We have recently closed out our last lot in Surrey Woods at 692 Westcott Road. As you may
recall, sewer and water service for this lot was installed under a City contract and under the
direction of the City's consulting engineer. When the builder attempted to locate and install
services to the house, he was beset with a series of difficulties originating with no availability
of ties from the City and culminating with extensive over excavation by the plumber. The
service shxbs were eventually located, the sewer being 18 feet deep and the water being 14
feet deep.
We believe the services should have been installed at normal depths when constructed and the
CiTy, its consulting engineer and its contractor should beaz the responsibility for the extra cost.
Enclosed is a copy of the plumbers invoice reflecting the $1750 extra paid by Sienna. We
would greatly appreciate your assistance in arranging for a reimbursement directly to Sienna.

As you may be aware, Wescott Road is considered a community collector street. The
City does require that all new homes on community collectors have a turnaround of the
driveway in order that vehicles leaving the property do not have to back out on a heavily
travelled road. Typically this can be done with a hammerhead turnaround and is
iliustrated on the enclosed attachment. The City is. requesting that you have this or an
alternate turnaround provided prior to the issuance of a Certificate of Occupancy. Please

Sewer & Water Connection - Claim For Extra Costs
Dear Rod:
Since receipt of your letter of December 13 and a claim requesting reimbursement for
$1,750 of extra costs incurred for connection to the sewer and water sen+ice for the
above-referenced property, the Public Works Department has had an opportunity to do
some additional research into this matter. Your claim was supported by two contentions:
1) no location ties were available from the City, 2) excessive depth of excavation. I will
respond to each of those specifically.
1. No Location Ties Available
Afthough the Certificate of Survey submitted with the building permit corrtained a notation
°City has no information on a sewer service location or if one was constructed", I am
confused as to the basis for such a statement by your surveyor, Rehder & Associates,
Ine. Enclosed with this letter is a copy of the record asbuilt plans when these utilities
were installed in 1987 under City Contract No. 87-15. The enclosed record plan sheet
provides detailed ties to the water service to a tenth of a foot and also references the
installation of a 6' sewer riser adjacent to said water service. This information is readily
available to the pubiic. in addition, the Public Works Utility Maintenance Division marked
the location in the field and spotted the location for the plumber to begin digging.

2. Excessive Depth of Excavation
On January 6, the City of Eagan televised the sewer service and verified that a minimum
6' sewer riser was in fact installed with original construction as shown on the record
asbuilt plans. As shown by the enclosed Grading/Development Plan for the Bridle Ridge
Addition, Lot 1, Block 6, proposed to have a first floor elevation of 924.0 at a location
where the existing topography ranged from 903.0 to 915.0. At the right-of-way property
corners, the existing elevation ranged from approximately 913.0 to 924.0. With the
Certificate of Survey submitted with the building permit, the northeast corner of this
property shows an existing elevation of 922.9 which indicates approximately 10' of fill had
been placed on this lot prior to building permit issuance. This has been ver'rfied by
recollections of Engineering personnel who observed unauthorized filling taking piace on
this lot without an issued grading permit. As referenced by your plumber's invoice, this
grading obviousiy included an additional 3' berm which accounts for the overdepth
incurred by the connection. With the sewer riser elevation being referenced at
approximately 911.0 and an existing elevation of approximately 926 (includes 3' berm),
this can account for approximately the referenced 15' of depth. This is not considered
unusual in sewer and water connections, especially when fill has been placed on the lot
after the installation of utilities. We cannot verify the referenced 21' of excessive depth
as the utilities were covered when an inspection was pertormed by Maintenance
personnei as a part of the p?umbing permit.
After reviewing the records available relating to this sewer and water connection and the
televising of the sewer service on January 6, 1995, I cannot find any information that
would indicate the City has any liability for the alleged extra costs incurred by Star
Plumbing & Excavating.
I am sorry that this research and response couid not support your ciaim, but hope that
the information contained herein provides you with the information to understand the
basis for the City's position and response to your claim.
