stated that [he proposal would be to convert to condominiums sometime in the future.
Tom Walsh, president of Timberline Civic Association, was present as were other
affected residents in the area and suggested a meeting with the developer regarding
the propoeal. No formal action was taken.
OAKWOOD GATES ADDITION PRELIMINARY PLAT AND VARIANCES. Mr. Wilson Robinson
appeared on behalf of his application for preliminary plat approval5or Oakwood
Gates Addition and~ariance for 6 undersized lots covering property East of Dodd
Road. The City Attorney questioned Mr. Howard Stacker who was also present and
is the title owner of the property whether he would consent to the applications.
Mr. Stacker stated that Mr. Rabinson is negotiating regarding the completion of
the acquisition of the property and would not consent to the anplication until
those negotiations are complete. Smith moved and Wachter seconded the motion,
all members voted in favor to continue the application untilttie `-ee owner of the
property consents.
JOHN REMICH VARIANCE - AIGHVIEW ADDITION. The application of John and Piary
Remich for variancefor public street access for a single family dwelling on
Highview Avenue was not acted upon because the applicants were not present. Egan
moved and Murphy seconded the motion, all members voted in favor to continue the
application of Mr. and Mrs. John Remich to the next meeting.
rfICHAEL NEISIUS - DODD VIE4/ ADDITIOt7. Mr. Michael Neisius appeared on beF.dlf
of his application for conditional use permit for storage of motorfzed vehicles on
Lot 1, Block 4, Dodd View Addition. The APC recoumended approval subject to
certain conditions. Mr. Neisius stated that he would have his own trucks stored
on the property and 1n addition, two additional tractors owned by friends. A£ter
~ discussion, Egan moved and Smith seconded the motion, all members voted in favoi

to approve the application subject to the recommendations of the Advisory Planning
Commission, that the conditional use permit be limited to 5 years because the
development of the area is generally unknown at the present time and [hat the
landscaping be completed within two years of approval of the application; further,
that there be no more than lo vehicles stored on the property at any one time.
All voted in favor except Wachter who abstained.
THRIFT WAY LEASING COHPANY - CEDAR INDUSTRIAL PARK. Mr. Denats Besser appeare
on behalf of the applicatlon of Thrift Way Leasing Company for waiver from platting
regulations and conditional use permi[ for outside storage on part of Lot 1,
Block 3, Cedar Industrial Park. The AFC recommended approval. After discussion,
upcn motion by Smith and second by Wachter, it was resolved that the applications
be approved subject to the conditions imposed by the APC including the 1.5 acres
that was not included as part of the building or parking be seeded and maintained;
further that landscape plan, lighting plan, and drainage plan be approved by the
City ataff. All members voted in favor except Parranto who abstained.
EUROPEAN FI.OWER MARKETS - SIBLEY TERMINAL INDUSTRIPJ. PARK. I1r. Donald
Swenson appeared on behalf of the application of European Flower Market for 12 to
16 foot variaace from the front setback requirement for a proposed addition to the
European Flower Market proper[y in Sibley Termina= Industrial Park. The purpose
would be to expand the greenhouses to properly air condition and for conservation
of heating. It was noted that no variance was needed on the slde because of
completion of acquisition of the property lying adjacent to the existing building.
In addition, the application was for temporary waiver of plat with the understand-
ing that in the future the property would be replatted under procedures required
by the City. Smith moved and Egan seconded the motlon to approve the applicat:ion
for temporary waiver of plat for 60 days and for the variance requested, all
members voted in favor.

Dear Mr. Neisius:
This letter is written in response to your inquiry about installing an above ground fuel tank on
your property at 4855 South RobeR Trail and about constructing a horse bam. This letter pertains
to the above two properties.
The southerly of the two parcels (10-20900-010-04) is zoned GB, General Business. The
trucking operation that currently exists on this site is not listed as either a permitted or conditional
use in the GB zoning district, and is therefore, considered a non-conforming use. The Section
11.10, Subdivision 3 of the city's zoning ordinance (copy enclosed) allows for repair and
main[enance of a non-conforming use, but prohibits the expansion of a non-conforming use. The
proposed mstallation of a fuel [ank is considered an expansion of this non-conforming use and
would be conhary to the provisions of the city's zoning ordinance. This issue has been
previously addressed by City staff in a letter to you dated June 18, 1998, a copy of which is
enclosed for yourreference.
The northerly of the two parcels (10-20900-040-04) is zoned R-1, single-family residential. With
regard to the construction of a horse bam, neither the R-1 nor the GB zoning disfict allows the
keeping of horses. Therefore, the presence of horses on the property is also considered a non-
conforming use. While the horses may continue to remain on the property, the construction of a
horse barn would be considered an expansion of or improvement to a nonconforming use and
would be contrary to the provisions of the city zoning ordinance.

This letter is intended to serve as a follow-up to our 17 June meeting at which we discussed your
desire to ]ocate a fuel storage tank upon your property located at 4855 South Robert Trail. It is
understood that such storage tank would serve as an accessory to the trucking operation which
currently exists on the site. In our discussion, you raised question as to the acceptability of an
above ground or partially above ground fuel storage tank.
Beyond the issue of tank type, a more basic question exists in regazd to alteration of the existing
use. As you are likely aware, trucking operations are not listed as permitted or conditional uses
within GB, General Business zoning districts (applicable to your property). As a result, the use
in question is considered "legally non-conforming". In this regard, the foilowing ordinance
provisions aze considered applicable to your property.
Section 11.10 subd. 3.13
The expansion of an existing nonconforming use shall not be permitted,
and no land shall be used by any person or in any manner which is not in
Conformity with this chapter (the zoning ordinance).
Section 11.10 subd. 3.C
Except as provided herein, no nonconforming structure shal] be erected,
converted, enlarged, reconstructed, altered, or changed in any manner
which is not in conformity with this chapter. No structure shall be erected,
converted, enlarged, reconstructed, altered, or changed in any manner upon
any land upon which a nonconforming use is conducted.
Section 11.10 subd3.D
Routine maintenance and repair may be made to a nonconforming structure
or any structure upon land upon which a nonconforming use is conducted,
provide the market value of the structure does not increase as a result of such
maintenance or repair
It is the interpretation of the planning staff that the location of a fuel storage tank (above ground
or underground) upon your property would result in an expansion of the non-conforming use and
would be contrary to the provisions of the city's zoning ordinance.
While an obvious response to this "nonconforming" condition would be to rezone the property
(to an industrial designation), the City's land use plan suggests future residential use of the
property. Thus, an industrial zoning designation would not be considered consistent with the
City's comprehensive plan and long term land use objectives for the area.

Sec. 11.10. General proviaions.
Subd. 1. Applicafion.
A. In their interpretation and application, the provisions of this chapter shall be held W
be the minimum requirements for the promotion of the public health, safety, morals
and general welfare.
B. Where the conditions imposed by any provisions of this chapter are either more
restrictive or less restrictive than comparable conditions imposed by any other law,
City Code provision, statute, resolution or regulation of any kind, the regulations
which are more restrictive or which impose higher standazds or requirements shall
prevail.
C. Except as in this chapter specifically provided, no structure shall be erected, converted,
enlarged, reconstructed or altered and no structure or land shall he used for any
purpose nor in any manner which is not in conformity with this chapter.
Subd. 2. Separability. It is here6y declared to be the intention of the council that the several
provisions of this chapter are separable in accordance with the fn]]owing:
A. If any court of competent jurisdiction shall adjudge any provisions of this chapter to be
invalid, such judgment shall not affect any other provisions of this chapter not
specifically included in said judgment.
B. If any court of competent jurisdiction shall adjudge invalid the application of any
provision of this chapter to a particular property, building or structure, such judgment
shall not affect the application of said provision to any other property, building ar
structure not specifically included in said judgment.
Subd. 3. Nonconforming str¢ctures and uses.
A. Policy. It is the policy of the city that nonconforming structures and noncanforming
uses in time be eliminated due to obsolescence, exhaustion or destruction so as to
insure a uniform use of and within the districts established within this chapter.

nonconforming structure or any structure upon land upon which a nonconforming use

abandoned and thereafter ahall be discontinued, when any nonconforming structure
is not used or any nonconforming use is discontinued for a period greater than six

F. Variances. No provision hereunder shall preclude a request for a variance, as
governed by this chapter, for the erection or reconstruction of a nonconforming
structure. This provision dces not apply to any nonconforming usea.
i G. Scope oj application. The provisions of this subdivision shall apply to all eidsting
nonconforming uses or structures under the provisions of the Cade in effect prior to
the ett'ective date of Ordinance No. 189, which amended this subdivision to read as
provided herein.
Subd 4. Lot provisions• A duly created lot of record ahall be deemed a buildable lot,
provided all of the following aze met:
A, The lot shall have a minimum of 60 feet of frontage on a public street or the lot shall
have been approved in platting a condominium project or an attached dwelling project
wherein a contiguous lot, owned in common, provides said frontage.
B, There shall be no more than one prinapal building on one lot except when approved
as a part of a planned development.
C. The lot shall be capable of supporting a building(s).
D. The lot shall be of sufficient size to accommodate a building(s) within the minimum
required building setbacks for the particulaz zoning district in which it is Iceated.
Subd 5. Accessory buildings and structures. ,
A. Accessory buildings and structures related to a farming operation and on a farm may
be located anywhere on the lot, except that a building for housing more than two
animal units shall be not less than 50 feet fmm lot line and all buildings shall conform

Re: Fuel storage tank proposal
Dear Mike,
This letter is intended to serve as a follow-up to our 17 June meeting at which we discussed your
desire to locate a fael storage tank upon your property located at 4855 5outh Robert Trail. It is
understood that such storage tank would serve as an accessory to the trucking operation which
currently exists on the site. In our discussion, you raised question as to the acceptability of an
above ground or partially above ground fuel storage tank.
Beyond the issue of tank type, a more basic question exists in regard to alteration of the existing
use. As you are likely aware, trucking operations are not listed as perntitted or conditional uses
within GB, General Business zoning districts (applicable to your property). As a result, the use
in question is considered "legally non-conforming". In this regard, the following ordinance
provisions are considered applicable to your property.
Section 11.10 subd. 3.13
The expansion of an existing nonconforming use shall not be permitted,
and no land shall be used by any person or in any manner which is not in
Conformity with this chapter (the zoning ordinance).
Section 11.10 subd. 3.C
Except as provided herein, no nonconforming structure shall be erected,
converted, enlarged, reconstructed, altered, or changed in any manner
which is not in conformity with this chapter. No structure shall be erected,
converted, enlazged, reconstructed, altered, or changed in any manner upon
any land upon which a nonconforming use is conducted.
Section 11.10 subd.3.D
Routine maintenance and repair may be made to a nonconforming structure
or any structure upon land upon which a nonconforming use is conducted,
provide the market value of the structure does not increase as a result of such
maintenance or repair
It is the interpretation of the planning staff that the location of a fuel storage tank (above ground
or underground) upon your property would result in an expansion of the non-conforming use and
would be contrary to the provisions of the city's zoning ordinance.
While an obvious response to this "nonconforming" condition would be to rezone the property
(to an industrial designation), the City's land use plan suggests future residential use of the
property. Thus, an industrial zoning designation would not be considered consistent with the
City's comprehensive plan and long term land use objectives for the azea.

Road. The City Attorney questioned Mr. Howard Stacker who was also present and
is the title owner of the property whether he would consent to the applications.
Mr. Stacker stated that Mr. Robinson is negotiating regarding the completion of
the acquisition of the property and would not consent to the application until
those negotiations are coaplete. Smith moved and Wachter seconded the motion,,
all members voted in favor to continue the application untilthe _ee owner of the

European Flower Market property in Sibley Termina= Industrial Park. The purpose
would be to expand the greenhouses to properly sir conditlon and for conservation
of heating. It was noted that no variance was needed on the side because of
completion of acquisition of the property lying adjacent to the existing building.
In addition, the application was for temporary waiver of plat with the understand-
ing that in the future the property would be replatted under procedures required

This letter is wntten in response to your inquiry about installing an above ground fuel tank on
your property at 4855 South Robert Trail and about constructing a horse bam. This letter pertains
to the above two properties.
The southerly of the two parcels (10-20900-010-04) is zoned GB, General Business. The
trucking operation that currently exists on this site is not listed as either a permitted or conditional
use in the GB zoning disfict, and is therefore, considered a non-conforming use. The Section
11.10, Subdivision 3 of the city's zoning ordinance (copy enclosed) allows for repair and
maintenance of a non-conforming use, but prohibits the expansion of a non-conforming use. The
proposed installation of a fuel tank is considered an expansion of this non-conforming use and
would be contrary to the provisions of the city's zoning ordinance. This issue has been
previously addressed by Ciry staff m a letter to you dated 7une 18, 1998, a copy of which is
enclosed for yourreference.
The northerly of the iwo parcels (10-20900-040-04) is zoned R-1, single-family residential. With
regard to the construction of a horse barn, neither the R-1 nor the GB zoning district allows the
keeping of horses. Therefore, the presence of horses on the property is also considered a non-
conforming use. While the horses may continue to remain on the property, the construction of a
horse barn would be considered an expansion of or improvement to a nonconforming use and
would be contrary to the provisions of the city zoning ordmance.

Sec. 11.10. General provieions.
Subd. 1. Application.
A. In their interpretation and application, the provisions of this chapter shall be held to
be the minimum requirements for the promotion of the public health, safety, morals
and general welfare.
B. Where the conditions imposed by any provisions of this chapter are eithet more
restrictive or less restrictive than comparable conditions imposed by any other law,
) City Code provision, statute, resolution or regulation of any kind, the regulations
which are more restrictive or wtuch impose higher standards or requirements shall
prevail.
C. Except as in this chapter specifically provided, no strvcture shall be erected, converted,
enlarged, reconstructed or altered and no structure or land shall be used for any
purpose nor in any manner which is not in conformity with this chapter.
Subd. 2. Separability. It is hereby declazed ta be the intention of the council that the several
provisions of this chapter are separable in accordance with the following:
A. If any court of competent jurisdiction shall adjudge any provisions of this chapter to be
invalid, such judgment shaIl not affect any other provisions of this chapter not
specifically included in said judgment.
B. If any court of competent jurisdiction shall adjudge invalid the application of any
provision of this chapter to a particular pmperty, building or structure, such judgment
shall not affect the application of said provision W any other property, buffding or
structure not specifically included in said judgment.
Subd. 3. Nonconforming strrectures and uses.
A. Policy. It is the policy of the city that nonconforming structures and nonconforming
uses in time be eliminated due to obsolescence, exhaustion or destruction so as to
insure a uniform use of and within the districts established within this chapter.

nonconforming structure or any structure upon land upon which a nonconforming use .

E. A6aridonmertt. Any nonconforming structure or nonconforming use shall be deemed
abandoned and thereafter shall be discontinued, when any nonconforming structure
is not used or any nonconforming use is discontinued for a period greater than six
months for any reason.
F. Yariances. No pmvision hereunder shall preclude a request far a variance, as
governed by this chapter, for the erection or reconstruction of a nonconforming
structure. This provision dces not apply to any nonconforming uses.
i G. Scope of applicacion. The provisions of this subdivision shall apply to all existing
nonconforming uses or structures under the provisions of the Code in effect prior to
the effective date of Ordinance No. 189, which amended this subdivision to read as
provided herein.
Subd 4. Lot prouisions. A duly created lot of record shall be deemed a buildable lot,
provided all of the following are met:
A The lot shall have a minimum of 60 feet of frontage on a public street or the lot ahall
have been approved in platting a condominium project or an attached dwelling project
wherein a contiguous lot, owned in common, provides said fmntage.
B. There shall be no more than one principal building on one lot except when approved
as a paz't of a planned development.
C. The lot shall be capable of supporting a building(s).
D. The lot shall be of sufficient size to accommodate a building(s) within the minimum
required building setbacks for the particular zoning diatrict in which it ia located.
Su6d 5. Accessory brsildings and structures.
A Accessory buildings and structures related to a farming operation and on a farm may
be located anywhere on the lot, except that a building for housing more than two
animal units shall be not less than 50 feet fmm lot line and all buildings shall conform
l to yard regulations.

Dear Mike,
This letter is intended to serve as a follow-up to our 17 June meeting at which we discussed your
desire to ]ocate a fuel storage tank upon your property located at 4855 South Robert Trail. It is
understood that such storage tank would serve as an accessory to the trucking operation which
currently exists on the site. In our discussion, you raised question as to the acceptability of an
above ground or partially above ground fuel storage tank.
Beyond the issue of tank type, a more basic question exists in regard to alteration of the existing
use. As you aze likely aware, trucking operations are not listed as permitted or conditional uses
within GB, General Business zoning districts (applicable to your property). As a result, the use
in'question is_considered "legally non-conforming". In this regard, the following ordinance
provisions are considered applicable to your property.
Section 11.10 subd. 3.13
The expansion of an existing nonconforming use shall not be permitted,
and no land shall be used by any person or in any manner which is not in
Conformity with this chapter (the zoning ordinance).
Section 11.10 subd. 3.C
Except as provided herein, no nonconforming structure shall be erected,
converted, enlarged, reconstructed, altered, or changed in any manner
which is not in conformity with this chapter. No structure shall be erected,
converted, enlazged, reconstructed, altered, or changed in any manner upon
any land upon which a nonconforming use is conducted.

Section 11.10 subd.3.D
Routine maintenance and repair may be made to a nonconforming structure
or any structure upon land upon which a nonconforming use is conducted,
provide the mazket value of the structure does not increase as a result of such
maintenance or repair
It is the interpretation of the planning staff that the location of a fuel storage tank (above ground
or underground) upon your property would result in an expansion of the non-conforming use and
would be contrary to the provisions of the city's zoning ordinance.
While an obvious response to this "nonconforming" condition would be to rezone the property
(to an industrial designation), the City's land use plan suggests future residential use of the
property. Thus, an industrial zoning designation would not be considered consistent with the
City's comprehensive plan and long term land use objectives for the azea.

completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
The grant of the foregoing temporary construction easement for site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct and inspect site grading and the further right to remove
trees, brush, undergrowth and other obstructions. After completion of such construction,
maintenance, repair or removal, shall restore the premises to the condition in which it was found

I woke up morning thinking about our conversation yesterday. You provided some insightful
information on the history of this project and the property, in general. The particular
point of our conversation I was thinking about was the fact that the first phase of this
project, involving his neighbor to the south. Apparently, you knew that they were
directing the Justman runoff into our ditch and then back onto the neighbor's property for
treatment in a pond. You mentioned that they had done some work in the Mn/DOT ditch to
make this diversion and you commented on how they had put in erosion control blanket in
the ditch.
It is my understand that the Gun Club Lake WMO delegates authority to the City of Eagan
for projects within the city limits. If this is true (and it seems to be as other
projects have been reviewed by the City Engineer's office), I was thinking about was if
you knew they were doing that work in Mn/DOT R/W why didn't you advise them that they
needed to get a permit from us or why didn't notify us because you knew the nature of .Mr.
Neisius. I would also think that the County personnel, supposedly helping Mr. Neisius
with this design, would know that any time work is planned to be done in Mn/DOT R/W that
we should be notified or a permit should be applied for. This may be an isolated
incident, but I would like to see all of us work more closely together so the right thing
may be accomplished with water issues.
My problem now is to get things corrected and to obtain appropriate documentation.
I told Mr. Neisius (in person and in a letter) that Mn/DOT required plans, drainage
modeling computations, and documentation that his watershed authority had been provide
with project plans and they had approved of them. Mr. Neisius told me he was working with
the County on this project, but he neglected to tell me the entire scope of the
development. He had implied that there had been an earlier project with his neighbor that
the County had helped him on. I was told it involved a pond on his neighbor's property
and that pond outlet to a wetland. He never told me that the flow path of that stormwater
runoff went through our ditch to his neighbor's property.
It is my understanding that water flowing in a Mn/DOT ditch or even Mn/DOT ditches, in
general, are considered "waters of the State." It is also my understanding that any time
untreated water is allowed to flow into a Mn/DOT ditch there is potential for a pollution
violation. Mr. Neisius has untreated stormwater runoff flowing to the south and north
through Mn/DOT ditches. The fact that he has paved his parking area decreases the
possibility of sediment transfer, but strongly increases the possibility of deposits of
oil and grease into "waters of the State." The runoff from Mr. Neisius' property needs to
be treated prior to being conveyed to Mn/DOT R/W.
To date, I have not received any of the information or documentation that I had advised
Mr. Neisius that we needed. Our permits office has advise him that we will take action on
our R/W after 1 September 2008 to stop this potentially polluted water from entering our
R/W. Again, it is my understanding that there is little else we can do as he never
provided all the required information with his drainage permit application to obtain an
approval of the permit. He has continued to move ahead with the project even though he
had no permits what -so -ever for drainage or work to be conducted on Mn/DOT property. He
has ignored the advice provided and it appears that the project is now complete.
The problems are:
No detailed plans provided
No drainage computations provided
No runoff water treatment plan

Untreated stormwater runoff entering waters of the State Constructing a berm on State
Property Leaving exposed soil for well over 30 days with no erosion control measures (top
of berm) Lack of response to requests for documentation
There may be more problems that I am not aware of.
I would appreciate any help any of you could provide to bring Mr. Neisius into compliance
with this project.

We are applying for a permit to add to the berm in front of our shop to improve the
aesthetics of our trucking business. We want to plant 16 to 20 fifteen foot high evergreen
trees to hide our business from traffic on Highway 3. We are not re -directing any water.
Our run offwater has run through this area for over 30 years. When the water leaves our
parking lot it goes north in the ditch about 600 feet to a holding pond just north of Red
Pine Lane and Highway 3, then it flows into a small lake just north of that holding pond.
I estimate this project will cost between $12,000 to $15,000. It is getting late in the
season now so it will be completed in the spring of 2008. If there is any available help
we can get through MNDOT to cover the costs of the trees, etc. please let us know. We
are also getting a price from Bituminous Roadways to black top our truck parking lot
next spring. Out of respect for our neighbors I am sure they will appreciate that. When
the wind gusts and the lot is very dry the dust is a problem. For the winter we will cover
the berm with straw and seed and disc it in.

would like to make it clear that my job is not to design your drainage system. The
design and plan is your responsibility. My job is to check your design and plan against
required Mn/DOT standards. Based on these facts, I would recommend that you
consider the following in your design and plan.
1. Check the grade of the parking lot or re -grade it to make sure that stormwater
runoff flows to the outlet in the berm.
2. Remove the large corrugated metal pipe that was put in place without permission
from Mn/DOT.
3. Place a shallow catch basin structure on the east side of the parking lot at the
outlet in the berm.
4. Place a concrete, aluminized CSP, or HDPE pipe of the proper size determined
by hydraulics calculations at a grade no greater than .005 ft/ft slope (flatter would
be even better). The outlet invert should be at the same elevation as the ditch
bottom. An RC arch pipe may work also.
5. A safety apron MAY be required at the outlet in Mn/DOT Right -of -Way. Your
designer should be able to find this information for you.
6. Place some type of erosion control matting (ScourStop, Pyramat, cabled-
concrete mat, or equivalent) at the outlet in the ditch bottom to prevent scour
erosion. Use manufacturer's recommendations.

PARTIAL VACATION
That part of Hall Street, DODD VIEW ADDITION, according to the plat thereof on file at the
County Recorder's office, Dakota County,Minnesota, described as follows:
Beginning at the southwest corner of Lot 1, Block 4, said DODD VIEW
ADDITION; thence North 89 degrees 56 minutes 39 seconds East along the
northerly right-of-way line of said Hall Street, a distance of 227.75 feet to the
southeast corner of said Lot 1; thence southerly 64.65 feet along the southerly
extension of the east line of said Lot 1, on a nontangential curve concave easterly,
having a radius of 2014.86 feet,a central angle of 01 degree 50 minutes 19 seconds
and a chord, which bears South 21 degrees 48 minutes 00 seconds West for 64.65
feet,to the southerly right-of-way line of said Hall Street; thence South 89 degrees
56 minutes 39 seconds West along said southerly right-of-way line a distance of
280.61 feet to the northwest corner of Lot 1, Block 3, said DODD VIEW
ADDITION; thence North 12 degrees 33 minutes 59 seconds East, along the
northerly extension of the west line of said Lot 1, Block 3 a distance of 30.75 feet
to the centerline of said Hall Street; thence North 89 degrees 56 minutes 39
seconds East along said centerline, a distance of 63.46 feet to the southerly
extension of the west line of said Lot 1, Block 4; thence North 12 degrees 37
minutes 18 seconds East along said southerly extension, a distance of 30.75 feet
to the point of beginning.
