11/05/1973 - City Council Special IVIN TMS OF A SPECIAL MEETING OF THE VILLAGE COUNCIL VILLAGE OF RAC-AN, DA:0'Y'A C0U2.:f, MINVESO,"A November 5, 1973 A special meeting of the Village Council, Village of Eagan, Dakota County, Minnesota, was held on November 5, 1973 at 6:30 p.m. at the Village Hall. Those present were Mayor Polzin, Councilmen Rahn, Wachter and Rydrych; Councilman Smith arrived at approximately 7:15 p.m. The Council first met with Erwin Helmken and discussed a proposed Agents Letter of Record for group health, hospitalization, accident and life insurance whereby the agent would assist in preparing specifications for bids on such insurance for the Village. Because of the experience of Mr. Helmken with the Village for a number of years and of his knowledge of the insurance business, upon motion by Mayor Polzin, seconded Councilman Rydrych, all members voting in IIIfavor, it was RESOLVED to appoint Erwin Helmken as the Agent of Record for he Village of Eagan for the insurance mentioned above for the policy period, unless earlier terminated. Upon further motion by Councilman Wachter, seconded Councilman Rahn, all members voting yea, it was FURTHER RESOLVED that the agent together with the Clerk be directed to prepare specifications for such insurance and that the Village Clerk be authorized to advertise for bids according to law to be opened on November 23, 1973 at 2:00 p,m, at the Village Hall. The application of New Horizon Homes for sign permits at four locations was reconsidered by the Village Council. Upon motion by Councilman Smith, seconded Councilman Rahn, all members voting yes, it was RESOLVED that the loca- tions No, 2 & 4 be and they hereby are approved according to the applications. Upon motion by Councilman Rahn, seconded Councilman Wachter, it was RESOLVED that the applications of Kenneth Appelbaum for variance from Ordinance #6 for division of Lot 1, Block 1, LeTendre Addition into two lots according to the Planning Committee and Board of Appeals recommendations be approved, All rxenbers voting yes, The request of Mr. Halladay for private septic tank and water well on his property at Sibley Terminal Industrial Park because of lack of easement access to Terminal Drive to a public street was upon recommendation of the Village Engineer deferred until the next meeting, The Village Attorney discussed the lawsuit being brought by a former Volunteer Fire Department member against William Milliron, another former Volun- teer Fire Department member, He indicated that the Eagan casualty insurance carrier in effect in 1971 when the incident occurred has denied responsibility for coverage. Other measures are being taken by the Village to defend the action. on behalf of Mr. Milliron. The Council then reviewed the contract with Kenneth Kersten for maintenance of the hockey rinks for 1973-74. Upon motion by Councilman Wachter, seconded Councilman Rahn, it was RESOLVED that the contract as presented be and it hereby is approved. All members voted yes. The Village Attorney reported that he had reviewed in detail a request by the Lost Spur Country Club for transfer of its on-sale liquor license to a club license and recommended that upon approval of formal application that such a license could be granted without affecting the number of allotted on-sale licenses for the Village either for regular on-sale or Sunday on-sale licenses. Upon motion by Mayor Polzin, seconded Councilman Rydrych that the Village will issue a club license to the Lost Spur, Inc. provided an appropriate application is submitted and approved by the Council, further upon compliance with applicable laws and ordinances and further subject to returning the existing on-sale license and revocation by the Village. The request of Mrs, Flood for additional school traffic signs on Lone Oak III Road near Pilot Knob School was deferred until the next regular meeting. Upon motion by Councilman Wachter, seconded Councilman Rahn, all members voting yea, it was RESOLVED that Martin Shields be appointed the Village repre- -2- ill sentative to the committee being organized to review the future use of the old Dakota County Courthouse. The Village Engineer recommended that a sanitary sewer service be installed to connect the Lemke property North of Highway #13 near the R.Johnson warehouse, with the assessment not to exceed 85' for lateral L. sewer purposes as recommended l sanitary °mmended by the Assessment Committee., The Village Engineer recommended that the performance bond for South ; 1st Addition be executed uth H..11s prior to the execution of the final plat and upon motto', by Councilman Wachter, seconded Councilman Rahn, all,members votin g was RESOLVED that the developers of South Hills 1st Addition be required it include in their development bond or escrow account a sum for qui es re to for improvements of Wescott Road and Elrene Road on the basis future assessments essments of a residential equivalent for the frontage on each of the roads and that at the time of improve- ment of each of the roads that the III developer be then charged for the residential equivalent. Upon motion by Councilman Rahn, seconded Mayor Polzin, all members voting yes, it was RESOZVED that Mr . Ed Boetcher be granted a permit to sell Christmas trees on his residential property on Blackhawk Road near Silver Bell Road for 1973 only, The Village Attorney submitted a proposed resolution relating to Project #107 and upon motion by J y Councilman Wachter, seconded Councilman Rahn, all members voting in favor it was RESOLVED that Improvement Project #122-A be substitute for Improvement Pr d Project #107 for the General Obligation Bond Issue of 1973® All members voted yes. At approximately 8:O0 P.m. the Village Council met with the Police Depart- ment regarding salaries for the Police Department for 1973„ Upon motion the meeting adjourned. November 5, lg r -3-
