PERTINENT REGUTATIONS '
Safety •
1. Traffic shall be allowed to pass and to be protected at all times. If it is not
possible to allow traffic to pass, a suitable detour must be provided and plans
submitted to the Director of Public Works 72 hours in advance.
2. Barricades shall be erected in a manner which will provide suitable visibility in all
directions. All barricades shall be in good condition, and all signs shall be of such
size and legibility to provide adequate warning to oncoming traffic. At least two 7"
flashing amber lights shall be mounted on each end barricade with one on an advance
warning sign.
3. Excavations must be shored or sheeted when necessary to prevent under-mining of
roadway, trailways, utilities, or for safety reasons.
4. Guys or stays shall not be attached to trees on right-of-way or private property
without written permissfon.
5. Flagmen shall be furnished by the party or organization performing the work whenever
the work being done creates a hazard either to the traffic using said road or the
personnel engaged in the construction, or when directed to do so by the City.
OPERATIONS

progress in the custody of the individual in charge, and sha11 be exhibited upon
request made by any City official.
2. Provisions and Specifications--These general provisions, specifications and Std. Plate
P-1 shall be considered as forming an integral part of each and every permit issued for
operations within Eagan. The work authorized by this permit shall be done at such time
and in such manner as shall be consistent with the safety of the public and shall
conform to all requirements and atandards of the City. If at any time it shall be
found by the City that the work is not being or has not been properly performed, the
permittee, upon being notified by the City, shall immediately take the necessary steps,
at his own expense, to place the work in condition to conform to said requirements or
standards.
3. Execution--The permittee ahall use diligence in the execution of the work authorized
under this permit in order not to endanger or unnecessarily obstruct travel along any
road or trailway. Operations shall be so conducted at all times as to permit safe and
reasonable free travel over the roads and trailways within the limits of the work

subsequent to completion of_street repair to protect the City from defects in

b. The applicant shall furnish evidence of puhlic liability insurance of not less
than $100,000/300,000 and property damage of not less than $25,000 issued by an
insurance company authorized to do business in the State of Minnesota on which
the City is named as an additional insured party.
c. Except for the negligent acts of the City, its agents and its employees, the
permittee shall assume all liability for, and save the City, its agents and its
employees, harmless and defend same at its sole cost and expense from any and all
claims for damages, actions or causes of action arising out of the work to be
done herein and the continuing uses by the permittee, including but not limited
to the placing, constructing, and reconstructing, maintaining, pxotecting and use
of said facility under this application and permit for construction.
5. Existing Facilities--The utility facility and installations shall not interfere with
any existing utility facility on the City's right-of-way or easements. It is the
responsibility of the applicant to call for necessary locations of existing utilities.

6. Private Property--The work permit or permit for construction as iasued does not in any
way imply an easement on private property.
7. Quality of Work--Finished surface, base and sub-base of road or trailway upon •
completion of work shall be at least equal to or bettex than specifications of
originally provided road or trailway in accordance with City Standard Specifications.
Surface shall be finished within 48 hours unon comvletion of backfill
8. Cutting Trees--The permission herein granted does not confex upon the permittee the
right to cut, remove or destroy trees or shrubbery within the legal limits of the
right-of-way, easements that are not specifically identified on the plan attached to
this permit or relieve permittee from obtaining any consent otherwise required from the
owner of the property adjacent thereto.
9. Drainage--All waterways and lines of drainage sfiall remain operative.
10. Pole Anchors--Pole anchors, anchors, braces or other construction will be pexmitted
within right-of-way or easements and will be approved on a case by case basis.
11. Driving Limitations.
a. Driving or parking on City trails or sidewalks shall only be permitted for those
operations requiring direct access to the boulevard area.
b. Vehicles operating or parked within the right-of-way area shall utilize their
warning flashers at all times.
c. Vehicles driving on trails or sidewalks shall not operate in excess of 5 miles
per hour. Vehicles shall operate at slower speeds when weather conditions, trail
conditions, poor visibility, obstructed sightlSnes or other conditions xequire
special precautions to ensure the safety of trail users and the general public.
d. Driving shall not be permitted within those bouievard areas where dsmage to turf
trailways or other infrastructure may occur.
e. Vehicles shall not be parked on trails or sidewalks in such a manner as to
unnecessarily impede the safe and efficient use of trailways by the general
puhlic.

1. Curb and Gutter shall be removed only after saw cutting at joints and replaced

Better Business Bureau or the City of Eagan. Similarly, Tri-Land has not contacted us in response
to our request to address your problem.
I regret that you have been unable to get any response from this builder/developer, much less a
satisfactory one. I'm not aware of what else we can do other than to keep this unfortunate incident
and unresponsiveness as a matter of record and, hopefully, be able to review it the next time the City
has an opportunity to deal with this company.
If through some opportunity you are able to obtain any response or, hopefully, a satisfactory
resolution, I would be very interested in being so informed.

date, I have not heard from Tri-Land, and as you can see from the enclosed copies, the Better

business within this area. Other home owners within the Summer Place Addition have also
expressed their displeasure with this company, mainly with a water runoff problem. I can only
suggest that you carefully monitor, and seriously consider, any future dealings with this

SUBJECT: Replacement of Landscaping
In a letter from the City of Eagan, dated April 19, 1994, you were advised to notify the
affected property owners and have the berm along Dodd Road modified to conform to the
City's request. Shortly thereafter a construction crew chopped off half of the berm. Because
you failed to notify me, I lost $400 worth of rock that I had used to landscape the berm with.
ThaYs not counting the plastic, edging, and labor involved in that project. When I contacted
you on that date, you said that you would fix it up as before because you had landscapers that
worked for you.
In the fall of 1994, the construction along Dodd Road was completed. After a few tries
to reach you, and when we did finally talk, we agreed to wait until spring because of the fresh
sod placed along the roadway and bike path. This spring, after some phone calls, someone
from your crew showed up with a bobcat and planted 3 lilac bushes. We discussed how best
to level off the piles of dirt and rock, and replace the plastic, edging, and rock. All 1 wanted to
do was stop the weeds. That action took place on April 14, 1995, and we haven't had any
action since. I've called you every couple of weeks to see what you have planned. My wife
and i finally leveled off the dirt and rock around the lilac bushes so they could start growing
again. Then we dug out the half buried edging and replaced that along the sod line. Around
Memorial Day you said you'd be out to look over the berm and see what could be done.
Never heard from you after that, and I have left some messages for you on your answering
machine. We spread out what little rock we had left, but with no weed-guard fabric and very
little rock, the weeds are growing real nice.
I expect the berm to be repaired back to its former self and I would appreciate timely
action on your part. I'm sure you would agree that this has dragged on long enough.

' In a letter dated September 1, 1993 from John Wingard, you were notified of the required
, berm removal that has been constructed partially on Dodd Road right-of-way located on
the rear lots of Summer Piace 2nd Addition.
j This berm removal is a requirement prior to the construction of Dodd Road which
~ includes an 8 foot bituminous trail located in the west boulevard of Dodd Road. The
Dodd Road reconstruction bid date has been set for May 13, 1994 which means
approximately 3 weeks from that date construction work could begin.
It is your responsibility within 30 days of this date to properly notify the affected property
owners and have this berm removed as per the cross sections attached in the letter of
I September 1, 1993.
~I Fnal acceptance for Summer Piace 2nd Addition will not be processed untii this berm
situation is rectified.

This Agreement, made and entered into the day

of L , 1990, by and between the CITY OF EAGAN, a
municipality of the State of Minnesota, (hereinafter called the
City), and the Owner and the Developer identified herein.
The terms "Developer" and "Owner" as used herein refer to:
TRI-LAND DEVELOPMENT, INC., whose address is 1875 Plaza Drive, #200,
Eagan, Minnesota 55122.
WHEREAS, the Developer has applied to the City for approval of
the plat or subdivision known as StJMMER PLACE SECOND ADDITION,
located within the City; and
WHEREAS, the Owner and Developer agree to notify the proposed
potential buyers of all lots within SUP44ER PLACE SECOND ADDITION that
Lots 1-8, Block 1 and Lots 1-13, Block 2, are in a high water
pressure zone and a pressure reducing valve shall be installed in
each home below the elevation of 966 feet. All costs shall be the
responsibiiity of the Owner and Developer and shall be installed to
prevent damage due to high water pressure.
NOW, THEREFORE, the City, Owner and Developer agree as follows:
1. Recordinp. This agreement shall be recorded with the Dakota
County Recorder so as to provide notice to the owners of Lots 1-8,
Block 1 and Lots 1-13, Block 2. The Owner shall provide and execute
any and all documents necessary to implement the recording of this
agreement.
2. Notice. The recording of this document shall constitute notice
to all owners and future owners of property in the SUMMER PLACE
SECOND ADDITION subdivision that Lots 1-8, Block 1 and Lots 1-13,
Block 2 are in a high water pressure zone and that a pressure
reducing valve shall be installed in each home below the elevation of
966 feet. All costs shall be the responsibility of the Owner and
Developer and shall be installed to prevent damage due to high water
pressure.
3. Validitv. If any portion, section, subsection, sentence,
clause, paragraph or phrase of this agreement is for any reason held
to be invalid, such decision shall not affect the validity of the
remaining portion of this Contract.
4. Bindina Agreement. The parties mutually recognize and agree
that all terms and conditions of this recordable agreement shall run
with the land herein described and shall be binding upon the heirs,
successors, administrators and assigns of the owners and developers
referenced in this Contract.
