09/04/1973 - City Council Regular MINUTES OF REGULAR MEETING OF EAGAN COUNCIL VILLAGE OF EAGAN, DAKOTA COUNTY, MINNESOTA September 4, 1973 A regular meeting of the Council, Village of Eagan, Dakota County, Minnesota, was held on September 4, 1973 at 6:30 P.M. at the Village Hall. All.• members were present, The meeting was commenced with the Pledge of Allegisnct. Upon motion by Councilman Rydrych, seconded by Councilman Rahn, all m:• bers voting yea, it was RESOLVED that the minutes of the regular Council meeting of August 21 be approved with the exception that on page 4 in relation to the proposed sauna application that the Village Attorney recommended against the issuance of the sauna permit; upon further motion by Councilman Rahn, seconded by Councilman Smith, all members voting yea, it was RESOLVED that the minutes of the special meeting oR che Council of August 28, 1973 be a , =>:or :1 as distributed. There was no Fire Department business. Police Chief Martin DesLauriers appeared and requested that according to Ordinance No 9 the Council approve the target range at MetcaJ!x Junior High thool tc 'bo used for the Firearm Safety program and also to approve tike sand pit at Gopher Smelting as a target range for police use and the Firearm's Safety program. Upon motion by Councilman Rahn, seconded by Ccuncilman Smith►, it uas RESOLVED that the Metcalf Junior High and Gopher Sme1ti.ng target z:aziges be approved for uce as described above, Chief re3Lauriers also presented a petition from resinancs of Wider.- ness Pun :requesting a reduction of speed and no passing lanes on Pilot load from County Road 30 to Cliff Road. It was his recommendation that the sp,...ed limit on Pilot Knob Road be reduced to 50 MPH all through the Village because of the residential development adjacent to it and also the driving capability of the road. Upon motion by Councilman Wachter, seconded by Counci lmun » 1 » ■ all members voting yes, it was RESOLVED that the Clerk be authorized to send the Dakota County Board of Communissionare a copy of the petition and an appro- priate resolution requesting a recommended speed reduction to 50 MPH on Pilot Inob Road all through the Village. The Police Chief reported to the Council on the meeting in Burnsville regarding the possibility of subsidizing Alien's Ambulance service to the Village. He did not recommend subsidizing this service since Divine Redeemer ambulance is covering the whole Village at present and Apple Valley will open a medical clinic in 1974 for minor emergencies. No formal action was taken_, Public Works Superintendent, Mr. Branch, appeared and requested that he be allowed to hire temporary carpenter help for building warming houses, etc. for park purposes. Upon motion of Councilman Wachter, seconded by Councilman Smith it was RESOLVED that Mr.. Branch be authorized to hire the addit3.c.1 1 recommended help. Upon motion by Mayor Polzin, seconded by Councilman Rahn, it was RESOLVED that Mr. Branch contact the Civil Defense Director regarding purchase of a portable generator and if this is not feasible he be authorized to purchase orte for the lowest bid price. Mr. Branch also requested the Council to have the Village Engineer check the streets in Saddle Horn Addition for maintenance by the Village, The Councilauthorized this request and instructed the Engineer to report back to the Council. Myrel Lundsten appeared on behalf of the Park Committee. The corgi mittee recommended that purchase of the William Sell land consisting of acres South of Blackhawk Lake for park purposes. After considerable disc;ss'ion, upon motion by Councilman Smith, seconded by Councilman Rahn, all members voting in favor, it was RESOLVED that the negotiations be recommended to acquire the property of William Sell for park purposes. ■ 2 .. M . Ltundsten also recommended the fence policy for Pagan park purposes, a copy of which is attached to these minutes. Upon motion by Councilman Rahn, seconded by Councilman Wachter, all members voting in favor, it was RESOLVED that the fence policy as recommended be approved. The Park Committee also recommended that the Joseph McCarthy house located on park property near McCarthy Lake be rented to Mr. McCarthy's son for the sum of $75.00 per month. The Clerk was requested to check into the insurance for the McCarthy house prior to entering into a rental arrangement, The request for sign permit for Julius Matlinski for the on-sate liquor restaurant on Shawnee and Highway #13 on the owners property was next presented. Upon motion by Councilman Rahn, seconded by Councilmen R.ydrych, all members voting yea, it was RESOLVED that the application he approved subject to the Building Inspector's approval as to size and location. It was 1::/t€71 that that the sign would be double sided, Mr, Frank Nutall appeared on behalf of his application for a s: rgls family residence on a 9.1 acre parcel North of Cliff Road consisting of the former Ostendorf property, The Council indicated that its policy was to acquire a 75 foot half right-ofwway on Cliff Road at the time any building permit is granted, Upon motion by Councilman Smith, seconded by Councilman Raha, all members voting yes, it was RESOLVED that the application be approved subject to the grant of the 75 foot half right•ofd.way easement for road purposes of Cliff Road, Mr. John O'Toole of the Dakota County Assessor's office appeared with three requests for abatements according to the list attached to these minutes. Upon motion by Councilman Rahn, seconded by Councilman Smith, E...1 members voting yes, it was RESOLVED that the abatements be approved. Published and mailed notices have been completed, the Mayor announced the convening of the following Assessment hearings in this order commencing at 7cO0 • 3 - • Improvement Project #112 - sewer, water, storm sewer in Cedar Grove 9, 11, and 12 and part of Section 20. Upon motion by Councilman Wachter, seconded by Councilman Rydrych, all members voting aye, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #100-B - street improvements on Random Road and Rita Court. Upon notion by Councilman Wachter, seconded by Councilman Rydrych, all members voting aye, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #99, revised as #100-A - street improvements in Cedar Industrial Park and part of Section 17. Upon motion by Councilman Wachter, seconded by Councilman Rahn, all members voting yes, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #91 - sewer, water, and storm sewer fmpprcriemAnts in Eagan on the Green. Upon motion by Councilman Wachter, seconded by Couu.ilman Smith, all members voting yea, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #92 - street improvements in Sections 28 and 29. Upon motion by Councilman Rahn, seconded by Councilman Wachter, all members voting yes, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #97 - sewer and water improvements in Sibley Terminal Industrial Park and Sections 8 and 9. Upon motion by Mayor Polzin, seconded by Councilman Wachter, all members voting in favor, the assessment roll was adopted and ordered certified to the County Auditor. Improvement Project #86 - sewer, water and storm sewer improvemts in Sections 28 and 29. Upon motion by Councilman Rahn, seconded by Councillwn Wachter, all members voting yea, the assessment roll was adopted ordered and certified to the County Auditor. 1mpr0vetnent Project #90 street improvements, Pilot Knob Heights First Addition, Timbershores 1, 2 & 3 Addition, and part of SW'k of Section 15. Upon motion by Councilman Smith, seconded by Councilman Rahn, all members voting yes, the assessment roll was adopted and ordered certified to the County Auditor, Improvement Project #81 a street surfacing improvements on Coachman Road and Four Oaks Road in Section 9. Upon motion by Councilman Smith, seconded by Mayor Polzin, all members voting yes, the assessment roll was adopted and ordered certified to the County Auditor. There were no objections to any of the foregoing rolls. The Mayor then convened the continued public hearing on behalf of the application of William C. Morton to rezone and for PUD approval of a 39.61 acre parcel in the NE of the NU 3 of Section 28, South of County Road 30., Th3 Advisory Planning Committee recommended approval. The plan presented by Mv, Morton and Mr. Nelson, planning consultant, indicating pedestrian trails with 219 dwelling units proposed at approximately 5 units gross per acre, 8 units net per acre. Roads would consist of 3.4 acres, residential 31.7 acres and 4.5 acres of green space. No contact had been made with the Perk Committee and the Park Committee representative requested a meeting with the applicant to review proposed park planning in the area. Upon motion by Councilman Wachter seconded by Councilman Smith, it was RESOLVED that the public hearing be continued until September 13, 1973 meeting to be reviewed after consultation with the Park Committee. All members voted yes. Upon motion by Councilman Rahn, seconded by Councilman Smith, all members voting yes, it was RESOLVED that the public hearing on behalf of Lhe application of J.E. Parranto for preliminary plat approval of Cedarvale Offi-:e Park No.' 1 be scheduled for September 18, 1973 at 7:30 P.M, 4 5 III I4r Don Prettyman appeared on behalf of his application for a building permit for a temporary addition for storage purposes for the Mill Work Barn on Beau d'Rue Drive. The APC recommended approval. Upon motion by Councilman Rahn, seconded by Councilman Rydrych, all members voting yes, it was RESOLVED that the application be granted on a temporary basis only be approved. Mr. Nick Dreis and Mr. Gary Anderson of Northern States Power Company appeared on behalf of its application for a building permit for a substation in Tract A, Registered Land Survey NO. 4,.. Section 17 in Cedar Industrial Park. The APC recommended approval. It was noted that the landscape plan will be submitted to the Council before a building permit is issued. Upon motion by Councilman Rahn, seconded by Councilman Smith, all members voting yea, it was RESOLVED that the application be approved subject to submission and approval of landscape plan for the project. IIIUpon motion by Councilman Wachter, seconded by Councilman Rahn, ?.t was RESOLVED that a public hearing on behalf of the application of Ladco Corporation to rezone part of Lot 3, Auditor's Subdivision 38 in Section 12, South of Highway #55 and East of Highway #49 from R-1 to R-4, for September 18, 1973 at 7:30 PmL at the Village Hall, All members voted in favor. The Mayor then announced the convening of the hearing on the pre- liminary report covering Project #117 consisting of sanitary sewer, water; and storm sewer improvements in Oak Chase Second and Third Additions. There were no objections to the project. Upon motion by Councilman Wachter, seconded by Mayor Poizin, it was RESOLVED that the project be ordered in and the Village Engineer be ordered to prepare plans and specifications. All meshes voted yes. III Upon motion by Councilman Rahn, seconded by Councilman Wachter, it was RESOLVED that the public hearing be scheduled for September 13, 1973 at 7:30 P.M. at the Village Hall regarding the application of D. H. Gustafson - 6 - and Associates and Gold Medallion Corporation to rezone from I-1 to R.1 PUD and preliminary plat approval of the South half (S ? ) of the Southwest quarter (SW Z, of Section 13 lying West of E rene Road. All members voted yea„ Upon motion by Councilman Wachter, seconded by Councilman Rahn, all members voting it favor, it was RESOLVED that public hearings ccncerning the application of Dreyfus Corporation to rezone from A, Agricultural to R.1 PUD and for preliminary plat approval for property in Section 14 North of Wescott Road be scheduled for September 18, 1973 at 7:30 P.M, at the Village Hall. The Council then reviewed the proposed revisions of the Sign Ordinance N . 16 that had been reviewed at the previous meeting. After discussion, upon motion by Councilman Rydrych and seconded by Mayor Polzin, all members voting yea, it was RESOLVED that the Amendment to Sign Ordinance No, 16 as presented be and it hereby is adopted and ordered published, The Council then consider d proposed amendments to Ordinance No, : concerning underground utility requirements, street lighting and sidewalks, Upon motion by Councilman Smith, seconded by Councilman Rahn, all members voting yes, it was RESOLVED that the proposal concerning requirement of under• ground utilities in all new subdivisions be and it hereby is approved. After considerable discussion, upon motion by Councilman Smith, seconded by Councilman Rahn, it was RESOLVED that the provisions concerning the requirements for street lighting in all new subdivisions be approved. Those voting in favor were Councilmen Smith and Rahn; those voting against were Councilmen Rydrych, Wachter and Mayor Polzin. The motion failed and it was recemmerded that further study in street lighting be undertaken for rncona sidieration at a later time. Upon motion by Councilman Rydrych, seconded by Councilman Rahn, those members voting yes, were Rydrych, Rahn, Polzin and Wachter with Smith voting against, it was RESOLVED that the proposed revision to Ordinance No. 10 to .. 7 - 111 require sidewalks along major thorough€arey and collector streets and streets in the area of schools be and it hereby is approved and ordered published. A proposed assessment policy in regard to special assessments on park land was submitted by Councilman Rydrych, after considerable discussion, upon motion by Councilman Rahn, seconded by Councilman Smith, all members votf f g lea, it was RESOLVED that the assessment policy as amended be adopted regarding park lard. The Council further reviewed the proposal submitted by the Village Attorney, upon recommendation of the Park Committee to amend the park Ordinance No 10 to conform with the 1973 legislative changes relating to dedication of lend or cash by developers. After review and upon motion by Mayor Polzin, seconded by Councilman Rahn, all members voting yes except Councilman Rydrych who abstained,. it.was RESOLVED that the amendment be adopted and ordered IIIpublished. Copies of the proposed Sauna Ordinance submitted by a subcommittee including Councilman Rydrych, Chief Martin DesLauriers and Paul flange, Village Attorney were distributed and reviewed by the Council. It was recommended that no formal action be taken for the reason that it is expected that certain individuals desired to be present at the time that action is taken on such an ordinance. Changes were recommended in the proposed ordinance. A petition from the owners of Blackhawk Hills Addition to extend maintenance and snowplowing on Blackhawk Hills Road and Blackhawk Cove Road was submitted and a further petition for blacktop improvements on certain streets in the same addition was submitted and reviewed,. Upon motion by Councilman Rahn, seconded by Mayor Polzin, alI members voting yea, it was RESOLVED that the petitions be referred to' the Village Engineer for study and recommendations. An application by Applebawaca for transfer of the off.isale liquor n 8 r license from DCR Company to Applebaums on Beau d'Rue and Rahn Road was next submitted. Upon motion by Mayor Polsin, seconded by Councilman Rydrych, all members voting yes, it was RESOLVED to approve the application for transfer subject to approval by the police department after its investigation, according to the ordinance. The Clerk was requested to send a thank you note to Bonestroo, Rosene, Anderlik and Associates for contributions for park equipment for the Village. Upon motion by Councilman Rahn, seconded by Councilman Smith, it was RESOLVED that the following assessment hearings be scheduled for October 2, 1373 at 7:30 P.M, at the Village Hall: Improvement Project #49- Part 2, consisting of the Metropolitan Sewer Board area. Improvement Project #88, concerning utility improvement East of Pilot Knob Road on Deerwood Drive. Upon motion by Councilman Rahn, seconded by Councilman Smith, all members voting yea, it was RESOLVED that the bills presented be ordered paid as follows: Warrant Nos. 79 - 84; 1524 1568; 11130 - 11195. Upon motion by Councilman :with, seconded by Councilman Wachter, all members voting in favor, it was RESOLVED that the contract covering Project #113 consisting of Donnywood Addition water and sewer improvements be and it hereby is approved and ordered signed by the appropriate officials. The Mayor announced that the meeting was open for the consideration of objections, if any, to said proposed assessments.
