as "Landowner" and the CITY OF EAGAN, a municipal corporation,
organized under the laws of the State of Minnesota, hereinafter
referred to as the "City".

That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its employees, agents or contractors, permanent
easements for ingress, egress, and driveway purposes, over, across
and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
The Easterly 10 feet of Lot Four (4), Block Four
(4), Timbershore Fourth Addition, according to the
recorded plat thereof on file in Dakota County,
Minnesota.
See also Exhibit "A" attached hereto and incorporated herein.
This permanent easement for ingress, egress and driveway purposes
is to permit City personnel, its' agents or contractors to use this
easement for the purpose of ingress, egress and driveway access to
and from the Hurley Lake lift station (Lift Station No. 14). No
obstructions such as trees, shrubs, fences, buildings, gardens, etc.
will be permitted to occupy this easement. The grant of the foregoing
permanent easement for ingress, egress and driveway purposes includes
the right of the City, its contractors, agents and servants to
inspect, repair and maintain the bituminous access drive within the
easement area.
The Landowner, its heirs and assigns, does covenant with the
City, its successors and assigns, that it is the owner of the
premises aforesaid and has good right to grant and convey the
easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to
be executed as of the day and year first above written.

RIGHT OF ENTRY
CITY OF EAGAN
IMPROVEMENT PROJECT N0. 382
THIS AGREEMENT, dated this ~ day of 1983, by and
between the CITY OF EAGAN, called Eagan and MALECHA-NABITY, a Partnership,
called Owner;
WHEREAS, the City of Eagan has undertaken to install certain improvements
over land owned by Owner descritred as follows:
The East 10 feet of Lot 4, Sloek u, Timbershores 4th-Addition,
aecording to the recorded plat thereof on file in Dakota County,
Minnesota.
The ?ature of the improvements is as follows: access to Hurley Lake lift
station for City Utility Department. In order to install such improvements,
easements are required from the property owners through which the aecess drive
shall pass; and
WHEREAS, in consideration of certain ftems, the Owner desires to grant an
easement to Eagan upon completion of the installation of the improvement;
NOW THEREFORE, for and in consideration of the mutual covenants herein
contained the parties agree as follous:
1. The Owner agrees to grant Eagan and its contractor consent to enter
upon the abo:=_ dc-seribzd lac:ds c.r.=d by Ou:°.^ fc^ the nurposc-a.` iastalli;,g
the improvement specified above uhieh shall have a bituminous surface from

owner's driveway to at least the MeCarthy property boundary.
2. That during or immediately after construction of the 10 foot
, bituminous access d~r3,v~e, the City's contraetor shall repair and reatore
Grantor's driveway to a condition at least as good as it existed prior to
construetion. In addition, the contractor shall provide a new overlay of
bituminous to Owner's drivexay.

3- That if and xhen the City is able to oDtain reasonable alternate
access to the Hurley Lake lift station through the development of the property
surrounding it, the City will release this easement at the request of the
Owner and the three other Owners afFected by the aecess drive. Eagan agrees
to restore the area to ss near an equal condition as existed prior to the
commencement of construction.
4. That in consideration of the granting of the easement deseribed, the
City shall pay to the Oaner $250.00.

WITNESSETH WHEREAS, said Grantor is the owner of the tracts of land in
the City of Eagan, Dakota County, Minnesota, legally deacribed as follows:

NOW THEREFORE, the said Grantor in consideration of One ($1.00) Dollar
and other good and valuable consideration to it paid by Grantee, receipt

of Eagan all grasses, shrubs, trees and natural growth now existing on said
lands or that may be hereafter planted or grown thereon.
And the said Grantor, for itself, its heirs, executors, administrators
and assigns does hereby release the said City of Eagan, its suceessors and
assigns, from all elaims for any and all damages resulting to the premsies
hereby conveyed by reason of the location, grading, construetion, maintenance,
and use of a utility aecess drive over and upon, the removal of materials from
the premises hereby conveyed and from the uses incident thereto; it being
understood said release shall not apply to any damage to any property abutting
the premises conveyed hereunder arising because of the use of the premises
conveyed hereunder by the Grantee; and said City of Edgan shall have the right
to use and remove all earth and other materials lying within the parcel of
land hereby co~veyed.
And the said Crantor, for itseli, its heirs, executors, administrators
and assigna does hereby waive the right to any and all notice for the removal
of trees or hedges within the limits of the above described aecess drive and
hereby expressly waives any claim for damages on aecount thereof.
This Agreement shall terminate at such time as the City of Eagan,
Minnesota determines and agrees that the rights and easements herein provided
are no longer necessary.
