THIS INGRESS, EGRESS AND DRIVEWAY EASEMENT made and entered into this g � day of

hereinafter referred to as "Landowner, and THE CITY OF EAGAN, a municipal corporation, organized
under the laws of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:
That the Landowner, in consideration of One Dollar($1.00)and other good and valuable
consideration,the receipt and sufficiency of which is hereby acknowledged,does hereby grant and convey
unto the City, its successors and assigns, permanent easements for ingress,egress,and driveway purposes,
over,across and under the following described premises,situated within Dakota County, Minnesota,to-
wit:
The Westerly 10 feet of Lot Two (2), Block Five (5),Timbershores Fourth
Addition,according to the recorded plat thereof on file in Dakota County,
Minnesota
See also Fig.A attached hereto and incorporated herein.
This permanent easement for ingress, egress and driveway purposes indudes the right of the City, '�
its contractors, agents and servants, to use this easement for the purpose of ingress, egress and driveway
access to and from the Hurley Lake lift station (Lift Station No. 14) and the alurr� sediment basin No
obstructions such as trees, shrubs, fences, buildings, gardens, etc., will be permitted to occupy this
easement. The grant of the foregoing permanent easement for ingress, egress and driveway purposes
includes the right of the City, its contractors, agents and servants, to inspect, repair and maintain the
bituminous access drive within the easement area.
The Landowner, for itself, its successors and assigns, does covenant with the City, its successors
and assigns, that it is the owner of the premises aforesaid and has good right to grant and convey the
easement herein to the City.

year first above written.

Egress and Driveway Easement that this office has prepared in
connection with Lot 3, Slock 4; Lot 4, Block 4; Lot Block 5; and
Lot 2, Block 5; Timbershore 4th Addition. As you may recall, these
Fasements are redrafts of px•ior• Easements that had been obtaiued from
the landowners, but had not been placed of record in the office of

This easement, made this day of , 1993,
between PHILLIP HARVEY WALKER, a single person, herein referred to as
"Landowner" and the CITY OF EAGAN, a municipal corporation, organized
under the laws of the State of Minnesota, hereinafter referred to as
the "City".
W I T N E 8 S B T H:
That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its employees, agents or contractors, permanent
easements for ingress, egress, and driveway purposes, over, across
and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
The Westerly 10 feet of Lot One (1), Block Five
(5), Timbershore Fourth Addition, according to the
recorded plat thereof on file in Dakota County,
Minnesota.
See also Exhibit "A" attached hereto and incorporated herein.
This permanent easement for ingress, egress and driveway purposes
is to permit City personnel, its' agents or contractors to use this
easement for the purpose of ingress, egress and driveway access to
and from the Hurley Lake lift station (Lift Station No. 14). No
obstructions such as trees, shrubs, fences, buildings, gardens, etc.
will be permitted to occupy this easement. The grant of the foreqoing
permanent easement for ingress, egress and driveway purposes includes
the right of the City, its contractors, agents and servants to
inspect, repair and maintain the bituminous access drive within the
easement area.
The Landowner, its heirs and assigns, does covenant with the
City, its successors and assigns, that it is the owner of the
premises aforesaid and has good right to grant and convey the
easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to
be executed as of the day and year first above written.

IMPROVEMENT PROJECT N0. 382
THIS AGREEMENT, dated this ~//-A day of 1v0Jem8,E2 , 1983, by and
between the CITY OF EAGAN, called Eagan and DAVID E. NYMAN and MURIEL NYMAN,
husband and wife ca2led Owner;
WHEREAS, the City of Eagan has undertaken to install certain improvements
over land owned by Owner described as follows;
The West 10 feet of~Lot 2, Block 5, Timbershores 4th Addition, ~
aecording to the recorded plat thereof on file in Dakota County, ~
Minnesota.
The nature oF the improvements is as follows: aceess to Hurley Lake lift
station for City Utility Department. In order to install sueh improvements,
easements are required from the property owners through whieh the aceess drive
shall pass; and
WHEREAS, in consideration of certain items, the Owner desires to grant an
easement to Eagan upon completion of the installation of the improvement;
NOW THEREFORE, for and in consideration of the mutual covenants herein
contained the parties agree as follows:
1. The Owner agrees to grant Eagan and its contractor consent to enter
upon the above deseribed lands owned by Owner for the purpose of installing
the improvement specified above which shall have a bituminous surface from
owner's driveway to at least the MeCarthy property boundary.
2. That during or immediately after construction of the 10 foot
bituminous aecess drive, the City's contractor ahall repair and restore
Grantor's driveway to a condition at least as good as it existed prior to
construction. In addition, the contractor shall provide a new overlay of
6ituminous to Owner's driveway.

3• That if and when the City is able to obtain reasonable alternate
access to the Hurley Lake lift station through the development of the property
surrounding it, the City will release this easement at the request of the
Owner and the three other Owners affected by the access drive. Eagan agrees
to restore the area to as near an equal condition as existed prior to the
commencement of construction.
4. That in consideration of the granting of the easement deseribed, the
City shall pay to the Owner $250.00.
