C2 • Oakdale, Minnesota 55128 • Office: 651 - 779 - 1900 • Fax: 651 Certification of Underground Storage Tank Removal Former Sixty One Stop 3575 Pilot Knob Road Eagan, MN 55122 MidAmerica Project #10P- 1433 -A INTRODUCTION MidAmerica Technical & Environmental Services, Inc., (MidAmerica) was contracted by Mr. Brian Carnes of Premier Banks to perform the removal of one (1) 10,000 -gallon Premium Gasoline Fuel Underground Storage Tank (UST), one (1) 12,000 -gallon Gasoline Fuel UST, one (1) 12,000 - gallon Diesel Fuel UST and six (6) Dispenser Islands located at 3575 Pilot Knob Road, in Eagan, MN 55122 (Property). The Property is the location of closed MPCA Leak Site #15548. Premier Banks obtained ownership of the Property through foreclosure and is not a responsible party according to Minnesota Statute 115C.021, subd. 4 (2008). Premier Banks joined the Petroleum Brownfields Program in September 2009 and was granted a Petroleum Storage Tank Release Liability Letter for the Property on October 8, 2009. Companies Involved in the Removal of the UST MidAmerica Technical & Environmental Services Inc., 6989 North 55 Street, Suite C2, Oakdale, Minnesota 55128 performed the product pumping, tank cleaning, field screening, laboratory sampling, and field management/site supervision. MPCA Contractor #688, MPCA Site Supervisor #8391 Landwehr Construction, P.O. Box 1086 St. Cloud, MN 56302 performed the excavation and removal of the USTs. Pace Analytical Services, Inc. 1700 Elm Street S.E., Minneapolis, MN 55414 provided Laboratory Analytical Services for Fixed Soil Sample Analysis. MDH Laboratory Certification #027 - 053 -137. Minnesota Petroleum, 682 39 Avenue, Columbia Heights, MN 55421, processed the petroleum- impacted water and sludge that were removed from the tanks. EPA ID# MND004595694 RESULTS OF THE UST REMOVAL & EXCAVATION OBSERVATIONS Methodology The USTs were initially pumped of gasoline and diesel for processing. The gasoline and diesel were pumped prior to the removal of the UST, to minimize the potential for environmental impacts, in the event that the UST would leak or rupture during excavation. Following tank pump -out procedures, the USTs were removed. Upon verifying that environmental conditions within the tanks were below the lower explosive limit, an access hole was cut into an end of the tank for purposes of cleaning. The tanks were slip -3 with a fiberglass coating (clad USTs). No pinholes or evidence of excessive pitting were observed in the tanks. No petroleum odors or stains were observed directly around or below the USTs or UST basin. A slight petroleum odor was noticed under dispensers D -5 and D -11. All soil samples were field screened with a MiniRae Photo Ionization Detector (PID) containing a 10.6 e.V. lamp. Soil samples were collected from the clean backfill material at a depth of 14' from the end of each tank and results from field screening yielded up to 14.7 parts per million (ppm) of organic vapors. Soil samples from under the dispensers were collected at a depth of 5' and results from field screening yielded up to 15.9 ppm of organic vapors. A total twelve (12) soil samples from under the UST basin and pump islands were submitted for laboratory analysis to confirm field observations. A site map with sampling locations is included as Attachment C. The soil samples were sent to a fixed laboratory (Pace Analytical Services, Inc.) to be analyzed for Diesel Range Organics (DRO) or Gasoline Range Organics (GRO), and Benzene, Toluene, Ethyl Benzene and Xylenes (BTEX). Laboratory analysis yielded concentrations of the aforementioned parameters below the applicable method detection limit, i.e. non - detect, with the exception of D -11. Soils from D - 11 yielded detections of DRO up to 3,200 milligrams per kilogram (mg/kg). The release was called in to the Minnesota State Duty Officer and reported as likely residual petroleum impacts from previous leak site # 15548 (MPCA report number 116027). MidAmerica discussed tank removal activities and sampling with MPCA representative Kate Lewison, including field screening results and observations. Ms. Lewison requested a site map showing sample locations and a copy of the final lab reports for the MPCA to compare with historic documents. The requested documents were sent and are awaiting a final determination. Findings The tank removals were performed on November 23, 2010. • At the time of tank removals, approximately 1,075 gallons of gasoline/gasoline- impacted water and 395 gallons of diesel were removed for processing; • Soils field screened at two (2) feet below the tank excavation and five (5) feet below the dispenser islands were up to 15.9 ppm; • No pitting or pinholes were observed in the tank structure; • No petroleum odors or stains were observed directly in or below the tank basin or dispenser islands. However, a slight petroleum odor was noticed under dispensers D -5 and D -11; and • Laboratory analysis of all twelve (12) soil samples submitted yielded results of Non Detect (ND mg/kg) for DRO and/or GRO/BTEX, except D -11, which yielded detections of DRO at 3,200 mg/kg; DISCUSSION AND CONCLUSIONS MidAmerica performed the removal of the USTs in accordance with the City of Eagan, the MPCA and State Fire Marshal guidelines. A copy of the City of Eagan Inspections Permit is included as Attachment A. A copy of the MPCA's Change of Status Form is included as Attachment B. Copies of the manifests are included in Attachment E. Final inspection of the USTs, after removal and cleaning, yielded no visual signs of pitting or pinholes in the USTs. Visual and olfactory observations of the soils directly around the USTs, in addition to field screening, did not indicate the existence of petroleum impacts. Laboratory analysis of DRO and/or GRO/BTEX for the UST system samples submitted yielded Non- 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 Detections, confirming field observations. Laboratory analysis of DRO and/or GRO/BTEX for the dispensers yielded a detection of DRO at 3,200 mg/kg under dispenser D -11. A copy of the analytical report is included as Attachment D. On behalf of Premier Banks, MidAmerica requested an additional General Liability Letter be issued to the Buyer of the Property as an assurance that the Buyer will not be named a Responsible Party. Minnesota Statute 115C.021, subd. 1 (2010) states that if a person comes into possession of a property after the tanks have been removed, that person is not a responsible party and cannot be ordered to take corrective action. As the tanks have been removed from the Property prior to the transfer of ownership to the Buyer, the Buyer is not Responsible Party and will not be required to perform corrective action on the Property. However, the Buyer is required to cooperate with corrective actions issued to the Responsible Party, as stated in Minnesota Statue 115C.03, subd 1. MidAmerica believes that neither Premier Banks, nor the Buyer, will be targeted as the Responsible Party for releases from tanks on the Property. MidAmerica understands that development is planned for the Property. The Buyer should be aware that Minnesota Law requires contaminated soils and water uncovered or disturbed to be properly managed. Contaminated soils are likely to be encountered on this Property related to one or more historic releases. MidAmerica recommends the Buyer hire a qualified environmental consultant to assist them with a Development Response Action Plan (DRAP) for the management of contaminated soils or groundwater, should they be encountered during development. The MPCA's Petroleum Brownfields Program can assist with the review and approval of the DRAP. Based on field observations, field screening and fixed laboratory results, MidAmerica does not recommend any further investigation with respect to the former fuel dispensing system. MidAmerica recommends awaiting the final MPCA determination of the property prior to any subsurface investigation or development of the Property.
