The question is whether the existing deck can be replaced to its current size and configuration, or if the replacement deck is required to meet the 5'side yard setback.After reviewing City records, I have concluded that the existing deck may be replaced,and is not subject to the typical 5' side yard setback. However, it is the property owner's responsibility to locate the east side lot line,and demonstrate that the deck is within their own property. Please note this with issuance of the Building Permit. My conclusion in regard to the setback is based on the following: • The lot is part of the Fawn Ridge subdivision,which is in the Lexington South Planned Development. • The Planned Development designates this area for single-family use. • The 1990 Planned Development summary report identifies that lots below the typical 12,000 s.f. minimum size were allowed in this PD; and this lot is 8,230 s.f. • While there is no mention of the PD allowing reduced setbacks,there are several houses/garages in this neighborhood that are clearly at less than the 5'or 10'side yard setback, as evidenced by the surveys provided for initial construction on file in the parcel records. • There is no public d/u easement along the east side of this property, so allowing the deck at less than a 5' setback would not encroach into an easement.
