Reantly, you oontacted the City regazdincT your oonoern of surfaoe wates nmoff as
it affects your oxvperty (Lot 5) resulting fran the reoent oonstruction of Lot 6
adjacent to and south of your property. Uuring past discussions and meetings with
you, I am familiar as tD the preventive measure taken by you to insure aderniate
drainagE during the Construction of your dwell;ng i.mit on Lot 5. Last wee]:, I in-
spected the drainage problen that you referred to earlier. Our field investigation
revealed that during the mnstruction of Lot 6 that the natural drainaqe pattern has
been artificiallyaltered during the oonstnaction of the dwelling wtit of Lot 6 ad-
jacent to your property. This has resulted in excessive nmof£ beuzg cairected onto
your property which presently creates a problan. Consea,uently, Your drainage pro-
blans are a direct result di the oonstruction activity of your next door neighbor.
As such, your best reoourse to oorrect this problan wvuld be to deal directly with
your neighbor to have this issue resolved.
If you are unable to satisfactorily resolve this prcblen after direct oontact with
your neiohbor, an alternative would be to petition the City for a formal storm
sewer inprovement along your oamion lot line within the presently dedicated 10'
drainage and utility easenent. This petiticn request could result in the installa-
tion of a stoxm sewer systan along your omamn lot line to resolve the problan. All
costs associatecl with this wvrk would te assessed equally to Ipt 5 and Lot 6. After
revicaing the site, several laxge mature trees would have to he renoved along this
lot line for this storm sewer systan to he installed. In additicm, additional t-sr
poraxy oonstruction easerents would have to be dedicated by both property aaners to
allaa this to occur. Because of the time frane and costs imvolved and adverse im-
pact to the woorled lots for this City action, it should only be used as an absolute
last resort to resolve the probler.i. riberefore, we strongly urge you to work closely
with your neighbor to resolve this problem. I am sure that ance you explain the ad-
verse iuTpact his actions have createcl, that a satisfactory resolution to your pm-
blem can be obtained.

It has come to a?y attention that the grading at,14557 Oak Chase CircleJ has
created a water problem at 4555 Oak Chase Circle. Mr. Toomey at the 4555 address requested aide from Eap,an Public Works Director
Tom Colbert early in September. Upon completion of Mr. Colbert's investigation
he recommended that Mr. Toomey meet with you and resolve the problem.
Please inform me what course of action you and Mr. Toomey agreed to. If I can
be of he1p, please contact me.
