I have had no recent communications with them and no response to my letter of April 25 in which we explained the CC position on not waiving penalties and interest. It doesn't seem to likely that Argosy will follow up with the City again, but that remains to be seen. I assume you are all over it, but this might be a good update for the CC during the listening session if there is time. As agreed to in those communications, City staff has reviewed the circumstances surrounding the penalties and interest situation on the Argosy property. While we understand the financial challenges caused by the original assessments and further compounded by the penalties and interest, we have concluded that staff will not be making a recommendation to the City Council to waive or reduce the penalties or interest that is due at Dakota County. The City Council is aware of this conclusion and has been advised that you would perhaps like to meet with them directly. If that remains your desire, at your request the matter will be placed on a City Council Agenda as an action item for public discussion and consideration. The City's past practice has been to not waive penalties and interest unless it was clear that the City had some responsibility for the deadlines being missed. don't believe that you have suggested that the City has any responsibility for the payments not being made in advance of the deadlines. Although unpopular at times, this practice takes the City out of the internal affairs of any individual taxpayer's business and is the most consistent and fair position to take in representing all taxpayers. Further, the City as a local government cannot reasonably allow itself to be placed in a position of subsidizing certain businesses or individuals through abatements or forgiveness of amounts due. That agreement would likely require a signed waiver of assessments for the total amount and the outstanding balance would again be assessed to the property, if not paid per the terms of the agreement. VanOverbeke of Administrative Services Cc: City Administrator Hedges Chief Financial Officer Pepper City of Eaaall ' MOM TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: APRIL 2, 2010 SUBJECT: ADDITIONAL INFORMATION Z ARGOSY UNIVERSITY SPECIAL ASSESSMENT PENALTIES & INTEREST, Argosy University located at 1515 Central Parkway is a tax exempt property; however, it is subject to payment of special assessments as billed on annual property tax statements. Payment deadlines are consistent with those for all other property taxpayers and penalties and interest charges for late payments or non - payments are accrued in a manner similar to those for property taxes. Argosy was late in paying its May 2008 special assessment installment and has been asking the City to waive /negotiate a reduction of penalties and interest for that late payment on an intermittent basis since June of 2008. Argosy applied to the County for a hardship abatement on the 2008 interest and penalties, but the request was denied by the County. Subsequently, the October 15, 2009 installment was also paid late and is incurring penalties and interest through the normal course of business. Argosy officials are again requesting consideration for "some form of abatement or for us to come to a mutually acceptable consensus with regards to a modified penalty." As of April 1, 2010 the 2008 penalties and interest total $5,722.92 and the 2009 penalties and interest total $12,412.34, for a grand total due of $18,135.26. For the most part, the amounts increase monthly per State Statute. Since the interest and penalties all relate to City of Eagan special assessments, only the City can abate or negotiate payment amounts and absent action from the property owner they continue to accrue at the County. Except in cases where there has been an obvious error, staff does not have the authority to abate any City charges. Therefore, any negotiated resolution resulting in a reduction would require City Council approval. I called on Monday to make the suggestion that perhaps it would be best for you to make the payment to Dakota County for all outstanding penalties and interest to keep them from continuing to accrue, as I believed more interest would accrue as of April 1. I realize and understand that you have business decisions to make as to how you approach this situation, as does the City of Eagan, and from your perspective that might not have been a practical suggestion. I would also like to reiterate that since the annual special assessment installments must be made payable to Dakota County, the City has no record as to whether or not checks were actually received or the date on which they were received. The City can only collect or directly receive money for special assessments for deferred balances that have not yet been placed on a tax statement. I believe you have had some conversations with other City staff regarding the process. At that time the service that handled our payables had ample time to prepare and send in the payment but for reasons unknown to us the payment was received over a week late. Eagan City staff and I had been in communication with regards to this situation since that initial notification. We are writing to you because Dakota County stated that any adjustment to the penalties levied was a city issue, as it was for a city assessment, and as such we should be in communication with the City of Eagan. After meeting with Mr. Pepper and Mr. Hedges, it was suggested to me that I should write a letter detailing the situation so that they could take this case further with the city. Unfortunately our tribulation does not end there. Most recently our October 2009 payment was not receipted by the Dakota County Property Taxation and Records department. Our records stated that a check was drawn and sent in September of 2009. We were unaware that it had not been received by the County until a notification dated 11/12/2009 stated that it was past due. We stopped payment of the original check. With the notification was a penalty due of 7,867.46, an 8% fee. We quickly had a replacement check cut and sent in November for the original amount. We humbly ask the city for some form of abatement or for us to come to a mutually acceptable consensus with regards to a modified penalty. We were not malicious in either case nor were we without the proper funding to meet our commitments. The penalties charged are more than punitive, they are institutionally damaging. These penalties can create an undue hardship as we operate under an extremely tight plan and unbudgeted penalties such as these would take away our ability to provide the academic services required by our accrediting agencies. We are more than willing to settle for an amount that would be fair for both the City and the University. We are filing under the hardship category. Argosy University is an accredited private educational institution that services the Twin Cities area. Our purpose is to provide Associate, Bachelor, Graduate and Doctoral degrees to our successful candidates. This penalty would cause us undue hardship as it is an unbudgeted item. The majority of our expenditures are of the non - discretionary type. To cover this penalty, services that are discretionary and deemed critical by our accreditation agencies would have to be sacrificed. As such students would be forced to bear the effect of this unfortunate and unique situation. There was no malice involved in this late payment. The individual who handled these matters left our employment prior to the mailing of the payment. We are filing under the hardship category. Argosy University is an accredited private educational institution that services the Twin Cities area Our purpose is to provide Associate, Bachelor, Graduate and Doctoral degrees to our successful candidates. This penalty would cause us undue hardship as it is an unbudgeted item. The majority of our expenditures are of the non - discretionary type. To cover this penalty, services that are discretionary and deemed critical by our accreditation agencies would have to be sacrificed. As such students would be forced to bear the effect of this unfortunate and unique situation. There was no malice involved in this late payment. The individual who handled these matters left our employment prior to the mailing of the payment. It was identified as a priority and sent out before the stated deadline to our service that produces our payments and was mailed from that location. Thank you for your consideration in this matter.
