Dear Mr. Dietze:
It has come to our attention that a considerable amount of silt
and sediments have eroded from your lot into public right-of-way
along the West Boulevard of Elrene Road near the northeast corner
of your lot. This material has eroded from your property due to
insufficient vegetation being established.
Due to the hazardous situation that this condition presents to the
general public, it is necessary for you to remove this material
from the public right-of-way and take the necessary corrective
action to prevent further occurrences. Until proper vegetation
can be established, it is advisable that you establish a temporary
erosion control barrier to retain the sediments on your property
during rainstorms. If these conditions continue, these sediments
will eventually find their way into the storm sewer system which
could reduce the capacity to the storm sewers and add to future
flooding.
Therefore, I hope you can appreciate the City's efforts to try and
maintain the public right-of-way in their proper condition. We
will anticipate that you will take the necessary corrective action
within 30 days of receipt of this letter. If you have any
questions pertaining to proper temporary erosion control necessary,
please feel free to contact our Engineering Division which can
inform you of inethods used by developers during construction
procedures.
If the material is not removed and the area restored properly
within the next 30 days, the City will have no alternative but to
contract to have this work performed and to forward any costs
