THIS ACCESS EASEMENT ( "Easement ") is made this 14 I 'kay of j- 2 Qf
2009, between CHARLES F. HALL, SR. and JUNE G. HALL, husband and wife, (hereinafter
referred to as "Landowners "), and the CITY OF EAGAN, a municipal corporation, organized
under the laws of the State of Minnesota, (hereinafter referred to as the "City ").
WITNESSETH:
That the Landowners, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent access easement,
over, across and under the following described property, situated within Dakota County,
Minnesota, to -wit:
A strip of land 20 feet in width over and across that part of Lot 2, Block 1, THE
OAKS OF BRIDGEWATER 3RD ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota, the centerline of said 20 foot strip is
described as follows:
Commencing at the southeast corner of said Lot 2; thence North 5
degrees 47 minutes 47 seconds East, along the east line of said Lot
2, a distance of 117.61 feet to the beginning of centerline to be
described; thence North 80 degrees 48 minutes 37 seconds West a
distance of 35.18 feet; thence South 85 degrees 04 minutes 59
seconds West a distance of 89.73 feet; thence South 75 degrees 46
minutes 22 seconds West a distance of 60.62 feet; thence South 33
degrees 25 minutes 27 seconds West a distance of 42.64 feet;
thence North 79 degrees 40 minutes 31 seconds West a distance of
50.58 feet; thence North 86 degrees 31 minutes 41 seconds West a
distance of 72 feet, more or less, to the shoreline of Bald Lake and
there said centerline terminates.
See also Exhibit "A" attached hereto and incorporated herein (the "Easement Area ").

The grant of the foregoing permanent easement for access purposes includes the right of
the City, its contractors, agents and servants to enter upon the Easement Area at all reasonable
times for access purposes; and the further right, but not obligation, to enter upon the Easement
Area at all reasonable times to remove potential obstructions, such as wood, brush, leaf piles,
grass clippings, or other objects that may obstruct the Easement Area. After completion of
removal, the City shall restore the Easement Area to the condition in which it was found prior to
the commencement of such actions, save only for the necessary removal of potential
obstructions.
And the Landowners, their heirs and assigns, do covenant with the City, its successors
and assigns, that they are the Landowners of the property aforesaid and have good right to grant
and convey the Easement herein to the City.
IN TESTIMONY WHEREOF, the Landowners have caused this easement to be executed
as of the day and year first above written.
