The grant of the foregoing permanent easement for ponding and
utility purposes includes the right of the City, its contractors,
agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes,
conduits, mains and ponds; and the further right to remove trees,
brush, undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore
the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of
trees, brush, undergrowth and other obstructions.
And the Landowner, its heirs and assigns, does covenant with the
City, its successors and assigns, that it is the Landowner of the
premises aforesaid and has good right to grant and convey the
easement herein to the City.

27, Range 23,(Parcel No. 10-02400-012-58), Dakota County, Minnesota.
DENNIS M. BARTEL and KATHLEEN BARTEL, husband and wife,
The undersigned /for themselves, their heirs, executors, administrators, suc-
cessors and assigns, hereby consent to the levy of assessments or the raking of
a connection charge in lieu of assessment at the time said property is
connected to the trunk water main installed under Project 365
or at any earlier time at the option of the undersigned, so long as said assess-
ment or connection charge is made at the prevailing rate at the time of connec-
tion or such earlier time.
The undersigned, for themselves, their heirs, executors, administrators, suc-
cessors, and assigns, further hereby waive notice of any and all hearings neces-
sary and waive objection to any technical defects in any proceedings related to
any assessment or connection charges for City of Eagan Project 365
or Contract No. 82-14 for said improvements, and further waive the right
to object to or appeal from any assessments or nnection charges made in the
