The Community Development Department received a complaint regarding your property
located at 3300 Terminal Drive. On March 19, 1992 I performed a site inspection and
noted what appears to be construction debris, including piles of dirt and concrete.
This letter is to advise that the City of Eagan requires a Conditional Use Permit for any
outside storage. Our records indicate that a Conditional Use Permit has not been granted
by the City for the property referenced above. Prompt and proper removal of the contents
on your property is necessary no later than April 3, 1992 to avoid further Ciry action.

"Grantor" and the CITY OF EAGAN, a municipal corporarion, referred to as "Grantee".

WHEREAS, said Grantor, is the owner of the tracts of land in the City of Eagan,
County of Dakota, Minnesota, legally described as follows:
An easement for ponding,_ drainage. and_uUlity--purposes-over, under and
across that part of Lot 7, Block 2,_SIBLEY TERMINAL INDUSTRIAL
~;PARK, according to the recorded plat thereof and situate in Dakota County,
Minnesota lying southeriy of the following described line:
Commencing at the most southerly corner of said Lot 7; thence North 45
degrees 26 minutes 41 seconds West along the southwesterly line of said
Lot 7 a distance of 105.00 feet to the point of beginning of the line to be
described; thence North 44 degrees 33 minutes 19 seconds East a distance
of 170.00 feet; thence South 78 degrees 34 minutes 27 seconds East a
distance of 53.02 feet to the southeasterly line of said Lot 7 and there
ternunating.

NOW, TBEREFORE, the said Grantor, in consideration of One Dollaz ($1.00) and
other good and valuable consideration, to it paid by Grantee, receipt of which is hereby

assigns, for ponding and conservation purposes, including the normal pracrice of filling with
water the above-described premises from storm sewer runoff and for utility line purposes.
The Grantee shall have the right to do whatever is necessary for the enjoyment of the
rights herein ganted, including the right of clearing the easement azea to allow for the use of
the land as stated herein, and also including the right to excavate within the easement azea and
to install, lay, maintain, operate and repair storm sewer pipes and utiliry lines and the right of
ingress and egress to and from said tract of land and over and across the easement area for
these purposes.

located outside the anticipated perimeter of standing water to as neaz the existing grade as is
reasonably possible and fiuther agrees to replace existing cultivated shrubs or sod and to seed
all other areas not covered with standing water.
It is expressly understood that the Grantee, its successors or assigns sha11 waive and
release said lands or that portion thereof used for permanent lake or ponding purposes from
any special assessment levied on an area basis on account of any improvement in the City of
Eagan for such time as said lar.c:s a:e used fcr permanent lal:e or pondi:.b pu.reses, but at
such time as such uses or purposes are abandoned then said lands may again be subject to
such special assessments, as have been levied or may hereafter be levied.
The Grantor, its successors and assiens, does covenant with Grantee, its successors

convey the easement herein to Grantee.
