May 3, 2010 Mr. Collin Merrill Suburban Landscape Service 3486 Dodd Road Eagan MN 55123 Re: 3486 Dodd Road Dear Collin: I have had the opportunity to review with members of our staff your proposed building permit plans for the already constructed lean -to as well as how the adverse possession process you recently went through affects the subject property. The adverse possession process created non - conformities on the subject parcel by combining two principal uses (residential and commercial) and two principal structures (home and business) on one parcel. While the City acknowledges these non - conformities, an expansion to either of the structures and/or the use, cannot be allowed. Therefore, the lean -to, which was built without a building permit, must be removed. If you wish to proceed with the lean -to addition, it will be necessary to meet the building material requirements, as well as bring the lot and principal uses into conformance. This would be done by means of the Subdivision process in order to create separate parcels; one for the home and one for the landscape operation. In either case, a Conditional Use Permit (CUP) is required to allow the existing outdoor storage on the site. We discussed this process a few months ago and I have enclosed the associated information necessary for the CUP application.
