundred five) dollars to the County of Dakota as required by Ordinance
Number 114 and has complied with all of the requirements of said
Ordinance necessary for obtaining this permit to permanently seal the
well(s) described herein:
An abandoned well(s) with a casing diameter of 4 inches, depth(s) oi
173 feet and completed in unconsolidated sediments will be permanently
sealed. The well(s) shall be cleaned of equipment and debris,

feet below grade. I

Code and any conditions attached on the reverse side of this permit
form.
