THIS DRAINAGE AND UTILITY AND TEMPORARY CONSTRUCTION
EASEMENT is made and entered into this eN: of \ ,009 by and
between Kenneth G. Bergman & Lisa J. Blee, husband and wife, hereinafter referred to as
"Landowners," and the City of Eagan, a municipal corporation organized under the laws of the
State of Minnesota, hereinafter referred to as the "City ".
That the Landowners, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do
hereby grant and convey unto the City, its successors and assigns, a permanent Drainage and
Utility Easement over, across and under the following described premises, situated within Dakota
County, Minnesota, to -wit:
A 20.00 foot perpetual easement for drainage and utility purposes over, under and across Lot 13,
Block 1, LEXINGTON POINTE FOURTEENTH ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota, the centerline of said easement is described as follows:
Commencing at the southeast corner of said Lot 13; thence South 89 degrees 59 minutes 31
seconds West, assumed bearing, along the south line of said Lot 13, a distance of 75.58 feet to
the actual point of beginning of the centerline to be described; thence North 00 degrees 23
minutes 14 seconds West 146.96 feet; thence northeasterly along a tangential curve, concave to
the east, having a radius of 150.00 feet and a central angle of 28 degrees 41 minutes 42 seconds a
distance of 75.1,2 feet to the westerly line of the drainage and utility easement dedicated on said
Lot 13 and said centerline terminating. The side lines of said easement are to be lengthened or
shortened to terminate on the existing easements dedicated on said Lot 13.

LEXINGTON POINTE FOURTEENTH ADDITION, according to the recorded plat thereof,
Dakota County, Minnesota, lying easterly and southeasterly of the following described line:
Commencing at the southeast corner of said Lot 13; thence South 89 degrees 59 minutes 31
seconds West, assumed bearing, along the south line of said Lot 13, a distance of 105.58 feet to
the actual point of beginning of the line to be described; thence North 00 degrees 23 minutes 14
seconds West 146.85 feet; thence northeasterly along a tangential curve, concave to the east,
having a radius of 180.00 feet and a central angle of 43 degrees 23 minutes 40 seconds a distance
of 136.33 feet to the westerly line of the drainage and utility easement dedicated on said Lot 13
and said centerline terminating. The side lines of said easement are to be lengthened or shortened
to terminate on the existing easements dedicated on said Lot 13.
Said temporary construction easement contains ±13,198 square feet.
Said temporary construction easement to expire October 31, 2010.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect or repair site grading, erosion control and turf
establishment; and the further right to remove trees, brush, undergrowth and other obstructions.
After completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions, subject only
to permanent easement alterations.
The grant of the foregoing Temporary Construction Easement for site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all

establishment; and the further right to remove trees, brush, undergrowth and other obstructions.

And the Landowners, their heirs and assigns, do covenant with the City, its successors and
