November 4, 2010
A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor
Maguire, Councilmembers Bakken, Fields, Tilley and Hansen. There were no visitors who wished to be
heard.
A regular meeting of the Eagan City Council was held on Thursday, November 4, 2010 at 6:30 p.m. at the
Eagan Municipal Center. Present were Mayor Maguire, Councilmembers Bakken, Fields Tilley and
Hansen. Also present were City Administrator Tom Hedges, Community Development Director Jon
Hohenstein, City Planner Mike Ridley, Public Works Director Tom Colbert, Administrative Services
Director Gene VanOverbeke, Director of Communications Tom Garrison, and City Attorney Michael
Dougherty.

Councilmember Tilley moved, Councilmember Hansen seconded a motion to approve the agenda as

CONSENT AGENDA
Councilmember Fields moved, Councilmember Bakken seconded a motion to approve the Consent

A. It was recommended to approve the minutes of the October 19, 2010 regular City Council and the
minutes of the October 12 Special City Council meeting as presented.
B. Personnel Items.
1. It was recommended to approve the hiring of Connor Mullarky, Maria Martin, and Patrick Otturley
as Building Attendants at the Civic Arena.
2. It was recommended to approve the 2011 Long Term Disability vendor to be named.
3. It was recommended to approve the 2011 Employee Assistance Program to be named.
C. It was recommended to ratify check registers dated October 14, 2010 and October 21, 2010 as
presented.
D. It was recommended to award Contract 10 -21 (Trapp Farm Park Infiltration Basin and Sediment
Removal — Water Quality Improvements) to Stocker Excavating, Inc., for the base bid in the amount
of $30,721.50 and authorize the Mayor and City Clerk to execute all related documents.
E. It was recommended to approve the temporary on -sale liquor license for the Friends of the Wescott
Library for a silent auction fundraiser to be held at the Wescott Library on November 20, 2010 and
waive the $150 license fee.
F. It was recommended to approve an agreement between the City and Clear Channel Outdoor, Inc. to
provide the City five (5) hours /month (2250 eight- second spots) for public service announcements on
the billboard located on 70.47 acres south of Highway 494 and east of Highway 13 (Sibley Memorial
Highway) in the NE % of Section 4.
G. It was recommended to approve a Final Subdivision (Lone Oak 3rd Addition) — NWA Real Estate
Holding Company, LLC (Delta Airlines)
H. It was recommended to approve the 2nd and Final Payment for Contract 10 -08 (Citywide Sanitary
Sewer Lining) in the amount of $18,441.00 to Insituform Technologies, Inc., and accept the
improvements for perpetual City maintenance subject to warranty provisions.

PUBLIC HEARINGS
CERTIFICATION OF DELINQUENT FALSE ALARM BILLS
City Administrator Hedges discussed the final assessment roll for delinquent false alarm bills, noting
there are currently five delinquent bills with an assessable amount of $895.
Mayor Maguire opened the public hearing. There being no public comment, he turned discussion to
the Council.
Councilmember Bakken moved, Councilmember Tilley seconded a motion to close the public hearing
and approve the final assessment roll for delinquent false alarm bills and authorize its certification to
Dakota County. Aye: 5 Nay: 0
CERTIFICATION OF DELINQUENT WEED CUTTING BILLS
City Administrator Hedges discussed the final assessment roll for delinquent weed cutting bills, noting
there are currently nine delinquent bills with an assessable amount of $1,742.70.
Mayor Maguire opened the public hearing. There being no public comment, he turned discussion to
the Council.
Councilmember Hansen moved, Councilmember Tilley seconded a motion to close the public hearing
and approve the final assessment roll for delinquent weed cutting bills and authorize its certification to
Dakota County. Aye: 5 Nay: 0
CERTIFICATION OF DELINQUENT UTILITY BILLS
City Administrator Hedges discussed the final assessment roll for delinquent utility bills, noting there
are currently 1,002 utility bill accounts with delinquent payments. The assessable amount of the
delinquent accounts is $173,196.35.

the Council

and approve the final assessment roll for delinquent utility bills and authorize its certification to Dakota

OLD BUSINESS
HAWTHORNE RIDGE — CUQUI'S CAFE
MODIFICATION TO COVENANT RESTRICTIONS
City Administrator Hedges introduced this item regarding a request for modification to the covenant
restrictions for the Hawthorne Ridge strip retail center located at 525 Diffley Road. City Planner
Ridley gave a staff report.
Councilmembers held a discussion.
Councilmember Tilley moved, Councilmember Hansen seconded a motion to direct consideration of
the petition for a request for modification to the covenant restrictions for the Hawthorne Ridge strip
retail center located at 525 Diffley Road to the December 7, 2010 Council and direct preparation of
notice to neighboring property owners. Aye: 5 Nay: 0

CONDITIONAL USE PERMIT — KEVIN FITZGERALD
City Administrator Hedges introduced this item regarding a Conditional Use Permit to exceed the
maximum 25% impervious surface requirement by 5.6% for property located at 656 Crimson Leaf
Trail. City Planner Ridley gave a staff report.
Councilmember Fields moved, Councilmember Bakken seconded a motion to approve a Conditional
Use Permit to exceed the maximum 25% impervious surface requirement by 5.6% for property
located at 656 Crimson Leaf Trail, subject to the following conditions: Aye: 5 Nay: 0
1. This Conditional Use Permit shall be recorded at Dakota County within 60 days of approval by
the City Council with the following exhibit: Site Plan received September 30, 2010.
2. The applicant shall remove permanent improvements placed on Park property.
3. The impervious surface of this lot shall not exceed 30.6% per the Site Plan received September
30, 2010.
4. Permeable pavers shall be designed to allow infiltration into the ground of at least the first 1/2" of
stormwater runoff, with this runoff not leaving the lot area after infiltration.
5. Permeable pavers shall be installed according to appropriate designs and installation details of
the specific product to be used, in consultation with a qualified civil, hydrological engineer
regarding site soil conditions, base preparation, etc.
6. Rain gardens shall be designed with a bottom, flat area that is at least 10 percent of the size of
the contributing hard - surface area. There shall be proper soil loosening /soil - replacement below
the rain garden basin area to ensure its effectiveness to infiltrate water within 48 hours of a storm
event.
7. Geosynthetic fabric shall be installed in the planted rain garden, located south of the pool, to keep
soil from washing through the wall.
8. The final design of both rain gardens shall specify receipt of runoff through sheet flow, surface
swale, crush -proof piping or a similar conveyance method to ensure adequate and safe runoff
delivery to the basins. Overflows from rain gardens shall not adversely affect the long -term
integrity of the retaining wall structure or cause downhill erosion into Lakeside Park.
9. Permeable pavers and rain gardens shall be installed according to the design criteria and
according to the guidance of the Minnesota Stormwater Manual, with technical assistance from
the Dakota County Soil and Water Conservation District.
10. The rain garden and permeable pavers shall be properly maintained to sustain the infiltration rate
according to the design criteria.
11. Mitigative designs and installations shall be approved by the City Engineering Division and the
installation shall be overseen and inspected by City staff at the time of installation.
12. Prior to the release of the Conditional Use Permit for recording, the applicant shall provide a $500
escrow deposit for inspection of the paver installation and inspection of the rain garden(s)
installation.
13. The rear yard paver patio shall be removed prior to issuance of the building permit for the
swimming pool.
14. The applicant shall discharge water from the pool in a form and manner acceptable to the Water
Resources Coordinator.
15. Building Permits shall be obtained for the retaining walls along with engineered drawings of the
proposed walls.
16. The applicant shall install rain barrels or other drainage system as approved by city staff to
capture runoff from the roof pitch that drains toward Crimson Leaf Trail and divert runoff from
gutter downspouts toward the backyard of the lot.

CONDITIONAL USE PERMIT — HORIZON EQUIPMENT
City Administrator Hedges introduced this item regarding a Conditional Use Permit for outside storage
of commercial vehicles upon property located at 1960 Seneca Road. City Planner Ridley gave a
staff report.
Councilmember Hansen moved, Councilmember Tilley seconded a motion to approve a Conditional
Use Permit for outside storage of commercial vehicles upon property located at 1960 Seneca Road,
legally described as part of Lot 2, Block 1, Cedar Industrial Park, subject to the following conditions:

1. This Conditional Use Permit shall be recorded at Dakota County within 60 days of approval by the
City Council.
2. The outdoor storage shall be limited to the number and type of vehicles shown on the site plan.
3. The storage area shall be maintained in an orderly fashion.
4. All parking and storage areas shall be properly maintained to prevent deterioration.
5. The owner shall purchase a padlock for the gate that is approved by the Fire Department and
acceptable for emergency access.
6. The service drive along the north side of the site shall be signed "no parking fire lane" to maintain
emergency access.
PLANNED DEVELOPMENT AMENDMENT — DISCOUNT TIRE
City Administrator Hedges introduced this item regarding a Planned Development Amendment to
allow auto repair and service, upon approximately 1.32 acres located at 3575 Pilot Knob Road. City
Planner Ridley gave a staff report.
Councilmember Fields moved, Councilmember Bakken seconded a motion to approve a Planned
Development Amendment to allow auto repair and service, upon approximately 1.32 acres located at
3575 Pilot Knob Road, subject to the following conditions: Aye: 5 Nay: 0
1. An Amendment to the Planned Development Agreement shall be executed and recorded with the
Dakota County Recorder's office.
2. The applicant shall be responsible for obtaining all necessary permits from regulatory agencies
regarding any petroleum contamination on the site.
3. The applicant shall have a site assessment performed and mitigation efforts shall be concluded
prior to issuance of a building permit.
4. Underground tank removal shall occur per MPCA requirements and an underground tank removal
permit shall be issued by the City.
5. Proof of the underground removal in accordance with state law shall be submitted to the City in
addition to a copy of any no action letter that may be issued by the MPCA.
6. The minimum architectural standard of 65% Class 1 materials and not more than 35% Class III
materials shall be satisfied on each of the four building elevations. The elevation plan shall be
modified accordingly and calculations provided by the architect to verify compliance with this
standard.
7. Roof -top mechanical units shall be set back a minimum of 20 feet from the edge of the roof.
8. Ground mounted mechanical equipment/utility boxes shall be screened by either a masonry wall
or opaque landscaping.
9. The trash enclosure shall comply with City code requirements.
10. If after review by the City, it is determined that additional on -site parking is needed due to
extensive on- street parking, additional on -site parking shall be provided in the proof -of- parking
location, as identified on the Site Plan, within one year of notice to the Applicant or its successors.

11. The Landscape Plan shall be revised to incorporate additional plant materials to screen and
buffer the parking areas from public right -of -way and add foundation plantings.
12. The Lighting Plan shall be revised to show compliance with City Code standards, and the
standards identified in the planning report, including, light poles shall not exceed 22 foot pole
heights.
13. All site and building signage shall be subject to City Code standards.
14. The base of the pylon and monument signs shall match the principal building and the pylon sign
shall not have an exposed pole.
15. One directional sign located Lot 1, Block 1, George W. Giles Addition at the entrance to the site
from Duckwood Drive is allowed, for the property to the north (lot 1, Block 1 Precision Tune
Addition). The directional sign shall not contain signature or logo advertising of the business, b ut
instead shall be a simple directional sign stating only the name of the business and identifying the
entrance to the site.
16. The applicant shall provide evidence of private ingress /egress easement covering the new
access drive between this property and the property to the north (Lot 1, Block 1 Precision Tune
Addition) for review and approval by the City Attorney.
17. The applicant shall provide sidewalk connections from the site to the corner of Pilot Knob Road
and Duckwood Drive intersection.
18. The applicant shall work with the adjacent property owner to the north and the City staff to
explore appropriate solutions regarding the potential removal of any trees to accommodate the
placement or relocation of the existing signage for the adjacent property owners existing sign on
the applicant's property.

F. APPROVE 2011 FUNDING APPLICATION FROM DAKOTA VALLEY
RECYCLING TO DAKOTA COUNTY FOR THE COMMUNITY
LANDFILL ABATEMENT FUNDS
ACTION TO BE CONSIDERED:
To approve the funding application of Dakota Valley Recycling to Dakota County for
community landfill abatement funds to operate the 2011 Dakota Valley Recycling Program.
FACTS:
• The Cities of Eagan, Apple Valley, and Burnsville annually submit a joint application to
Dakota County for Solid Waste Abatement funds, which are used to operate the
collaborative Dakota Valley Recycling (DVR) program.
• The deadline for the grant application is November 25, 2010, by which time the
application must have been approved by all three city councils and submitted to Dakota
County.
• The base level funding request for the Recycling Program has been set at $156,500, and
supports two full -time employees, outreach materials, a Web -site, and public contact
phone lines.
• DVR responds to the recycling needs of the community. Examples of 2010 programs
include: securing recycling containers for Eagan Market Fest, coordinating the annual
shoe recycling collection that is taking place November 15 -21 at the Eagan Civic Arena,
and maintaining the Technotrash cans at City facilities, which are used to collect
employee e -waste to be recycled such as cell phones, DVD's, and small computer parts.
• Dakota County is offering additional money for projects that support the Dakota County
Solid Waste Master Plan outcomes. Therefore, DVR is applying for an additional grant
of $14,675 to fund business outreach in the areas of green teams, recycling and waste
reduction. Should DVR be successful in obtaining the added grant money, further
information will be forthcoming to the Council regarding the efforts to reach out to the
Eagan business community in sustainability and recycling efforts.

G. APPROVE RESOLUTION TO ESTABLISH THE 60 DNL AS THE AIRPORT NOISE
THRESHOLD FOR PREVENTATIVE AND CORRECTIVE MEASURES IN THE ENVIRONS
OF MINNEAPOLIS -ST. PAUL INTERNATIONAL AIRPORT
ACTION TO BE CONSIDERED:
To approve a resolution to establish the 60 DNL as the airport noise threshold for preventative and corrective measures in
the environs of Minneapolis -St. Paul International Airport.
FACTS:
• It has been the City of Eagan's long standing position that noise mitigation and corrective actions to mitigate
noise be extended to the 60 DNL contour.
Examples of this position include:
• The 2007 legal settlement with the Metropolitan Airports Commission (MAC) to extend noise mitigation
to the 60 -64 DNL contour; and,
• The City of Eagan's policy that the 60 -64 DNL contours, along with the buffer zone (the contour one mile
beyond the 60 DNL contour), are designated as the area within which aircraft noise would be a
consideration for land planning and development decisions.
• By 2030, MAC projections show an additional 5.600 single family homes and 3,160 multi - family homes that
could be located in the 60 -64 DNL contours in the communities surrounding MSP Airport. Of those homes, 342
single family and 104 multi - family homes are located in Eagan.
• Attached is a resolution formalizing the City's longstanding position that the 60 DNL should be the standard for
preventive and corrective land use measures for airport noise.
• A similar resolution was approved earlier this month by the City of Minneapolis. Additionally, the cities of
Richfield and Mendota Heights plan to consider the resolution in the coming weeks.
• All of the surrounding communities are meeting with staff from the MAC on November 18, 2010 to discuss the
potential impacts of the MAC's 2030 Plan, and thus, the communities sought to have the respective resolutions
considered in advance of that meeting to formally demonstrate the cities' ongoing support for the establishment of
the 60 DNL as the standard for preventative and corrective land use measures for airport noise.
• Given the attempt to have the resolution approved in advance of the November 18 meeting with the MAC, and as
a result of the bimonthly meeting schedule for the Airport Relations Commission (ARC), the ARC did not have
an opportunity to review the resolution. However, the resolution represents a long standing position of both the
ARC and the City.

A RESOLUTION ESTABLISHING 60 DNL AS THE AIRPORT NOISE THRESHOLD FOR
PREVENTATIVE AND CORRECTIVE MEASURES IN THE ENVIRONS OF MINNEAPOLIS -ST.
PAUL INTERNATIONAL AIRPORT
WHEREAS, residents of the City of Eagan are subject to airport noise as a result of operations at
Minneapolis -St. Paul International Airport and will continue to be subject to airport noise for the foreseeable
future; and
WHEREAS, FAA has determined that the responsibility for determining acceptable and permissible
land uses and the relationships between specific properties and noise contours in response to locally determined
needs and values in achieving compatible land uses rests with local authorities; and
WHEREAS, in 1996 the Minnesota Legislature decided to expand the existing Minneapolis /St. Paul
International Airport and directed MAC to develop a noise mitigation plan examining measures to 60 DNL; and
WHEREAS, in 1996 the MSP Noise Mitigation Committee adopted recommendations including noise
mitigation to the 60 DNL and recommended a modified program to homes through 55 DNL; and
WHEREAS, on October 28, 1996 MAC approved the recommendations of the MSP Noise Mitigation
Committee, including extending the residential sound insulation program for the area encompassed by the 2005
DNL 60 contour, but did not approve a modified program to the 55 DNL; and
WHEREAS, the State of Minnesota Advisory Council on Metropolitan Airport Planning, pursuant to
the Legislature's direction to review the recommendation and comment to the Legislature, reviewed the
recommendation and concurred with the Commission's recommendation; and
WHEREAS, the Metropolitan Airports Commission in their 2001 and 2004 Part 150 studies stated that
they considered a standard of 60 dB for eligibility in the MAC Sound Insulation Program; and
WHEREAS, Metropolitan Council's Land Use Policy guidance indicates that residential land use
within the 60 DNL contour is inconsistent without sound attenuation; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGAN, MINNESOTA, that 60 DNL is the City of Eagan's airport noise threshold for preventive
and corrective noise mitigation and the one -mile buffer zone is the City of Eagan's threshold for land use
planning and development standards in the environs of the Minneapolis -St. Paul International Airport.
BE IT FURTHER RESOLVED that all airport comprehensive plans, environmental studies and noise
compatibility studies shall analyze airport noise impacts to at least the 60 DNL and address preventive and
corrective measures to the 60 DNL contour, and

➢ The Dakota County CDA submitted the winning bid for the 2.34 acre site. In
official action taken by the Dakota County CDA Board on November 9, 2010, the
Board adopted a resolution authorizing the Waiver of Rights. Dakota County is
expected to close on the property on November 12, 2010.
➢ The City of Eagan's legal counsel believes the combination of Dakota County
waiving its rights any and all CUP's related to 3206 Sibley Memorial Highway and
the City of Eagan terminating the same will render the lawsuit moot.

WHEREAS, on September 28, 2010, the Dakota County Community Development Agency ( "Agency ") placed the
highest bid at an auction of the property located at 3206 Sibley Memorial Highway, Eagan, Minnesota ( "Property "); and
WHEREAS, the closing on the Agency's purchase of the Property is scheduled for November 12, 2010; and
WHEREAS, the Property is zoned R -2, residential double, but is currently being used for commercial purposes,
including gravel storage, under one or more conditional use permits issued by the City of Eagan ( "CUP "); and
WHEREAS, the CUP and the current owner's use of the Property gave rise to a lawsuit entitled Ronald A. Miller and
Barbara C. Miller v. City of Eagan and Heritage Investments, Inc., d /b /a Richfield Blacktop, Court File No. 19HA -CV-
10 -295, currently pending in the Dakota County District Court; and
WHEREAS, at its meeting on October 12, 2010, the Agency's Board of Commissioners discussed the Property and did
not express any interest in using the Property for commercial purposes, storing gravel on the Property, or making use
of the CUP after the closing; and
WHEREAS, the Agency intends to develop the Property for residential use; and
WHEREAS, the Agency wishes to relinquish, disclaim, surrender, release and waive any and all rights and privileges it
would acquire under the CUP; and
WHEREAS, the Agency wishes to authorize the City of Eagan to recognize the termination of all existing CUPS for the
Property upon the Agency's closing on the purchase of the Property.
NOW, THEREFORE, BE IT RESOLVED, by the Dakota County Board of Commissioners that:

K. FISH LAKE NUTRIENT TMDL IMPLEMENTATION PLAN
ACTION TO BE CONSIDERED: Approve the Fish Lake Nutrient Total Maximum Daily Load
(TMDL) Implementation Plan for submittal to the Minnesota Pollution Control Agency.
FACTS:
• The Federal Clean Water Act (CWA, USC 33, § 1313(d)) and applicable federal regulations require
states to adopt water quality standards to protect waters from pollution. The CWA requires states to:
1) assess waters to determine if they meet water quality standards; 2) list waters that do not meet
standards (i.e. "Impaired Waters List "); and 3) conduct TMDL studies to set pollutant reduction goals
needed to restore impaired waters.
• "TMDL" is the maximum amount of a pollutant a waterbody can receive and still meet water quality
standards. Federal and state regulations also require restoration measures to meet TMDLs.
• The Minnesota Pollution Control Agency (MPCA) classified Fish Lake as impaired by nutrients (i.e.,
phosphorus) on the 2006 Impaired Waters List.
• Minnesota's Clean Water Legacy Act (CWLA, Minn. Stats. Ch. 114D) was established in 2006 "to
protect, restore, and preserve the quality of Minnesota's surface waters by providing authority,
direction, and resources to achieve and maintain water quality standards for surface waters,"
according to the CWA and applicable federal regulations. The CWLA established an account in the
state's environmental fund to accelerate surface water monitoring, TMDL development, and
restoration activities throughout the state.
• On January 15, 2008, the City Council authorized execution of a professional and technical services
grant contract between the MPCA and the City of Eagan, for the City to conduct a Fish Lake Nutrient
Impairment TMDL Project during 2008 and 2009, receiving $45,000 in CWLA funding.
• The TMDL Project began in early February 2008 and originally was to end by December 30, 2009. In
order to accommodate the final schedule for project completion, on December 15, 2009, the City
Council approved an extension of the MPCA grant contract to December 30, 2010.
• The U.S. Environmental Protection Agency approved the Fish Lake TMDL report on September 9,
2010.
• The Fish Lake Nutrient TMDL Implementation Plan is the final required component of the 2008-
2010 TMDL Project. The plan specifies activities the City will undertake to reduce phosphorus
loading to Fish Lake with the goal to remove the lake from the Impaired Waters List.
• The Fish Lake alum dosing and settling basin, the construction of which the City Council approved
on October 5, 2010, and which is now underway, is a major element of the implementation plan.

3.2.5 IMPLEMENTATION PLAN SUMMARY
Table 3.3 presents a proposed schedule of BMPs for a 5 -year period from 2011 to 2015.
Consistent with Table 2.2, the City of Eagan is solely responsible to implement this schedule.
Overall costs for implementation are estimated to be about $1,134,000, while construction costs
for capital projects may reach $465,000. The BMPs, estimated costs, and timelines in Table 3.3
are recommendations for initial planning purposes and may need to be re- evaluated annually
based on funding, adaptive management, technological advances, and economic conditions.
Additional BMPs beyond 2015 may be implemented, depending on funding, need, cost -
effectiveness, and ultimately, decision - making by the Eagan City Council.

FACTS:
• Contract 09 -20 provides for the site grading, building pad preparation, and utility
services, including sanitary sewer, water main, and storm sewer, for the Fire Safety
Center as presented in a schematic design to the City Council on August 11, 2009.
• On March 16, 2010, the City Council awarded the base bid for Contract 09 -20 for
these improvements.
• Change Order #5 provides for three items:
• The overrun of the contract's sidewalk construction bid item. The portion
of concrete sidewalk near the east entrance of the building was
inadvertently omitted from both the original building and site work
contract bid items. (ADD $4,515.80).
• The use of high -early strength concrete to reduce curing time on the
concrete pavement sections of the parking lot near the building's entrance
bay doors, reducing the time the building trade workers will be limited in
accessing the building. (ADD $2,975.00)
• Revision of the final contract completion date from November 15, 2010 to
May 27, 2011 for placement of the final layer of bituminous pavement on
Station Trail and the parking areas. Delays in building construction
(Contract 10 -04) also delayed the Contract 09 -20 site work schedule,
necessitating the extension of the completion. There is no additional cost
associated with completion date extension.
• Change Order #5 provides for a total ADD of $7,490.80 (1.21% of original contract).
The cost of the additional work will be the responsibility of the City's Fire Safety
Campus Fund.
• This change order has been reviewed by the Fire Department and Engineering
Division and found to be in order for favorable Council action.

WATER QUALITY IMPROVEMENTS
ACTION TO BE CONSIDERED: Approve Change Order No. 1 to Contract 09 -04 (Fish Lake
Alum Dosing and Settling Basin — Water Quality Improvements) and authorize the Mayor and
City Clerk to execute all related documents.
FACTS:
• Contract 09 -04 provides for the modification of the Fish Lake alum dosing process located at
the Hurley Lake (Pond JP -11) storm sewer lift station, as well as the construction of a settling
basin east of Pond JP -47, north of Wescott Rd and east of Denmark Avenue.
• On October 5, 2010, the City Council awarded the bid for Contract 09 -04 for these water
quality improvements to Stocker Excavating, Inc.
• Change Order #1 provides for two items:
o Floatation silt fence for the inlet work in Pond JP -47. The additional silt fence will
adequately address the potential for excavated debris /sediment to impact Pond JP -47
during construction. (ADD $1,650.00).
o Under drain system in the sedimentation basin to drain ground water. During the
excavation of the pond, sand veins were exposed causing groundwater from Pond JP -47
to seep into the sedimentation basin zone. During alum sludge removal operations, when
the pond is empty, the hydrostatic pressure of the groundwater could damage the
synthetic pond liner. The under drain system would remove the water from under the
pond liner and protect the liner during the long -term maintenance efforts. (ADD
$10,437.00)
• Change Order #1 provides for a total ADD of $12,087.00 (4.85% of original contract). The
cost of the additional work will be the responsibility of the City's Water Quality Expansion
& Modification Fund.
• This change order has been reviewed by the Engineering Division and found to be in order

Accept a grant of $8,000 from the Metropolitan Regional Arts Council for a collaborative project
with Eagan Parks and Recreation, Dakota Center for the Arts and local business partners and
authorize the change to the 2010 budget.
FACTS:
• On March 16, 2010 the City Council took action to apply for a Creative Intersections
grant from the Metropolitan Arts Council (MRAC) for "projects to support innovative
partnerships that integrate arts and culture into plans for community development and
enrichment." The grant required the collaboration of a private non - profit organization,
public /government, and businesses
• Eagan Parks and Recreation was notified that they had received a grant from the MRAC
in the amount of $8,000 to support innovative partnerships that integrate arts and culture
into plans for community development and enrichment.
• The grant would be used to develop a strategy for long range art planning in our
community, a series of community dialogues and implementation of selected projects.
• The planning and dialogues for this purpose would focus on developing cohesive art plan
for existing city facilities as well as discussion of creative programming. The goal of the
grant is to connect with the community in a unique way to enhance the vitality and
quality of life in Eagan through the arts.
• Implementation of the grant will span 2 years from the Fall of 2010 to December 2012.
• If the Council accepts this grant of $8,000 the appropriate budget adjustments should be
made to the appropriate budgets.

U. MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
GENERAL PERMIT
ACTION TO BE CONSIDERED: Approve the application for the reissuance of the Municipal
Separate Storm Sewer System General Permit and authorize the Mayor and City Clerk to execute
all related documents.
FACTS:
• On March 4, 2003, the City Council authorized the submittal of a Municipal Separate Storm
Sewer System (MS4) permit application to the Minnesota Pollution Control Agency (MPCA)
under the National Pollutant Discharge Elimination System (NPDES), Phase II Program. A
Storm Water Pollution Prevention Plan (SWPPP) was included with this permit application.
• The MS4 permit and SWPPP were modified June 1, 2006, as a result of a May, 2003
Minnesota Court of Appeals decision in which the court required the MPCA to provide the
opportunity for public review of each MS4 SWPPP.
• The MPCA is currently developing a reissuance of the MS4 General Permit and expects to
reissue an upgraded permit before the current permit expires on May 31, 2011. However,
under Minnesota Rules, an application for permit reissuance is to be submitted at least 180
days before the expiration date of the existing permit.
• In order for the City to stay under coverage of an existing MS4 permit, it is necessary for the
City to apply for the reissuance of the MS4 permit at this time.
• Once the MPCA completes the upgraded permit, tentatively scheduled in the next six
months, the City will be notified of the required additional information that will need to be
submitted to the MPCA. In response, City staff will gather the requested information, seek
any needed Council authorization, and forward said information to the MPCA.
• The application has been reviewed by the Engineering Division and found to be in order for
favorable Council action.

ACTION TO BE CONSIDERED:
Authorize the application of a grant from the Dakota County Public Health Department through a
program called Improving Environments for Active Living.
FACTS:
• The Dakota County Public health Department (DCPHD) with funding from the Statewide
Health Improvement Program (SHIP) is offering an opportunity for local government
agencies in Dakota county to apply for grants to create active communities by increasing
opportunities for non - motorized transportation and. /or increasing access to community
recreation facilities.
• Awarded funds up to $25,000 are intended for local government agencies in Dakota
County to implement sustainable policy, environmental and systems changes.
• Funding is competitive; grants will be chosen based upon submission of a meritorious
action plan and budget request.
• This opportunity for funding is for local government agencies that are ready to make
changes.
• Initial ideas for Eagan's grant proposal is to apply for funding for Way - finding signs for
trails, Bike Racks at park facilities at Central Park and other large park facilities,
Incentives and Educational materials for the Eagan Walk N' Roll Community Event in
May 2011.

V. PRESENTATION OF COMMUNITY SURVEY RESULTS/DECISION RESOURCES
ACTION TO BE CONSIDERED:
None. Informational presentation only.
FACTS:
➢ The City of Eagan periodically conducts both residential and business community surveys.
➢ Results from the 2010 residential survey are now in. Previous residential surveys were most
recently conducted in 2008 and 2005.
➢ As a reminder, to meet budgetary constraints, this year's survey was shortened by nearly 50
questions. Though many of the same questions are asked over the years for tracking
purposes, Decisions Resources, Ltd. worked with Communications Director Garrison on
updating the 2010 questions. The survey was pre- tested in August and fielded in September,
just after Labor Day.
➢ Phone interviews were scheduled with a random sample of 400 Eagan residents. The sample
is drawn from every precinct of the city, equally divided between males and females and
with a demographic spread in age range.
➢ The results are accurate to 95% with a +/- margin for error of 5 %.
➢ Dr. Bill Morris of Decision Resources will again be with us to give a presentation of the
significant findings and will answers City Council questions regarding the results.
➢ Dr. Morris calls Eagan the "Jewel of the South Metro," noting that his findings will indicate
that at a time where residents in many metro cities are giving cities less favorable ratings, in
Eagan key City Council and staff indicators have actually risen.

• Project 1024 provided for the street improvements of Kennebec Drive, between Silver
Bell Road and Seneca Road, in northwestern Eagan.
• The Final Assessment Roll was presented to the City Council on October 19, 2010,
with a public hearing scheduled for November 16 to formally present the final costs
associated with this public improvement to the affected benefiting properties.
• The final assessment costs are approximately 35% less than the estimated benefit
amounts that were presented at the original Public Hearing on January 19, 2010.
• All notices have been published in the legal papers and sent to all affected property
owners informing them of this public hearing. An informational meeting was held on
November 8 to address all property owners' questions or concerns and provide any
additional information of interest. Of the 5 commercial/ industrial parcels being
assessed, no one attended the meeting.

Kennebec Drive Street Overlay Improvements
At the public hearing on January 19, 2010, the City Council ordered Project 1024, and in accordance with the feasibility
report, the following improvements were constructed: mill and overlay, replacement of traffic and street signage, and concrete
entrance aprons for Kennebec Drive (Silver Bell Road to Seneca Road)and replacement of curb and gutter as needed. In the
feasibility report, it was proposed to assess 100% of the street overlay and signage improvements, and 100% of the concrete
entrance improvements, in accordance with the City Special Assessment Policy. The improvements were completed under
Contract 10 -01. The following information was used in the preparation of the assessment roll for Project 1024.
PROJECT COST
The construction cost includes the amount of $71,512.81 paid to the contractors for the construction of the improvements.
Traffic and street signage was installed at a cost of $147.28. Other costs including engineering, design, contract management,
inspections, financing, legal, bonding, administration, and other totaling $20,121.63 were incurred resulting in an
improvement and project cost of $95,309.89. The detail of these other costs is provided on Schedule I. These other costs are
allocated to the improvements constricted in order to determine the cost of each improvement and the assessment rate.

FACTS:
• Project 1015 provided for street improvements of Blackhawk Road, between Cliff
Road and Highway 13, in west - central Eagan.
• The Final Assessment Roll was presented to the City Council on October 19, 2010,
with a public hearing scheduled for November 16 to formally present the final costs
associated with this public improvement to the affected benefiting properties.
• The final assessment costs are approximately 34% less than the estimated benefit
amounts that were presented at the original Public Hearing on March 16, 2010.
• All notices have been published in the legal papers and sent to all affected property
owners informing them of this public hearing. An informational meeting was held on
November 8 to address all property owners' questions or concerns and provide any
additional information of interest. Of the 305 parcels (293 low- density residential, 6
high - density residential, 3 parks/ public facility, 3 commercial/ industrial) being
assessed, one resident representing one property attended the meeting. In addition,
one letter was received and another comment received via phone from a 3rd property
owner.
ISSUES:
High - Density Residential Assessment
• Four current single - family residential properties (4276, 4280, 4290 & 4300
Blackhawk Road) are guided for future use as high - density residential (12+ units/
acre).
• The City's current Special Assessment Policy provides for properties to be assessed at
their highest and best use, in this case high - density residential.
• On November 8, 2010, the City received a written objection from Mr. Ron Staeheli,
property owner of 4300 Blackhawk Road, to the proposed assessment on the property.
The objection is to the application of the underlying land use as high - density
residential for calculating the assessment on his property, which is currently used as a
single - family residence.
• The property owners at 4280 Blackhawk Road (Mr. Robert Richardson) and 4290
Blackhawk Road (Mr. Bob Kruger) also raised this concern at the project public
hearing March 16, 2010. The option for a deferment of the difference between the

single - family and high - density assessment rates for these properties was mentioned at
the public hearing, subject to an application for deferment or postponement by
affected property owners.
• Mr. Kruger again raised the assessment vs. land use issue at the neighborhood
meeting November 8 (see attached minutes).
• The high - density assessment rate is $12.88/ front foot and the single - family rate is
$6.21/ front foot.
• Street & utility improvements on Blackhawk Road in 1984 (under Project 317) were
assessed to these properties at single - family rates. The "highest and best use"
assessment policy was not in effect at that time.
Public Facility (Eagan Cemetery) Assessment
• The Eagan Cemetery in the northeast corner of Blackhawk Road and Diffley Road is
zoned Public Facility, and a special assessment consistent with this zoning and the
City Special Assessment Policy is proposed (approximately $2,600 total).
• While no written objection to this assessment has been received at time of preparation
of this memo, long -time property owners/ caretakers (Mr. and Mrs. Linkert,) have
contacted City staff regarding this assessment. The couple assumed ownership of
property in 1958 and have been the sole caretakers ever since.
• The Linkerts indicate that the cemetery has no church affiliation, and is "full ", with
little future revenue or likely chance of sale for other use. The property is considered
tax - exempt by the County. Special assessments are permissible against tax exempt
property, limited to the benefit accrued from the project.
• If an assessment is levied, there is question as to whether it will be paid and as to the
City's ability to subsequently collect it through the delinquent property tax/
assessment process.
• Special assessments for the original street and utility improvements on Blackhawk
Road in 1987 (under Project 488) were not levied against the cemetery property.

Blackhawk Road Street Overlay Improvements
PROJECT HISTORY
On February 16, 2010, the City Council approved an update to the City of Eagan's Special Assessment
Policy addressing premature infrastructure failure, including the premature failure of street pavement
surfaces. At the public hearing on March 16, 2010, the City Council ordered Project 1015, and in accordance
with the feasibility report, the following improvements were constructed on two segments of Blackhawk
Road
Segment 1 - Resurfacing (edge mill and overlay) for approximately 1.6 miles of Blackhawk Road
from Cliff Road to Deerwood Drive, the replacement of damaged curb and gutter adjustments and /or
replacement to sanitary/storm sewer utility castings, water gate valves, concrete entrance aprons,
pedestrian curb ramps, street signage, bituminous trail overlay, and new 8' bituminous trail construction
on the east side of Blackhawk Road (Cliff Rd. to Beecher Dr.). The signal system revisions and turn lane
installation at Diffley Road and Blackhawk Road were included per previous City Council approval of
those improvements.
Segment 2 - The complete pavement reconstruction of 1.3 miles of Blackhawk Road from
Deerwood Drive to Highway 13 (Segment 2), the replacement of damaged curb and gutter, adjustments
and /or replacement to sanitary/storni sewer utility castings, replacement of a section of sanitary sewer,
water gate valves, pedestrian curb ramps, and street signage. In the Project 1015 feasibility report, it was
proposed to assess the street overlay and signage improvements for this segment in accordance with the City
Special Assessment Policy, as amended February 16, for premature infrastructure failure, in this case a 20%
special assessment credit on the Segment 2 improvements.
All the improvements were completed under Contract 10 -01. The following information was used in the
preparation of the assessment roll for Project 1015.
PROJECT COST
The construction cost includes the amount of $1,403,839.97 paid to the contractors and vendors for the
constriction of the improvements. Traffic and street signage was installed at a cost of $12,297.92. Other costs
including engineering, design, contract management, inspections, financing, legal, bonding, administration,
and other totaling $20,121.63 were incurred resulting in an improvement and project cost of $1,756,653.85.
The detail of these other costs is provided on Schedule L These other costs are allocated to tl-e
improvements constricted in order to determine the cost of each improvement and the assessment rate.

direct driveway access on to Blackhawk Road to be improved, are proposed to be assessed based on the amount of
front footage adjacent to Blackhawk Road within the project. While the City's Assessment Policy states that 75%
of the pavement reconstruction costs are assessable for residential properties (R -1, R -2, R -3) based on a normal
residential width street (32 feet), the assessments are proposed at a mill & overlay ratio (50 %) minus a 20% credit,
proposed because the pavement condition of Segment 2 prematurely deteriorated (4 years prior to an anticipated
20 -year pavement life cycle, 4/20 = 20 %). The cost per residential lot equivalent to be assessed based on the City
Assessment Policy for a standard mill & overlay improvement, with a 20% credit, is calculated as follows:

Questions/ Comments
1. Why is my property (4290 Blackhawk Road) and three others (4276, 4280 and 4300
Blackhawk Road), used as single- family homes, being assessed as high- density
residential properties? My neighbors have the same concerns. These four properties
(4276, 4280, 4290, 4300 Blackhawk Road) are either zoned High - Density Residential
(R4) or guided as High- Density Residential in the City's Comprehensive Guide Plan.
Although the properties are currently used for single - family homes, the City's Special
Assessment Policy provides for properties to be assessed at their highest and best uses, as
identified with zoning or the comp guide. They can request that the City Council grant a
deferment of the additional assessment amount beyond the single - family rate, until such
time that the properties redevelop to the high- density residential use.
2. Would the deferment include interest? Yes. Interest would accrue on the assessment at
5% annually until the assessment is paid.
3. When and why did the rezoning or change in the guide plan to high - density
residential occur? Gorder will check history after the meeting. (Research subsequent to
the meeting shows that all four properties have been consistently guided as a high-
density land use since 1974.
4. Why is the low- density townhome rate less than the high - density residential rate?
The amount of participation by benefiting properties called for in the City's Special
Assessment Policy is roughly based on the traffic generation from certain land uses. Low -
density townhomes at 0 -4 units/ acre will generate less traffic than a high - density land
use at 12+ units/ acre. The policy designates 50;% of blacktop street improvement costs to
low- density residential properties, with an allowance for reduction in street width (i.e.
321/44'). The policy designates 75% of blacktop street improvement costs to high- density
residential properties, with no allowance for reduction in street width.
5. Mr. Kruger's deferment of assessment for the original construction of Blackhawk
Road in 1985 was discussed. In 1985, the assessment for streets and utilities
(approximately 511,000, under City Project 317) was deferred by agreement, without
interest, until the property was either: 1) split or platted, 2) rezoned or 3) developed.

I own 4300 Blackhawk Rd. in Eagan and would like to be heard at the November 16,
2010 hearing on the special assessment that will be placed upon my property as a result
of road improvements on Blackhawk Rd.
I am being assessed at a much higher rate than current usage and by an accident of
geography am being assessed as much as the 300 unit apartment complex that borders my
property. It is outrageous and I would like the assessment refigured to reflect the value to
my property as it benefits my property in proportion to adjoining properties and their
assessments.
The property has been a single family lot with a single family house since 1974. Its
current zoning can not be the only reason to assess at the much higher R4 rate. The
property is not being used as high density residential. In order to use the property as
zoned would require the demolition of our home.
The assessment does not properly reflect the improvement to our property and is
therefore capricious, arbitrary and not allowed under current law. It also reflects a
laziness of staff to simply apply a much higher rate against single family lots because it
would be too hard to properly classify the lots and assess them as properly reflects the
improvement to the lots. Please note that the Minnesota statues 429.051 states that an
assessment may only be "based on benefits received ". Charging us the R4 rate is not
consistent with that requirement.

FACTS:
➢ As part of its 2001 Comprehensive Guide Plan Aviation Section, one of Eagan's goals was to
consider the adoption of a noise attenuation ordinance to permit the city to require noise
attenuation construction techniques for buildings in the noise zones.
➢ On February 9, 2009, a Noise Attenuation Ordinance was approved by the City Council that
partially incorporates preventative noise measures found in the Metropolitan Council's Land
Use Compatibility Guidelines and Model Ordinance, but limits its application to only
development associated with new subdivisions, land use /zoning changes, or new or amended
Planned Developments.
➢ Post - secondary schools, trade schools, and certain medical uses have been considered
compatible within the city's general land use standards either by permitted or conditional
use, where office and commercial uses are currently allowed. However, the adopted land use
compatibility guidelines within the noise attenuation standards, currently list educational and
medical uses "Incompatible" in certain zones where current office uses are either existing or
intended.
➢ The purpose of this proposed amendment is to remove this inconsistency by specifically
separating types of educational and medical uses in the land use tables that are "Compatible"
with office and commercial uses and those more sensitive to noise impacts such as K -12
schools and hospitals.
The City Attorney has reviewed the proposed changes and the Advisory Planning
Commission recommended approval of the amendment at its regularly scheduled meeting on
October 26, 2010.

AUTHORITY FOR REVIEW
City Code Chapter 11, Section 11.50, Subdivision 5 states, in part:
1. The provisions of this chapter may be amended by the majority vote of the council, except that
amendments changing the boundaries of any district or changing the regulations of any district
may only be made by an affirmative vote of two - thirds of all members of the council.
BACKGROUND /HISTORY
As part of its 2001 Comprehensive Guide Plan Aviation Section, one of Eagan's goals was to
consider the adoption of a noise attenuation ordinance to permit the city to require noise attenuation
construction techniques for buildings in the noise zones. On February 9, 2009, a Noise Attenuation
Ordinance was approved by the City Council that partially incorporates preventative noise
measures found in the Metropolitan Council's Land Use Compatibility Guidelines and Model
Ordinance, but limits its application to only development associated with new subdivisions, land
use /zoning changes, or new or amended Planned Developments.
Noise Overlay requirements and land use compatibility tables were based on model standards
established by the Metropolitan Council in their current comprehensive transportation plan and
define uses as either Compatible (permitted), Provisional (permitted with mitigation requirements),

Conditional (discouraged but allowed with mitigation requirements), or Incompatible (not
permitted).
The Eagan City Council directed preparation of this amendment on September 7, 2010.
EXISTING CONDITIONS
Post - secondary schools, trade schools, and certain medical uses have been considered compatible
within the city's general land use standards either by permitted or conditional use, where office
and commercial uses are currently allowed. However, the adopted land use compatibility
guidelines within the noise attenuation standards, currently list educational and medical uses
"Incompatible" in certain zones where current office uses are either existing or intended.
EVALUATION OF REQUEST
The proposed amendment redefines more noise sensitive uses by specifically listing preschools
and K -12 schools as Incompatible in the Land Use Compatibility Tables. The amendment also
eliminates reference to generic "medical" uses in the tables. Noise sensitive medical uses such as
hospitals are left alone, and all other medical and educational uses, such as day clinics, post
secondary, and business schools are defined as "services ", which are considered Provisional uses.
SUMMARY /CONCLUSION
Staff is proposing an amendment to the Aircraft Noise Overlay District that better defines
educational and medical uses within the Land Use Compatibility Tables. The purpose of the
amendment is to alleviate an existing discrepancy between the overlay district and general land use
and zoning standards.
The City Attorney has reviewed the proposed changes and a draft ordinance revision has been
completed for review.

To recommend approval of an Amendment to City Code Section 11.64, Subd. 7, Tables 1 and 2,

ACTION TO BE CONSIDERED:
To approve (or deny) an Ordinance Amendment to City Code Chapter 11 relative to the
definition of the Business Park Zoning District and direct the City Attorney to publish the
amendment in the legal newspaper.
REQUIRED VOTE FOR APPROVAL: Majority of Council Members Present
FACTS:
➢ The City Council directed staff to prepare this amendment at their regular meeting of
September 7, 2010.
➢ The Eagan City Code states the purpose of the Business Park (BP) District is
intended to accommodate development of low intensity office, light industrial and
supporting commercial service uses that may be suitable in relative close proximity
to non - industrial development. More intensive industrial uses which require outdoor
storage and high truck traffic are excluded.
➢ Staff believes that a minor tweak to this purpose statement is important to maintain
the goals of this Zoning District and the investments already made in the City's BP
areas. The intent is to modify the last sentence of the purpose statement to read
"More intensive industrial uses which require outdoor storage and /or high truck
traffic are excluded.
➢ The APC held a Public Hearing on October 26, 2010 and they are recommending
approval of the amendment subject to the conditions in their draft minutes.

Staff report dated October 21, 2010. He noted the background and history.
Chair Chavez opened the public hearing.
There being no public comment, Chair Chavez closed the public hearing and turned the
discussion back to the Commission.
Member Filipi questioned the addition of the phrase "or both" as being redundant.
City Attorney Bauer indicated the City Attorney's office would review that verbiage prior the City
Council meeting.
Member Piper moved, Member Daley seconded a motion to recommend approval of an
Ordinance Amendment to Chapter 11, Section 11.60, by adding Subd. 17 (A), relating to the
Purpose Statement for the Business Park Zoning District.
All voted in favor. Motion carried 7 -0.

The City of Eagan is requesting approval of an Ordinance Amendment to Chapter 11, Section

AUTHORITY FOR REVIEW
City Code Chapter 11, Section 11.50, Subdivision 5 states, in part:
The provisions of this chapter may be amended by the majority vote of the council, except
that amendments changing the boundaries of any district or changing the regulations of any
district may only be made by an affirmative vote of two - thirds of all members of the council.
BACKGROUND/HISTORY
The Eagan City Code section describing the purpose of the Business Park BP District states that
it "is intended to accommodate development of low intensity office, light industrial and
supporting commercial service uses that may be suitable in relative close proximity to non-
industrial development. More intensive industrial uses which require outdoor storage and high
truck traffic are excluded. The performance standards for this district are intended to establish
and maintain high quality site planning, architecture, signage and landscape design to create an
attractive and unified development character."
The City Council directed staff to initiate this amendment on September 7, 2010.

EXISTING CONDITIONS
As mentioned above, the portion of the BP Purpose Statement that says "More intensive
industrial uses which require outdoor storage and high truck traffic are excluded" may be
problematic in that it could be interpreted to read that only uses that feature both outdoor storage
and high truck traffic should be excluded.
EVALUATION OF REOUEST
City staff believes that a simple house - keeping edit to the Purpose Statement will clarify the
City's desire for the BP District moving forward. Essentially, making outdoor storage and high
truck traffic mutually exclusive will better support the City's goals for BP Zoning Districts.
SUMMARY /CONCLUSION
This amendment is necessary to avoid confusion and provide clarity to the type of BP use that is
consistent with the City's goals for low intensity, high quality development in its Business Park
areas.

To recommend approval of an Ordinance Amendment to Chapter 11, Section 11.60, by adding
Subd. 17 (A), relating to the Purpose Statement for the Business Park Zoning District.

AN ORDINANCE OF THE CITY OF EAGAN, MINNESOTA, AMENDING EAGAN CITY
CODE CHAPTER ELEVEN ENTITLED "LAND USE REGULATIONS (ZONING)" BY

A. KUTOFF COURT
NO PARKING
ACTION TO BE CONSIDERED: Consider one of the following actions:
1) Approve a resolution to prohibit parking on the west side of Kutoff Court between Trunk Highway
149 and the cul -de -sac bulb, including said cul -de -sac bulb; or
2) Approve a resolution to prohibit parking on both sides of Kutoff Court between Trunk Highway 149
and the cul -de -sac bulb, including said cul -de -sac bulb; or
3) DO NOT restrict parking;
AND authorize the Mayor and City Clerk to execute all related documents.
FACTS:
• City staff became aware of a potential prohibited use of a public street for the storage of equipment
on Kutoff Court, northeast of the intersection of Yankee Doodle Road and Trunk Highway 149 in
eastern Eagan. Upon investigation, it became apparent that the public street was being used to drop
off and stage trailered equipment belonging to the customers of one of the businesses in the area.
• While investigating the matter, City staff inquired of other City departments to determine whether
other concerns may need to be addressed. The Fire Department expressed concern regarding the fire
code, specifically referring to fire apparatus access to the adjacent buildings.
The following requirements from Section 503.4 of the Fire Code, entitled "Obstruction of fire
apparatus access roads" and Section 503.2.5, entitled "Dead ends" were stated.
o Fire apparatus access roads shall not be obstructed in any manner, including the parking of
vehicles. The minimum widths and clearances established in section 503.2.1 shall be maintained
at all times (20 feet minimum).
o Dead -end fire apparatus access roads in excess of 150 feet in length shall be provided with an
approved area for turning around fire apparatus.
Kutoff Court is about 700 feet long and 32 feet wide (face of curb to face of curb), except for the cul-
de -sac bulb, which is the standard 47 feet from the center of the bulb to the back of curb. This
standard street width accommodates two lanes of traffic, one in each direction, with additional space
for a safety or parking lane, but only on one side of the street. As is common throughout the City,
neither side of a 32' street width is typically designated or reserved for on- street parking. However,
alternating Odd/Even Winter Parking restrictions are in effect from Nov. 15 to April 15 every year by
declaration rather than signage.
The adjacent property owners were notified of the City Council's consideration of two options
regarding parking restrictions on Kutoff Court.
• Option 1 proposes parking restrictions on the west side of the street and around the cul -de -sac bulb.
The purpose of this designation is to address public safety and traffic concerns.
•
• Option 2 proposes parking restrictions for the entire street and cul -de -sac bulb. The purpose of this
designation is to also address land use concerns. The adjacent businesses are required to provide
adequate on -site parking and storage per City Code.
City staff have met with some of the adjacent property owners and business representatives. Valley
Sports, 3380 Highway 149 So., Gopher Resources, owner of the property at 3380 Highway 149 So.,
and Twin City Wire, 3350 Highway 149 So., have all expressed strong concern about a restriction of
all parking. Gopher has rented the property to Valley Sports, the current occupant, for about one
year. All of the representatives stated that the use of the street for parking is minimal, but the loss of
the ability to allow some parking on the street when it is necessary would be a detriment to their
businesses, employees and customers. Gopher also expressed concern about a complete parking
prohibition regarding the potential harm to future rental opportunities if Valley Sports would choose
to relocate. The restriction of parking on the west side of the street and within the cul -de -sac
appeared to be acceptable to the representatives, as they indicated they understood the benefit to the
fire apparatus access.
• An additional alternative would be to include a prohibition on overnight on street parking in addition
to any of the options. If implemented, this would assist the businesses in their communication with
customers to insure that any after hour or week end drop offs would be to the business property itself.
• Each of the proposed options for prohibition of parking have been reviewed by the Engineering
Division, Police and Fire Departments and Code Enforcement and found to be in order for favorable
Council action.
