1988, between SALM, HARLEY AND MILLS ASSOCIATES, a Minnesota General
Partnership, herein referred to as "LANDOWNER" and the CITY OF SnGAN,
a municipal corporation, organized under the laws of the State of
Minnesota, hereinafter referred to as the "CITY".
WITNESSETH:
That the LAND04VNER, in consideration of the sum of One Dollar
(S1.00) ana other good and valuable consideration, the receipt and
suEficiency of which is hereby acknowledged, does hereby grant and
convey unto the CITY, its successors and assigns, easements described
hereafter, over, across and under premises situated within Dakota
County, Minnesota.
An easement for construction and maintenance of a storm sewer,
over, under and across a strip of land 15.00 feet wiae and
300.00 feet long described as follows:

'Phe grant of the foregoing Kampoxaxy easement Por construction
and maintenance of a storm sewer includes the right of the CITY, its
contractors, agents and servant•s to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and
maintain pipes,.conduits or mains, and the further right to remove
trees, brush, undcrgrowth and other obstructions, provided, however
that af-ter completion of :,uch construction, mainter.ance, repair or
removal, the CITY shall restore the premises to the condition in
which it was found prior to the commencement of sucti actions.
LANDOS4NER retains the right to use the easement property for any
lawful purpose, provided such use does not interfere with the storm
sewer purposes of this easement. Said use shall include the right to
pave the surface of the easement, but shall not allow the erection of
structures upon the easement.
