THIS EASEMENT, made this ail day ofci , J J06g, between THOMAS
J. MAURER CONSTRUCTION, INC., a Minnesota corporation (hereinafter referred to as
"Landowner "), and the CITY OF EAGAN, a municipal corporation, organized under the laws of
the State of Minnesota (hereinafter referred to as the "City ").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to -wit:
That part of Lot 9, Block 1, Walden Heights Second Addition, City of Eagan,
Minnesota described as follows:
Commencing at the southeast corner of Lot 9, Block 1, which is the
point of beginning; thence South 89 degrees 52 minutes 51 seconds
West, and a distance of 10.51 feet; thence North 18 degrees 08
minutes 40 seconds West, and a distance of 42.20 feet; thence
North 11 degrees 31 minutes 56 seconds East and a distance of
20.20 feet; thence South 18 degrees 08 minutes 39 seconds East,
and a distance of 63.00 feet to the point of beginning.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the rig t of the City, its contractors, agents and servants to enter upon the premises at all
reasona . le times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstructions. After
comple ion of such construction, maintenance, repair or removal, the City shall restore the

premise to the condition in which it was found prior to the commencement of such actions, save
only for he necessary removal of trees, brush, undergrowth and other obstructions.
