Whenever a lawful non-confonning structure shall have been damaged by fire, flood, explosion, earth- quake, tornado, war, riot, or act of God, it may be reconstructed and used as before if it is reconstructed within 12 months after such event, unless the damage to the building or structure is 50 percent or more of its fair market value as shown on the assessor's records at the time of damage in which case the whole thereof shall be for a use in accordance with the provisions of this Code. E. Abandonment. Any noncon£orming structure or nonconforming use shall be deemed abandoned and thereafter shall be discontinued, when any nonconforming structure is not used or any naiconforming use is discontinued for a period o eater than one year for any reason. F. Variances. No provision hereunder shall preclude a request for a variance, as governed by this chapter, For the erection or reconstruction of a nonconforming structure. This provision does not apply to any nonconforming uses. G. Scope of application. The provisions of this subdivision shall apply to all existing nonconforming uses or structures under the procisions of the Code in effect prior to the effective date of Ordinance No. 189 (November 17, 1994), wliich amended this , subdivision to read as provided herein. 'Fhe feasibility report did not include Farm Road from Dodd Road to Trunk Highway #3. At the public hearing, it was brought to the attention of the City Council that Farm Road be included in the project. Council directed staff to contact the residents along Farm Road to see if they desired inclusion in the proposed improvements. Attached is a"Waiver of Hearing of Special Assessment" for your consideration and signature. The attached "Waiver" identifies the approximate cost of the overlay improvement to your parcel. The proposed assessment will be spread over 3 years at an annual interest rate, yet to be determined. Typically the interest rate has been in the 9-11$ range, dependent upon the bond rate used to finance the project. Please contact/return the "Waiver" prior to July 27, 1988, to the City Engineering Department. It is important to contact the City Engineer's office prior to July 27, 1988 so the Farm Road portion can be included in the Contract Bid documents.
