+ We are not satisfied with the sesponce from New Horizan Homes, Inc.
(cupy attached)
We beleeve that New Horizan should have known what kind of soil
they were building the driveway on and provided adequate drainage.
The heat loss from the house is great enough to prevent the snow
~ from remaining there or for the ground to freeze enough to cause
the type of damage they cited in their letter.
In fact now, the water that collected and froze underneath the
driveway near the garage door has thawed: The driveway has cracked
and the water is now draining through the cracks.
Also since our February letter and the current thaw, more internal
damage occurred to the wall of the bedroom•next to the entry. The
corner.seam is cracked from ceiling to floor. There is also a
verticle crack, over Z feet long, from the seam toward the back
of the house.
We would 6oth appreciate any help HUD can give us in convincing
New Horizan Homes to correct all the damage caused by their
original error and do whatever it takes to see that it does not
occur again (my suggestion in the first letter to New Horizan).

Dear Mr. Council,
The internal structural 3amage ycu are eaperiencing this year is
not unique to your townhouse but is occuring in many areas throughout
the Twin Cities area this year. We have discussed this problem with
various buildin9 inspectors throughout the metro area and they are in
agreement that this is an extremely severe winter for frost heaves.
Due to the excessively wet fall we had followed by minimal snow cover
and an unusually extended cold spell the frost penetration has been
excessive this yeac. We feel the wet soil is freezing to the foundation
and ground movement has carried the foundation with it causing the
damage to your home.
Your home was built in 1973 and up until now has experienced
only minor shifting. Your home was built according to plans and spec-
ifications approved by and filed with the City of Cagan and the FHA
who both made inspections during the construction of your home.
Do to the time factor involved and the uncontrolability of the
situation we do not feel New Horizon Htmes, Inc. can werrant any
action on our part.
The seam in your apron is common practice to contcol cracking as
much as possible.
We are sorry this letter is not what you wanted to hear but we
cannot justify any action in this matter.
