On May 24", I reviewed the townhouse residence at the above address, and find the following. The header

proper support fo: the structure above. The ends had adequate support on at least three studs. The
transferred load to the footing below would be spread over more than three feet of 20 wide footings which
would also give adequate support assuming a minimum soil bearing pressure of 2,000 #s per squaze foot of
footing.area.
A question of corner bracing was considered. I deterniined the following:
• The plywood facing on the beam (above) gave the comer some support.
• I recommended that the corner be sheathed with'/a° CDX plywood from the door jamb to the comer
and for 18" to 24" on the return wall. This would give the corner adequate support for wind loads.
• Considering wind loads, the townhouse gouping of 2 story structures was so close as to negate most
side wind loads. In other words, the wind forces will be broken by the adjacent units and construction
and will be significantly diminished by the next-door houses. The wind forces against the front face will
be taken by the sidewalls of the gazage.

I noticed that similaz situations were found at 221 2225, 2239 and 2243 Liberty Lane. The above
considerations would apply to those units as well. Two photos ofthe garage door lintel aze enclosed
With this plywood corcectior, the townhouses aze, in my opinion, are adequately supported by the reviewed

• Considering wind foads, the townhouse grouping of 2 story stnictures was so close as to negate most
side wind loads. In other words, the wind forces will be broken by the adjacent units and construction
and will be significantly diminished by the next-door houses. The wind forces against the front face will
be taken by the sidewalls of the garage.

RE: INCOMPLETE PERMITS AT EAGAN HEIGHTS TOWNHOMES
Dear Bill,
Enclosed is a list of 10 addresses at Eagan Heights with permits (some over three
years old) that have not 6een finailed, including the inspection record and correction
comments. These units are in various stages of completion.
We have information alleging that 2220 Liberty Lane has been occupied since
December 15, 2006 without passing a final inspection or a temporary Certificate of
Occupancy as of that date. This is in violation of the Minnesota State Building Code.
A Temporary Certificate of Occupancy was issued on 1/23/07.
The residence at 2247 Liberty Lane has no siding on the back side. The gyp
sheathing has been exposed to the weather since July 2003. Please provide an
affidavit from the gyp sheathing manufacturer stating if the Gyp sheathing is still
adequate.
The 3 units (4169 - 4177) on Old Sibley Memorial Highway currentiy do not have
valid mechanical permits.
Please familiarize yourself with the excerpts from the Minnesota Building Code below
and respond accordingly:
Minnesota Rules Chapter 1300.0120 Permits
5ubpart 11 Expiration
Every permit issued shall become invalid unless the work authorized
by the permit is commenced within 180 days after its issuance, or if
the work authorized by the permit is suspended or abandoned for a
period of 180 davs after the time the work is commenced. The
building official may grant, in writing, one or more extensions of time,
for periods not more than 180 days each. The extension shall be
requested in writinq and iustifiable cause demonstrated.
Minnesota Rules Chapter 1300.0130 Construction Documents
Subpart 9.(C)
C. Work regulated by the code shall be installed according to the
reviewed construction documents, and anv chanqes made durinq
construction that are not in compliance with the approved
construction documents shall be resubmitted for aoproval as an
amended set of construction documents.
Minnesota Rules 1300.0220 Certificate of Occupancy
Subpart 1 Use and Occupancy
No buildrna or structure shall be used or occupied, and no change in
the existing occupancy classification of a building, structure, or
portion of a building or structure shali be made until the buildinp
official has issued a certificate of occupancv for the building or
structure under this part. Issuance of a certificate of occupancy is not
approval of a violation of the code or other ordinances of the
municipality. Certificates presuming to give authority to violate or
cancel the code or other ordinances of the municipality are not valid.
Minnesota Rules 1300.0220
Subpart 6 Temporary Occupancy
The building official is authorized to issue a temporary certificate of
occupancy before the completion of fhe entire work covered by the
permit, provided that the portion or portions shall be occupied safely.
The Building Official shall set a time qeriod durinq which the
temporarvi certificate of occupancv is valid.
Minnesota Rules 1300.0140 Violations
It is unlawful for any person, firm, or corporation to erect, construct,
alter, extend, repair, move, remove, demolish, or occuqy any buildinq
structure, or equipment regulated by the code, or cause any of those
actions, in conflict with or in violation of the code. The building official
may serve a notice of violation or order on the person responsible for
the erection, construction, alteration, extension, repair, moving,
removal, demolition, or occupancy of a building or structure in
violation of the code, or in violation of a permit or certificate issued
under the code. The order shall direct the discontinuance of the
illegal action or condition and the abatement of the violation.
Minnesota Rules 1300.0150 Violations, Penalty
A violation of the code is a misdemeanor under Minnesota Statutes,
Section 1613.69.
