After approval is given to the June 21, 1994 City Council agenda, regular meeting minutes
for the June 7, 1994 City Council meeting, and special meeting minutes for the June 7, 1994
Special City Council meeting, the following items are in order for consideration.
A. FINANCE DEPARTMENT:
DEPARTMENT HEAD BUSINESS
Item 1. Presentation of Comprehensive Annual Financial Report - -The 1993 audit has
recently been completed and the Comprehensive Annual Financial Report for calendar year
1992 has been prepared. The report and two letters were previously distributed to the City
Council and discussed at the Special Workshop meeting on Tuesday, June 14.
Mr. Dave Edson, auditor in charge, and Ms. Barb Diekmann, manager, from Deloitte and
Touche will be at the meeting to make a brief presentation to the City Council as well as
to answer any questions.
Enclosed without page number is the Single Audit Report which is the final document
relating to the 1993 audit. This report is required by the Federal Government since Eagan
expended more than $25,000 in Federal grant money during 1993.
ACTION TO BE CONSIDERED ON THIS ITEM: To accept the audited Comprehensive
Annual Financial Report for the year ended December 31, 1993.

CONSENT AGENDA
There are twenty -two (22) items on the agenda referred to as consent items requiring one
(:l) motion by the City Council. If the City Council wishes to discuss any of the items in
further detail, those items should be removed from the Consent Agenda and placed under
Additional Items unless the discussion required is brief.
A. PERSONNEL ITEMS
PERSONNEL ITEMS
Item 1. Collective Bargaining Agreement /Police Unit - -As the Council is aware, the police
collective bargaining unit and the Eagan City Council both tentatively approved a table
agreement regarding the 1994/1995 collective bargaining agreement for the police unit. The
collective bargaining agreement has now been formally approved by the unit in a written
ballot. Therefore, it would be appropriate at this time for the Council to formally approve
the agreement. As the Council is aware, the main provisions in the agreement concern (1)
a 2.5% compensation increase for 1994 and a 3% compensation increase for 1995; (2)
provisions for health insurance which are the same as for all other City employees; (3)
overtime provisions which are basically the same as for other employees at the City; (4) a
reduction in the compensatory time bank limit; and (4) in 1995, the elimination of the
uniform allowance.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the 1994/1995 collective
bargaining agreement with the Police bargaining unit.
Item 2. Seasonal Tennis Instructors - -Due to the resignation of two previously submitted
tennis instructors, it was necessary to interview for replacements. It is the recommendation
of Superintendent of Recreation Peterson that Matthew Knutson and Patricia Mraz be hired
as seasonal tennis instructors. Due to the timelines involved with these positions, it was
necessary for City Administrator Hedges to approve their hiring.
ACTION TO BE CONSIDERED ON THIS ITEM: To ratify the hiring of Matthew Knutson
and Patricia Mraz as seasonal tennis instructors.
Item 3. Seasonal Forestry Technician - -It is the recommendation of Superintendent of Parks
VonDeLinde and Forestry Supervisor Hove that Christopher Gruber be hired as a seasonal
forestry technician.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Christopher
Gruber as a seasonal forestry technician.

Item 4. Seasonal Recreation Leaders - -It is the recommendation of Recreation Supervisor
Nowariak that Leah Sweeney and Theresa Swartzer be hired as seasonal recreation leaders.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Leah Sweeney
and Theresa Swartzer as seasonal recreation leaders.
Item 5. Seasonal Recreation Assistants - -It is the recommendation of Recreation Supervisor
Nowariak that Lisa Heine and Chad Rother be hired as seasonal recreation assistants.

and Chad Rother as seasonal recreation assistants.
Item 6. Living Skills Instructor - -After interviews, it is the recommendation of Youth
Development Coordinator Ashley that Joyce McGee be hired as a living skills instructor.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Joyce McGee
as a living skills instructor.
Item 7. Basketball Referee /Coach - -After interviews it is the recommendation of Youth
Development Coordinator Ashley that Brent Grengs be hired as a basketball referee /coach.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Brent Grengs
as a basketball referee /coach.
Item 8. Student Intern/Water Resources - -For Council's information, Chris Repinski will
be fulfilling a student internship in the Water Resources area during the summer months.
Mr. Repinski will not be an employee of the City of Eagan. The item is on the Consent
Agenda only for the Council's information. No action is required on this item.
Item 9. Planning Interns - -After interviews, it is the recommendation of Director of
Community Development Reichert that Gary I. Morrison and Daniel L. Olson be hired as
temporary planning interns.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the hiring of Gary I.
Morrison and Daniel L. Olson as temporary planning interns.

SCHWANZ LAKE RESTORATION FUNDING
C. Resolution, Adoption of Resolution for Schwanz Lake Restoration Phase II Funding- -
The City has been awarded grant funds for the above referenced project by the Minnesota
Pollution Control Agency. In order to execute the ap ropriate agre ments, it is necessary
to pass the enclosed resolution. Enclosed on pages 7 through y are a memorandum
with additional background information and a copy of the resolution for the Council's
consideration.

SCHWANZ LAKE WATER QUALITY IMPROVEMENT PROJECT.
DATE: JUNE 14, 1994
City staff have been notified by the Minnesota Pollution Control
Agency (MnPCA) that grant funds will be awarded to the City of
Eagan to fund 50% of the cost of the implementation phase of the
Schwanz Lake Water Quality Improvement Project. The project plan
has been reviewed and approved by both the Advisory Parks,
Recreation, and Natural Resources Commission and the City Council.
As you may recall, total project costs are $187,948 and the project
will be implemented over a three -year time horizon.
The study phase of this project was completed in 1992 with the help
of a grant from MnPCA. After several unsuccessful tries to secure
grant funding for the implementation phase, the City's perseverance
has finally paid off and we are ready to begin putting into action
the plan to improve the recreational and aesthetic suitability of
Schwanz Lake.
In order to do so, the City will need to execute a grant agreement
between itself and MnPCA. Adoption of the attached resolution by
the City Council will allow us complete the grant agreement and
begin work on the project this summer. The resolution is in a
format suggested by the MnPCA. I am requesting that this item be
placed on the June 21, 1994 City Council agenda for action.

BE IT RESOLVED by the City of Eagan that the City enter into the attached Substate
Agreement with the Minnesota Pollution Control Agency (MPCA) to conduct the following

SOLID WASTE ABATEMENT SPECIAL ASSISTANCE GRANT
D. Resolution, Adoption of a Resolution to Approve a Solid Waste Abatement Special
Assistance Grant /Dakota County-- Applications are due for the final funding cycle of the
Dakota County's special assistance grant program for solid waste abatement. The staff and
Solid Waste Abatement Commission have reviewed the projects eligible for special
assistance grant funding and are recommending that an application be submitted covering
the items outlined in the memorandum which is enclosed on pages /0 through 1/ . Also
enclosed on page is a resolution necessary to submit the grant application.
ACTION TO BE CONSIDERED ON THIS ITEM: To adopt a resolution authorizing the
submission of a Dakota County special assistance grant application for solid waste
abatement as presented.

SUBJECT: SOLID WASTE ABATEMENT SPECIAL ASSISTANCE GRANT REQUEST
As you are aware, Dakota County has Special Assistance Grant funds available for
use by Cities to help in solid waste abatement goals. In the past Eagan has used
such funds to purchase residential recycling containers, to pay for the storage of
these containers, to purchase recycling receptacles for several community parks,
for canvas tote bags, and to fund other program items that cannot be supported
through annual Landfill Abatement Grants.
July 1, 1994 represents the last Special Assistance Grant round of this type, and
Eagan has $17,550 available for application. In working with the Parks and
Recreation Staff, and reviewing other possible needs, we have mapped out a
number of projects that can be partially supported through the use of these funds.
The park projects will include the use of equipment and supplies manufactured
from recycled and /or reclaimed materials in construction and improvement projects
throughout the City's park system. The County Grant money will represent the cost
differential In the use of these recycled materials over virgin product. The
following is a list of projects that these funds will impact:

It is staff recommendation that the Precinct 17 polling place be
changed because Fire Station #4 can no longer accommodate the
rapidly growing number of residents moving into Precinct 17. We
have toured St. Thomas Becket and received positive response from
Fr. Tom Kommers. St. Thomas Becket meets handicap accessibility
requirements and is more than large enough to accommodate Precinct
17 voters into the future.
Minnesota Election Law requires that designation of a different
polling place shall be effective more than 30 days prior to an
election. It is appropriate that the Council approve the
resolution noting the change so that Precinct 17 voters can be
notified in plenty of time before the primary election.

RESOLUTION
CHANGE IN PRECINCT 17 POLLING PLACE DESIGNATION
WHEREAS, Minnesota Election Laws Chapter 204B.16 Polling Places: Designation, states
a polling place for a precinct in a municipality shall be located within the boundaries of the
precinct; and
WHEREAS, Voting for Eagan Precinct 17, in the Southeast area of the City, should be
discontinued at Fire Station No. 4 as it can no longer accommodate increasing numbers of
voters; and
WHEREAS, Designation of a new or different polling place shall become effective more
than 30 days prior to an election;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Eagan, that the
St. Thomas Becket Church, 4455 South Robert Trail, be designated the polling place for
Precinct 17 commencing with the September 13, 1994 primary election.
AND BE IT FURTHER RESOLVED that the City Clerk's office is hereby directed to notice
registered voters in accordance with the election laws.

Fundraiser -- Enclosed without page number is a copy of an application for a shows license
for a fundraising event being sponsored by the Eagan Convention and Visitors Bureau. The
event involves a circus scheduled for July 23, 1994 at the Blue Cross /Blue Shield facility on
Highway 13 and Yankee Doodle Road.

number is a copy of the applications submitted by Mitchell Knoll for a shows license and
business solicitation license pertaining to the Haunted Hayride and Santa's Hayride activity
which is to be held at 900 Apollo Road at Eagandale Industrial Park. This activity has been
licensed in the past and the applications are in order for consideration by the City Council.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the shows and solicitor
licenses for Mitch Knoll for the Haunted Hayride /Santa's Hayride at 900 Apollo Road as
presented.
BID AWARD /POLICE FACILITY CONSTRUCTION
H. Award Bids, Multiple Bid Packages, Police Facility Construction - -On June 15, 1994, the
City and its construction manager opened the 29 separate bid packages to be considered
relative to construction of the new police facility at the Municipal Center site. The bids
were highly competitive and the construction manager is in the process of reviewing details
of the bids and meeting with the apparent low bidders. At this time, it appears that the low
bids place the proposed cost of the project at or below the construction manager's estimate
for building cost which was reviewed by the Council at the time that the plans and bid
documents were approved.
A memorandum from the construction manager and a preliminary tabulation were
unavailable at the time of packet preparation, consequently, they will be included in
Monday's Additional Information packet. A final bid tabulation and contract
recommendation for all 29 packages will be presented at Tuesday evening's City Council
meeting.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the construction manager's
recommendation and award bids for construction of the police facility as presented.

no reason to deny the license.
Conditions of approval have previously included:
1. Continuation of liability insurance
evidenced by an insurance certificate.
2. Hours of operation will be from 12:00 noon
to 15 minutes prior to sunset.
3. The approval is granted from June 13
to October 15,1994
4. The trucks will not generate a noise
level greater than 65 decibels
5. Caution swing arms will be required on
each vehicle
6. Trucks are excluded from city parks.

SUBJECT: ARC RECOMMENDATION - MAC NOISE ABATEMENT PRIORITY
At its meeting of June 14, the Eagan Airport Relations Committee recommended that the
City Council formally encourage the MAC to retain noise abatement as one of its top
priorities as it sets goals for the airport both now and in the future.
The issue was raised in Tight of a discussion at MASAC concerning the MAC's most
recent goal setting exercise, the results of which are attached. MASAC members
expressed concern that MAC may perceive the Stage II phase out, ANOMS Noise
Monitoring System and the Part 150 Program to be sufficient to deal with noise impacts.
MASAC pointed out that noise impacts extend over a very large area and that
communities continue to experience noise nuisance.
MASAC will be further discussing this matter at its June meeting. The ARC felt it
appropriate to communicate a position on behalf of the City of Eagan to prevent noise
abatement from being left off the MAC agenda.
ACTION TO BE CONSIDERED BY THE CITY COUNCIL: To approve or deny a
recommendation by the Airport Relations Committee that correspondence on behalf of
the City be forwarded to the Metropolitan Airports Commission strongly urging that noise
abatement be placed among the top priorities for the MAC's strategic plan.

K. Recommendation, Airport Relations Committee, Encouraging MAC Consideration of
Alternative Means of Engine Run -Up Noise Suppression -- Enclosed on page ,3 is a
memorandum covering a recommendation by the Airport Relations Committee that the City
encourage the Metropolitan Airports Commission to explore alternatives to the Hush -House
engine run -up noise suppressor currently in the MAC capital improvements program.
Because of the $6 million dollar cost of the Hush - House, the MAC has been reluctant to
make an investment in this item to date. As a consequence, many residents of Eagan near
Highway 13 continue to experience run -up noise impacts associated with maintenance
operations occurring on the south side of the airport property. In particular, the committee
had the opportunity to review a presentation on the technology being manufactured by the
Westinghouse Company which may offer a cost effective alternative to the Hush -House
construction.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve a recommendation by the
Airport Relations Committee to urge the Metropolitan Airports Commission to investigate
and consider the purchase of an alternative engine noise suppression mechanism in the near
future.

SUPPRESSOR
At its meeting of June 14, the Eagan Airport Relations Committee heard a presentation
by Daniel Fuller on behalf of the Westinghouse Corporation which is marketing a mobile
aircraft engine run -up noise suppressor under the name of Q -JET. As a result of the
presentation, the Committee is recommending that the City Council formally encourage
the MAC to investigate a noise suppressor technology similar to the Westinghouse model
as a cost effective alternative to the hush -house currently in the MAC CIP.
The MAC has included a hush -house in its CIP for a number of years at an estimated
cost of $6 million. The ARC identified the Westinghouse technology in an noise periodical
article and asked for additional information in its regard. Mr. Fuller was able to come to
Minneapolis to provide to the Committee a presentation and videotaped demonstration
of the technology used in the Q -JET. He indicated that the system was as effective as
the hush -house technology (approximately 17 dBA noise reduction at 1000 feet) at
approximately 15% to 25% of the cost. A copy of the video is available for review.
While the ARC did not wish to take an action endorsing a specific commercial product,
they did feel that the Q -JET technology offered significant benefits to residents of Eagan
who are currently affected by ground noise from MSP, particularly those who live near
Hwy 13 and the Minnesota River Valley who are exposed to frequent engine run -up tests.
As a consequence, the Committee is recommending that the City take a position
supporting the MAC's investigation and consideration of this noise suppression
technology as an alternative to the hush -house in the MAC capital budget.
ACTION TO BE CONSIDERED BY THE CITY COUNCIL: To approve or deny a
recommendation by the Airport Relations Committee that correspondence on behalf of
the City be forwarded to the MAC urging that alternative engine run -up noise suppression
equipment, such as the Q -JET technology, be investigated and considered for purchase
as a part of the short term capital budget for MSP.

RECEIVE FEASIBILITY REPORT /ORDER PUBLIC HEARING
(CEDARVALE ACCESS IMPROVEMENTS)
L. Project 656, Receive Feasibility Report/Order Public Hearing (Cedarvale Access
Improvements - Silver Bell Road & TH 13) - -In response to a petition and a $4,000
contribution from several businesses in the Cedarvale shopping district, the Council
authorized the preparation of a feasibility report to address transportation access
improvements to the overall Cedarvale shopping center area. Several informational
neighborhood meetings have been held with interested businesses to present various
alternatives. In addition, the City Council held special workshops to discuss various revenue
options to finance the proposed improvements. As a result of this process, the draft
feasibility report, enclosed without page numbers, has now been completed and is being
forwarded to the City Council for their consideration of scheduling a public hearing to
formally present and discuss the proposed improvements and related assessments to the
benefitted properties.
ACTION TO BE CONSIDERED ON THIS ITEM: Receive the feasibility report for Project
656 (Cedarvale Access Improvements - Silver Bell Road & TH 13) and schedule a public
hearing to be held on July 19, 1994.
RECEIVE FEASIBILITY REPORT /ORDER PUBLIC HEARING
(WATERVIEW ADDITION )
M. Project 666R, Receive Feasibility Report/Order Public Hearing ( Waterview Addition
- Utility Extension) - -In response to a petition received from the developer of the proposed
Waterview Addition, the City Council authorized the preparation of a feasibility report for
the installation of sanitary sewer and watermain extensions to service the proposed
development.
In December of last year, the City Council continued indefinitely action regarding approving
the rezoning and preliminary plat for the Waterview Addition. Subsequently, with no
approval of the proposed development, the public hearing for Project 666 (Waterview
Addition - Sanitary & Water Main Extensions) was closed and the project canceled.
During the months that followed, the S. Dodd Road area had numerous discussions at
Council workshops pertaining to long -range urbanization of the S. Dodd Road area. The
appropriate development density and the layout for the proposed Waterview Addition was
questioned by the Council and the residents at that time. Also during this time, ISD #196
selected a site for the new elementary school to be across TH 3 from the proposed
Waterview Addition adjacent to the proposed Pines Edge Addition. On May 3, the City
Council approved the R -1 rezoning and the preliminary plat layout for the proposed
Waterview Addition. As a result, the developer renewed his request to the City for the
extension of sanitary sewer and watermain to service his proposed development. This
request was presented to the City Council and subsequently the Council authorized the

preparation of a feasibility report to review the extension request. This feasibility report has
now been completed and a copy is being forwarded to the City Council, under separate
cover, for their consideration of scheduling a public hearing to formally present and discuss
the proposed improvements as well as related assessments on the benefitted adjacent
properties.
ACTION TO BE CONSIDERED ON THIS ITEM: To receive the feasibility report for
Project 666R (Waterview Addition - Utility Extension) and order a public hearing to be held
on July 19, 1994.
RESCHEDULE PUBLIC HEARING
(TH 3 /SCHOOL ROAD)
N. Project 673, Reschedule Public Hearing (TH 3 /School Road - Streets & Utilities) - -In
response to a petition received from ISD # 196 and the developer of the Pines Edge
Addition, the City Council authorized the preparation of a feasibility report for the
installation of streets and utilities to service both the new elementary school and the Pines
Edge development. The Pines Edge development and the new elementary school are
located east of TH 3 and south of the Weston Hills development. The feasibility report for
the improvement was presented to the City Council on June 7, 1994, for their consideration
of scheduling a public hearing on July 5, 1994. At the June 7 meeting, the City Council did
receive the feasibility report and scheduled a public hearing for July 5.
Subsequent to that Council action, the feasibility report for the proposed Waterview
Addition has been prepared and is being presented to the City Council earlier on this
agenda for consideration of a public hearing to be held on July 19, 1994. Staff feels its
appropriate for the Waterview Addition and the TH 3 /School Road - Street & Utilities
Improvements, be heard on the same evening.
ACTION TO BE CONSIDERED ON THIS ITEM: To reschedule the public hearing for
Project 673 (TH 3 /School Road - Streets & Utilities) from the July 5, 1994, date as set by
the City Council on June 7, 1994, to the July 19, 1994, date.

O. Ordinance Amendment, Chapter 5, Proof of Age /Liquor Sales - -As a result of the
ordinance codification process, it was suggested that this State law change be incorporated.
This ordinance adds "a valid military identification card issued by the United States
Department of Defense" as an acceptable form to meet the proof of age provisions of the

AGREEMENT /GENERAL SERVICES AGREEMENT /DCA, INC.
S. Agreement, Approve General Services Agreement with DCA, Inc., for Third Party
Administration of Worker's Compensation - -When the City elected to self - insure worker's
compensation effective July 1, 1993, DCA, Inc. was selected as the third party administrator
to handle the processing of all claims. A general services agreement was entered into for
a one -year period at a cost of $23,400 annually. The City has been very pleased with the
services that have been provided by DCA, Inc. in both the start-up and on -going operation

providing these services for July 1, 1994, through June 30, 1995, at an annual cost of $21,300.
The reduction reflects one -time start-up costs previously incurred. Given the success of the
program, the cost reduction and the desire for continuity, it is the staffs recommendation
that the agreement be approved. Enclosed on page 37 is a copy of the proposed
agreement.

STANDARD SIZED LOT DEVELOPMENT
This agreement made and entered into by and between Dakota Electric
Association, a Cooperative Association, Incorporated under the laws of
the State of Minnesota, hereinafter called the Company and City of
Eagan, Partnership hereinafter called the Developer.
Whereas the Developer has requested the Company to provide an
underground electric distribution system to serve certain properties
being developed by the Developer, hereinafter called Lexington
Meadows Addn. located on the following described real estate situated
in the city, of Eagan, county of Dakota, State of Minnesota, to wit:
Lot 1 through 8 of Block 1
All in accordance with attached Exhibit "A"
Now, therefore, in consideration of the mutual covenants and
agreements hereinafter contained to be kept and performed, the parties
hereto do agree as follows:
Paragraph 1
The Company shall, subject to all the terms and conditions hereinafter
contained, install, own, and maintain all facilities necessary to
provide an underground electric distribution system to serve the real
estate within the area indicated on the map or plat attached hereto as
"Exhibit A" and made a part hereof, it being understood and agreed
that the term "underground system" as used herein shall exclude the
underground service connection from the utility pedestal to the
consumer served thereby as shown in "Exhibit A" and that the consumer
shall be responsible for the underground service from his premises to
the utility pedestal.

Paragraph 2
The said underground system shall be installed by the Company in
accordance with industry practice, provided however, if the Company is
unable to secure, upon reasonable terms and conditions from the
appropriate governmental unit, the permits, licenses, or authority
necessary for the installation and operation of said underground
system, then this agreement shall be void, and both parties hereto
shall have no rights, duties, or privileges hereunder. The Company
shall have no obligation or responsibility for the installation,
maintenance, repair, or replacement of the underground service from
the consumer's premises to the utility pedestal or transformer pad and
shall have no interest in ownership of said underground service.
Paragraph 3
The Company shall to its best ability coordinate the installation of
said underground system with the activities of the Developer in the
area to be served thereby; provided, however, that the Company shall
not be required to install said underground system in segments smaller
or larger than considered economically feasible by the Company.
The Company reserves the right to cancel any part of said underground
system which is not constructed within two years from the executed
date of this agreement. The Company agrees to refund any advance
payments made by the Developer for any parts so canceled.
The Company shall not be held responsible for any damages resulting
from delay in completing the installation of the underground system,
herein, when such delay is due to casualty, labor problems, weather,
inability of manufacturer to ship materials for said job, or other
similar or dissimilar causes beyond the control of the Company.
Paragraph 4
The Developer shall, at no cost or expense to the Company and prior to
installation of said system, secure such easement rights as the
Company may require and also remove all trees and stumps within the
right -of -way for the installation, operation, and maintenance of said
system.
Paragraph 5
The Developer, prior to the time before an installation is started of
said underground system, shall establish grades in the easement
right -of -way which shall be not more than four (4) inches above or
less than four (4) inches below the finished grade. This must be
determined before any trenching is started on the job.
A. The right -of -way strip must be completely accessible to the
Company's equipment.

B. All obstructions must be removed by the Developer at no cost or
expense to the Company.
C. Lot corners shall be marked by the Developer at such intervals as
might be designated by the Company.
Paragraph 6
The Company shall make the final connection from the consumer's
facilities to the utility's terminus.
Paragraph 7
In consideration of the Company installing and owning the underground
distribution system as described in Paragraph 1, the Developer will
contribute to the portion of the facility cost not justified by the
anticipated revenue. The Developer agrees to contribute at the time
he signs this agreement the following estimated cost:
Non - Refundable Contribution 8 Lots at $33.00 each = $264.00
It is expressly understood and agreed that the Developer shall not be
entitled under any circumstances to any refund whatever for any
consumer additions derived from other electric installations connected
with or to the above described real estate.
Paragraph 8
The said underground system installed by the Company shall be the
property of the Company and any payment made by the Developer shall
not entitle him to any ownership interest or rights therein.

Paragraph 9
The Developer shall pay all additional installation costs incurred by
the Company because of (a) installation of said underground system
after frost is in the ground, (b) delays caused by the Developer, (c)
unknown subsurface conditions such as rock formation, (d) installation
of concrete curbs ahead of cable installation or (e) because streets
or other areas have been paved or blacktopped prior to installation of
said underground system. The cost of any relocation or rearrangement
of any portion of the said underground system made to accommodate the
Developer which creates an added expense to the Cooperative after
construction is under way shall be borne by the Developer.
The above costs are in addition to the sums contributed in Paragraph 7
and are to be paid in one lump sum due and payable upon completion of
the project.
The developer further agrees that the capacity of the service entrance
conductors to each residence constructed by the Developer shall be a
minimum of 150 amperes, and the conduit on the load side of the meter
shall be a minimum of two (2) inches in diameter.
Paragraph 10
This Agreement shall be in lieu of any other provision that the
Company may have which pertains to the payment of extra costs which
arise with the installation of the underground electric system.
Paragraph 11
The Developer shall not have the right to assign this Agreement in
whole or in part without first obtaining the written consent of the
Company. The Company covenants and agrees that it will not
unreasonably or arbitrarily withhold such consent.
All of the undertakings and obligations of the parties, relative to
the subject matter hereof, are contained herein and shall extend to
and be binding upon the heirs, successors, and assigns of the parties
hereto.

A. Renewal, General Insurance - July 1, 1994 through June 30, 1995- -The City has received
renewal information for the general insurance coverages. The renewal proposal has been
assembled through Jeff Bowers of R.L. Youngdahl and Associates, Inc., the City's insurance
representative. General insurance coverages include buildings and contents, equipment,
automobile, general liability and numerous smaller areas of risk exposure.
While official quotations were not solicited, other markets were reviewed. The general
conclusion was that other companies had higher costs with fewer coverages than the League
of Minnesota Cities Insurance Trust (LMCIT). This is especially true for larger cities.
Consequently, we have only the quote from the LMCIT to present to the City Council for
consideration.

The most dramatic change is in the liability coverage where the LMCIT has instituted an
across the board increase of 5 %. This, combined with City growth, generates the overall
increase of 8.8% in liability coverage.
The City's total increase including all coverages is 4.2% which is reasonable again given the
City's growth and increasing exposure simply due to size and complexity.

Given the fact that it would be necessary to double both the per occurrence and aggregate
deductibles (Option 2) to save only $14,598 of premium, it is Mr. Bowers and the staff's
recommendation that the current deductible levels be retained. The current levels do reflect
a sizable savings (41% credit) over the old deductibles.
The staff is also recommending that the Worker's Compensation - excess coverage which
would pay all costs over $1,000,000 be dropped. This would save $25,217 of premium and
reduce the overall insurance costs below the 1994 levels. There is some risk in dropping the
excess coverage in that the City would have no upper limit on its workers' compensation
liability. We would retain the occurrence limit of $240,000 which caps the severity on any
single claim.

It would take a very unusual year and set of circumstances to exceed the $1,000,000 cost per
year although there are no guarantees. All indications are that there would be no payback
on this premium investment, consequently, the recommendation to drop this coverage.

Crestwood Enterprises is requesting approval of a preliminary plat consisting of one lot on
12.72 acres and a conditional use permit for a truck and freight terminal in a limited
industrial district, located along the west side of Kennebec Ro d in the SE 1/4 of Section
18. The staff report on this request is enclosed on pages 5 through aff .
The Advisory Planning Commission conducted a public hearing on this matter at its meeting
of May 24, 1994. The Advisory Planning Commission recommended approval of the
preliminary plat, subject to the 16 conditions set forth in their minutes. The commission
also recommended approval of the conditional use permit for Freightmaster, Inc., for a truck
and freight terminal on Lot 1, Block 1, Crestwood Addition, subject to the two conditions
set forth in the Planning Commission minutes.

PRELIMINARY PLAT AND CONDITIONAL USE PERMIT -
CRESTWOOD ADDITION
Chairman Voracek opened the next public hearing of the evening
regarding a Preliminary Plat consisting of one lot on 12.72
previously zoned LI (Light Industrial) acres and a Conditional Use
Permit to allow a truck and freight terminal located west of Kennebec
Drive in the SE 1/4 of Section 18.
Project Planner Tyree introduced this item. She stated that the
applicant is requesting a Preliminary Plat consisting of one lot on
12.72 acres and a Conditional Use Permit for a truck and freight
terminal in a Limited Industrial district located along the west side
of Kennebec Road in Outlot 3 of Silver Bell Addition. Ms. Tyree
stated that the subject property is surrounded by Haragon
Distributors to the north, Freight Master Warehousing to the east,
Seneca Water Treatment to the west, and a vacant parcel to the south.
She explained that Lot 1 is 12.72 acres and that all proposed
building and parking setbacks required by City Code are met.
She stated that the proposed users of the property would be
Freightmasters which is a 19 -year old company currently operating in
five states. Ms. Tyree stated that Freightmasters current warehouse
is located at 1980 Seneca Road and the warehouse will be leased to
Blue Cross Blue Shield when the new building on the proposed subject
property has been constructed. She further stated that
Freightmasters' currently employs approximately 255 people, with 155
based in Eagan.
She explained that Freightmasters is proposing to construct a
two - story, 153,515 sq. ft. warehouse building. She stated the
building will be constructed out of a combination of smooth and
textured pre -cast concrete panels and the warehouse will have 66
loading docks. She stated that access to the site is gained from
Kennebec Drive near the south property line. Ms. Tyree explained that
the parking lot is at an elevation approximately 13 feet below the
highest point on Kennebec Drive, gradually decreasing to a point
where the driveway intersects. Therefore, she stated, the dock doors
will be below street grade for a portion along Kennebec Drive. Ms.
Tyree stated that parking for the trailers is proposed to be on the
north and east side of the building, with 80 trailer parking spaces
proposed. She further stated that the entire site will be fenced in
accordance with the U.S. Customs regulation. With respect to grading,
Ms. Tyree noted that there will be maximum cuts of 12 feet along the
easterly edge and with maximum fills of 4 feet along the westerly
edge.

She stated that the only wetland on the property lies along the
northeast perimeter of the site but such wetland was unintentionally
created as a result of a publicly approved project and is therefore
exempt from the Wetlands Conservation Act. Ms. Tyree advised that
runoff from the site will discharge to Pond AP -51.2 which is a 0.4
acre pond within Silver Bell development. She further stated that the
water eventually drains overland to the Minnesota River through a
portion of the Nichols fence. She stated that the Minnesota
Department of Natural Resources strongly support the construction of
a storm water ponding area in such a way as to maximize infiltration
of ponded water into the shallow aquifer underlying this area. She
further noted that runoff will also discharge to the head waters of
Kennealy Creek, a designated trout stream. She stated that the
Department of Resources favors ponding to treat runoff from this
industrial area to reduce impacts to the stream. Ms. Tyree stated
that there are 16 significant trees on the site, five of which will
be removed. She stated that the Advisory Parks, Recreation and
Natural Resources Commission recommends a cash parks dedication and a
cash trails dedication.
Tyree also stated that the applicant is requesting a conditional
use permit to allow a truck and freight terminal. She advised that
Freightmasters specializes in three areas of transportation activity,
namely pool distribution, air freight trucking services and public
warehousing. She concluded that the proposed use is compatible with
the zoning district. Finally, Tyree stated that with respect to
parking requirements, the City Code addresses buildings up to 6,000
square feet within this zone and thus the City Council shall
determine the appropriate parking requirements. She noted that the
office area of the building was redesigned, and therefore, the
developer can provide 133 parking stalls.
Ron Have, a representative of the applicant, was present but made
no comment. Member Isberg inquired with Shannon as to the basis for
Condition No. 5 to which Tyree stated it is to give the applicant an
option with respect to parking. Member Segal asked whether the
applicant was requesting a parking variance to which Tyree stated
that it was not a variance issue. She explained that the City Code
addresses parking requirements for buildings up to 6,000 square feet,
but that this building is greater than 6,000 feet and therefore the
City Council shall decide what the appropriate requirements for
parking should be. The applicant stated that there are currently 80
trailer parking spaces designated for the project and thus if the
property were ever used for other uses, the removal of the trailer
parking stalls would increase auto parking space. Mr. Have further
stated that he has no objection to the Condition No. 5.

Isberg moved, Segal seconded the motion to approve a Preliminary
Plat consisting of one lot on 12.72 acres for Crestwood Addition
subject to the following conditions:
1. These standard conditions of plat approval as adopted by
Council action February 3, 1994 shall be complied with:
Al, B1, B2, B4, Cl, C2, C3, C4, D1, El, F1, G1, and H1.
2. The revised landscape plan shall be submitted on the final
grading plan.
3. All landscaped and green areas shall be served by an
underground irrigation system according to City Code.
4. All trash shall be stored within the building or a trash
enclosure per City Code shall be constructed.
5. Provision of 133 parking stalls with proof of parking for an
additional 101 spaces.
6. This development shall be subject to a cash parks
dedicaiton.
7. This development shall be subject to a cash trails
dedication.
8. The wetland idenitifed on the site shall be exempt from
regulation under the Wetlands Conservation Act.
9. This development shall provide a two -cell pond with an
additional 2 acre -feet of wet pond volume in the existing

BACKGROUND /HISTORY:
Freightmasters is a 19 year old company currently operating in five states, it is their
intention to expand and consolidate their Minnesota operations which are currently located
in Mendota Heights, Burnsville and Eagan. The applicant owns three buildings in Eagan.
The largest is located at 1980 Seneca Road and will be leased to Blue Cross Blue Shield as
soon as the new building has been constructed. Approximately 255 people are employed
by Freightmasters, 155 of that total will be based in Eagan. The facility operates 24 hours
a day in three work shifts.

They specialize in pool distribution, air freight trucking services, and public warehousing.
They also are the appointed Central Examination Station for U.S. Customs for the
Minnesota district of the U.S. Department of the Treasury. There are only two such
appointments in Minnesota and Western Wisconsin.
Originally this parcel was platted as Outlot 3, Silver Bell Addition, recently it was
incorporated into the Silver Bell 2nd Addition as Outlot A; which is in the final plat process.
EVALUATION OF REQUESTz
A. Surrounding Uses. The following existing uses, zoning, and comprehensive guide plan
designations surround the subject property:

B. Preliminary Plat Review.
Lots. Lot 1 is 12.72 acres and exceeds the minimum lot size and width requirements for an
I -1 zoning district.
Setbacks. As proposed all building and parking setbacks meet City Code requirements.
Tree Preservation The tree preservation plan submitted for this site indicates a total of 16
significant trees on site (cottonwoods and boxelders). Initial site development will result in
the removal of five significant trees (31.3% of the total), which is 1.3% above the allowable
removal percentage. Ten Category B trees will be planted as replacement trees, eight more
than required for mitigation.
Parks and Recreation At the May 16, 1994 Advisory Parks, Recreation Natural Resources
Commission recommended that this plat be subject to a cash parks dedication and a cash
trails dedication requirement.
On -Site Improvements Freightmasters is proposing to construct a two story, 153,515 s.f.
warehouse building on the 554,040 s.f. lot. Of the 153,515 s.f., 16,360 s.f. will be occupied
by offices, the remaining square footage will be warehouse. The building will be constructed
out of a combination of smooth and textured pre -cast concrete panels. The warehouse
portion of the building has 66 docks for loading and unloading.

Kennebec Drive slopes from north to south along the property line. Access to the site is
gained from Kennebec Drive near the south property line. The parking lot is at an
elevation approximately 13' below the highest point on Kennebec Drive gradually decreasing
to the point where the driveway intersects. Therefore the dock doors will be below street
grade for a portion along Kennebec Drive. The north elevation will also be below the grade
at the property line (abutting Herrigan Distributors).
Parking for the trailers is located on the north and east sides of the building; 80 trailer
parking spaces are indicated on the plan. The parking areas have been designed to segregate
the two types in order to reduce the potential conflict between the two.
Automobile parking is located on the northwest side of the building and the drive aisle is
kept along the southerly property line, away from any tractor trailers. 117 parking spaces are
indicated on the site plan; 90 employee parking stalls (9') and 22 designated visitor parking
stalls (10') and 5 handicap stalls. City Code would require 147 parking spaces for the
warehousing use alone and another 87 for office for a total of 234 stalls. In reviewing the
parking requirement staff considered several issues; 1) The employee parking is done in
three shifts and, 2) the trailer parking could be reduced and used as a proof of parking if
automobile parking becomes a problem.
The entire site will be fenced in accordance with United States Customs regulations.
Although, typically an 8' fence is required, in this instance they will be installing a 6' fence
topped with barbed wire.
The landscape plan submitted for the site indicates the use of plant material along
Kennebec Drive as an attempt to buffer the vehicular traffic from loading dock area. To
achieve this, the developer is proposing to use a mixture of spruce trees interrupted by Ash
and Maples. To ensure safe visibility, the landscaping has been set back from Kennebec
Drive near the access point. Prior to final plat the landscape plan should be submitted on
the final grading plan. In addition, all landscaped areas should be irrigated according to
City Code.
Gradine/Wetlands
The preliminary grading plan submitted with this application shows that almost the entire
site will be disturbed by grading. The site will be graded with maximum cuts of 12 feet
along the easterly edge and with maximum fills of 4 feet along the westerly edge. The
finished floor of the building is approximately 3 feet higher than the existing surface
elevation.

The developer will be responsible for installing and maintaining erosion control measures
in accordance with the City's Erosion /Sediment Control Manual Standards.
The developer's wetland consultant conducted a field review of the site in April 1994. The
only wetland found lies along the northwest perimeter of the site. The developer's
consultant has submitted documentation showing that the wetland may be exempt from
regulation under the Wetlands Conservation Act. Soil borings within the wetland site
indicate that about four feet of hydric soil was placed as fill on upland soils within the site.
In addition, aerial photos from 1979 and anecdotal evidence indicate that the fill was
excavated from portions of the area now occupied by Highway 77, and that the site was
being graded at the time the photo was taken. Based on this information, staff believes that
the wetland was unintentionally created as a result of a publicly approved project and is
therefore covered under Exemption 10 of the Wetlands Conservation Act.
Storm Drainage/Water Quality
This development is located at the lower end of Drainage Basin A. Runoff from the site
will discharge to Pond AP -51.2, which is a 0.4 acre pond within the Silver Bell development
site. The pond is included in the City's Comprehensive Storm Water Management Plan and
has an existing control structure outlet with an outlet pipe that discharges into the wetlands
along the east side of the MWCC Seneca Wastewater Treatment plant property. The water
eventually drains overland to the Minnesota River through a portion of the Nicols fen that
lies between the proposed development and the Minnesota River. This calcareous fen is
a unique type of wetland habitat given special protection under state law. City staff and the
Minnesota Department of Natural Resources strongly support the construction of the
stormwater ponding area in such a way as to maximize infiltration of ponded water into the
shallow aquifer underlying this area. The proposed two -cell ponding requirement for this
development will more than double the area covered by ponded water, which will help meet
this objective. To further increase infiltration, the developer should avoid compaction of
the pond bottom or introduction of any fine grained material that could plug pores in the
relatively sandy soils that underlie the pond. The pond design must also allow access by a
large track - mounted backhoe to the middle of the pond so that the bottom can be scarified
periodically.
In addition, runoff generated by the proposed development will discharge to the headwaters
of Kennealy Creek, a designated trout stream. City staff and the Department of Natural
Resources favor ponding to treat runoff from the industrial area and feel that maximizing
the infiltration of ponded water is essential to reduce thermal impacts to the stream.

To meet the water quality pond requirements, the Crestwood Addition will need to provide
an additional 2 acre -feet of wet pond volume in the existing pond system within the Silver
Bell parcel. As shown on the preliminary grading plan, the pond modification will need to
include two cells. The average depth of the second (lower) cell should be at least 5 feet.
The existing pond is proposed to be increased in size and an additional sedimentation pond
added to provide a two -cell pond. The two cells should be connected with a pipe. The City
will have to analyze the existing pond system to determine the size necessary for ultimate
development in this area and to minimize the discharge rate.
Sanitary Sewer
Sanitary sewer exists along Kennebec Drive and an 8" stub was provided to this site.
However, the proposed elevation of the docking area is only 2 feet higher than the 8" stub
and, therefore, cannot be utilized. The preliminary utility plan shows the proposed sanitary
sewer draining westerly from the southwest corner of the building and connecting to the
Metropolitan Waste Control Commission's (MWCC) 72" trunk line. This trunk line is under
the jurisdiction of the MWCC and the developer will be required to contact MWCC
regarding this proposed connection to obtain approval. All MWCC requirements concerning
this connection will have to be met.
Watermain
The watermain will be extended from Kennebec Drive in two locations. An 8" stub will be
extended along the south side of the property and will provide service and fire protection
to the building. The second location is shown connecting to an existing hydrant lead and
extending a 6" watermain northerly to provide fire protection to the north parking lot.
This development will be responsible for providing two 8" water main stubs to the adjacent
property to the south. The first water main stub would serve the proposed Silver Bell 2nd
Addition. The second stub would serve the future development on Outlot B of Silver Bell
2nd Addition.
Access /Street Design
Street access to this development is available from Kennebec Drive. The access will be
directly across from the curb -cut on the east side of Kennebec Drive. The access appears
to be about 40 feet wide and should be adequate for truck traffic. The radii at the access
are 60 feet and 70 feet and should allow proper turning movements for trucks. The parking
lot will require a hard surface (bituminous or concrete) and concrete curb and gutter around
all edges of the parking lot.

The preliminary plat submittal for Silver Bell 2nd Addition showed that the driveway
connection to Kennebec Drive would be a shared driveway opening with the Crestwood
Addition. The site plan layout for Silver Bell 2nd showed that the drive aisle for the Silver
Bell 2nd Addition development would connect to the driveway of the Crestwood Addition
as a tee intersection 50 feet west of Kennebec Drive.
Easements/Right -of- Way/Permits
This development will be responsible for providing utility and drainage easements for the
storm sewer from the development to the existing pond and for the expansion of the existing
pond.
C. Conditional Use Permit.
Required Findings:
A. Will not be detrimental to or endanger the public health, safety, or general welfare
of the neighborhood or the City.
B. Will be harmonious with the general and applicable specific objectives of the
Comprehensive Plan and City Code provisions.
C. Will be designed, constructed, operated and maintained so as to be compatible in
appearance with the existing or intended character of the general vicinity and will not
change the essential character of that area, nor substantially diminish or impair
property values within the neighborhood.
D. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer
systems and schools.
B. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be hazardous or detrimental to any persons, property or the
general welfare because of excessive production of traffic, noise, smoke, fumes, glare
or odors.
F. Will have vehicular ingress and egress to the property which does not create traffic
congestion or interfere with traffic on surrounding public streets.
G. Will not result in the destruction, loss or damage of a natural, scenic or historic
feature of major importance.

ANALYSIS OF PROPOSAL Freightmasters is requesting a Conditional Use Permit to allow
a truck and freight terminal within the I -1 zone.
As previously mentioned, Freightmasters specializes three areas of transportation activity:
pool distribution, trucking services for the Twin Cities air freight consumers, and lastly is
public warehousing. The largest segment of Freightmasters business is pool distribution,
where full loads of merchandise are brought in, the contents sorted by the ultimate delivery
location and either immediately reloaded or stored in the warehouse pending future
delivery. This type of service is mainly used by the retail industry for example stores like
The Limited, Eastman Kodak, Barnes & Noble, and Eddie Bauer.
In the air freight segment, Freightmasters provides local/ regional pickup and deliveries for
customers such as Northwest Airlines, Lufthansa, KLM Airlines, and American Airlines.
In the public warehousing segment short and long term storage to corporate customers is
provided as well as inventory control, packing and shipping. Economics Laboratories, Uarco
Business Forms, WR Grace Corporation and General Electric use this service.
Freightmasters, as previously mentioned, is the appointed Central Examination Station for
U.S. Customs for the Minnesota district of the U.S. Department of the Treasury. All
imported goods are directed to the warehouse facility. Every day inspections from U.S.
Customs, Federal Drug Enforcement, Department of Agriculture, and Immigration are
made.
Compatibility with Surrounding Area. The proposed site is located in an industrial area
where trucking is commonly associated with the types of uses present within this zoning
district. The City's Comprehensive Guide Plan designates this area as IND (Industrial).
SUMMARY/ CONCLUSION
Preliminary Plat. The request for a Preliminary Plat appears to substantially meets the
findings as set forth in Section 13.20 Subd. 6, as outlined on pages 1 and 2 of this planning
report.
Conditional Use Permit. The proposal appears to meet the standards as set forth in the
City Code for a Conditional Use Permit.

ACTION TO BE CONSIDERED
A. To approve /deny the Preliminary Plat for Crestwood Addition consisting of one lot on

provide service to this development shall be designed and certified by a
registered professional engineer in accordance with City adopted codes,

PRELIMINARY PLAT/WACHTER ADDITION /CITY OF EAGAN
C. Preliminary Plat, Wachter Addition /City of Eagan, consisting of three lots on 35.3
previously zoned PF (Public Facilities) acres located at the SE intersection of Pilot Knob
Rd and Wescott Rd in the NW 1/4 of Sec 22 - -The City of Eagan is requesting preliminary
plat approval of three lots on 35.3 acres zoned public facilities located in the SE intersection
of Pilot Knob and Wescott Road in the NW 1/4 of Section 22.
The Advisory Planning Commission conducted a public hearing on this preliminary plat at
its meeting of May 24, 1994. The staff report on this item is enclosed on pages
through (03 The Advisory Planning Commission recommended approval of this plat,
subject to six conditions included in the minutes of the Planning Commission meeting. It
should be noted that the commission added a 6th condition requesting that the detailed site
plan be reviewed and approved by the Advisory Parks, Recreation, and Natural Resources
Commission and the Advisory Planning Commission. There is no detailed site plan
developed at this time. It will be developed over the coming year.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny any preliminary plat
for the Wachter Addition, consisting of three lots on 35.3 acres zoned public facilities,
located at the SE intersection of Pilot Knob and Wescott Roads in the NW 1/4 of Section
22, subject to the six conditions set forth in the Advisory Planning Commission minutes.

PRELIMINARY PLAT -
WACHTER ADDITION
Chariman Voracek opened the next public hearing of he evening
regarding a Preliminary Plat consisting of three lots on 35.3 acres
in a Public Facility District located at the southeast intersection
of Pilot Knob and Wescott Roads in the NA of Section 22.
Project Planner Tyree introduced this item. She stated there is
no strict requirement for municipalities to plat property, but that
the City believed that it was appropriate for it to plat the property
concurrently with the Municipal Center /Safety Building expansion. She
stated that a new roadway alignment for the Municipal Center, Public
Safety Building and Dakota County Library is currently being
redesigned with a ring road, which will have a parkway design, to be
constructed from Pilot Knob Road along the south and the east side of
the existing City Hall building and connect to Wescott Road between
the City Hall and the Library. The proposed ring road would allow the
Library to reconstruct its parking lot and connect their existing
driveways to the proposed ring road.
Tyree stated that the property is surrounded by single - family
residential to the north and south, multiple - family residential to
the east and the Old Town Hall and single - family residential to the
west. She stated that the preliminary plat is proposing three lots,
consisting of Lot 1 for the Municipal Center /Public Safety Building,
Lot 2 for the Dakota County Library and Lot 3, which is currently
vacant but proposed for the Civic Arena.
Tyree stated that there is a total of 132 trees and 28,400 square
feet of significant woodlands. She stated that the staff is
recommending 122 trees on the site to be reserved but 10 trees will
be removed either because of damage or. disease. She stated that
grading will be needed to prepare the site for the proposed Public
Safety Building and City Hall expansion, the construction of the
proposed ring road, the construction of proposed parking lots and the
excavation for the quality treatment pond. She noted that there are
four small wetlands on the site but they are exempt from regulation
under the Wetland Conservation Act. She concluded that no parks or
trails dedication would be associated with this plat. No persons from
the public were present for comment.
Member Wallace inquired as to whether the proposed civic arena
was within the site to which Ken Vraa, Director of Parks &
Recreation, stated that it was within the proposed Lot 3. Segal
inquired as to whether there was enough area between Wescott and the
proposed ring road on Pilot Knob Road for safe traffic flow. Vraa
stated that there was sufficient room and that signalization at Pilot
Knob and Wescott Roads was scheduled for 1994.

Merkley moved, Heyl seconded, a motion to approve a Preliminary
Plat consisting of three lots on 35.3 acres in a Public Facility
District located at the southeast intersection of Pilot Knob and
Wescott Roads in the NW; of Section 22, subject to the following
conditions:
1. The developer is to provide on -site ponding to meet water
quality treatment requirements for this development. Ponding
should be designed to treat runoff from existing and
proposed developed areas in the southdrainage of the site,
and will thereby provide sufficient treatment credit so that
water quality mitigation for the north drainage of the site
is unnecessary.
2. Wetland basins 1, 2, 3 and 4, as identified in staff's
February 10, 1994 wetland delineation and inventory report
should be exempted from regulation under the Wetlands
Conservation Act as allowed under the permanent program
rules.
3. No filling or draining of the delineated fringe wetland
adjacent to Pond JP -6 is to be permitted.
4. 122 trees on site are to be either preserved during
construction or transplanted to a "safe" location on site.
Ten trees are recommended to be removed because they are
either too large ;to be transplanted or they are
damaged /diseased.
5. There are no parks or trails dedications associated wit this

SUMMARY OF REQUEST The City of Eagan is proposing a Preliminary Plat of three
lots on 35.3 acres in a Public Facilities district located in the SE intersection of Pilot Knob
and Wescott Roads in the NW 1/4 of Section 22.
AUTHORITY FOR REVIEW:
City Code Section 13.20 Subd. 6 states that "In the case of all platting, the Planning
Commission and City Council shall be guided by criteria, including the following, in
approving, denying or establishing conditions related thereto:"
A. That the proposed subdivision does comply with applicable City Code provisions and
the Comprehensive Guide Plan.
B. That the design or improvement of the proposed subdivision complies with applicable
plans of Dakota County, State of Minnesota, or the Metropolitan Council.
C. That the physical characteristics of the site including, but not limited to, topography,
vegetation, susceptibility to erosion and siltation, susceptibility to flooding, water
storage, and retention are such that the site is suitable for the type of development
or use contemplated.
D. That the site physically is suitable for the proposed density of development.
E. That the design of the subdivision or the proposed improvements is not likely to
cause environmental damage.

F. That the design of the subdivision or the type of improvements is not likely to cause
health problems.
G. That the design of the subdivision or the improvements will not conflict with
easements of record or with easements established by judgement of court.
H. That completion of the proposed development of the subdivision can be completed
in a timely manner so as not to cause an economic burden upon the City for
maintenance, repayment of bonds or similar burden.
I. That the subdivision has been properly planned for possible solar energy system use
within the subdivision or as it relates to adjacent property. (Refer to City Handbook
on Solar Access).
J. That the design of public improvements for the subdivision is compatible and
consistent with the platting or approved preliminary plat on adjacent lands.
K. That the subdivision is in compliance with those standards set forth in that certain
document entitled "City of Eagan Water Quality Management Plan for the Gun Club
Lake Watershed Management Organization" which document is properly approved
and filed with the office of the City Clerk hereinafter referred to as the "Water
Quality Management Plan ". Said document and all of the notations, references and
other information contained therein shall have the same force and effect as if fully
set down herein and is hereby made a part of this Chapter by reference and
incorporated herein as fully as if set forth herein at length. It shall be the
responsibility of the City Clerk to maintain the Water Quality Management Plan and
make the same available to the public.
BACKGROUND /HISTORY:
The property acquired in the late 1970's for the development of Eagan's Municipal Center
was never platted. There is no strict requirement for municipalities to plat property
however, city staff and Council thought it would be appropriate for the City to plat the
property at this time, concurrent to the Municipal Center /Public Safety building expansion.
Construction of the new Public Safety building and remodeling of the Municipal Center will
occur as phased development over the next two years. A new roadway alignment for the
Municipal Center, Public Safety and Dakota County Library is currently being redesigned
in an effort to serve the public better. Some of the associated design issues are still being
developed and information regarding the on -site development will be forthcoming.

EVALUATION OF REOUEST:
A. Surrounding Uses. The following existing uses, zoning, and comprehensive guide plan
designations surround the subject property:
North -
South -
East -
West -
Single family residential; zoned A & PD; designated D -I.
Single family residential; zoned R -1; designated D -I.
Multiple family residential; zoned PD; designated D -II
Old Town Hall, and single family res.; zoned R -1; designated D -I.
B. Preliminary Plat Review.
The 35.32 acre site has been platted into three lots. Lot 1 (7.72 acres) is located on the
corner of Pilot Knob Road and Wescott and contains the Municipal Center / Public Safety
building. Lot 2 (8.48 acres) is located immediately east of Lot 1 on Wescott Avenue and
contains the Dakota County Library. Lot 3 (19.13 acres) is located south adjacent to both
Lots 1 & 2, and is currently vacant.
Setbacks
All existing buildings meet or exceed the minimum building setbacks.
Tree Preservation
The tree inventory for this site indicates a total of 132 trees and 28,400 s.f. of significant
woodlands. The woodlands are comprised mostly of chinese elm, box elder and silver maple
with the exception of 2,500 O. pine plantation woodland. Staff is recommending that 122
trees on site either be preserved during construction or transplanted to a safe location on
site. Ten trees are recommended to be removed because they are either too large to be
transplanted or they are damaged or diseased.
Compatibility with Surrounding Area
The proposed plat and future development is consistent with the City's Comprehensive
Guide Plan and existing use.

Grading & Wetlands
The grading that will be needed to prepare this site will include the following:
• Grading for the proposed Public Safety Building and City Hall expansion.
• Construction of the proposed ring road that will loop around the south and east side
of City Hall from Pilot Knob Road to Wescott Road.
• Construction of the proposed parking lots.
• Excavation required for the water quality treatment pond.
The grading that will be required for the Public Safety Building includes removal of some
unsuitable material along the south edge of the building that is approximately 10 -15 feet
below grade. The basement level for the Public Safety Building will require cuts of 20 feet.
Also, 20 feet of cut will be required at the water quality treatment pond, Pond JP -6.1.
Maximum fills will be approximately 10 feet for the proposed parking lot that will be
constructed south of the existing City Hall building.
The development will be responsible for installing and maintaining erosion control measures
in accordance with the City's Erosion /Sediment Control Manual standards. Special care
needs to be taken to protect Pond JP -6 which is located in the southeast corner of the site.
A wetland inventory of the site was completed by City water resources staff in February,
1994. Four small wetlands, ranging in area from 60 square feet to 4,000 square feet were
located within the development area. All four are associated with ditches and overland
drainage swales and none are identified on the National Wetlands Inventory. Staff
examined detailed soil surveys, 1970 and 1990 aerial photos, and grading records for the
area and have compiled documentation showing these wetlands were formed by site grading
that altered drainage patterns and inadvertently created the wetland. Since the actions were
taken by public entities, the wetlands are exempt from regulation under the Wetlands
Conservation Act (Exemption 10) and can be filled or drained without providing
replacement.
A fringe wetland located adjacent to Pond JP -6 was also found and delineated. No filling
or draining of this wetland is being proposed as part of the development.

Storm Drainage/Water Qua lity
This development is located in drainage basin J which discharges eventually to Fish Lake.
The northern 12 acres of the site currently drains to Pond JP -15 which is a 2 -acre pond
classified as an indirect contact waterbody. Pond JP -15 is located on the east edge of Fish
Lake and is separated from Fish Lake by a berm. The southern 22.7 acres of the site
discharges to Pond JP -6, an 8 acre wetland with an average depth of about 3 feet classified
as an indirect contact recreation water body in the City's water quality management plan.
Lot 2 and the north half of Lot 1:
Development of the site that lies within the direct drainage of Pond JP -15 will increase by
about 1.8 acres the impervious area that discharges to this pond. Staff evaluated the only
possible ponding site for this portion of the development and it would have been located
in the northeast corner of the library site. Because of topography and constraints imposed
by the existing development features on the site, on -site ponding is not feasible.
Lot 3 and the south half of Lot 1:
Of the 22.7 acres of the site that currently drain to the south, about 11.7 acres are currently
undeveloped and 11 acres are developed as part of the present Municipal Center complex.
Development currently on the site took place prior to the adoption of the City's water
quality ordinance, so on -site ponding to treat stormwater was not considered at the time.
The current development proposal as well as likely future development of the site will
convert all the present undeveloped area to a land use similar in intensity to
commercial /industrial. On -site ponding is feasible and has been incorporated into the site
plan to treat stormwater generated by this portion of the site. The pond system is currently
designed to treat runoff from both the existing ( "grandfathered ") portion of the City -owned
portion of the Pond JP -6 watershed and all new development that is likely to occur on the
site in the future. In so doing, the pond will generate sufficient water quality treatment
"credit" for both the north and south sub - drainages of the site.
The proposed water quality treatment pond is shown to be constructed along the northwest
edge of Pond JP -6. The design of the pond will feature two cells with the upper cell
containing 0.28 acre feet of wet storage volume and the lower cell containing 1.52 acre feet
of wet storage volume. The pond storage volume that will be required is 2.0 acre feet with
a maximum flow out of 34 cfs.

Utilities
An 8" sanitary sewer line will be extended from the proposed public safety building to the
north to connect to an existing 8" sanitary sewer line in Wescott Road. A proposed 8" water
line will also be extended to the north from the Public Safety Building to connect to the
existing 12" water main in Wescott Road. The proposed construction will require the
extension of an 8" watermain along the proposed ring road to provide fire protection to the
south edge of the Public Safety Building and City Hall and to provide a water main stub to
future developments on the southwest 10 -acre portion of this site.
Streets /Access /Circulation
Street access is readily available from Wescott Road to the north and to the west to Pilot
Knob Road. As shown on the preliminary site plan, a ring road with a parkway design will
be constructed from Pilot Knob Road along the south and the east side of the existing City
Hall building and connect up to Wescott Road in between City Hall and the Library. The
proposed street connection to Wescott Road will allow the Library to reconstruct its parking
lot and connect their existing driveway to the proposed new street. The proposed street
connection to Pilot Knob Road will be opposite the Kings Wood Road intersection.
The City and Dakota County Highway Department are planning to add traffic control
signals to the Wescott Road and Pilot Knob Road intersection. The signal construction
work is scheduled to be completed this summer,(County Project No. is 31 -37).
The preliminary site plan shows the construction of 18 parking spaces for staff parking along
the east side of the Library and the construction of an additional 40 parking spaces along
the west and northwest side of the Library for visitor parking. The preliminary site plan
shows the construction of an additional 56 parking spaces along the south side of the
existing City Hall.
Easements /Right -of -Way /Permits
This development will be responsible for obtaining regulatory agency permits from MPCA,
MnDept. of Health, MWCC, and Dakota County Highway Department prior to construction.
Parks And Recreation.
The Advisory Parks, Recreation, and Natural Resources Commission reviewed this proposal
at its May 16, 1994 meeting. No parks or trails dedication will be associated with this plat.

SUMMARY /CONCLUSION
When the City originally aquired this property it was intended that the facilties would
further expand. Now that the expansion plans are being developed it is appropriate at this
time to plat the property. Additional information regarding the specific on -site details will
be provided as they become complete.
The proposed preliminary plat and existing, use is in conformance with the City's
Comprehensive Guide Plan.

A Special City Council meeting was held on Tuesday, June 07, 1994 at 5:00 P.M. in the Eagan Municipal
Center Building. Mayor Egan, and City Councilmember Awada, Hunter, and Wachter were present. Absent
for the first part of the meeting was Councilmember Masin who then attended the Special City Council meeting
from 530 on. Also present were Director of Public Works Colbert, Director of Community Development
Director Reichert, Director of Finance VanCvetbek:{?et: :Af: Police Geagan, Chief Building Official Reid,
Cable Coordinator Reardon, Director of ParkSVria; S tir:City Administrator Hohenstein, Assistant to
Administrator Duffy, Administrative Intern Pruitt, and 6i4; Administrator Hedges. The purpose of the meeting
was to provide City Council direction on 1) remodeling of the municipal center building and 2) consider a •
settlement regarding the police officer's negotiations,

City Administrator Hedges provide an update on the site development phase, which started June 6, 1994
along with the pre -bid conference. He thanked Assistant to City Administrator Hohenstein and Chief Building
Official Reid for their work behind the scenes in the municipal expansion/ police building construction process.
Mr. Hedges also asked what date would be . most convenient for the Council to attend a ground breaking
ceremony. Wachter moved, Hunter second4::i3:.motion to approve a ground breaking ceremony for the
municipal center expansion /police building constriietion:im Wednesday June 22, 1994 which would include the

Architect Thorbeck provided an update on ;ihe a iari1 t5F He noted that shortly an addendum asking
questions for approval and clarifying modifications :wotild:be•presented shortly to the Council. Chief of Police
Geagan reminded the public and Councilmei ber•5Tiliat beginning on June 8, 1994 a temporary access would be
used. Exterior building materials, Mr. Thorbeck noted, would be carried out through the expansion and new
building Providing clarification, Mr. Thorbeck described that the curtain wall would consist of gypsum board
and a band of windows across both buildings. During the day, Mr. Thorbeck noted, the curtain wall will read
like a full sheet of glass, which will add to the appearance of the Municipal Center. Councilmember Wachter
endorsed Mr. Thorbeck's proposal of usingsplar,glass.a$ it will look attractive and provide a substantial cost
savings to the City. City Administrator He4g 0a :that :stf:had investigated alternatives to parking within
the City lot, for example, building inspectors'will tie paiking riti off -site location in order to lessen the amount
of on -site parking during construction.
Mr. Thorbeck presented sketches and a mode3: if the pro .sed expansion. He described the external
configuration and appearance of the muncicipal expansion and potriv building construction. Mr. Thorbeck also
provided an update on the layout of the first floor of the building, noting modification to the Council ante room,
police hallway and community room as requested by the Steering Committee and City Council. He stated that
the proposed public inner lobby invites people into the entryway service space. The design reflected the current
thinking of the Steering Committee that instead of a staff person sitting at the front counter, instead, staff would
be responsible for coming up to the service counter as the public :needed them, in order to create a more user
friendly service environment. He added that in order to create a savings, the elevator and telephone system
would only be updated and not significantly edt�rec}.: : : :. : . : • : • : • : •• : •:• ;: •
• When questioned about the possibility of a portable lectern- podium with a microphone located in the
middle of the Council Chamber, in addition to an audio- visu4: presentation platform with a large wall
presentation screen and elevated ADA accessible podium for the:public, Council consensus was in approval of
such a lectern- podium for the middle of the chamber. The Council, Mr. Thorbeck noted, would still rely on
monitors for detail orientation. The simple podium was in order to facilitate a less formal area to speak from

for the public. Cable Coordinator Reardon >remarked that the . offset podium provides more of a balanced
relationship between the Council and the pubic;for the City of Bsiisville.
City Councilmember Awada questioned'.Tio:'tat•fe':'seating m the new Council Chambers. Mr.
Thorbeck responded the amount would remain approximately the same, with 100 stackable chairs.
Councilmember Wachter pointed out that in addition to the new Council Chambers the existing Council
Chambers could provide overflow seating for an additional 100 citizens if equipped with appropraite montiors.
