MAURER CONSTRUCTION, INC., a Minnesota corporation (hereinafter referred to as "Landowner "), and the CITY OF EAGAN, a municipal corporation, organized under the laws of the State of Minnesota (hereinafter referred to as the "City "). WITNESSETH: That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant and convey unto the City, its successors and assigns, a permanent drainage and utility easement, over, across and under the following described premises, situated within Dakota County, Minnesota, to -wit: That part of Lot 9, Block 1, Walden Heights Second Addition, City of Eagan, Minnesota described as follows: Commencing at the southeast corner of Lot 9, Block 1, which is the point of beginning; thence South 89 degrees 52 minutes 51 seconds West, and a distance of 10.51 feet; thence North 18 degrees 08 minutes 40 seconds West, and a distance of 42.20 feet; thence North 11 degrees 31 minutes 56 seconds East and a distance of 20.20 feet; thence South 18 degrees 08 minutes 39 seconds East, and a distance of 63.00 feet to the point of beginning. The grant of the foregoing permanent easement for drainage and utility purposes includes the rig t of the City, its contractors, agents and servants to enter upon the premises at all reasona . le times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and the further right to remove trees, brush, undergrowth and other obstructions.
