Custom food and beverage service equipment shall be designed, fabricated, located and installed to NSF International requirements. 5. Provide adequate dirty and clean dish counters of stainless steel NSF International approved construction for the dishwashing operation. 7. Gopher Resource Corporation located on Highway 149 in Eagan was a company whose business it was to crush battery casings, wash them, and make them available for private disposal systems. Battery casings were commonly used in place of rock for over 20 years. When drainfields are abandoned, it is common [o allow casings to remain in the drainfield. COMMENTS: The applicants have applied for an Owner's Permit to relocate this building to provide storage facilities incidental to the operation and service of the principal business use, currently a Class I restaurant doing business as Richard's Restaurant. Such an accessory use of the building is permitted in a Genera] Business District. As proposed, the relocaied buflding will meet all setbacks and lot coverage requirements. Architecturally, both the storage buflding and the restaurant building have similarly low pitched roofs. The applicant has agreed to apply to the exterior of the accessory building siding of a style and color to match the principal building. An inspection of the subject buflding by City personnel has found the building to be substantially structurally sound and maintained in reasonably good repair. The owners have agreed to the few minor modifications which must be made to the buflding to bring it into conformance with the Building Code due to iu relocation and use. CONDITIONS: 1. The trash enclosure must be relocated at least Sve feet from the buildings (per the F'ue Code). 2. Those portions of the storage building walls facing the restaurant must be upgraded to a one-hour firewall (per the Building Code). 3. I have found the following: 1. The Eagan Police Department executed a search warrant at the Southfork bar, located at 4185• South_B ail, on June 27, 1984, and seized approximately seven grams of cocaine both from • the manager's safe and from the restaurant safe. Within the last several months, our officers have made several controlled buys of cocaine at Southfork. Subsequently, Stanley Lynn, the owner of Southfork, and his manager, Debra Schwabbauer, were charged with several counts of possession and sale of narcotics. 2. On August 3, 1984, I spoke to Stanley Lynn's insurance carrier, the Gombold-Allen and Associates Agency, and they ad- vised me that as of August 4, 1984, Mr. Lynn's insurance would be cancelled because of unreliability. The agent will contact me if any further change occurs. 3. I spoke to investigators in the Minnesota Department of Taxation and they advised me that, according to their records, Mr. Lynn has never paid Minnesota personal income tax. Hedges, City Adrninistrator FROM: Administrative Captain SUBJECT: Investigation for the Purpose of Revocation of Southfork Liquor License , Per City Attorney Paul Hauge's request, I have conducted the following investigation relative to the Southfork Bar and Restau- rant. 1/26/82 Anonymous report of pull-tab boards being used for qambling. We were unable to substantiate this at that time but pull-tab boards were seized in the search warrant on 6/27/84. 2/5/83 Southfork cited for Late Hours. Disposition of Guilty with a Stay of Imposition of Sentence for Six Months. 9/2/83 Late hours. A written warning issued. 4/14/84 Southfork cited for Late Hours, Allowing a Container on the Bar more than 20 minutes After Closing, Allowing a Person on the Premises more than 20 minutes After Closing. Continued until 8/15 to see if the sale goes through. 6/15/84 Southfork cited for Sale to a Minor under 19. Continued to see if the sale goes through. 6/27/84 Narcotics Violation. Eagan police officers executed a search warrant at Southfork. Debra Schwabbauer was present working as a manager of the bar. In her purse was found approxi- mately seven grams of cocaine and $1,793, some of which was marked money with which we had previously made a buy. In the restaurant's office in a black receipt box was found approxi- mately two grams of cocaine. In the safe in the office, Eagan police investigator.s found more cocaine and $2,621 and more of the marked money we had previously used to buy cocaine at Southfork Bar and Restaurant. On 6/27/84 Debra Schwabbauer was interviewed by investigators of this department. She said she has worked for Stan Lynn, owner of the Southfork Bar and Restaurant, off and on since March 1984. and she has been selling cocaine for him. She stated she was the manager of the bar and she would receive quantities THE LONE OAK TREE THE SYMBOL OF STRENGTH AND GROWfH IN OUR COMMUNITY + of cocaine from Stan Lynn and she would sell it throughout the week at the bar to different people. She would then put the money in Stan Lynn's bank account in Vermillion, Minnesota. She stated that Stan Lynn occasionally goes to Florida and purchases cocaine and brings it back to the cities. She also stated that Stan Lynn was currently picking up another key or two of cocaine worth $60,000. Stan Lynn has subsequently been charged with two counts of Unlawful Sale of Narcotics and one count of Unlawful Possession of Narcotics. Debra Schwabbauer has been charged with two counts of Onlawful Sale of Narcotics and one count of Unlawful Possession of Narcotics. On 8/6/84 Eagan Police Department investigators attended the Omnibus Hearing for the narcotics charges. The hearing was postponed until 8/27/84. Assistant Dakota County Attorney Bob King was advised by Debra Schwabbauer's attorney, Paul Rogosheske, that the deal with Dick Stariha for Southfork Liquor had fallen through, and also that Debra Schwabbauer had a financial interest in the bar and that interest is unclear. On 8/7/84 I spoke to John Tamborino (tel. 333-3225) the attorney for Dick Stariha, the new liquor applicant for Southfork. Mr. Tamborino said they are currently attempting to purchase the business but are having problems because of the confusion over who actually owns what. On 8/7/84 I spoke to Frank Gombold of Gombold-Al1en Associates (tel. 777-1355). he told me the Surety Bond for Southfork is still in effect but all other coverage as far as Southfork, Inc. is concerned had been cancelled. He did say that someone else could have picked up that coverage. The surety carrier is waiting to see what we do before deciding about the Surety Bond. I have checked with the Dakota County Treasurer's office and found that Southfork Liquor was delinquent in their real estate taxes in the amount of $3,172.37 plus penalities of $535.71. Captain Aszmann of this department advised Southfork Liquor that if their real estate taxes were not paid, their license would be revoked. Their real estate taxes were paid in full on March 27, 1984 by Stan Lynn. Eagan police officers have had communications with investigators from the Minnesota Tax Department Investigative Division and they advised that Mr. Lynn has not paid Minnesota Personal Income Tax. A letter was sent to you on July 9, 1984 informing you of the proposed hearing on the revocation scheduled for August 7, 1984 at 7:00 p.m. and a copy of that letter is enclosed. The Administrative Captain of the Eagan Police Department submitted a Memorandum dated August 7, 1984 addressed to the Council indicating that several citations have been issued concerning alleged violations of Minnesota Liquor Statutes and the Eagan Liquor Ordinance in addition to a narcotics citation currently being processed through the Dakota County Attorney's office. At the hearing on August 7, 1984, the Council reviewed the Memorandum from the Police Department, including the fact that real estate taxes had, at one time, been delinquent, information received by the City that liquor liability in- surance may be in default, the fact that personal income tax returns apparent- ly have.not been filed recently, and the fact that the restaurant is now closed to the public. Based upon the information received by the City Council, a motion was adopted, according to Eagan City Code, Section 5.02, Subd. 4(end to f) authorizing the City Council to revoke a liquor license for any reasonable cause not to exceed sixty (GO) days. This is to notify you that the Council did act to revoke your license for a period of up to sixty (60) days for the reasons that are outlined in this letter. At its regular meeting on Suly 2, 1984, the City Council adopted a motion to notify you that it will hold a hearing before the Council on August 7, 1984, at 7:00 p.m. or as soon thereafter as the hearing comes before the Council to consider the revocation of your on-sale liquor license pursuant to Eagan City Code Section Section 5.02 requires that notice be sent to you not less than fifteen (15) days nor more than thirty (30) days prior to the date of the hearing to consider such license revocation. You will be given an opportunity to be heard either hy yourself or any representative on your behalf and if the hearing becomes too extensive the City Council could continue the hearing to a later date to allow additional time for the submission of information concerning the proposed revocation. St. Paul, Mn. 55109 d~--- Dear Mr. Differt: 'eVithin the past six weeks, your department contacted the City of Eagan regarding an access permit Por Elmer Scott located on State T.H. 3 in the Ez of the SEw of Section 24„ Township 27N, R.23W. At the time the City was contacted, the staff thought the access permit would be an additional access to Rupert's Restaurant, and the City staff opposed this proposed access. In discussing this matter further with Mr. Scott, it was found that the proposed access would be for ivir. Scott's property. Early in 1980, Mr. Scott subdivided his land selling the south half where Rupert's Restaurant is located. Now Mr. Scott is requesting an access to serve his property. The City staff is not opposed to this access as long as it does not provide a second access to Rupert's Restaurant. I£ the access permit is granted, the City staff requests that a condition for the access be that there is a physi- cal separation or barricade provided between the parking lot of Rupert's Restaurant and the new access vahich is being proposed. Staff has enclosed an eachibit showing where this pk~ysical separation should be. If the access is granted, it should only be to serve 14r. Scott's property. It is Staff's understanding that on May 6, 1980, Mr. Scott is proposing to split a portion of his property, where LeAnn's Restaurant is located,to Mr. Jerry Snyder. According to sub- division regulations, there are only two ways property can be split. One is requesting a waiver of plat, the other is platting the property. Both applications would require a public hearing wtiich would be held at the Eagan Advisory Planning Commission meeting. If the liquor license is transferred, Staff is suggest- ing that a condition be placed on this transfer. This condition should be that the property Mr. Scott owns'shall be platted within one year or the liquor license will not be renewed in 1981. According to the zoning ordinance, it states all land shall be platted prior to issuance of a building permit. Since this is an existing structure about the only way this area will be platted is to require the platting as a condition of the trans- fer of the liquor license. Scott's property. However, I informed Mr. Scott that the trailer could be used on a temporary basis and that the City of Eagan would reserve the right to require a trailer permit application for further consideration in the future. The items discussed above and the action taken by the City Council upon approving the liquor license should be reviewed with the City Planner in the near future so that all conditions are met by November 1 of this year which is just prior to the annual review of all liquor licenses. Jon, attached you will find a letter from Barry Schade, Dakota County Director of Environmenta] Management. Barry has had a number of contacts with Gail McMahon regazding excavation of battery casings on her property at 1429 Lone Oak Road. As you can see by Barry's letter, the County has identi6ed ten sites in Eagan that used battery casings in the construction of individual sewage treatment systems (I.S.T.S.). It appeazs that four of ten sites aze still pending, or casings remain on-site. Based on this information, I believe we should place a warning flag on lots containing battery casings that haven't been mitigated, as well as place a copy of Bazrys letter in the relevant pazcel files. A warning flag on the PIMS system would allow us to inform individuals requesting permits of this issue. Barry has indicated that sites containing battery casings usually don't need to be mitigated until they are disturbed. Once they aze discovered, it is Dakota Count}fs policy to require the property owner to record this information with the property data base at Dakota County. If you need additional information or if you feel our plan of action needs to be modified, please advise. The results indicate that the interior dusts and the well water supply are free of lead contamination. The soils collected from the soil/battery casing stockpile in your backyard contained significant levels of lead. This suggests that tead from the soil/battery casing stockpile has not been transported into your house and has not impacted the well water supply. However, the lead in the soil/battery casing stockpile represents risk to human health and measures should be taken to reduce the potential for exposure to this lead source. While the plastic cover placed over the stodcpile has 'served to reduce the potential for direct contact with the lead, bare soils contaminated with lead are accessible to direct contact or through wind dispersal. We recommend placing additional plastic sheeting on the stockpile to further reduce the exposure to the lead contaminated waste and soils. We also recommend that you limit the use of the backdoor and install additional fencing around the stockpile to prevent inadvertent contact with the stockpile. Also enclosed is the list you requested of other situations the County has encountered where battery casings have been used in the construction of ISTS's (individual sewage treatment systems).
