11/14/1978 - City Council Special MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL EAGAN, MINNESOTA November 14, 1978 A special meeting of the Eagan City Council was held on November 14, 1978, at 7 p.m. at the City Hall. Those present were Mayor Murphy, Council Member Parranto, Egan, Smith and Wachter. Also present were City Engineer Rosene, City Administrator Hedges, Public Works Director Colbert and City Attorney Hauge. I-35E - BLACKHAWK LAKE DNR PERMIT. Mayor Murphy convened the meeting and explained that Hearing Examiner Myron S. Greenberg had issued his report concern- ing the proposed I-35E crossing over Blackhawk Lake regarding the permit appli- cation of MnDOT for a permit from the Department of Natural Resources for a bridge crossing. The report is dated November 9 and had been received by the City on November 14. McClay Hyde, the special counsel for the City of Eagan, was present and reviewed the report with the Council. A number of interested residents of the City were also present and had questions concerning procedure and the report. Mr. Greenberg recommended that the permit application of MnDOT be denied and further study be undertaken to minimize drainage to Blackhawk Lake area during construction and after completion of the highway. In addition, he stated that the feasible and prudent route is the A2 route running easterly of Blackhawk Lake rather than bridging the lake. He stated that the applicants did not sustain the burden of proof and in the 33 page report reviewed the impact of the bridge in the area as far as lake quality, noise, future develop- ment, etc., was concerned. His findings No. 38 reflected his concern about the bridge alignment including aesthetic impact, visual intrusion, nearness to the existing park, etc. It was noted that the City and any other party has ten days to file exceptions prior to the Commissioner of the Department of Natural Resources ruling on the recommendations. Within 30 days of the decision of the DNR, any party that is adversely affected may appeal to District Court either in Ramsey or Dakota County. Mr. Hyde recommended that exceptions be filed with the DNR. Although there was no recommendation that A2 alignment be followed, Mr. Greenberg's conclusion was that it was preferable and there was considerable discussion concerning timing to acquire all necessary permits and plan preparation so that the construction can be commenced if an appeal is taken or A2 is selected. Council Member Smith moved and Council Member Parranto seconded the motion, with all members voting in favor, to authorize Mr. Hyde to prepare exceptions to the recommendations to submit in a timely fashion to the Department of Natural Resources. There were also residents present who had questions concerning the impact upon Fish Lake and the additional cost of moving in place utilities in the event that the A2 alignment is implemented. POLICE NEGOTIATIONS. The Council reviewed with City Administrator Hedges the salary proposals by the Police Department for 1979. A counter proposal to the Police Association proposal was prepared and the City Administrator was directed to present the same to the Association's collective bargaining unit. Dated: City Clerk 2
