Winter Recreation Leaders --Since the last City Council meeting, it has been necessary for the City Administrator to approve the hiring of the following seasonal winter recreation leaders in order to staff the skating ponds and sliding hills: Kristopher Cavanaugh, Bryan Crepeau, Ken Fry, Rob Helebrandt, Brian Kapferer and Kristina Kapferer. ACTION TO BE CONSIDERED ON THIS ITEM: To ratify the hiring of Kristopher Cavanaugh, Bryan Crepeau, Ken Fry, Rob Helebrant, Brian Kapferer and Kristina Kapferer as seasonal winter recreation leaders. Item 2. Assistant Utility Billing Clerk—Approximately 200 applications were received for this position. After screening of the applications, approximately 100 applicants were invited in for testing at the municipal center. Seventeen of those candidates will be interviewed on Tuesday, January 4, 1994. It is the intention of the interview panel to select five candidates for a final interview with the Director of Finance and Assistant Director of Finance It would be appropriate at this time for the Council to approve the hiring of the person who will be recommended for hire as Assistant Utility Billing Clerk. ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of the person to be recommended by the Director of Finance as the Assistant Utility Billing Clerk. PLUMBERS' LICENSES B. December, 1993 Project Childsafe 1549 University Ave. W., Suite 110, St. Paul, My 55104 (612) 646-2314 (800) 488-8874 _ Fax (612) 646 - Dear City Official: Motor vehicle crashes are the leading cause of death of Minnesota's children once past infancy and are responsible for significant numbers of severe and often disabling injuries. In 1992,12 children (Birth through 10 years old) died m motor vehicle crashes and 1,904 more were injured in Minnesota. More than 70% of these deaths and injuries could be prevented if children were properly restrained in a child car seat and 50% could be prevented if children were properly restrained in a seat belt. Minnesota's laws requiring children under the age of four to be secured in a child car seat and children ages four to eleven to wear a seat belt have made an impact on usage rates. However, restraint use is still low as measured in crash reports. In 1992, only 43 percent of children 0 to 3 years old and 50 percent of children 4 to 10 years old with minor to severe injuries were properly restrained. Of the deaths in 1992, only 50 percent of children Birth to 3 years old and 25 percent of children 4 to 10 years old were properly restrained. Project Childsafe is a public information, resource and referral contact for child passenger safety. Our program provides educational materials, technical expertise, speakers, displays, car seat clinics, and a short-term child car seat loaner program. We also maintain an up-to-date directory of all loaner programs in the state and a "Child Car Seat Recalle list February 13.19, 1994, is National Child Passenger Safety Awareness Week. This week is dedicated to children all around the country and the hope that we can keep them safe from injury while traveling in motor vehicles. Governor Arne Carlson will be declaring the same week as Minnesota Child Passenger Safety Awareness Week at a press conference on Sunday, February 13. The event will be held at the Minneapolis/St. Paul Airport. An announcement will also be made about the airport's new car seat rental program. We need your support. Please join the Governor by declaring Child Passenger Safety Awareness Week in your may, and, ifpossible, encourage your local media to cover your signing ceremony. The signing can take place any day that week or the dates for the week can be changed to fit your needs. Enclosed is a sample proclamation, other sample materials, and ideas to promote the week in your community. Your local media will be sent a press kit on February 2, please entourage them to use the materials. Licenses, Service Station, Tobacco & Off -Sale, Non -Intoxicating Liquor, Cedarvale Texaco Food Mart, 3830 Sibley Memorial Highway --Applications have been received of Hussein Ansari for a service station permit, tobacco license and non -intoxicating malt liquor license for the Cedarvale Texaco location, the former Rax Restaurant site. A copy of each application is enclosed without page number for your review. Also enclosed on page is a memorandum from the Finance Department regarding these applications. As noted in the memorandum, the City does not allow the same owner to hold more than one on or off - sale liquor license. Mr. Ansari is the owner of Mediterranean Cruise restaurant which currently holds an on -sale liquor license. The code does not prohibit multiple ownership of an on -sale liquor license and off -sale, non -intoxicating malt liquor licenses. However, staff felt it appropriate to inform the Council of this circumstance. He has applied for a service station permit, a license to sell tobacco products and an off - sale non -intoxicating malt liquor license. Eagan City Code does not allow multiple ownership of On and or Off -sale liquor licenses but does not address On -sale with an Off -sale non -intoxicating malt liquor license. Investigator John Stevenson, will be reviewing the beer application and will make a recommendation to the Council. Agenda Information Memo January 4,1994 City Council Meeting RESOLUTION/AMENDMENTS TO DECLARATION OF TRUST/ MINNESOTA MUNICIPAL MONEY MARKET FUND F. Resolution, Authorizing Execution of Proxy in Favor of Certain Amendments to the Declaration of Trust of the Minnesota Municipal Money Market Fund—In October of 1989, the City Council approved a resolution authorizing entry into a joint powers agreement in the form of a declaration of trust establishing an entity known as "Minnesota Municipal Money Market Fund" and authorizing participation in certain investment programs in connection therewith. The 4M Fund was established to provide a means through which municipalities may jointly and cooperatively exercise their power to enhance their investment opportunities pursuant to an investment program conducted in accordance with State law. The Technical Advisory Board of the 4M Fund recently proposed to the 4M Fund Board of Trustees certain changes in the 4M Fund Trust Document. The changes require a vote of the participants. The following three (3) changes have been recommended for approval by the Trustees: 1) Authority is given which would permit the Board of Trustees to create multiple investment portfolios within the fund. 2) The limitation which currently restricts investments to a maturity date of not more than one year is changed to allow the use of floating rate government and agency securities with maturities of three years or less if there is a coupon reset period within 397 days of the date of the 4M Funds purchase thereof. 3) The portfolio manager would be given authority to use reverse repurchase agreements in the fund for up to 25% of total assets. CITY OF EAGAN RESOLUTION AUTHORIZING EXECUTION OF PROXY IN FAVOR OF CERTAIN AMENDMENTS TO THE DECLARATION OF TRUST OF THE MINNESOTA MUNICIPAL MONEY MARKET FUND BE IT RESOLVED by the City Council of the City.of Eagan, Minnesota as follows: Section 1. $ackground 1.01 The City of Eagan is a participant in the Minnesota Municipal Money Market Fund (4M Fund), by reason of its approval of a joint powers agreement in the form of a Declaration of Trust. 1.02 The City has been asked to consider certain amendments to the Declaration of Trust of the 4M Fund. 1.03 The City has reviewed and considered the proposed amendments to the Declaration of Trust as described in the attached proxy statement and amended Declaration of Trust. Resolution, Giving Final Approval to the Issuance of the Multi -Family Housing Revenue Refunding Bonds, Aspen Woods of Eagan --A public hearing was held and a resolution giving preliminary approval to the issuance of multi -family housing revenue refunding bonds, Aspen Woods of Eagan, was approved. A decision had not been reached at that time regarding the final form of the financing; consequently, only preliminary approval was given. It has now been determined that the issuing will be floating rate transactions and final documents are being prepared. ACTION TO BE CONSIDERED ON THIS ITEM: To approve the resolution giving final approval to the issuance of multi -family housing revenue refunding bonds - Aspen Woods of Eagan. Agenda Information Memo January 4, 1994 City Council Meeting MEDIA EQUIPMENT SERVICE CONTRACT II. Consideration, Media Equipment Maintenance Service Contract—Staff is soliciting quotations for a service contract to provide maintenance of the Council Chamber media equipment. Service to date has been covered under one-year warranties from the installation of the equipment. As the warranties expire, additional service may be necessary. Staff is in the process of soliciting quotations for the service contract. The quotations received and the lowest qualified bid will be presented to the City Council no later than the Additional Information packet on Monday. ACTION TO BE CONSIDERED ON THIS ITEM: To approve a maintenance service contract for the City Council Chamber media equipment with a firm to be designated. Agenda Information Memo January 4, 1994, City Council Meeting RECEIVE FEASIBILITY REPORT/ORDER PUBLIC HEARING (OSLUND TIMBERLINE ADDN) L Project 643, Receive Feasibility Report/Order Public Hearing (Oslund Timberline Addition - Street Rehabilitation) --In accordance with the schedule for the 1994 street reconstruction program, the staff would like to present the feasibility report for the above - referenced project and request the City Council to schedule a formal public hearing to be held on February 1, 1994. Enclosed without page number is a copy of the preliminary feasibility report as revised based on comments received from the informational neighborhood open house meeting held on November 30. Staff would be happy to informally review any aspect of this project prior to the public hearing at the Council's discretion. RESOLUTION RESTRICTING PARKING, APPROVING PLANS & REQUESTING MUNICIPAL STATE AID (LONE OAK RD & LEXINGTON AVE INTERSECTION UPGRADE & SIGNALIZATION) J. Project 607A, Resolutions Restricting Parking, Approving Plans & Requesting Municipal State Aid Financing (Lone Oak Road & Lexington Avenue - Intersection Upgrade & Signalization)--Staff has applied for Municipal State Aid Street (MSAS) financing to help fund the roadway improvements and signalization of the above -referenced intersection. In order to receive MSAS funds, the City must pass a Resolution restricting parking on Lexington Avenue (Lone Oak Road Resolution adopted August 6, 1991), approve the detailed plans and request Municipal State Aid financing. Enclosed on pages and ti are copies of the proposed Resolutions being offered for Council's nsideration. ACTION TO BE CONSIDERED ON THIS ITEM: Approve Resolutions for Project 607A (Lone Oak Road & Lexington Avenue - Intersection Upgrade & Signalization) restricting on -street parking, approving detailed plans and requesting MSAS financing, and authorize the Mayor and City Clerk to execute all related documents. CITY OF EAGAN RESOLUTION RELATING TO PARKING RESTRICTIONS ON MSAP 195-111-03 (CP 26-19) on Lexington Avenue (County Road 43) from 250 feet south of Clubview Drive to CSAH 26 (Lone Oak Road) in the City of Eagan, Minnesota. THIS RESOLUTION, passed this 4th day of January, 1994, by the City of Eagan in Dakota County, Minnesota. The Municipal Corporation shall hereinafter be called the City, WITNESSETH: WHEREAS, the City and Dakota County have planned the improvement of County Road 43 (Lexington Avenue) from 250 feet south of Clubview Drive to CSAH 26 (Lone Oak Road); and WHEREAS, the County and City will be expending State Aid Funds on the improvement of this highway, and WHEREAS, this improvement does not provide adequate width for parking on both sides of the road; and approval of the proposed construction as a State Aid Highway project must therefore be conditioned upon certain parking restrictions. NOW, THEREFORE, IT IS THEREBY RESOLVED: That the City, shall ban the parking of motor vehicles on both sides of County Road 43 (Lexington Avenue) from 250 feet south of Clubview Drive to CSAH 26 (Lone Oak Road) at all times. APPLICABLE REGULATIONS: Chapter 13, Section 13.40, Subd. 3, Waivers. PROPOSAL: The Woodlands 4th Addition (Final Plat approval October 19,1993) finalized development adjacent to Outlot C, Great Oaks. This outlot which was dedicated for utility and drainage purposes was required as a Condition of Plat Approval for The Woodlands 4th Addition to be incorporated with other lots. This Waiver of Plat application will satisfy that condition by combining the outlot with three adjacent lots in Great Oaks. PLANNING CONSIDERATIONS: • There is no development associated with this waiver. PARKS & RECREATION: The Advisory Parks, Recreation, and Natural Resources Commission will be reviewing this waiver at their January 1994 meeting. Because this waiver does not result in the creation of an additional buildable parcel, no parks or trails dedication is anticipated. GRADING/DRAINAGE/EROSION CONTROL: No grading is proposed with this Waiver of Plat. The drainage from this area is conveyed overland to Pond JP -14 which is located on Parcels A and C and in the north, half of Parcel B or to Pond GP 33 which is located in the southeast corner of Parcel B. The City has a storm water lift station located on Parcel B that serves as the outlet for Ponds JP -14 and GP -33. Along the south edge of Parcel B is an existing bituminous driveway that serves as the City's access to the lift station from Woodland Trail. WATER QUALITY: This proposed plat would merely. add land to the backs of several•lots with existing homes and will not result in changes which modify the hydrologic character of .Outiot C Thus, staff will recommend that this plat be subject to neither a cash dedication nor an onsite ponding requirement for water quality. It should be noted that the City intends to evaluate the feasibility of raising the normal water level in Pond JP -14 which lies • within this oudot in order to enhance its water quality treatment functions. Any raise in the normal water level an be accommodated within the existing easement for the pond. No filling or draining of wetlands within this oudot is permitted. These recommendations are subject to the approval of the Advisory Parks, Recreation, and Natural Resources Commission. LOCATION/EXISTING CONDITIONS: The proposed restaurant is located within the Eagan Town Centre development directly south of the existing Applebee's restaurant along Town Centre Drive, north of McDonald's restaurant. This site abuts I -35E on the west. The open, grassy site is currently vacant and is relatively flat (due to prior grading). PROPOSAL: Perkins family restaurant is proposing a 5,054 sq. ft. Class I restaurant. Class I restaurants are a permitted use in a CSC zoning district. The restaurant will seat approximately 176 people. Required parking for 176 seats is 58 stalls; Perkins is providing 93 stalls. The building exterior consists of brick on the lower portion with stucco on top. The trash enclosure has been attached to the building and is constructed of like building materials. City Code allows businesses one pylon sign adjacent to the freeway and a monument sign (to be located on the side opposite the freeway.) Perkins has proposed a 35' pylon along I -35E and a free-standing ground sign along Town Centre Drive. The proposed sign meets the Town Centre Pylon Sign Agreement. City Code requires that pylon signs be no more than 27' in height and 125 sq. ft. (maximum) per side. As proposed, the height shall be reduced by 8' to bring the sign into conformance. Perkins has agreed to the 8' reduction. The maximum height in a CSC zoning district is 35'. Perkins has proposed a 70' flag pole. To conform to Code requirements, the flag pole shall be reduced by half of its proposed height. The submitted landscape plan shows a variety of overstory and understory plantings. Groupings of Black Hills Spruce, Scotch Pines, and Red Oaks will blend in with the existing landscaping along Town Centre Drive and I -35E. All setbacks meet Code requirements. GRADING/DRAINAGE/EROSION CONTROL The existing site is fairly flat with no trees. A limited amount of grading will be needed for this site's development. The preliminary drainage plan shows connection to an existing 18" public storm sewer system stubbed from the McDonalds site to the south. The proposed, privately maintained storm sewer that will serve this site will extend both west and north to ensure proper drainage of the parking lot. The storm sewer system that drains this site drains into Pond JP -66 which is a pond on the City's Comprehensive Storm Water Management Plan. Pond JP -66 is a sedimentation basin located in the northwest corner of Denmark Avenue and Duckwood Drive. The development will be responsible for installing and maintaining erosion control methods in accordance with the City's Erosion/Sediment Control Manual Standards. WATER QUALITY AND WETLANDS: This development will be subject to a cash dedication to meet water quality mitigation requirements. For Lot 2, Block 1, the cash dedication amount will be $10,680 and this amount must be paid by the developer prior to the issuance of a building permit. There are no wetlands on the site. UTILITIES: An existing 8" sanitary sewer in Town Centre Drive with sufficient depth, size and capacity is readily available to serve this site. Also, an existing 8" water main in Town Centre Drive with sufficient size, pressure and capacity is readily available to serve this site. The preliminary utility plan shows connecting to an existing 6" sewer stub and 6" water stub and extending the lines up to the building. The proposed sanitary sewer service shall include a manhole on the service line at the edge of the drainage and utility easement. STREET/ACCESS/CIRCULATION: Street access for the proposed development will be provided from Town Centre Drive which runs along the east property line of this site. The preliminary site plan shows two driveway access points onto Town Centre Drive. With the proposed Kohl's development, the existing entrance to Town Centre Shopping Center and Dougherty's Restaurant will be moved north 120'. The preliminary site plan does not show this new driveway location. The proposed driveway locations for the Perkins site will not match centerlines with the proposed Kohl's/Dougherty's driveway. The north entrance centerline is 60' apart and the south entrance centerline is shown to be 132' away from the Kohl's driveway opening. Staff is recommending the northerly driveway be located to match the most northerly drive aisle, thus all spacing requirements will be met. Therefore, the northerly driveway connection to Town Centre Drive shall be shifted to the north 60 feet to provide improvement separation to the proposed Kohl's driveway. EASEMENTS/RIGHT-OF-WAY/PERMITS: The right-of-way and easements for this development have already been dedicated on the plat. CONDITIONS OF SITE PLAN REVIEW FOR TOWN CENTRE 70 16TH ADDITION 1. The City officials and its Public Works Department are also responsible for maintaining and reconstructing these facilities in a timely manner as they approach the end of their useful life. These facilities must be properly and cost effectively maintained for the public's safety and welfare. Typically, utilities have a design Life of 40 to 80 years dependent upon how they've been maintained and constructed while streets have a design life of 20 to 25 years. The design life for streets is considerably less due to the nature of the materials that are used to build them, and deterioration resulting from weather and traffic. Local streets and utilities serving the Oslund Timberline area were constructed privately approximately 25 years ago. Therefore, the streets in this area are approaching the end of their useful design life and are in a condition where street reconstruction should be considered. It's important that property/homeowners and City officials know and are confident that the infrastructure system is being properly maintained and replaced at the most opportune time and at a reasonable cost for the longest period of time. In an attempt to better inform homeowners/property owners of the condition of their streets, the City of Eagan recently had structural and surface evaluations done on the streets in Oslund-Timberline area. The results of the evaluations are presented in this report to help homeowners better understand the condition of their streets. These evaluations are based on technical and objective observations made by representatives trained in this work. SCOPE: This project provides for reconstructing 1.34 miles of existing streets in Oslund- Timberline area as shown on Figure No. 1. Also included is the construction of new storm sewer and upgrading portions of the existing storm sewer system. Improvements are also proposed to the existing sanitary sewer and water main systems. Pine Ridge Drive between Red Cedar Road and McCarthy Road in Oslund-Timberline was previously reconstructed in 1985 and assessed to the abutting homeowners. The project can best be carried out as one contract. STREET EVALUATION: The streets in the Oslund-Timberline area, with the exception of Pine Ridge Drive between McCarthy Road and Red Cedar Road, are proposed to be reconstructed as part of this project. The justification for street reconstruction is based on the following: - Street Age - Structural Strength - Surface Condition - Future Maintenance Requirements In accordance with engineering standards, the anticipated life of a street pavement constructed to today's standards is 20 to 25 years. As previously mentioned, the life of a street is based on the type and quantities of materials that are used to build it and the rate of deterioration due to weather and the volume and load of traffic. The streets in the Oslund-Timberline area are all greater than 20 years old and were built to a lesser standard privately by the developer. Therefore, each street has approached the end of its design life based on its age. The standard structural strength of a local residential street is a 7- to 9 -ton design. The heavier design thickness is recommended due to the number and size of service vehicles (garbage trucks, delivery trucks, school buses, etc.) presently serving residential neighborhoods. In the case of the streets in the project area, the recommended overlay thickness for many of the streets ranged between 1" and 2", based on a 9 -ton design requirement. The structural testing was done by use of a Road Rater which is an electro- hydraulic device which imposes a load to the roadway and measures its deflection. Based on the measured deflection, a recommended overlay equivalent thickness is determined to prevent the deflection based on the design load. Another important consideration for evaluating an existing street is its surface condition. The Pavement Condition Index (PCI) ranks the surface condition of each street. Table 1 presents the categories which define PCI Rankings. 49532.rpt 3 TABLE 1 PCI MAINTENANCE REQUIRED 55-100 Routine (Crack Seal/Seal Coat) 35-55 Patch/Repair and/or Overlay 0-35 Reconstruct In general, PCI Rankings below 35 require removal of the existing bituminous pavement before constructing a new bituminous surface. In some cases, based on soil borings and further field investigation during construction, the existing aggregate base may also have to be replaced or expanded. PCI Rankings between 35 and 55 normally require patching before constructing a bituminous overlay. PCI Rankings over 55 typically don't require structural improvements and generally routine maintenance such as crack sealing and seal coat is acceptable. As noted on Figure No. 2, all of the PCI Rankings, with the exception of Pine Ridge Drive, are below 40. Therefore, based on the PCI Rankings, street reconstruction/overlay is recommended. The existing street sections are presented on Figures No. 4 and 5. The 0 existing street section for the most part includes a 32' wide street with different types of curb (none, bituminous, concrete). The concrete curb portion is limited to McCarthy Road approximately 1100' west of Pine Ridge Drive and Pine Ridge Drive between McCarthy Road and Lone Oak Road. Listed below is the length of existing street with bituminous/no curb and concrete curb: Length Bituminous/No curb 1.07 mile Concrete curb 0.27 mile 1.34 mile Street construction proposed in the Oslund-Timberline area includes constructing a new B618 concrete curb and gutter where none presently exists. On McCarthy Road and Pine Ridge Drive where concrete curb and gutter exists, only those sections in need of repair will be removed and reconstructed. The existing bituminous surface will be completely removed and a new 3" thick bituminous surface will be constructed as presented on Figures No. 4 and 5. The existing aggregate base will be checked for thickness and test rolled. If additional aggregate base is required, it will be added as directed by the Engineer. It's estimated for purposes of this report that approximately 3" of new aggregate base will be placed before constructing the new bituminous surface. McCarthy Road approaching TH 13 may warrant variable street widths due to existing slopes abutting the roadway. The proposed design widths and alignments are presented on Figure No. 3. As noted, it's also proposed to realign McCarthy Road to provide more gentle curves approaching TH 13. Due to the new concrete curb and gutter construction, driveway and boulevard restoration is required. Driveway restoration will include reconstructing the lower portion of the existing driveway to match the new concrete curb and gutter. In addition, existing storm sewer catch basins and leads are proposed to be reconstructed to present standards. Storm Sewer. The existing storm sewer serving Oslund-Timberline is shown on Figure No. 6. The performance of the existing storm sewer since its construction was reviewed along with evaluating its present capacity compared to present standards. In accordance with design standards, it is recommended the existing storm sewer in Red Cedar Road be extended from Loon Lane to Cherrywood Court. It's also recommended a short storm sewer section be constructed in McCarthy Road at TH 13. A special inlet structure is proposed at McCarthy Road and Red Cedar Road to provide additional inlet capacity in the event of a blockage. In addition, a low point is proposed to be constructed in McCarthy Road near Lot 8, Block 4 to reduce the storm water overflow between Lots 18 and 19, Block 3. Although the capacity of the existing storm sewer system is close to the required 5 -year design standard, the 100 -year overflow rate between Lots 18 and 19, Block 3 near McCarthy Road and Red Cedar Road is substantial (estimated at 70 cubic feet per sec (cfs) for a 100 year event). The storm water overflow in this area has caused an on going erosion problems for many years. Therefore, as part of this project two alternatives were investigated to improve the storm water overflow in this area which are shown on Figure No. 7. One alternative provides for constructing a storm sewer pipe to convey the 100 -year overflow event, while the second alternative provides for overland improvements. Included as part of each alternative is upgrading the access and overland drainage within the existing sanitary sewer and storm sewer easement to T.H. No. 13. The estimated cost for each alternative is presented herein; however, it's not recommended at this time to construct either alternative. As part of the street reconstruction two improvements are proposed which will reduce the stormwater overflow between Lots 18 and 19, Block 3. It's felt that by providing greater inlet capacity into the existing storm sewer system at McCarthy Road and Red Cedar Road. the existing storm sewer system will be less inclined to plug, thereby reducing the stormwater overflow in this area. In the event the stormwater overflow improvements proposed as part of the street reconstruction are not adequate, the overflow improvements proposed herein and shown on Figure No. 7 can easily be considered in the future. Sanitary Sewer and Water Main Repair. Sanitary sewer repairs include removing and reconstructing the existing 24" diameter sanitary sewer castings with 27" diameter castings. Water main repairs include locating and repairing fifteen (15) existing curb boxes (shut off) which are in need of repair as identified by public works. In addition, public works has experienced an unusual number of water main breaks near the intersection of McCarthy Road and Red Cedar Road. Therefore, it is proposed to reconstruct approximately 600 lineal feet of water main at this location. EASEMENTS/PERMITS: A small permanent street easement is required from Lot 1, Block 1, Odell Addition to realign McCarthy Road as shown on Figure No. 3. In addition, although it's not proposed to construct the stormwater overflow improvements shown on Figure No. 7 at this time, if they are considered in the future, easements will be required from Lots 18 and 19, Block 3, Oslund-Timberline Addition and Lot 7, McCarthy Ridge.
