existing conimercial/industrial use is non-conforming in the R-1 zoning distric[ and as
such, is subject to the City's nonconfonning uses ordinance. Neither the expansion of the
facility nor the type of shvcture you propose is allowed on this site. Additionally, the
Ciry cannot consider either a variance or an interim use pennit to allow it because both
would be contrary to city ordinances which prohibit the expansion of a nonconforming

contiguous ]ots shall be considered to be an undivided parcel for the purpose of this
chapter. If part of the parcel is sold, the sa]e shall constitute a self-created liardship
under the variance provisions of this chapter.
Subd. 4. Requ.ired yards and oyeiz space.
A. WUenever a park or play area is so located that it abuts on a public right-of-way or
railroad right-of-way, either a landscaped ,yard area of at least 30 feet shal] maintained
frmn such right-of-way and tlie nearest developed play space, or a fence in conformity
with subdicision 20 of this section, or similar barrier inay be used. This section shall
apply to all public and private parks, scliools, churches and areas where play areas are
provided.
B. No yard or open space existing upon the effective date of this section shall be reduced
in area or dimension so as to make such yard or other open space ]ess than the
minimum required by this section.
C. The counci] may waive the required side yard setback requirement in all districts, if
two legal lots of record are held in one ownership and are combined by tl:e county
assessor as one tax parcel.
D. The foilowing shall not be considered as encroachments on required yard setUacks:
1. Air conditioning or heating equipment, chimneys, flues, sills, pilasters, ]intels,
ornamental features, cornices, eaves, gutters, and similar featiu-es, provided they
do not project more than 30 inches into the required yard.
2. Decks, patios, balconies, stoops, or other similar features provided they do not
extend more than 30 inches above the fiiushed grade and a distance greater than
eight feet into a required front yard, five feet into a required side yard.and five
feet into a required rear ,yard and provided they do not encroach upon a.public
easement.
3. In rear yards, recreational equipment and clothes lines, a~,-bors and treltises,
gazebos, Ureezeways, detacbed accessory buildings, air conditioning and heating
equipment may encroach to a point not less tlian five feet from the rear lot line.
Subd. 5. Accessory buildings, sb-uctures and uses.
A. General standards.
1. No accessory building or structure other than a fence or a temporary construction
office shall be permitted on any lot in a residential zoning district prior to the
time of construction of the principal building to which it is accessoiy, except a
residential garage, Nvhich prior to the construction of a residence can be used only
. for storage purposes pertaining to and until the completion of tlle main structm•e.
2. Accessory buildings g-eater than 150 square feet in size shall eshibit finish
?iaterials similar and compatiUle to those utilized on the principal building and
match the principal building in color.

3. Accessory buildings shall be maintained in a manner that is compatible with
adjacent uses and does not present a hazard to public'health, safety and general
welfaze.
B. Agricultura] uses. Buildings and structures accessoiy to £arming operations are
exempt from the requirements of this subdivision except that a building containing
more than two animal units shall not be less than 50 feet from a lot line.
C. Detached single family uses.
1. No accessory use or building shall be allowed withi? a required front yard
setback. With the exception of an attached garage, no accessory buiiding or
structure may be placed within the front yard.
2. No building permit sliall be issued for more than two detached accessory
buildings for each single family dwelling.

D. Other uses.
1. Buildings and structures accessory to uses other than farms and single fainily

detached dwellings shall not exceed the district height liinit or tlie height of the
principal building, whichever is less, except as otherwise allowed by this chapter.
E. Swimming pools. .
1. The interior vertica] wall of swimming pools shall not be closer than five feet to
any side or rear lot line.
2. Swiimning pools shall be located in the side or rear yard and shall not Ue located
within any required front yard setback.

3. NO swinuning pool shall be located Ueneath or within ten feet of any overhead
utility lines or over any underground utility lines.
4. All outdoor swimming pools sliall Ue cmnpletely enclosed by a security fence or
wall at least four but not more than six feet higli and located at least four (4) feet
from the edge of the pool. The bottom of the fence or wall shall be no higlier than
four inches above the surface of the ground. Fence openings or points of eiitiy to
the pool area shall be equipped witli self-closing and self-latching lockable gates.
5. No swinuning pool shall be used, kept, maintained or operated in such a manner
as to constitute a nuisance or as to be liazardous to health, life or property. All
swimming pools sliall have and operate adequate equipment to filter and
otherwise keep t6e water clean and free from contamination.
Subd. 6. Taffi.c aisibility. On all corner lots in all districts, no structure or planting in
excess of 30 inches above the abutting curbline shall be permitted within a triangular area
defined as follows: beginning at the intersection of tlie project ciu•blines of two intersecting
streets, thence 30 feet along one curb diagonally to a point 30 feet from the point of beginning
of the otlier curbline, chence to the point of beginning.
SuGd. 7. Public utility seruice. It is unlawful for any person to install, construct, erect, alter,
revise, reconstruct or move any pipeline, underground teleplione line, undergromnd electric
transmission line, and overhead electric transnussion line including structures related thereto
or any other puUlic utility device or related structure, without first obtaining a written periuit
from the city. All persons obtaining a written permit pursuant to this subdivision shall be
subject to those standards and regulations set forth in and as a condition of the permit issued
pursuant to this subdivision. In issuing said permit, the city shall find that: ,
A. ' The proposed' location of the essential service shall not uiu-easonably interfere with .
future land use of the'city.
B. Tlie depth of any buried essential services shall be at a depth that will not cause future
probleuis with roads, streets, utilities or buildings.
C. The width of any linear easements or rights-of-way slizll not Ue sucli that it will
unreasonably interfere with future land use.

in or on any public lands or rights-of-way without approval by the wuncil.
Subd. 9. Naaconfonniiig structures ar2d uses.
A. Policy. It is the policy of the city that nonconforming structures and nonconforming
uses in time be eliminated due to obsolescence, exhaustion or destruction so as to
insure a uniform use of and within the districts established within this chapter.
B. Expansion of use. The expansion of 2n existing nonconforming use shall not be
permitted, and no land shall be used by any person or in any manner which is not in
conformity with this cUapter.

C. Alteration or enlargement of structure. Except as provided herein, no nonconforming
structure shall be erected, converted, enlarged, reconstructed, altered, or chaziged in
any manner which is not in conformity with this chapter. No structure shall be erected,
converted, enlarged, reconstructed, altered, or changed in any manner upon any land
upon which a nonconfonning use is conducted. ,
D. Maintenance and repair. Routine maintenance and repair may be made to a noncon-
forming structure or any structure upon land upon which a nonconforming use is
conducted, provided the repairs are nonstructura] in nature. Whenever a lawful
non-confonning structure shall have been damaged by fire, flood, explosion, earth-
quake, tornado, war, riot, or act of God, it may be reconstructed and used as before if
it is reconstructed within 12 months after such event, unless the damage to the
building or structure is 50 percent or more of its fair market value as shown on the
assessor's records at the time of damage in which case the whole thereof shall be for a
use in accordance with the provisions of this Code.
E. Abandonment. Any noncon£orming structure or nonconforming use shall be deemed
abandoned and thereafter shall be discontinued, when any nonconforming structure is
not used or any naiconforming use is discontinued for a period o eater than one year
for any reason.
F. Variances. No provision hereunder shall preclude a request for a variance, as governed
by this chapter, For the erection or reconstruction of a nonconforming structure. This
provision does not apply to any nonconforming uses.
G. Scope of application. The provisions of this subdivision shall apply to all existing
nonconforming uses or structures under the procisions of the Code in effect prior to the
effective date of Ordinance No. 189 (November 17, 1994), wliich amended this ,
subdivision to read as provided herein.

We are requesting a permit to erect a 26' x 30' poly clear span canvas sheltec This is not
a permanent building with foundation but rather anchored to large concrete blocks. I've
enclosed information from the manufacturer for you.
The building would be located behind our current facility and out of sight from Highway
3. It has a life expectancy of IS yeazs but I would be willing to have the permit reviewed
after 5 yeazs.
We will use the shelter to house our snow removal equipment and other implements.

At the June 7, 1988 Eagan City Council meeting, City staff
presented a feasibility report identifying approximate costs for
a bituminous overlay of Dodd Road from Cliff Road to Farm Road.
'Fhe feasibility report did not include Farm Road from Dodd Road
to Trunk Highway #3. At the public hearing, it was brought to
the attention of the City Council that Farm Road be included in
the project. Council directed staff to contact the residents
along Farm Road to see if they desired inclusion in the proposed
improvements.
Attached is a"Waiver of Hearing of Special Assessment" for your
consideration and signature. The attached "Waiver" identifies
the approximate cost of the overlay improvement to your parcel.
The proposed assessment will be spread over 3 years at an annual
interest rate, yet to be determined. Typically the interest rate
has been in the 9-11$ range, dependent upon the bond rate used to
finance the project.
Please contact/return the "Waiver" prior to July 27, 1988, to the
City Engineering Department. It is important to contact the City
Engineer's office prior to July 27, 1988 so the Farm Road portion
can be included in the Contract Bid documents. If you have any
questions or feel you need additional information, please contact
the City Engineer's office at 454-8100.
Also, included for you'r information is a copy of the feasibility
report prepared for podd Road.

Dear Mr. i.acson:
You have asked whether a building permit would be issued by the City of
Eagan to a proposed buyer of Lot 5, Block 3, Dodd View Addition along
Highway I13, which I understand will be used for the identical purpose
that thc property is currently being used for.
Under Eagan Ordinance 1152, it would be my opinion that a building per-
mit could be issued for an expansion of that use under the non-conform-
ing use clause of Ordinance 1I52 providing the use of the property by the
buyer would be similar to the current use. Under the General Business
District category, outdoor sales or storage of motorized vehicles is a
conditional use and if there is no change in the current use, a build-
ing permit will be issued providing it complies with all other require-
ments of the City.
However, this letter is conditioned upon the aubmission of a letter signed
by the buyer describing the intended use of the property and verifying
that it will be identical to the present use.
