the ABF Freight Systems to be located at 2950 Lone Oak Circle within the City of Eagan.
It is the Council's understanding the minor remodeling and bathroom addition will not change
the SAC use of the property; therefore, no additional SAC is due.
The business information was provided to MCES by the applicant at this time. It is the City's
responsibility to substantiate the business use and size at the time of the final inspection. If there

Hi Craig,
I looked at the area calculations and agree that changing the construction classification to Type IIB makes much more
sense. I didn't originally do that because I knew that there was at least some wood construction in the existing offices.
The change however will bring the building closer to the allowable areas if the building were to meet current IBC 2006
requirements. It is 17% over area for IIB under new codes; however, since this is an existing condition, would not need
to be addressed at this time. Obviously, no change in use or addition would be allowed without addressing the
allowable area with fire suppression or area separation fire walls.
I have attached the revised plans in pdf format showing the new classification and changing the few new walls to metal
stud. I will also drop off a set of revised plans around noon today.
If you have any other suggestions or questions, please let me know.

I found the original plans for this address in our archives. Unfortunately, the plans that we have are lacking a code
analysis. There are not any wall types listed either. The building was built of masonry and steel (in 1968) according to
our records. Knowing these facts, I would ask that you work up a code analysis that supports the use of combustible
construction for the walls in this remodeling proposal, or change the construction of the new walls to non combustible
materials.

The Minnesota Pollution Control Agency (MPCA) has received your notification
that a release of petroleum has occurred from storage tank facilities which you
own and operate. The first report of the release was made to MPCA staff on
September 8, 1988. The tank facilities are located at:

Eagan, Minnesota
Federal and state laws require that persons legally responsible for storage tank
releases notify the MPCA of the release, investigate the extent of the release
and take actions needed to ensure that the release is cleaned up. A perso? is
generaily considered legally respans=62e for a tank release if the gerson owned
or operated the tank either during or after the release. Excerpts from the
state law es[ablishing cleanup liability, with a limited exception for certain
owners who were unaware they owned a tank, are enclosed with this letter. In
addition, the Petroleom Tank Release Cleanup Act requires that any person
furnish upon request from the MPCA Commissioner whatever information that person
may have or may reasonably obtain that is relevant to the release.
We are aware that a leaking underground storage tank has been pumped out.
However, the magnitude and extent of petroleum contamination has not been
determined. The MPCA is therefore asking you to sign and comply with the
enclosed Letter of Intent to Proceed with the necessary investigative and
corrective action at the site.

If you do perform the requested work, the state may reimburse you for some of
your costs. The Petroleum Tank Release Cleanup Act establishes a fund which in
certain circumstances provides partial reimbursement for petroleum tank release
cleanup costs. This fund is administered by the Petroleum Tank Release
Compensation Board (Petro Board). The section of the law that discusses who is
eligible for reimbursement from this fund is enclosed. More specific
eligibility rules are available from the Petro Board (612/297-3238).
Enclosed please find the following:

- Excerpts from state law regarding liability and reimbursement
You are asked to sign and return the enclosed Letter of Intent to Proceed within
30 days after receipt of this letter. If you do sign the Letter and remain in
compliance with its terms:
- your willingness to proceed will be documented and, if you apply for cost
reimbursement, reported to the Petro Board. The Petro Board would decide
whether or not you received any reimbursement of your costs, in part '
based on your cooperation with the MPCA.
- the MPCA will not issue a formal order to you to undertake the required
investigation.
- the MPCA will not take the required investigation itself, and will not
seek to recover its investigative costs from you by legal action.
- the MPCA will review your plans and reports and will comment on your
recommended investigations. We may suggest or require changes to ensure
adequate investigatio? and corrective action.
If yau do r,ot sign the enc3osed Letter of Intent to iroceed:
- the Commissioner of the MPCA may formally order you to take the required
actions. Failure to comply with a formal order is a violation of federal
and state law.
- the MPCA may take the required actions itself and recover the costs from
you through legal action commenced by the Attorney General.

compel you to take the required actions.
As you review the Letter of Intent to Proceed with your insurance
representative, attorney, and consultant, you may wish to propose minor
modifications to the MPCA Project Leader. Any such modifications shall not be
effective until accepted by the MPCA Project Leader.
Signing the Letter does not prohibit you from taking investigative or corrective
actions more quickly than is required by the Letter of Intent to Proceed as long

as you are in compliance with the notification requirements of paragraph 5 of
the Letter. You may also exceed the requirements for investigations and
corrective actions described by the enclosed.
The MPCA may require additional investigation, corrective action or information
regarding the site, if the information generated by your initial investigation
or from another source indicates that addi[ional work is needed.
If you conclude now or at any point in your investigation that the release in
question is not from any tank w6ich you have owned or operated, please notify
the MPCA immediately and explain the basis of your conclusion. The MPCA Project
Leader may authorize you to stop your investigation.

By signing this form, I express the intent (on behalf of myself or my
organization, as indicated below) to cooperate with the Minnesota Pollution
Control Agency (MPCA) by taking the following steps in response to the petroleum
tank release at the above-referenced site. I am not admitting or denying
responsibility for the release. I intend to:
1. Facility Information. Submit the information required by Part I of the
attached document "Contents of Petroleum Tank Release Investigation Report"
(PTR) within 30 days after the receipt of this letter.
2. Remedial Investigation Vork Plan. Notify the Project Leader within 30 days
after receipt of this letter, of the name of consultant or persons selected to
conduct the Remedial Investigation (RI). Require consultant to call Project
Leader prior to commencing RI work to discuss scope and schedule of the RI.
Submit a written work plan if requested by Project Leader.
3. Remedial Investigation and Report. Undertake the Remedial Investigation
outlined in the RI Work Plan and submit anaP FtZ Report containing the information
required in Parts II and III of the PTR.
4. Free Product Response. Notify the MPCA within 24 hours after any discovery
of free floating petroleum product (free product) on the surface of the ground
water, take steps as directed by MPCA staff to remove the free product as
completely as possible, and submit a report to the MPCA within 30 days
describing these removal efforts.
5. Notification. Notify the MPCA three days before taking any steps such as
removing or repaizing tanks, testing tanks, conducting soil borings, recovering
free product, installing or sampling monitoring wells and excavating soil. I
will also immediately notify the MPCA of any new petroleum releases or the
discovery of previously unknown releases or health and safety threats.

APPLICATION SIIMMARY: An application has been submitted requesting
a Conditional IIse Permit to allow the sale and lease of used trucks
and trailers as a secondary use to the primary use of contract mail
haulers. The site is located east of Lone Oak Circle, just north
of Lone Oak Road.
COMMENTB: The applicant currently leases space from Roadway Inc.
and runs a contract hauling trucking firm. Roadway Inc. has
previously been granted a Conditional Use Permit to operate a truck
and freight terminal at this site. 95% of Hoovestol's business is
hauling mail, while the remaining 5% of the business operation is
the sales and leasing of trailers and trucks. The Conditional Use
Permit is being sought so the applicant can get a dealers license
from the State of Minnesota, primarily for leasing trailers. The
used trucks and trailers that will be available for sales and
leasing come from the applicant's fleet as newer vehicles are
acquired by the company.
The leasing and sales activity, as proposed, will not include the
general public, but instead will be geared to other trucking
companies and/or professional truckers. The applicant has also
stated that the average number of sale and lease items on site at
one time will be up to seven. The contract hauling operation has
been in Eagan since 1978 and at the current site for approximately
two years.
If approved, this permit shall be subject to the following
conditions:
1. No more than eight items for sale and lease shall be on-site
at one time.

monitoring for releases from underground storage tanks. The well.s will
be constructed with low carbon steel risers and 10 foot lq slot
stainless steel screens. Since the wells are in a high traffic area
they will be constructed at-grade according to MDH requirements. The
wells shall be neat cement pressure grouted.

PONDING AND DRAINAGE EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT is made as of O , 1994,
by and between Roadway Express, Inc., a Dela re corporation
("Roadway"), and the City of Eagan, a Minnesota municipal
corporation (the "City").
RECITALS:
A. Roadway is the owner of the following described real
estate situated in the City, Dakota County, Minnesota:
Lot 2, except the
200 feet thereof
to the North and
Eagandale Center
(the "Property").
North 150 feet of the West
(as measured at right angles
West lines, respectively)
Industrial Park No. 2
B. In connection with Roadway's proposed development of
the Property, it was necessary for Roadway to obtain an
Conditional Use.Permit. One of the conditions to the issuance of
the Conditional Use Permit is that Roadway dedicate drainage and
ponding easements to receive and hold storm water runoff from the
Property.
C. The purpose of this Easement Agreement is to provide
the drainage and ponding easements required by the City.
NOW, THEREFORE, it is agreed by and between the parties, for
valuable consideration, the receipt and adequacy of which are
N hereby acknowledged, as follows:
` l. Grant of Easement. Roadway hereby grants to the City a
non-exclusive easement for drainage and ponding purposes over
that part of the Property described on Exhibit A hereto (the
"Easement Area").
2. Maintenance of Easement Area. The City shall, at its
expense, maintain the Easement Area, and shall have the right to
do whatever is necessary to maintain the purposes of the Easement
Area, including, without limitation, the right to clear and
remove obstructions from the Easement Area; the right to excavate
within the Easement Area; the right to install, lay, maintain,
operate and repair storm sewer pipes serving the Easement Area;
and the right to fence or otherwise secure the Easement Area.
The riqhts granted to the City hereunder shall include the right
of ingress and egress to and from the Easement Area for these
purposes. After completion of any work within the Easement Area
of the Property, the City shall restore the Easement Area and the
Property•to the condition which existed prior to the work, except
for the removal of trees, brush, undergrowth and other
obstructions as noted above. The City shall use reasonable

efforts not to interfere with business operations on the Property
while conducting any work thereon or within the Easement Area.
3. Release. Roadway releases the City, its successors and
assigns, from all claims for any and all damaqes resulting to the
Easement Area by reason of the location of the pondinq area and
drainage lines within the same.
4. Restoration. Following any work by the City within the
Easement Area or Property, the City will restore the Easement
Area or Property as provided in paragraph 2 above, which
restoration shall include restoration of those pcrtions of the
Easement Area located outside cf the anticipated perimeter of
standing water to as near the existing grade as is reasonably
possible, and the City further agrees to replace existing
cultivated shrubs or sod and to seed all areas not covered with
standing water.
5. Snecial Assessments. The City hereby waives and
releases its riqht to assess the Easement Area or any portion
thereof for any special assessment levied on an area wide basis
on account of any City improvement for such time as the Easement
Area is encumbered by the tern?s and conditions of this Easement
Agreement. At such time as this Easement Agreement is
terminated, or the ponding and drainage purposes are abandoned,
then the Easement Area shall again be subject to such special
assessments as may then or thereafter be levied.
6. Title Representation. Roadway
to the City, its successors and assigns,
owner of the Easement Area, and has full

Thank you for the opportunity to bid the upcoming roofing project scheduled at tlus facility. We have
proposed an SBS Modified Bihunen Roof System. We are licensed and approved by all major
manufacturers (e.g. GAF, Firestone, Versico) so if you choose Allweather Roof for the installation you
will have your choice of manufacturers.
Scone of Work
Entire Building -11,846 Square Feet
SBS Modified Bitumen Roofing System
1. Conduct a pre job meeting to discuss job scheduling, safety requirements, and job site
logistics.
2. Vacuum or power sweep off all loose gravel and properly dispose of off site.
3. Clean and prepare the existing surface as necessary removing a111oose dirt, dust and debris.
4. Conduct infrazed thermal scan to locate any wet insulation. Remove wet insulation and build
roof back to level for at a cost of $2.65 per square foot. Cost of thermal scan is an additional
$400.00. A thermal scan is not required for this project.
5. Remove all of the existing metal and dispose of properly.
6. Inspect existing decking. Deteriorated decking will be mutually agreed upon by Allweather
Roof and the owner representative. Replacement of deteriorated metal decking will be at a
cost of $5.00 per square foot.

7. Lay and mechanically attach a layer of 1/2" High Densiry Wood Fiberboazd Insulation, asphalt
coated (R-1.39), over the prepared surface using F.M. approved fasteners and 3" steel plates.
8. Hold insulation back at roof drains to form a square sump, which will contain tapered
insulation board from the edge of the recover board to the outer edges of the drain bowl.
9. Install one ply of Type IV roofmg felt set in hot asphalt at a rate of 25 to 30 lbs. per 100 squaze
feet.
10. Install wood fibered cant at a11 vertical transitions in accordance with manufacturer's
specifications.
11. Install granulated SBS Modified Bitumen roof system.
12. Install base ply of Type N felt and a second layer of modified S.B.S. mineral surface cap
flashing to all projection and perimeter flashings in accordance with manufacturer's
specifications.
13. Install new 24-gauge Kynar finished gravel stop.
14. Provide complete clean up of work premises.
15. Provide a final job inspection prior to issuance of warranty.
16. Provide Ten year manufacturers warranty.

MAINTENANCE AGRSEMENT
THIS AGREEMENT is made as of September 8, 1994, by and between
the CITY OF EAGAN, a Minnesota municipal corporation (hereinafter
referred to as the "City") and ROADWAY EXPRESS, INC., a Delaware
corporation (hereinafter referred to as "Roadway").

shown on Exhibit "A". The City has additionally requested that
Roadway maintain, at its sole cost and expense, the pipes which
connect the pond depicted in the Northeast corner of the property to
