We have started our review of the construction documents submitted in pursuit of
obtaining a building permit for the above-referenced project. This review is not intended
to be an exhaustive and comprehensive report. Unless otherwise noted, all references aze
to the 1997 U.B.C. It is our goal that this review will help you in complying with the
applicable codes and we aze, therefore, requesting that the following items be addressed:
1. All framing members supporting the hori2ontal occupancy separation at the shop
mezzanine shall be I-hr. rated construction.
2. The elevator shall comply with MSAC, Section 1341.436.
3. Ventilation in the shop and storage areas shall comply with MSBC, Section
1202.2.7.
4. The private toilet room access by Rooms 205 and 206 shall be adaptable,
complying MSAC Section 1341.405.
5. Glazing near stainvays shall comply with UBC Section 2406.4, # 10.

In follow up to our conversation with the Dakota County Transportation Department
representatives, enclosed please find a two-sheet illustration of the construction plans for
the Lexington Avenue project. It indicates that 1/4 mile spacing from Lexington Avenue
would fall roughly within the area of Keefe Street and that 1/8 mile spacing would fall
roughly in the azea of the south driveway for Eagandale Center Industrial Park 42. From
our discussions, I understand that you wish to have a driveway access aligned with Keefe
Street, that you wish to address future access to the properties on the NW comer of the
Lexington Avenue-Lone Oak Road intersection, and that you wish to retain driveway
access at the current location both to serve your primary business location and that of
Acorn Mini Storage to the south.
I also understand from your telephone message following our meeting with Mr. Konat
and Mr. Krebsbach that the location of the pond between your current access and the four
homesites will present challenges for meeting the County's spacing guideline of no more
than one access for every 1/8 mile. At the time of our conversation with the County
representatives, the indication was that the prefened solution would be one in which the
four homesites, Acorn Mini Storage, Gresser Companies, and your tenant space could all
be served by those two access locations through some sort of circulation drive. I believe
that you indicated you would be willing to have your traffic engineer do some
preliminary schematic designs to show how that might be done.
As we discussed, issues of this kind are typically addressed in the context of a
development application. I very much appreciate your raising these concerns at this time
beqause it may allow us to plan ahead for the time in which the four homesites and the
other vacant property in that azea may be developed. Since there is no development
application before us at the present time, we also discussed the best means for the City
and County to look into this matter fiuther would be for your engineer to prepaze
schematic information that the City and County could review. If through that process we
are able to identify an access plan that meets the needs of the existing businesses, future
development, the County and the City, we believe that there should be some means by
which we could draft an agreement that would permit incremental steps towazd the

ultimate design. It seemed clear from our discussion with the County representatives,
however, that the first step is to have a concept plan on which to base that discussion.
Please share this information with your traffic engineer and ask him to prepare a
schematic plan for discussion purposes. If you or your engineer should have any
questions regarding this letter or the approach described, please do not hesitate to contact
Mr. Krebsbach, Mr. Colbert, or me.
